What is MYBA? BURGESS is a founding member of the Worldwide Yacht Brokers Association (MYBA) which has been running since 1984 and is involved at all levels within the superyacht industry. It guides its members on the highest ethical and technical standards, ensuring corporate and individual members meet the requirements of the Rules of Conduct. MYBA holds a significant role in the superyacht industry, working closely with government organisations, coastguards, the International Maritime Organisation, licensed marine underwriters, insurance companies and lawyers. With the input from many of these and other professionals, MYBA established a charter contract which has been regularly updated over the years and is today the universally accepted charter contract world-wide. Membership is available to eligible companies and individual members with a proven track record of professional excellence in the yachting industry. Member companies are required to hold professional indemnity insurance and meet the strict requirements as outlined in the MYBA Statutes. By working with a MYBA company, Charterers can benefit from the safeguards that have been established and be assured that they are adequately protected and represented by experienced professionals. 21
Terms and conditions Below is a summary of a number of the main terms used in the standard MYBA contracts. If you have any questions, however, please do ask! CHARTER EXPENSES The charter rate includes the hire of the yacht together with its crew, crew food and the yacht s insurance (although the Charterer is responsible for his own personal travel & Charterer s liability insurance). All other operational expenses are to the Charterer s account, such as fuel, port fees, food and beverages, personal laundry, local taxes, customs formalities, charges for water and electricity and ship s agency fees etc. Generally speaking, we estimate these costs in the region of 30% of the weekly charter fee, although this could vary depending upon the type of cuisine you select, your choice of yacht and the extent of cruising undertaken. Therefore, a 30% Advance Provisioning Allowance, (or A.P.A.) will be required at least 35 days prior to embarkation in order for the crew to fully provision the yacht according to your requests. A fully itemised set of accounts with supporting receipts will be provided at the end of the charter and any outstanding amount left-over will be returned to you. PAYMENT 50% of the Charter Fee is due upon signature of the charter contract. The balance of the Charter Fee, the APA, any delivery fees, security deposit and VAT are due 35 days before the start of the charter. All funds except for the APA are held by the Stakeholder until the embarkation, upon which 50% of the charter fee is paid to the Owner. The balance is paid the day after the end of the charter. WATERSPORTS Each yacht s recreational equipment is believed to be correct but cannot be guaranteed. Use of personal water craft (jet skis /wave-runners) may be restricted in certain cruising areas and often require appropriate licences. Please check with us first for any guidelines, if you require a license or if you have any specific expectations in this regard. CHILDREN Many yachts are child-friendly and safety-conscious with all the right equipment on board. However, some will only accept children over a certain age or require a nanny to be present, so it is helpful to let us know if there will be children in your charter party. GUEST NUMBERS The maximum guest number for sleeping or cruising on board will be clearly noted on the charter contract and generally does not exceed 12. Should you wish to entertain more guests during the charter, please check with your broker as to the numbers permitted while the yacht is berthed in port. GRATUITY We would like to advise that if you have enjoyed the service provided by the crew, it is customary to offer a gratuity. While the amount is completely at your discretion, MYBA recommends between 5 to 15% of the basic Charter Fee. The Captain will disburse the gratuity amongst the crew, unless you would like to personally reward an individual that has been particularly outstanding. 22
