EVENT REGISTRATION, RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT FOR PARTICIPATION IN: 2017 IRONMAN Mar del Plata, Argentina. December 3 th, 2017 (including related programs and/or events) (hereinafter, the Event) READ THIS DOCUMENT CAREFULLY BEFORE SIGNING, THIS DOCUMENT HAS LEGAL CONSEQUENCES AND WILL AFFECT YOUR LEGAL RIGHTS, AND WILL LIMIT OR ELIMINATE YOUR ABILITY TO BRING FUTURE LEGAL ACTIONS. In consideration of being permitted by World Triathlon Corporation (WTC), its existing and future subsidiaries and Event Live, S.A., (hereinafter, the Organizer) to participate in the Event, I, the Participant, understand and acknowledge that by signing below I am legally agreeing to the terms and statements included in the following Event Registration, Release and Waiver of Liability, and Assumption of Risk and Indemnity Agreement (hereinafter, the Agreement) and that these statements are being freely and voluntarily accepted by the parties who acknowledge each other enough legal capacity to execute this document in accordance with the following: GENERAL TERMS AND CONDITIONS OF PARTICIPATION IN THE EVENT First - Subject, scope of application and general regulations The subject of this contract is governing the General Terms and Conditions of Participation and the legal relationship between the Participant and the Organizer of the Event. Upon registration, the Participant acknowledges the race rules: http://www.ironman.com/triathlon/events/americas/ironman /mar-del-plata/athletes/rules-andregulations.aspx#axzz4syqrcz6u of the Organizer, the Competition Rules of WTC (World Triathlon Corporation) and the Argentina Triathlon Federation in their respective valid versions and in this order. Compliance with and acceptance of this basis is a fundamental condition for participation in the
Event. Second - Organizational measures 1) The Participant must follow the rules and regulations of the Organizer as defined by General Conditions of Participation, in addition to the race regulations, the official race program/race information, and as notified at any pre-race briefing. Compliance with the instructions given by the Organizer, and accordingly indicated organization personnel, is mandatory. 2) In case of non-compliance, the Organizer has the right to exclude the Participant from the Event and/or announce the disqualification as he deems convenient, should the order of the Event or the safety of other Participants of the Event be endangered. 3) In case of according medical indications the medical staff is authorized to exclude a Participant from the race for his own safety and/or to deny him further participation in the Event. 4) If the bib is altered in any manner whatsoever, especially if the promotional logo has been made invisible or unrecognizable, then the Participant may be excluded from participation in the Event, in any case he will be excluded from the results (disqualification). Third - Registration and payment 1) Applications are accepted only if the official via internet has been used. 2) Once registration via Internet becomes effective upon complete payment of entry fee, without bank fees and expenses, at the bank account of the Organizer, the Participant will received by e-mail, the confirmation of the registration in the Event, which will imply the conclusion of the contract between the Participant and the Organizer subject to the general terms and conditions of participation. 3) A copy of this Agreement will be e-mailed to the Participant together with the confirmation e-mail. 4) The Organizer may on the date of the Event request the
Participant, at the check-in, to sign this Agreement. 5) Different registration methods to the one above described will not be accepted. 6) The Organizer may limit the number of Participants and reserves the right, at its sole discretion, to refuse applications exceeding such a limit. 7) The Organizer reserves the right to reject registrations without needing to state the reason. In this case, the Participant will have no right to receive a compensation exceeding the entry fee. 8) The Organizer reserves the right to disqualify or to exclude a Participant from the Event at any time, if (a) he/she has provided incorrect information on the registration form, (b) he/she is subject to an order of ineligibility issued by a sports organization or an arbitral tribunal or court of law, (c) if there are concrete reasons for the Organizer to suspect that he/she has committed an anti-doping rule violation (see term 7), and/or (d) if there are concrete reasons for the Organizer to suspect that he/she has committed a crime. 9) Participation in the Event is strictly personal and cannot be transferred. Every Participant must personally collect his race bag and documents. The bib shall not be transferred to a third party. In case of violation, the Participant will be disqualified. 10) A listed Participant who does not start in or withdraws from the Event for whatever reasons is not entitled to reimbursement of the entry fee. The withdrawal regulations of the Organizer apply (see registration form). 11) Reimbursement of the entry fee shall only be considered in case of complete cancellation of the Event. If the Organizer is not to be held responsible for the cancellation, there will only be a partial reimbursement with regard to the expenses already incurred by the Organizer. The Participant is subject to prove that the expenses were less. Fourth - Disclaimer of liability
