TOWN OF NORTH GREENBUSH PLANNING BOARD 2 Douglas Street Wynantskill, New York 12198 MEETING MINUTES at 6:30 PM Attendance: Mary Jude Foley, William Madsen, Mark Lacivita (Chairman), David Wilson, Jeffrey Spain, Leanne Hanlon (Secretary), Matthew Hug absent (Legal Counsel), Thomas Murley (Town Engineer). Public Hearings: 6:30 PM - Application of Hudson Valley Stargreen s for Site Plan Review of a Planned Development District (PDD) at 50 North Greenbush Road and Vicinity Tom Andres reviewed the application again with the board and the public. He distributed updated maps for the board as well. Professional and residential parcels were combined per Mr. Andress. 46 unit townhouses, 4 single family home which are changes from prior. Commercial buildings staying the same. DOT will be doing roadwork for traffic improvement at the site as well. They completed a soil study per Andress and connecting to existing water and sewer and storm management will be onsite. Storefronts? Depends on what tenants they can get per Mr. Andress. No commitments on businesses coming in yet per Andress. There will be a HOA for the townhouses. They will be responsible for all exterior maintenance and snow removal. Mr. Madsen asked for the snow storage to be noted on the map. Dumpsters will be enclosed per Mr. Andress. Ms. Foley asked for plantings and arborvitae trees. She also asked about sidewalks. Mr. Andress stated it has not yet been addressed but their intention is to have people be able to walk from HVCC. Mr. Andress stated they discussed the site plan with the town board. He stated there will be shrubbery and green space as well. Someone met with the design committee for the town as asked by Chairman Lacivita. He also stated CDTA commented on sidewalks, bike racks, and bus stops in the area. Chairman Lacivita noted to the public that we are operating under a local law as adopted by the town board and we cannot change anything in the local law.

Page 2 Public Hearing Opened: Scott Kumajian, 19 Glenmore Road. He would like to know where the road will be on Glenmore and he lives on the south side of Glenmore. Also concerned about where he is located in conjunction with the buildings and is asking for buffering. His property will be affected every time someone enters the townhomes. Debbie Jones, 115 Glenmore road: has a traffic study been conducted and impact on the intersection on rt. 4. Andress stated they are working on the traffic study and when it is complete it will go to DOT. Asked about lighting and infrastructure and Glenmore road is deteriorating. HVCC traffic. Concerned of the increased traffic. She doesn t want the situation to get worse. Impact on environment. She asked if there has been an environmental impact study. No? Impact to the Little Red Schoolhouse? It is the last one in the US. Increase in students to that school would have a major impact on the residents paying the taxes. Emergency services impact? Fire Department Police Department, Ambulance due to increased population in the townhouses. Value of the homes and what impact will it have on the value of the existing homes in the area. Residents on Glenmore road have been fighting for water and sewer for 30 years. There is not enough well water in that area. She is requesting that the residents may be able to tie into the water and sewer lines. Asking for consideration of the residents in the area and this upsets her tremendously. No comments from the school district per Mr. Murley. Fire and police did comment on this per Chairman Lacivita and they did not object. Per Mr. Murley water and sewer will require and extension west of Glenwood Road. Same for sewer. No takers on the possibility of extending water sewer district per Mr. Murley. Mr. Durivage, off Mazaway behind Elks: Very difficult to get out of Glenmore onto rt. 4 need a left turn arrow. Concerned people will go down Mazoway to get out because of the congestion to get out onto Rt. 4.He doesn t feel as if there is enough room for the four homes. He has a concern about additional traffic.

