Resolved: None. 297) Police Matters (a) Police Report Kayleigh s Love Story Kayleigh s Love Story is currently being released to all Secondary Schools across Leicestershire by the Force. North West Leicesershire, and in particular Castle Donington College, was the first in the county to receive the workshops which included the showing of the award-winning film to students in Y7, Y8 and Y9. The powerful film portrays aspects of last two weeks of Kayleigh Haywood's life. It was screened last week in the college following showings to adults living in the communities of Ibstock, Measham and Coalville earlier this year. In November 2015, 15-year-old Kayleigh was groomed online by 28-year-old Luke Harlow a man she had never met. Over the course of 13 days, he sent the teenager more than 160 messages a day before she finally agreed to spend the night at his house in Ibstock. The tragic and horrific circumstances that followed saw the schoolgirl being held against her will by Harlow and his neighbour Stephen Beadman, before being raped and murdered by 29-year-old Beadman. 1

With the backing of Kayleigh's parents, Leicestershire Police made the film to raise awareness and highlight the dangers of online grooming to both parents and children. The workshop is part of a local police initiative to promote the awareness of CSE to pupils, teachers and parents throughout the academic year which also include further showings of Chelsea s Choice in March. Road Traffic issues across the beat Working with data supplied by Community Speed Watch Groups beat team members continue to carry out enforcement operations across the Valley beat. Resolved: This has been another busy month. As well as the ongoing flooding issue which Dave will update us on later in the meeting other issues have raised their heads. I have been told by David Shields junior that Cameron Homes have finally submitted their planning application, it is not on the agenda for today but no doubt we will be discussing it next month. Whilst on the subject of Shields and planning there are many rumors circulating regarding the closure of the Priory golf course and club house and replacement by a pay and play centered on Breedon. I have spoken to DS jnr on this matter and he confirms that issues are under discussion with regard to how they go forward. Apparently, they have a substantial loan, on an interest only repayment basis, which is approaching renewal and the lender is not willing to continue on an interest only basis therefore funds have to raise to pay down the capital sum. I am concerned about how this scenario will affect the promise that was made to provide a small shop in the clubhouse at Wilson for the villagers. This will not be possible if the golf pro and the clubhouse manager are asked to leave. Perhaps we should have further discussions with the builder James Ottewell and the planners. On a lighter note I would like to thank all those who helped in the litter picking last Saturday. A huge amount of rubbish was collected and a good old chinwag was enjoyed at The Old Chapel afterwards. I am really sorry I couldn't attend but I had an attack of gout however I enjoyed the apres pick in my kitchen. At the Macmillan coffee morning on Friday last the stalwarts of the WI ably assisted by many others managed to collect a massive 1600.00 The weather was excellent which helped no end. Guess the weight prizes, a joint of Venison from Donington Park Farmhouse and a joint of Ham from Les Fisher were won by Jill Jamieson from Shardlow and Kim Jones from Ulverscroft. Thank you also to all those who made cakes and samosas. Our next significant event is the Remembrance service at the war memorial on Sunday 13 th Nov I hope for a good turnout as we had last year. My plan is not to lose the wreath as I did last year! The A42 highways work has seen Breedon experiencing HGV s diverting through the village. Cllr S Jones explained that it is important if you do see HGV s passing through the village to note down the registration plate and report them to the Police. The Highways Agency and the Police are aware of this current situation. 2

299) Administration & Finance (a) Clerk's Report. CLERK S ADMINISTRATION REPORT 3 rd October 2016 Training Calling in Planning Applications Cllr Morrison and I attended. Email sent to all Cllrs with valid information from the evening. Budgeting and Financial Management Training Monday 10 th October. Green Shoots Grant Asked for an update. Litter Pick The Community Litter Pick held on Saturday 1 st October was a huge success. A massive thank you to all that came to volunteer. The Green, Breedon Insurance Update. Broadspire on behalf of Maven have approved our claim at The Green, Main Street Breedon and the Parish Council can now begin to start works to this area. (I am awaiting a confirmation email). Church Gate I met with the Community Support Office at NWLDC to discuss what procedure the Parish Council must follow in order to be successfully granted a PSPO. Firstly, the PC needs to gain evidence. i.e. pictures and Police reports etc. I have been in contact with the Police for their help with this and now have a report dating back to 2007. In the meantime, can you please urge people to take pictures and write down dates etc of the problems that occur. For example, if there are needles or fly tipping, please take pictures before they are cleared away. These activities will give us a stronger advantage of a PSPO being granted. Budget Cllr D Keith and I will be working on the budget over the month of October with a view to presenting a proposed budget for discussion in November. Would anyone else like to join following our first meeting (this is just where we will be sorting out spreadsheets etc). I will also be having my appraisal this month too. Remembrance Day I will be ordering two wreaths following this meeting. Meeting with NWLDC Planning Dept re: Flood Report Asked for an update. To date non received. LCC Flood Meeting Wednesday 12 th October at 7pm. (b) Comments Register. None. (c) To approve Annual Membership to the SLCC. Resolved: The Parish Council agreed to the 2016 SLCC Membership, which is part paid by Long Whatton and Diseworth Parish Council. (d) To discuss and confirm the works needed to the tree on Berry Ave following expert advice. Resolved: The Parish Council confirmed the works to the Tree on Berry Ave; Felling of the Ash Tree and removal of arisings and to remove the stump by grinding. Clerk to advise tree surgeon to carry out tree works. 3