1) The organizer or WTC may in its sole discretion, delay, modify, or cancel the Event if it believes the conditions on the race day are unsafe. If the event is delayed, modified, or cancelled for any reason, including but not limited to directives issued by authorities, force majeure or race course conditions, or any other cause beyond the control of organizer, there shall be no refund of organizers entry fee, except in case of 3 section 6. The participant has no right to withdraw from contract in this case. Any claims of the participant for whatever legal reason incurred in connection with the Event are excluded in this case. 2) The Organizer or WTC are not liable for damages except in cases of intent or gross negligence, which shall be proved. 3) The Organizer or WTC will take no responsibility for health risks of the Participant in connection with the participation in the Event. The Participant is aware that participation in the Event bears risks and that risk of serious danger and also death cannot be excluded by the Organizer in any case. 4) The Participant acknowledges and agrees that it is his responsibility to determine whether he is sufficiently fit and healthy enough to safely participate in the Event without reservations. 5) The Participant certifies that he has not been advised against participation in the Event by a qualified medical doctor or comparably. 6) The Participant is fully responsible for the condition and adequacy of his/her competition equipment. 7) The Participant states that he is aware of the inherent dangers of the race, in particular, those that may appear on the course route such as vehicle or pedestrian traffic and therefore he takes all the risks related to the sport of running, which constitutes the Event. The Participant also assumes any and all other risks associated with participating in this Event, including but not limited to the following: falls, dangers of collisions with vehicles, pedestrians, other Participants, and fixed objects; the
dangers arising from surface hazards, equipment failure, inadequate safety equipment; and hazard that may be posed by spectators or volunteers; and weather conditions. 8) It is the duty of the Participant to make himself/herself familiar with the race circuit and competition areas. By participating, the Participant accepts the race circuit and competition areas as they are presented for participation in the Event. The Participant shall immediately notify to the Organizer any dangerous sections and /or areas of the race circuit he/she becomes aware of. 9) The Participant is aware of the dangers associated with the consumption of alcohol and/or drugs before, during and after the Event and he/she recognizes that consumption of alcohol and/or drugs might impair his/her judgment and sporting skills. He/she assumes responsibility for any injury, loss or damage caused by his/her consumption of alcohol and/or drugs. 10) Should medical treatment of the Participant be necessary during the Event, the Participant declares in advance his consent with these measures. Medical treatments are not included in the entry fee and the Participant directly charged according to the general medical rates. The Organizer or WTC does not provide for insurance coverage for the medical treatment of the Participant and is not obliged to do so. It is in the responsibility of the Participant to ensure adequate insurance coverage for medical treatments. A liability of the Organizer or WTC is thus excluded. 11) The Organizer cannot be held liable for misplaced items belonging to the Participants. The Organizer or WTC shall assume no liability for items of the Participants stored by himself or third parties employed by the Organizer; the liability of the Organizer or WTC due to negligent selection will remain untouched. Fifth - Copy rights/transmission rights Upon his registration, the Participant, without compensation,
