There were no other nominations. Councillor T Wilson was elected Chairman for the year 2016-17 and will sign the Form of Declaration of Acceptance of Office at the next Parish Council meeting. 16/030 Election of Vice Chairman It was Proposed by Councillor Ryland and Seconded by Councillor Dawson that Councillor Airey be elected Vice Chairman. There were no other nominations. MINUTES OF LOWER HOLKER PARISH COUNCIL MEETING HELD AT FLOOKBURGH VILLAGE HALL FOLLOWING THE ANNUAL GENERAL MEETING ON WEDNESDAY 4 TH MAY 2016 PRESENT Parish Councillors R Airey, B Dawson, M Keith, S Rawsthorn, & J Ryland, Parish Clerk L Prescott, Mr W Dixon, Mr A Hadwin and Mr T Ryland. 16/033 Apologies for Absence Apologies were received and accepted from Parish Councillor T Wilson, Parish & District Councillor G Gardner, County Councillor S Sanderson and PCSO H Firth. 16/034 Requests for Dispensations None. 16/035 Declarations of Interest None. 16/036 Minutes of the Last Meeting Resolved The acceptance of the minutes of the Meeting of the Parish Council held on 6 th April 2016 was proposed by Councillor Ryland, seconded by Councillor Dawson, agreed unanimously and signed by the Vice Chairman. 16/037 Public Participation (at the Chairman s discretion) a) Mr Dixon reported that he had advised the removal of the last Cartmel Peninsula circular weekday bus service to Tim Farron MP, who was not aware of this. He has 1 of 6

received a reply from Mr Farron and is awaiting a further response once this has been investigated. He also reported that the waiting room doors at Cark Station have not been opening due to vandalism and he telephoned Transpennine and then Northern Rail regarding this. He found that there are 2 Station Managers, one for unmanned and one for manned stations. He also reported that some trains are not stopping at unmanned stations including Cark as they don t have conductors on the trains to issue tickets. He then reported these problem to Tim Farron MP. The doors are currently fixed open and the train stopping issue is being investigated by Mr Farron s office. He also reported that The Cabin in Cark are having problems with vehicles being parked just outside the shop and left for several hours, sometimes overnight. This creates a problem for deliveries and access for larger vehicles eg emergency vehicles. He asked whether there could be a 10 minute waiting sign/markings. This will be a Cumbria Highways matter. b) Mr A Hadwin advised that his planning application for a self-build house in Cark had been refused due to being outside the development line. He also advised that since then another Planning Application in Allithwaite has been granted, despite being outside the development line, he will therefore be re-submitting his planning application and asked if the Parish Council could support this new application as they had the previous application. c) Mr T Ryland advised that he is concerned that the large caravans being transported through the villages around 8 am are creating a hazard for the school children travelling to school by bus. He had already reported this concern to the Clerk (ref item16/043) 16/038 Police PCSO Firth was absent, however he has sent a report regarding Police calls for services in Cark and Flookburgh over the last 30 days: Road Related Offences 3, Suspicious Incidents 1, Road Related Offences 3, Assaults 2, Concerns For Welfare 2, Asb 2, Missing Persons 1, Drug Offences 1, Domestics 1, RTC 1, Others 3. Councillor Airey has also spoken to PCSO Firth and advises that he has visited Flookburgh Primary School to talk to the children about the vandalism in Cark Toilets; the Speed Indication Advice on Moor Lane has been moved as it had been vandalised and there Police have received no reports regarding incidents involving vehicles and horse riders on Moor Lane. 16/039 District and County Councillors a) District Councillor Gill Gardner was absent but provided the following written report: i) She continues to assist a person awarded a disabled facility Grant where it has been paid to a builder who has walked off site. ii) She was unable to attend the Planning Committee due to ill health iii) She will shortly be arranging a Litter Pick. b) County Councillor Sue Sanderson was absent and no report has been received. 16/040 Planning Applications The following Planning Applications were considered: a) SL/2016/0195 Fieldhead Farm Bungalow, Field Head, Flookburgh. Conversion and extension of garage into single self-contained holiday let. Resolved No comments. b) SL/2016/0321 Whitewell House, 39 Main Street Flookburgh Grange Over Sands LA11 7LA. Internal alterations and demolition of rear extension and formation of new back door and utility room and erection of two storey rear extension; alterations to pitch of part of roof, installation of rooflights, installation of replacement timber sliding sash window frames to front elevation; renovation of front porch and replacement front door and installation of railings to front of property. Resolved No comments. c) SL/2016/0374 Orchard View Winder Lane, Flookburgh, Grange-over-Sands, LA11 7LE. Change of use, extending curtilage of property & erection of garage. Planning application no longer on SLDC website so presume not currently valid. 2 of 6