(e) To discuss quotation to replace the two-rail fence at Berry Ave, after close inspection revealed that almost every post is rotten. Resolved: The Parish Council agreed to repair the old fencing with new posts and rail. Clerk to advise contractor to carry out works. (f) To confirm the amounts of the Financial Limits of Authority to be placed alongside the Financial Regulations. (fwd Cllrs). (a) Flooding - Cllr D Camp to provide a brief update of actions undertaken by The Flood Working Group since the last Parish Council meeting. Resolved: Since our last meeting the Holly Bush there have been a few things happening on the Flooding issues so I thought I should bring you all up to date. The draft flood report was issued on 5th September by LCC. I had quite a few comments from various people and on 8th September Simon, Martin and myself had opportunity to put the various points directly to Josh Wilce at a meeting following which the report will now be updated and reissued. LCC had quite an interest in Peters rainfall figures and he has been in touch with them. LCC are proposing to make a formal presentation of the report to the village and some provisional dates after 12th October are being suggested. A venue also needs to be sorted. The presentation will give opportunity for anyone to raise questions directly with LCC. LCC have been undertaking a full mapping exercise of the Breedon drainage system. They were planning a few days at the beginning of September but were in the village for over 2 weeks. Hopefully the drainage plans will be included in the new report. Letters have been sent out to riparian owners - to date I've heard nothing back. Simon again raised the A42 drainage issue with Highways England with a slightly less negative response. I think this is something LCC are looking at more closely. 4

My view is we have the public presentation then convene another meeting to consider next moves. (a) To note the date for the public meeting where the draft flood report will be presented by Leicestershire County Council. Resolved: Public Meeting confirmed for Wednesday 12 th October at 7pm at Breedon Primary School. The Clerk to advertise the meeting in the Parish notice boards and on the Parish Council Website and Facebook. (b) To discuss a potential Neighbourhood Watch Scheme. Resolved: The Parish Council agreed to set up the Neighbourhood Watch scheme. Volunteers are needed in order for the scheme to be successful. The Clerk to liaise with Cllr J Melen and the local Police to see what is needed to get started. (c) Cllr J Morrison to give an update on the upcoming works at the footpath at Tonge Station undertaken by Sustrans. Resolved: Cllr J Morrison explained that he d noticed signs at Tonge Station (near Breedon on the Hill) informing users that Sustrans wishes pedestrians to keep to the path in future in order to protect the wild flowers. He then received an email from Sustrans explaining that they have a new tools container on the Cloud Trail for our volunteers to use and on Friday 28 th October at 1pm they will be painting the container, having a barbeque and chatting about future plans for the route. Cllr Morrison is attending the event. 301) Planning Applications: (a) Planning Applications: consider and respond to the following: 16/01005/FUL: Demolition of No. 1 The Crescent and erection of two detached dwellings with associated works at 1 The Crescent, Breedon On The Hill, Derby, DE73 8AY. - NO OBJECTIONS, however, the Parish Council would like to see the existing garden preserved as much as possible and for NWLDC to consider placing TPO on the existing trees. 16/00980/FUL: Erection of a detached dwelling with associated off-street parking (Revised Scheme) at Land To The Rear Of 1 Hollow Road, Breedon On The Hill, Derby, DE73 8AU. - OBJECT. The planning application for the above was discussed at Breedon on the Hill Parish Council meeting, held on. The Parish Council is clear that the planning application for the above proposal fails to provide sufficient information. For example, no floor levels, or ridge heights are specified and more importantly, there is no comparison to show those existing properties located to the west in order to provide a clear idea of how overbearing the proposed development will be. Additionally, there is a further building shown on the site plan with no description or further detail whatsoever. The proposed development is located within the conservation area and abuts the designated SSSI and is just below the heritage asset of the bulwarks and Breedon church. The applicant s archaeological assessment and design and access statement both concede that there will be harm to these assets, albeit that they claim subjectively it is negligible, but the fact remains the statements acknowledge an element of harm. The Barnwell High Court ruling of 2014 is very clear that any harm to a heritage asset must result in a presumption in favour of refusal. Furthermore, the location of the proposal is in the conservation area and one of the oldest parts of the village, including be listed Horseshoe pub almost adjacent. We find it astonishing that the application specifies a metal cladding for the proposed building. The Parish Council would like to make sure that the village scene is protected, especially due to the proximity of the Church and other listed buildings in the vicinity. Consequently, there was a unanimous vote in the strongest possible terms to reject this application on behalf of 5

the Parish and particularly the many residents adjacent who will be directly affected by this inappropriate development. (b) Planning Decisions notified since the previous meeting: 16/00921/TCA: Works to 1 no. Ash Tree (Unprotected tree in a conservation area) at 3 The Lime Kilns, Breedon On The Hill, Derby, Leicestershire, DE73 8ND. - CONSENT TO CARRY OUT WORKS TO TREES IN CONSERVATION AREA. 302) Representatives Reports: Cllr J Morrison and the Clerk attended a training session on 20 th September called "Calling in Planning" held at North West Leicestershire District Council. The training was given by Chris Elston and Dave Gill (legal). Cllr J Morrison gave an update at the meeting and the Clerk had previously circulated information to all the Parish Councillors. The main points are the following Parish Councils are ONLY a consulted body, and have NO decision-making authority Planning Officers can ONLY make recommendations based on LAW (not public opinion) On contentious applications, the Parish Council needs to get them "called in" which can only be done by the specific District Council Ward Member. This is not an automatic process as it is then up to the Planning Officer and Chair of Planning to decide whether they should do this, usually after a site visit. To have an application "Called In" the Ward Member must meet certain criteria: Make the case within 3 weeks of the formal application Support the call with one or more genuine planning reasons And demonstrate how the item is a matter of local concern If the three-week period is missed then there is an opportunity for a DEL-1, which allows the Ward Member 5 working days to make the case to have an application not go to delegated powers, - the Officer recommendation determines without going to Planning Committee.
