This creates uncertainty for the types of uses that can be considered accessory to a recreational facility or auditorium such as an arena. The limited extent of zoning permissions also results in constraints to making best use of the City s public assets, particularly where it can be demonstrated that land use matters can be adequately addressed at each facility. The following is a Public Meeting report to the Planning Committee regarding a City-initiated application for a zoning by-law amendment to five (5) municipally-owned properties. This report describes the proposed application and includes an overview of the relevant policies and regulations that will be evaluated as part of a future comprehensive report. The subject properties include the arenas that are located at 1030 Sunnyside Road (Cataraqui Community Centre), 303 York Street (Kingston Memorial Centre), 100 Days Road (Centre 70), 1350 Gardiners Road (Invista Centre) and the facility at 53 Yonge Street (Portsmouth Olympic

The purpose of the zoning by-law amendment is to permit trade shows and specific day retail sales as an accessory use at the Invista Centre, Centre 70 Arena, Cataraqui Community Centre and the Kingston Memorial Centre, and to permit trade shows, exhibition events and ancillary sales as an accessory use at Portsmouth Olympic Harbour. New definitions to support this zoning by-law amendment application are also proposed. Staff will consider and review any feedback received at this meeting and a comprehensive report will be prepared and presented to the Planning Committee at a subsequent meeting. 52

Also, any person may make written submissions at any time before City Council makes a decision on the application. If a person or public body does not make an oral submission at a Public Meeting, or does not make a written submission to the City of Kingston before a decision is made by Council, the person or public body is not entitled to appeal the decision of the City of Kingston to the Ontario Municipal Board and may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to add the person or public body as a party. The Planning Committee will consider a comprehensive report and recommendation from the Planning Division, respecting the subject application, at a future meeting. Background Staff have continued to explore opportunities that will allow for a mix of uses at City-owned recreation facilities so as to ensure these public assets are managed in a fiscally-responsible 54

Report to Planning Committee Report Number PC-17-097 November 2, 17 Page 5 of 10 manner while also supporting the establishment of more complete communities (i.e. those that offer a range of uses within close proximity to one another thereby lessening the demand for the private automobile). Over the years, staff have received inquiries regarding the hosting of trade shows and specific day retail sales at municipally-owned arenas and facilities. Land use considerations associated with these events are in many respects the same as those associated with a permitted use, such as a sporting or entertainment event. The purpose of this Cityinitiated zoning by-law amendment application is to ensure that a broader mix of compatible uses can be accommodated within specific City-owned recreational facilities. The appropriateness of this application will be considered against the general intent of Zoning By- Law Number 8499 and Zoning By-Law Number 76-26, as well as the over-arching policy objectives of the City s Official Plan. Site Characteristics The five properties subject to this amendment are located in various locations in the City (Exhibit A - Key Map). Three of the five properties are located in the City s west end, being west of Little Cataraqui Creek. The Invista Centre (1350 Gardiners Road) is located at the intersection of Macrow Street and Gardiners Road and is surrounded by industrial and business park uses. The Cataraqui Community Centre (1030 Sunnyside Road) is located along Sunnyside Road between Highway 401 and McIvor Road and is surrounded by residential and open space uses (i.e. Cloverdale Park). Centre 70 (100 Days Road) is located at the intersection of Days Road and Front Road and is adjacent to institutional and commercial uses which include the Reddendale Plaza, Our Lady of Lourdes and R.G. Sinclair Public Schools, and the Collins Bay Penitentiary. Centre 70 is also close to established residential uses, being opposite Front Road from the facility. The two remaining properties subject to this rezoning application are located in the central area of the City, being between Little Cataraqui Creek and the Rideau Canal, south of Highway 401. The Kingston Memorial Centre (303 York Street) is located on a large parcel within an established residential neighbourhood. The site is also within close proximity to a number of commercial uses along Concession Street and within the Williamsville Main Street corridor along Princess Street. The Portsmouth Olympic Harbour (53 Yonge Street) abuts a marina on Lake Ontario and includes open parkland supporting an office building near the intersection of Yonge Street and King Street West. The property abuts the Kingston Penitentiary site and contains a mix of residential and commercial uses along King Street West. Existing Zoning Exhibits B to F show the existing zoning for each of the municipal properties. The subject properties contain unique zoning categories that all allow for arenas as shown in Exhibit G Proposed Floor Plans & Elevations. Under Zoning By-Law Number 76-26, the Invista Centre is zoned site-specific Heavy Industrial (M6-21) and the Cataraqui Community Centre and Centre 70 are zoned Institutional (I). The Memorial Centre is located in a Recreational Building (P1) zone in Zoning By-Law Number 8499. The Portsmouth Olympic Harbour facility is zoned General Recreation Park Modified (P.131) in Zoning By-Law Number 8499. Although the current zoning allows for the subject arenas in their respective zones, further clarification of the permitted uses ancillary to an arena is required. Neither Zoning By-Law Number 76-26 nor 55