d) SL/2016/0384 8 A Millstream Court, Cark In Cartmel, Grange-over-Sands LA11 7NW. Balcony extension to rear of property to form terrace. Resolved No comments. 16/041 Planning Decisions The following Planning Decisions were noted: a) SL/2016/0088 Fairview, 108 Main Street Flookburgh Grange Over Sands LA11 7LB Rear and first floor extension to attached garage and rear porch (Part retrospective). Granted. b) SL/2016/0143 Land at Garden Cottage, The Fold Cark in Cartmel Cumbria LA11 7PA Erection of 1no. Self Build Dwelling. Refused as site is located out with the development boundary. c) BE/2016/0006 45 Jutland Avenue Ravenstown, Flookburgh Grange-over-Sands LA11 7LF. Single storey rear extension. Planning permission not required. d) SL/2016/0175. 12-13 Stockdale Farm, Moor Lane Flookburgh Grange-over-Sands LA11 7LR. Internal alterations; installation of two roof lights and flue. Granted. 16/042 Financial Reports a) Resolved The Financial report, including budget comparison and bank reconciliation as at 24 April 2016, was accepted unanimously. b) The Clerk reported that she has completed the online compliance relating to the Pensions Regulation Compliance for the Parish Council and a confirmation letter has been received from the Pensions Regulator that this has been completed. 16/043 Payment of Accounts a) Resolved The authorisation of the following payments was agreed unanimously: Clerk s Salary (April 2016) 276.48 PAYE for Clerk s Salary (April 2016) 69.10 E.On Electricity (Street Lighting) (1/3/16-31/3/16) DD 36.05 South Lakes Services Toilets Cleaning (April 2016) SO 247.26 CALC Membership fee 282.00 SLDC (emptying 2 litter bins 1/4/16-31/3/17) 446.78 CALC (8 copies of New Good Councillor s Guide) & postage 21.50 South Lakes Services - Toilet unblocking & extra cleaning 54.00 Zurich Insurance 2016/17 417.09 Radar Key (Disabled Toilets) 5.40 b) It was noted that that United Utilities (Water) account for the Cark Toilets has a Credit Balance as at 9 March 2016 of 115.53. 16/044 Highways a) The Clerk reported that a joint meeting with the County Councillor and the Manager of Lakeland Leisure has not yet taken place regarding speeding and unsafe driving affecting horses on Moor Lane. b) The Clerk reported that she is still awaiting a response from Strava from her request to them that 2 Strava timed sections through Holker, Cark and Flookburgh be removed. c) The Clerk reported that she had reported several potholes in Cark to Cumbria Highways. Councillor Keith reported that some had been filled but some potholes on Caton Lane have not been filled. She reported additional potholes: behind the Engine Inn, on Caton Lane, on Station Hill and on Station Road near Cark Station Entrance. Resolved To report these potholes to Cumbria Highways. d) The safety of the road layout near Cark Station Railway bridge on B5278 was considered. The concern is that the roadway had been narrowed to allow the pavement to be widened and this creates problems when vehicles meet on this stretch of road. 3 of 6

Resolved To contact Cumbria Highways and request that they look at whether it is currently unsafe for pedestrians or drivers. e) The Clerk has taken photographs of the crumbling wall at side of the road Bridge over the River Eea in front of the Engine Inn. Concerns have been raised regarding the unrepaired section of damaged wall and it s possible effect in undermining the safety of the road bridge. These items have previously been reported to Cumbria Highways and the Brewery. Resolved i) To report the concerns regarding the road Bridge to Cumbria Highways and request they check the safety of the Bridge. ii) To write to the publican at the Engine Inn and request that the wall be repaired due to concerns over public safety. f) The Clerk received a report from Mr T Ryland that large static caravans have been moved within the Parish around 8 am in a morning both in April and February causing a near miss and a delay to the School Bus resulting in the students being late for school. There is a stipulation in place that caravan deliveries can only take place between 10 am and 4 pm to avoid this situation occurring. Resolved To write to Lakeland Leisure, Bigland Caravan Park and Holker Caravan park reminding them of this restriction. 16/045 River Eea The Clerk reported that she had received a complaint via Councillor Keith from Mr Butterfield regarding sewage outflows close to the Cark Farm sewage treatment works. The Clerk reported this to the Enviornment Agency in early March who advised that United Utilities had attended and cleaned up the debris. This re-occurred and the Clerk reported again to the Environment Agency in April and is awaiting a response. 