grants to the Organizer and WTC the right, permission, and authority to use the name, image, voice, and/or likeness, captured during the Event by the Organizer. Likewise, the Participant grants to the Organizer and WTC and to the natural and corporate persons he entrusts the exploitation and disclosure by means of videotapes, CDs, DVDs, broadcast, telecast, podcast, webcast, internet, recordings, motion pictures, commercial advertisement, promotion materials, and/or any other record of this Event for any purpose whatsoever, the right on the following: pictures, films, interviews and any other reproduction where the Participant appears during the Event and any other Event he is registered in. The Participant grants the rights on his image and any other related right so that they can be exploited without restrictions related to the person, time, form or territory. Rights to images and sound of the Event lie exclusively with the Organizer. Sixth - Severability Clause / Place of performance/ Applicable law 1) If individual provisions of this Agreement are wholly or partially invalid or unenforceable, this does not affect the validity of the rest of this Agreement. The invalid or unenforceable provision shall be deemed to be automatically amended and replaced by a valid or enforceable provision which economically accomplishes as far as possible the purpose and the intent of the invalid or unenforceable provision. 2) Place of performance for all obligations arising under or in connection with this Agreement is the place where the Event will take place. 3) This Agreement shall be exclusively governed by the Argentina law, and the jurisdiction of de ordinary courts of de City of Buenos Aires will apply. Seventh - Doping Upon signing this Agreement, the Participant expressly acknowledges that the Anti Doping provisions of the World
Triathlon Corporation (WTC), in their respectively valid version are binding on him. The regulations can be called up under the home page of WTC under http://ironmanpromembership.com/anti-doping/. Furthermore blood thresholds if to the extent that Anti-doping code of the national Federation (in the country the Event takes place) defines so are binding. If in a blood control these thresholds values are exceeded, the Organizer is entitled to pronounce a suspension from the race. No right to start at the Event exists during pending doping proceedings, no matter before which court of law or arbitrator, and also in case of concrete reasons for a doping suspicion. In this case, claims in respect of appearance fee, prize money or other claims as well as possible subsequent claims (damages) are excluded. Eighth - Data collection and data utilization Pursuant to the provisions of Argentina law No 25.326, the Participant shall be informed of the following: 1) The personal information of each Participant, given at the time of registration, will be stored in a computerized file owned by the Organizer in accordance with the provisions of the Data Protection Act. This file shall be registered with the Authorities of Data Protection and will be duly entered in the registry of the Data Protection Authorities. Upon his registration, the Participant consents the storage of personal information and communication of details. 2) That said details are used in the performance and development of the Event including medical assistance to the Participant in the course routes and at the finishing line for medical services responsible for the Event. The above is also applied to the necessary details to effect payment. Upon registration, the Participant gives his consent to storage and disclosure of data for these purposes. 3) That the stored data under paragraphs 1 and 2 will also be communicated to a third company responsible for the
measurement of times, to a third party in order to issue a results list and also for release of this list on the internet. Upon registration, the Participant gives his consent to storage and disclosure of data for these purposes. 4) That the Participant s surnames, given name, birth year, sex, federation, if any, bib number and ranking (ranking and times) will be printed and/or published with the aim of presenting the Participants lists and the results in all relevant media (printed matter such as the program and the results list as well as on the Internet). Upon registration, the Participant gives his consent to storage and disclosure of data for these purposes. 5) That the stored data under paragraphs 1, 2, 3 and 4 will be forwarded to a commercial photo service, in order to supply the Participant with photos of himself on the race course and when crossing the finish line. Upon registration the Participant gives consent to storage of data for this purpose. 6) The Participant may revoke the above consents and exercise his rights to access, correct, oppose and cancel his details by contacting the Organizer under the terms of law 25.326. Personal data requested at the time of registration, or periodically for the purposes indicated, are aimed mainly for individualization of participants, using it for all legal purposes described. When prompted for personal information, you will be informed explicitly and clearly if these data requested is mandatory or optional. Note that no person can be compelled to provide sensitive data. These data will be recorded in the database of the organizer, located in Av Del Libertador 7395, Buenos Aires, Argentina. The Organizer is registered in the National Department of Personal Data Protection (Ministry of Justice and Human Rights) Control Department, law No 25326, who has the authority to receive complaints and grievances that are made to that effect. The participant may request the withdrawal, blocking all or part of its name from the database. At his request, he will be informed of the name of the person or