Page 3 Barbara Warren: Hampton Place: concerned about the traffic now and increased when this will be built. Very dangerous. Joe Jones, Glenmore road: traffic study? Per Mr. Andress the traffic study will be updated. John Bentley, 122 Glenmore Road: has a crappy well. Will the county fix Glenmore road? It is very bad. The board has not heard anything. Will there be cost savings for a water line per existing home because they are running it for this project? Murley said the homeowners can form a water district and go to the town. He feels his water for his well runs right through the site and doesn t want his well ruined. What will he do if his water is ruined? Public is concerned about running water lines. Chairman Lacivita stated to the public that this board can and will ask the developer to bring the water line down with connectors so there would be a possibility they can hook into it. Residents have to petition the town board for this per Chairman Lacivita. Samantha Sharpe, 113 Glenmore Road asked the developer if they can join that water district. Andress stated he can work with Mr. Murley and see what can be done. Greg Spore, 3 Glenwood Road: Home value, traffic, concerns, how well people are aware about the drainage and has a problem already. Sewer smells are a concern too. Mr. Andress stated that the DEC has regulations that control the amount of runoff and cannot be greater than in an undeveloped state. Tim O Conner, 117 Glenmore Road. He stated there is no way you can put 4 houses in that area. He has a problem with the current intersection and you cannot put a band aid on it. It needs to be totally reconstructed.

Page 4 Curt Hayner, 25 Glenmore Road: There is a mess in front of his house while taking down trees. He was told it would be cleaned up but it has not happened. He also said there will not be enough room for additional children to go to little red and it will close and their taxes will go up. He is upset about the mess already in front of his house and it will only get worse. Per Chairman Lacivita they have not received any comments from the Little Red board. Samantha Sharpe: asking if it is possible to put the entrance in a different location. No per Mr. Andress because of the steepness. Sheryl Bentley, 123 Glenmore Road. Asked if the plans will be available so they can look at them. And they will be per Mr. Andress. Mr. Durivage spoke again and suggested a different way for this to go out onto rt. 4 to eliminate a lot of traffic on Glenmore. Mr. Andress said it depends on the slope. Peter? Glenmore Road: what is the approximate number of people? Mr. Andress said they will be 2 bedroom homes. Zoning Board Chairman Richard French spoke about the zoning process for this project to the public and the board. Chairman Lacivita stated there will be no further action on this application this evening because there is too much information to digest and review. Public Hearing closed. 6:40 PM - Application of Uriah Corporation for Site Plan Review for a 3-unit apartment building and accessory garage structure at 369 West Sand Lake Road (Tax Map Parcel No. 135.11-2-2) in a General Business (BG) Zoning District

Page 5 Frank Marotta reviewed the application again with the board and the public. He also distributed a new site map to the board and will be submitted to DOT. The entrance changed coming off of WSL road. That is the only change. Rt. 150 access only. He also plans to hide the dumpster with plantings. 3 bedrooms, two baths, about $1400 a month. He will also clean up the back. Foley asked what he was going to do at Snyder s corners road. Marotta stated it will be landscaped. Public Hearing Opened: No one wishing to speak. Public Hearing closed. 6:50 PM - Application of Gary W. Clarke for a 2-lot Minor Subdivision on a 20.29-acre parcel at 10 Sagendorf Lane (Tax Map Parcel No. 135.7-1-10.1) in an Agricultural Residence (AR) Zoning District Kevin McGrath from McGrath Land surveyor s spoke about the application. He provided a 911 address as well. It will be 22 Sagendorf. There is 20 acres of land he wants to divide it for one lot on a little less than 2 acres. Gas has been run and water. Almost double the minimum lot size. He noted the neighboring wells on this map and the 911 address. Public Hearing Opened: Harold Bearder, 21 Sagendorf, neighbor and lives directly across. He has an agreement with Gary Clarke himself and the town to put up shrubs and move the entrance. His concern is will this ruin those. He would like it clear cut and put trees in and would like the agreement updated. Chairman Lacivita is noting that it is not Mr. Clark s intent to do anything to disrupt that agreement. Chairman French spoke about that agreement and stated it is between two property owner and matches the ruling of the zoning board. Public Hearing closed.

