THE CORPORATION OF THE TOWNSHIP OF GEORGIAN BAY COMMITTEE OF ADJUSTMENT NOVEMBER 27, 2000 Minutes of the meeting of November 27, 2000 held in the Council Chambers, Baxter Ward Community Centre, Township of Georgian Bay, Port Severn, Ontario. The Chair called the meeting to order at 9:40 a.m. 2. Minutes of the meeting of November 6, 2000 were circulated for errors and omissions. 3. ERRORS AND OMISSIONS No errors and omissions were noted. Moved by Councillor K. Woll That the Committee of Adjustment of the Township of Georgian Bay accept the minutes of the previous meeting dated November 6, 2000 as circulated.
4. A40/00 - ANDERSON James Anderson the application proposes to permit an accessory structure in the front yard Councillor Keall enquired whether there was an issue with lot coverage for this application. Mr. Parks indicated there is no issue with lot coverage. Moved by Councillor B Howe That the Committee of Adjustment approve application A40/00 to permit an accessory structure in the front yard on 4757 Severn River Shore, Lot 14, Concession, Baxter Ward for James Anderson. ii) That the requirements of any other Agency be met; and iii) That a building/septic permit be obtained. 5. A41/00 - McCLELLAND Jack McClelland Jerry Jordan, Planner the application proposes to permit a maximum lot coverage of 16% and an accessory buildings coverage of 11.5%. J. Jordan submitted aerial pictures of the property and explained that the purpose of the building is to visually screen and secure the McClelland s vehicles and other valuable property. The larger garage would also provide protection from the elements. Mr. Jordan indicated that the location chosen for the structure is the most appropriate due to the minimal impacts on both the shoreline and adjacent properties. Councillor L Braid asked about the number of storeys of the structure. The structure will be
single storey. Mr. Parks indicated that the trend over the past years in the township has been towards larger accessory structures due to greater affluence; people have more recreational vehicles equipment and want secure places to house them. Moved by Councillor L. Keall Seconded by Councillor K. Woll That the Committee of Adjustment approve application A41/00 to permit a maximum lot coverage of 16% and an accessory building of 11.5% which allows the construction of an addition to an existing garage on 298 White Falls Road, Lot 24, Concession 9 & 10, Baxter Ward for Jack McClelland. ii) That the requirements of any other Agency be met; and iii) That a building/septic permit be obtained. 6. A42/00 - KUNG Mr. & Mrs. Kung the application proposes to permit a total floor area of a sleeping cabin of 69.3 square metres and to allow a side yard setback of 2.83 metres for such cabin. Mr. Kung indicated that the existing 2 nd dwelling would be removed. He pointed out that it is on a clay base very close to the shoreline and is currently much larger than the dwelling proposed in his application. Mr. Kung stated that the larger space will help accommodate his growing extended family. Councillor Keall enquired about the facilities in the existing dwelling. Mr. Kung indicated that there is a kitchen and bath in the existing dwelling. Under the Zoning By-law, the Kungs are entitled to tear down and rebuild the exact dwelling. However, the Committee after much discussion, decided that approval of the application was more favorable then letting the Kungs re-build the existing structure. Limiting the potential of this structure from becoming a second dwelling was a strong issue, with the insurance from Mr. Kung that the new cabin would have no kitchen facilities and that the existing 2 nd dwelling would be removed as a condition of the application
Moved by Councillor L. Braid Seconded by Councillor B. Howe That the Committee of Adjustment approve application A42/00 to permit a total floor area of a sleeping cabin of 69.3 square metres and to allow a side yard setback of 2.83 metres for such cabin on 331 Haskett s Drive, Lot 22, Concession 13, Baxter Ward for Tony Kung. ii) That the requirements of any other Agency be met; iii) That a building/septic permit be obtained; and iv That the existing southerly shoreline cottage must be removed. A39/00 - DEROCCHIS the application proposes to permit a maximum length of 15 metres for a boathouse to legalize the existing structure. Mr. Parks recapped the background on the location of the property and the nature of the application. This application was deferred from the November 6, 2000 meeting pending a site inspection by the Committee.