database user who provided the information. You also have the right of access this information for free within intervals of not less than six months, unless a legitimate interest, as established in art. 14 inc 3 of Law 25326. To contact the National Directorate for Personal Data Protection, any interested participant shall go to Sarmiento 118, 5th. floor. The Participant affirms that he is, or will be on the date of the Event, over 18 years of age that he has enough legal capacity to execute this agreement, which he has read and understands and voluntarily signs as registration application, which will proceed by clicking the box below. I have read and accept the general terms and conditions of this Agreement. ESPAÑOL: ACUERDO PARA EL REGISTRO EN EVENTOS, CON RENUNCIA Y LIBERACIÓN DE RESPONSABILIDAD, Y EXENCIÓN DE RIESGOS Y DE INDEMNIZACIÓN POR DAÑOS Y PERJUICIO PARA LA PARTICIPACIÓN EN: 2017 IRONMAN MAR DEL PLATA, ARGENTINA, 3 de Diciembre 2017 (Incluyendo programas y/o eventos relacionados) (en adelante el Evento ) IMPORTANTE: LEA ESTE DOCUMENTO ATENTAMENTE ANTES DE FIRMARLO. ESTE DOCUMENTO TIENE CONSECUENCIAS LEGALES Y PODRÁ AFECTAR A SUS DERECHOS Y LIMITAR O DESLINDAR SUS POSIBILIDADES DE EJERCITAR FUTURAS ACCIONES LEGALES. CONTENIDO:
Asumiendo la autorización por parte de World Triathlón Corporation (WTC), sus filiales presentes y futuras, y EVENT LIVE S.A (en adelante, conjuntamente, el Organizador ) para participar en el Evento, comprendo y reconozco que, al firmar el presente documento, estoy legalmente aceptando y acordando las cláusulas y declaraciones contenidas en el siguiente Acuerdo para el Registro en Eventos, con Renuncia y Liberación de Responsabilidad, y Exención de Riesgos y de Indemnización de Daños y Perjuicios (en adelante, el Acuerdo ), las cuales son aceptadas por ambas partes de forma libre y voluntaria, reconociéndose mutuamente capacidad jurídica suficiente, por lo que suscriben el presente documento con arreglo a las clausulas mas abajo detalladas. CLÁUSULAS Y CONDICIONES GENERALES DE PARTICIPACIÓN: Primera.- Objeto, ámbito de aplicación y reglamentaciones básicas. El presente contrato tiene por objeto regular las Condiciones Generales de Participación y la relación jurídica entre el Participante y el Organizador. Con su inscripción, el Participante acepta las Disposiciones de la Competición, el Reglamento Deportivo del Organizador, las Competition Rules de la WTC (World Triathlon Corporation) y el Reglamento Deportivo de la Federación Argentina de Triatlón, en sus respectivas versiones vigentes y en el orden indicado. Las reglamentaciones pueden descargarse desde: http://www.ironman.com/triathlon/events/americas/ironman /mar-del-plata/athletes/rules-andregulations.aspx#axzz4syqrcz6u Su cumplimiento y aceptación son requisito fundamental para tomar parte en la prueba y el Evento. Segunda.- Medidas organizativas 1) El Participante deberá respetar las condiciones del Organizador según lo dispuesto en las presentes Condiciones Generales de Participación, además de lo dispuesto en la
Convocatoria, las Disposiciones de la Competición, el Reglamento Deportivo, el Programa y la Información de la Competición oficiales, así como las disposiciones comunicadas en cualquier Sesión Informativa previa a la competición. El cumplimiento de las instrucciones del Organizador y de su personal convenientemente identificado son de obligado cumplimiento. 2) En caso de incumplimiento, y en particular si pudiera verse perjudicado el correcto transcurso de la prueba o ponerse en peligro la seguridad de los demás participantes del Evento y la prueba, el Organizador se encuentra facultado para excluir de la prueba y en cualquier momento al Participante y/o a descalificarlo, según el Organizador estime conveniente. 3) Asimismo, y a efectos de garantizar la seguridad del Participante, los miembros de los servicios médicos que atienden la prueba se encuentran autorizados a prohibir la participación del Participante o la continuación de su participación en la prueba y el Evento, ante la presencia de los síntomas que ellos estimen relevantes. Si el dorsal asignado oficialmente fuese modificado de algún modo, en particular si la publicidad impresa no fuese visible o reconocible, el Participante podrá ser excluido de la prueba y el Evento. El Participante siempre podrá ser excluido de la clasificación por tiempos (descalificación). Tercera.- Inscripción y Pago 1) La inscripción únicamente podrá realizarse mediante el formulario oficial de inscripción que se encuentra en Internet. 2) Una vez realizada la inscripción por Internet junto con el pago íntegro de la cuota de participación, con deducciones y gastos incluidos, mediante abono en la cuenta bancaria del Organizador, el Participante recibirá por correo electrónico que indique, una confirmación de su suscripción al Evento, con la que se entenderá debidamente perfeccionado el contrato entre el Participante y el Organizador, sujeto a las presentes cláusulas