Page 6 Presentations: Application of The Home Depot for Site Plan Review of modifications to the existing approved site plan at 600 North Greenbush Road in a General Business (BG) Zoning District. Chairman Lacivita stated he spoke with Steve Powers of the Nigro companies about an agreement and/or restrictions between Applebee s, Staples and? He is requesting they bring some type of release to explain this issue. Mr. John Kerekes spoke about the site plan for Home Depot. The application is for seasonal sales use from April 1-July 15 th on the northern side adjacent to the garden center. 4 spaces for shed display. 8 spaces for large equipment rental, 10 for Penske trucks, 8 space for contractor parking, 1 space for load and go, 2 spaces for disabled vets, and cart corrals. Contractor parking would eliminate any parking under the canopy because they do not want anyone to park under the canopy and or signs and possibly put material there so no one parks there. They came before Zoning Board last month for parking changes. He noted they are not taking away any spaces they are just allotting spaces. The sheds will take up spaces though. There has been a demand for outdoor supplies per Mr. Kerekes and they need the space for that. Chairman Lacivita spoke to the fire inspector today and he has concerns with parking in that loading area but it looks as if they are putting no parking signs but there is a concern that they are putting material there now. There is a lot of material stacked against the building that is unprotected. For instance fencing, pallets, etc. the site plan prohibited any outside material storage per Chairman Lacivita. He stated there are hazards with these items piled up front and back. They need to be addressed. Chairman Lacivita asked the fire inspector to meet with someone from home depot to ensure they are in compliance and doesn t want to review any changes until they can ensure they are compliant to the original site plan. Also there is not supposed to be no parking in front of the building at all per Chairman Lacivita. It was also noted that there were carts and such lined up in the fire lane.

Page 7 Chairman Lacivita stated that when they bring the revised site plan back next month the board would like to see these items cleaned up first. Chairman Lacivita suggested that Mr. Kerekes look at the temporary fencing that is there now and also run it by Councilman Mazone and the fire inspector and run through the design guidelines. Mr. Madsen said that the site plan specifically noted there would be no outside sales and/or storage and it needs to be rectified. Chairman Lacivita realizes that that was done in 1997 and things have changed so the board can take a look at possibly revising it. Chairman French stated he asked what is a Pro parker is. It gives you special sales, you can have your order pulled before you arrive, etc. he spoke to the manager and he explained it at the ZB meeting last month. Mr. French spoke and stated that the parking under the canopy has been taken care of. He stopped at two other Home Depots and they do not allow parking under the canopy. Mr. French also spoke about parking space creep. Sheds, garden equipment, etc. He also stated that there is some come of agreement that shares parking spots for Applebee s and Staples. Applebee s is in East Greenbush district. He also said the number of spaces has never been an issue it is the use of the spaces. Chairman Lacivita stated they need to decide what is going to be spaces that will not be used for parking and for storage and the construction fence issue. Chairman Lacivita is looking for a plan to look at from them and the Building Department to review as well and the owner of the property signs off on it so it looks nicer and is safer. Ms. Foley spoke about the fire lane: Why does home depot use the fire lane to store stuff? Will they be moved? Yes it will per Mr. Kerekes.

Page 8 Mr. Wilson asked if the garden center would be expanded in the future but Kerekes said it would not be cost effective that is why they use the area for temporary/seasonal items. Business Meeting: Action to be considered Approval of March 2, 2015 Motion made to approve the March 2015 minutes by Mr. Madsen and seconded by Mr. Wilson. Ms. Foley abstained she was not at the March meeting. Page 10 Tom Andress spoke about the application which will be before the ZB on April 15 th for a special permit. 4 pump island with 8 fueling areas. There is a 100 foot buffer shown. Some parking goes into that buffer that is why he has to come before zoning. He gave the board a site map to review. They will be tying into the water main and an extension for the sewer. 38 spaces required which includes the fuel islands. Town board zone change had a condition to go before the design committee. Not disturbing the area in the rear but will add additional trees. Chairman Lacivita asked if they were doing any improvements to Arbor Drive. Per Mr. Murley there will be a water main installed in the area as well. There will be a sewer connection as well. Ms. Foley asked about shrubs and greenery on either sides and Mr. Andress stated they will be doing landscaping. And she asked for trees along Arbor Drive and Mr. Andress is agreeable. She also asked about sidewalks but they are not in the plan at this time. Motion made to accept sketch plan and schedule public hearing for May 4 th at 6:45pm by Mr. Madsen and seconded by Ms. Foley. Other issues: Rite Aid is building a new building in front of TJ Max. Daegan proposal: wants to put a single family residence on the property. He leveled some ground over the winter per Chairman Lacivita. BD issued a stop work order. Mesco: complied with everything and are cutting trees per Mr. Murley.