Report to Planning Committee Report Number PC-17-097 November 2, 17 Page 6 of 10 Zoning By-Law Number 8499 does not provide a definition for an arena, and therefore rely upon the standard dictionary definition. The Merriam-Webster dictionary defines arena as an enclosed area used for public entertainment. Zoning By-Law Number 76-26 allows for arenas in more than one zone; however, as per Section 5.18.c General Provisions Public Uses, arenas are only permitted where specifically listed. Section 33.2 - General Provisions for the Recreational Building Zone "P1" of Zoning By- Law Number 8499 allows arenas to be permitted in the P1 zone, which is the only zoning category to include this use. These provisions indicate that arenas have been treated as a specialized use, separate in function than other type of recreational or community facility as outlined in Exhibit H Proposed Survey. Proposed Amendment to the Zoning By-Laws To provide clarity to ancillary sales and accessory uses, it is proposed that new definitions be included in Zoning By-Law Number 76-26, Zoning By-Law Number 8499 and the proposed Citywide zoning by-law, which will draw from the amendments presented in this application. It is proposed that these new definitions will more accurately capture the evolving use of City-owned recreation facilities and the desire to support a broader range of compatible land uses within each. The proposed definitions are as follows: 1. Arena means an indoor recreational facility, or part thereof, and which may also be used for events, assembly, spectating or exhibition. 2. Recreational facility means the use of any lot, building or structure, or part thereof, for the provision of participatory athletic or recreation, which may include a community centre, ice or roller skating rink, curling rink, racquet club, swimming pool, golf driving range, billiard parlour and bowling alley or other similar uses where the principle focus of the use is the participation in athletic or recreation activities. 3. Trade show means an exhibition limited to part of a calendar year in a specific location other than a retail store, and may include retail sales accessory to the trade show to promote awareness or sales through the display of products within an industry. 4. Specific day retail sales means the use of any lot, building or structure, or part thereof, for selling or buying goods and services, including entering into contracts for the sale and/or purchase of goods or services that are to be delivered at a later date, or promoting the sale and/or purchase of goods or services, limited to part of a calendar year in a specific location other than a retail store. The use of arenas for trade shows, sales events and uses that are not clearly accessory to a recreational building or auditorium are not addressed in the current by-laws. This creates uncertainty in the existing zoning by-laws for the types of uses that can be considered accessory to a recreational facility or auditorium such as an arena. Therefore, it is proposed that Zoning By-Law Number 76-26 be amended to: 56