y condiciones generales de participación. 3) Con el correo de confirmación de la inscripción se enviará al Participante copia del presente Acuerdo. 4) El Organizador podrá el día del Evento, y al momento de que el Participante haga su registro de inscripción, solicitarle al Participante que firme el presente acuerdo. 5) No se aceptarán otras modalidades de inscripción diferentes a la aquí mencionadas. 6) El Organizador podrá establecer un límite de participantes y negarse a aceptar inscripciones que superen dicho límite. 7) El Organizador se reserva el derecho a rechazar una inscripción sin indicar el motivo. En este caso, se excluye todo derecho a indemnización distinto del reembolso de la cuota de inscripción. 8) El Organizador se reserva la posibilidad de descalificar en cualquier momento y/o excluir de la prueba y el Evento a un Participante, si éste incurre en alguno de los siguientes supuestos: a) en su inscripción facilita dolosamente información falsa relativa a datos personales, b) está sujeto a una suspensión dictada por una federación deportiva, tribunal arbitral o tribunal, c) existen sospechas fundadas de que el Participante ha cometido una infracción en materia de dopaje (véase Art. 7), y/o d) existen sospechas fundadas de que el Participante ha cometido un delito penal. 9) La participación es un derecho personal e intransferible. El Participante debe recoger personalmente los documentos de participación. El dorsal no podrá transferirse a un tercero. En caso de incumplimiento, el Participante será descalificado. 10) Si un participante inscrito, sin causa justificada, no se presentase en la salida o no comunicase al Organizador previamente su renuncia a tomar parte en la prueba y el Evento, no tendrá derecho alguno al reembolso de la cuota de inscripción y participación. Se aplicarán las condiciones de cancelación del Organizador indicadas en el formulario de
inscripción. 11) Por lo demás, la devolución íntegra de la cuota de participación sólo operará en caso de suspensión completa de la prueba y el Evento. Si la suspensión no fuera responsabilidad del Organizador, se producirá tan solo una devolución parcial, teniendo en cuenta los gastos en que ya hubiera incurrido el Organizador para la realización del Evento y la prueba. Se reserva el derecho del Participante a demostrar que dicho gasto ha sido inferior. Cuarta.- Exclusión de responsabilidad 1) El organizador y WTC puede, a su discreción, retrasar, modificar o cancelar el Evento si se considera que las condiciones en el día de la carrera no son seguras. Si el evento se retrasa, modifica o cancela por cualquier razón, incluyendo pero sin limitarse las directrices recibidas de las autoridades, por causas de "fuerza mayor" o condiciones del recorrido, o cualquier otra causa más allá del control de los organizadores, no habrá reembolso por parte de los organizadores de cuota de inscripción, salvo en el caso del 3 apartado 6. El participante no tiene derecho a desistir del contrato en este caso. Cualquier reclamación del participante - por cualquier razón legal - incurridos en relación con el Evento quedarían excluidas en este caso. 2) El Organizador y WTC responderá tan solo de los daños causados por negligencia o con premeditación o dolo, que deberán en cualquier caso probarse. 3) El Organizador y WTC no asume responsabilidad alguna sobre los riesgos para la salud del Participante relacionados con su participación en la prueba. El Participante es consciente de que la participación en la prueba conlleva riesgos y que los riesgos de peligros graves y muerte no pueden ser excluidos como garantía del Organizador en ningún caso. 4) El Participante confirma y declara estar de acuerdo con que él mismo es responsable de constatar si está lo suficientemente