16/046 Bus Services Councillor Gardner was absent so was unable to report on her communications with Tim Farron MP regarding the reduced daytime service. 16/047 Dog Fouling A resident, Mr Lyons, has reported dog fouling within the parish, particularly on Main Street, Flookburgh. The Clerk advised him of the actions the Parish Council has taken ie more litter bins, notices, postings on the website and Facebook pages and arranging for SLDC Dog Officers to patrol the villages. Councillor Keith reported she had spoken to a woman who had a dog in Cark Park as there is a prohibition notice relating to dogs entering the Park. 16/048 Flookburgh Square Councillors Airey and Dawson and the Parish Clerk had a site meeting with Darren Chaplow of J Chaplow & Sons Ltd. Chaplows have provided a revised quotation for preparation and tarmacking ( 8,512 + VAT), marking out the parking spaces and pedestrian walkway as per the Cumbria Highways plan and installing 8 new metal bollards ( 1,600 + VAT) around the seating area. Two quotation options were provided for the white lining and marking the pedestrian walkway area, one with a textured surface in red ( 2,572.57+ VAT) and one with hatched pedestrian walkway ( 1,204.67 + VAT) The total cost for this would be: 12,684.57 + VAT (red textured surfaced walkway) or 11,316.67 + VAT (hatched walkway) Funding contributions have already been received from Cumbria County Council ( 1,500 towards the line marking) and District Councillor Grant ( 1,000 contribution towards the works) Chaplows can undertake the work the week beginning 13 th June 2016 and Flookburgh Square would need to be cleared of vehicles for most of this week for the works to take place. 4 of 6

Chaplows can also re-mark a removed white line outside Mr Manning s house on Main Street (previously agreed with Cumbria Highways) for 3 per linear metre. The Clerk has contacted Simon Robinson of Cumbria Highways and he agrees to the works going ahead. Resolved To proceed with tarmacking, new bollards, white lining including red marked textured walkway at a cost of 12,684.57 + VAT. Net cost to Parish Council (after grants) is 10,084.57. Additional white lining on Main Street to proceed at a cost of 3 per linear metre. 16/049 SLDC Environmental Partnership Fund The Clerk advised that the Parish Council can apply to this fund towards improvements to the local environment eg street furniture, signage improvements etc to encourage and increase trading and business activity and preserve and enhance the character of South Lakeland key towns & villages. Up to 10,000 can be applied for, however if the amount is more than 2,500 then match funding from the Parish Council will be required. Councillor Keith suggested a replacement picnic bench in Cark Park, at seat between Cark and Flookburgh and cycle stands. Resolved To apply for this funding and finalise the items to be included at the next Parish Council meeting. 16/050 Public Toilets The Clerk reported that a) She has signed an agreement to install a donations box, had confirmation from the Planning Office that no Planning Permission is required for this work and she has ordered the donations box and a padlock. b) She has written to Cartmel Priory School and Flookburgh Primary School asking that their students are advised of the vandalism at the Cark Toilets and she has received a reply from Dr Williams advising that he has asked staff to speak to children during Form Time regarding our recent communication and feedback should they have any information about potential involvement. c) An additional invoice has been received from SLS for their work unblocking the Gent s toilet and extra cleaning required. 16/051 Flookburgh & District Recreational Charity The Clerk reported that fund raising applications are being made by Committee members. The Charity is now registered for Gift Aid so it can receive an additional 25% from donations. A Duck race is planned for 5th June in Cark, ducks are being sold by Committee members and the Post Office for 1. Councillor Dawson offered to sell the ducks at the Flookburgh Library. A Chapel Island Walk is planned for 17th July, led by Ian McClure. 16/052 Cark Railway Station Tim Owen has passed on the issue of the station facilities at Cark to Jim Trotman, the Community Rail Partnership Officer for the Furness Line. The new franchise does have some money allocated to spend on stations and it will no doubt get Cark a little higher up the pecking order if the Parish Council is supporting the upgrading of facilities; some match funding would also assist matters when a scheme is produced. 16/053 England Coast Path The Clerk attended the landowners/occupiers drop in at Grange Methodist Church Hall on 3 rd May and spoke to Natural England representatives. Natural England have notified all landowners and plan to speak with all occupiers/tenants. The path is part of a 20 year plan, there is government funding for signage etc and it will be checked annually. They plan to list a Section 25 for marshy areas (no access).