Report to Planning Committee Report Number PC-17-097 November 2, 17 Page 7 of 10 Amend the zoning for the Cataraqui Community Centre and Centre 70 from Institutional (I) to a site-specific Institutional (I) zone that includes trade shows and specific day retail sales as an accessory use to an arena. Amend the site specific zoning, M6-21-Site-specific Heavy Industrial zone, for the Invista Centre to include trade shows and specific day retail sales as an accessory use to an arena. Further, it is proposed that Zoning By-Law Number 8499 be amended to: Amend the zoning for the Memorial Centre from Recreational Building (P1) to a sitespecific Recreational Building (P1) zone that includes trade shows and specific day retail sales as an accessory use to an arena. Amend the site specific zoning, General Recreation Park Modified (P.131) zone for Portsmouth Olympic Harbour to include trade shows as a permitted accessory use. The intention of the proposed amendments is to address the issue of stand-alone sales events, trade shows with retail sales components and other events that are not related to the more traditional, and one-dimensional, recreational use of arenas. These uses have been permitted in the past based on the umbrella definitions as provided in the respective zoning by-laws for an auditorium or community centre that allows athletic, civic, educational, political, religious or social events or fairgrounds (Exhibit H). Adding trade shows and specific retail day sales will reduce ambiguity with respect to permitted accessory uses and allow for a broader array of compatible community uses to be established. To ensure that the primary use of the properties remains a recreation facility, these uses are proposed to be listed as accessory to the primary use (as an arena or harbour). Any further limitation to the frequency of use cannot be easily expressed in the zoning by-law. However, new provisions in Licensing By-law Number 06-213 could be used to restrict licences by duration of use. For example, the by-law may be amended to establish a limit on the number of events that could be hosted within a calendar year and the duration, in consecutive days, over which each event could operate. This accompanying amendment would ensure that a trade show or specific retail day sales event does not become the predominant use of the facility. The Portsmouth Olympic Harbour facility is zoned General Recreation Park Modified (P.131) in Zoning By-Law Number 8499. The permitted uses include various types of parks, athletic uses, marinas, offices, educational classes, retail sales of marine supplies and other non-retail uses. The current uses of the property are varied, but there are currently no facilities as defined in the City s zoning by-laws to link these events as accessory uses. As such, it is proposed: That trade show be added as an accessory use to permit social, cultural and civic events to continue within this site-specific zone; and That accessory retail sales be permitted when associated with trade shows and that such use not be exclusively limited to marine supplies as is currently the case. 57

Report to Planning Committee Report Number PC-17-097 November 2, 17 Page 8 of 10 Provincial Policy Statement The Provincial Policy Statement (14) provides policy direction on matters of provincial interest related to land use planning and development, which are intended to be complemented by local policies addressing local interests. This proposal will be evaluated as part of the future comprehensive report in order to ensure it conforms to the policy direction in the Provincial Policy Statement (14). Official Plan Considerations Schedule 3A of the Official Plan identifies the land use designations of the five properties as shown on Exhibit I. 1350 Gardiners Road (Invista Centre) is designated Business Park Industrial and General Industrial. Complementary uses for the Business Park Industrial designation include office and business services, restaurants, hotels, public and private parks, and recreation facilities. The General Industrial designation permits manufacturing, wholesale trade, construction, transportation, storage, communications and utilities. 1030 Sunnyside Road (Cataraqui Community Centre) is designated as a Hamlet in the Official Plan. Permitted uses in the Hamlets include new one-unit and two-unit residential dwellings, parks and open spaces, limited commercial uses primarily of a local convenience nature or related to the surrounding rural and agricultural community, and community facilities such as schools, places of worship, community centres, libraries or fire halls, in accordance with Section 3.2 of the Official Plan. 303 York Street (Memorial Centre), 53 Yonge Street (Portsmouth Olympic Harbour) and 100 Days Road (Centre 70) are designated as Open Space. Permitted uses include active recreation uses, such as sports fields and sports and recreation centres; passive recreation uses and forms of urban agriculture, such as community gardens and garden plots; landscaped areas and conservation areas, woodlots and forestry reserves. The zoning by-law amendment proposes to permit trade shows and specific day retail sales as an accessory use to the existing permitted primary uses on the subject properties. As such, the proposed by-law amendment conforms to the intent of the City of Kingston Official Plan. Zoning By-Law Considerations A summary of the zoning by-law provisions applicable to the subject properties are indicated in Exhibit G. Technical Circulation Process The application has been circulated to a number of internal departments and external agencies for review and comments. The responses to the technical circulation will be addressed in the technical review and included in the comprehensive report for consideration at a future Planning Committee meeting. 58