sano y en condiciones para poder participar sin reservas en esta prueba. 5) Asimismo, el Participante confirma que ningún médico o profesional equiparable le ha desaconsejado su participación en la prueba. 6) El Participante es el único responsable de sus objetos personales y de su equipamiento de competición. 7) El Participante declara ser consciente de los riesgos inherentes a la prueba, en particular los riesgos que pueden presentarse en los recorridos de la competición, en los cuales puede haber tráfico de vehículos y peatones, por lo que asume todos los riesgos resultantes vinculados, bajo tales circunstancias, a correr. En particular, el Participante asume los siguientes riesgos vinculados a la participación en la prueba, sin que esta una enumeración puede entenderse en ningún caso exhaustiva: caídas, riesgo de colisión con vehículos, peatones, otros participantes y objetos fijos; riesgos resultantes de superficies peligrosas, deficiencias del material y equipamientos de seguridad y de equipamientos de competición insuficientes; así como cualquier otro riesgo provocado por los espectadores, los voluntarios o las condiciones atmosféricas. 8) Es obligación del Participante familiarizarse con los recorridos de la competición y con las áreas de competición. Con su participación, el Participante acepta los recorridos y las áreas de competición tal y como son propuestas para la participación en el Evento. El Participante debe informar de inmediato al Organizador si tuviese conocimiento de la existencia de tramos peligrosos dentro de los recorridos y/o áreas mencionados. 9) El Participante es consciente de los peligros resultantes de la ingesta de alcohol, medicamentos y drogas antes, durante y después de la prueba, y de que ello podría incidir negativamente sobre su capacidad de discernimiento y su rendimiento deportivo. El Participante es el único responsable de todas las consecuencias que se deriven de la ingesta de alcohol,
medicamentos y drogas. 10) Si fuera necesaria la asistencia médica del Participante durante la prueba, éste declara por adelantado su conformidad. Los servicios médicos no están incluidos en la cuota de participación y se le facturarán directamente al Participante según las tarifas médicas habituales. El Organizador ni WTC no proporciona ningún tipo de cobertura de seguro para asistencia médica, ni tampoco está obligado a ello. Es responsabilidad del Participante tener a su favor una cobertura de seguro que incluya la asistencia médica. Se excluye toda responsabilidad del Organizador y WTC en este aspecto. 11) El Organizador y WTC no asume responsabilidad alguna sobre los objetos extraviados por el Participante. El Organizador y WTC no asume responsabilidad alguna sobre los objetos del Participante gratuitamente custodiados por él o por terceros en los que el Participante delegase su cuidado; subsiste la responsabilidad del Organizador por negligencia grave en la elección. Quinta.- Derechos de imagen y sonido Con su inscripción y sin derecho a retribución alguna, el Participante cede al Organizador y a WTC todos los derechos que recaigan sobre su imagen y cualesquiera otros derechos que se encuentren relacionados. Asimismo, el Participante cede al Organizador y a WTC y a las personas físicas y jurídicas a quienes el Organizador y/o WTC encargue la divulgación y/o explotación de forma ilimitada, por medio de vídeo, CD, DVD, broadcast, telecast, podcast, webcast, internet,grabación, película, publicidad y/o material publicitarios, los siguientes: el nombre, las fotos, tomas de película, entrevistas y cualquier otra reproducción en la que figure el Participante durante la prueba u otros relacionados con su participación en la misma y en el Evento en el que se ha inscrito. El Participante cede los derechos sobre su imagen y
cualesquiera otros relacionados a efectos de que éstos puedan ser explotados sin limitaciones de ninguna clase, en consideración al la persona, el tiempo, la forma, o el espacio geográfico. Se aclara que los derechos de imagen y sonido de la prueba pertenecen en exclusiva al Organizador. Sexta.- Cláusula de ineficacia, lugar de cumplimiento y ordenamiento jurídico aplicable 1) Si por cualquier motivo alguna o algunas de las disposiciones contenidas en este Acuerdo, resultaran total o parcialmente ineficaces, ello no afectará a la validez de las disposiciones restantes. Una disposición ineficaz o nula (o bien una parte de una disposición) se considera automáticamente sustituida por otra que sea eficaz y conforme a la Ley y que se aproxime lo máximo posible al objetivo económico de la disposición inválida o nula. 2) El lugar de cumplimiento de las obligaciones derivadas de este contrato es el lugar en donde se llevará a cabo el Evento y la prueba a la que se ha inscrito el participante. 3) Se aplicará el ordenamiento jurídico argentino y la jurisdicción de los Tribunales Ordinarios de la Ciudad Autónoma de Buenos Aires. Séptima.- Dopaje Con su inscripción, el Participante acepta expresamente como vinculantes para él las disposiciones en materia de dopaje de la World Triathlon Corporation (WTC) en su versión vigente. La reglamentación puede consultarse en la página Web de la WTC en http://ironmanpromembership.com/anti-doping/. Además de ello se aplicarán, tal como se contempla en tal reglamentación, los valores límites en sangre propios de la federación nacional (del país de la prueba). En caso de superarse los valores límites en sangre, el Organizador está facultado para prohibir al Participante que tome la salida. Mientras exista un proceso de dopaje pendiente de resolución ante cualquier federación, tribunal del estado o tribunal arbitral,
así como en caso de existir sospechas fundadas de dopaje, no se tendrá derecho a tomar la salida en la prueba. En tales casos, las reclamaciones de la cuota de participación, premios en metálico o de otro tipo, así como eventuales reclamaciones subsiguientes (indemnizaciones) quedan excluidas. Octava.- Autorización de la recolección y utilización de datos En cumplimiento de lo dispuesto en la Ley N 25.326, de Protección de Datos Personales, se informa al participante lo siguiente: 1) Que los datos personales e información facilitados por el Participante en su inscripción se almacenarán en un fichero automatizado de titularidad y responsabilidad del Organizador según lo dispuesto en la Ley de Protección de Datos, el cual será debidamente inscrito en el registro de las Autoridades de Protección de Datos. Con su inscripción, el Participante autoriza el almacenamiento y la comunicación de los datos a estos efectos. 2) Que tales datos serán empleados en la realización y desarrollo de la prueba y el Evento, incluyendo la asistencia médica al Participante en los recorridos y en la meta por parte de los servicios médicos responsables de la prueba. Lo antedicho se aplica igualmente a los datos necesarios para efectuar el pago. Con su inscripción, el Participante autoriza el almacenamiento y la comunicación de los datos a estos efectos. 3) Que los datos personales almacenados según los puntos 1 y 2 anteriores, serán eventualmente comunicados a una empresa tercera encargada de la medición de tiempos, a otros terceros para la elaboración de los resultados finales, así como para la publicación de esas listas en Internet. Con su inscripción, el Participante autoriza el almacenamiento y la comunicación de los datos a estos efectos. 4) Que se imprimirán y/o publicarán apellidos, nombre, año de nacimiento, sexo, federación si la hubiese, número de dorsal y
resultado (puesto y tiempo) del Participante, con objeto de presentar las listas de participantes y los resultados en todos los medios relevantes que sigan la prueba (elementos impresos como el programa y la lista de resultados, así como Internet). Con su inscripción, el Participante autoriza el almacenamiento y la comunicación de los datos a estos efectos. 5) Los datos personales almacenados según los puntos 1, 2, 3 y 4 anteriores (apellidos, nombre, número de dorsal, dirección) serán eventualmente comunicados a un suministrador de servicios fotográficos con objeto de enviar las fotos del Participante durante la prueba y a su llegada a meta. Con su inscripción, el Participante autoriza el almacenamiento y la comunicación de los datos a estos efectos. 6) El Participante podrá revocar las anteriores autorizaciones en todo momento, y ejercer sus derechos de acceso, rectificación, oposición y cancelación ante el Organizador en los términos de la Ley 25.326. Los datos personales que se solicitan en el momento de la inscripción, o periódicamente, para los fines indicados, tienen como finalidad principalmente la individualización de los Participantes, utilizándola para todos los fines legales descriptos. Cuando se le soliciten datos personales, se le informara en forma expresa y clara si esos datos solicitados son de carácter obligatorio o facultativo. Tenga en cuenta que ninguna persona puede ser obligada a proporcionar datos sensibles Dichos datos se encontrarán registrados en la base de datos del Organizador, siendo su domicilio el de Av. Del Libertador 7395, Buenos Aires, Argentina. A tales efectos, el Organizador se encuentra registrado en la Dirección Nacional de Protección de Datos Personales (Ministerio de Justicia y Derechos Humanos), Órgano de Control de la Ley N 25.326; quien tiene la atribución de atender las denuncias y reclamos que se realicen a tal efecto. El titular de los datos podrá solicitar el retiro, bloqueo, total o parcial, de su nombre de la base de datos. A pedido del interesado, se le
informará el nombre del responsable o usuario de la base de datos que proveyó la información. Asimismo, tiene el derecho de acceso a los mismos en forma gratuita a intervalos no inferiores a seis meses, salvo que acredite un interés legítimo conforme lo establece el art. 14, inc. 3 de la Ley 25.326. El Participante afirma y reconoce ser mayor de 18 años, que tiene capacidad suficiente para suscribir el presente acuerdo, el cual ha leído y entiende en contenido e intención, por lo que procede a firmarlo con la solicitud de inscripción que continuará al dar aceptación más adelante en la casilla que se le indica. SI USTED NO ACEPTA LAS CLAUSULAS Y CONDICIONES GENERALES DE PARTICIPACIÓN QUE HA TENIDO OPORTUNIDAD DE LEER, POR FAVOR NO PARTICIPE EN EL EVENTO Y LA PRUEBA. He leído y acepto los términos y condiciones generales del presente contrato. La continuación en la página de entrada supone la aceptación plena del participante de todas las cláusulas y condiciones generales de participación.
