PARKS AND RECREATION 13.01 13.01 PURPOSE The purpose of this chapter is to govern the conduct of visitors to County land and to provide for the protection of the natural resources on these lands. 13.02 APPLICABILITY Except when the context provided otherwise, this chapter applies to all lands, structures, and property owned, under easement, leased or administered by Jackson County and under the management, supervision, and control of the Forestry and Parks Department hereinafter referred to as the department. (1) The Committee is empowered to designate any and all regular full time employees of the Jackson County Forestry & Parks Department to enforce the provision of Chapter 13 of the Jackson County Code of Ordinances contained herein. It is understood that the enforcement of Chapter 13 will be limited to the issuance of citations and the authority to arrest for violations of Chapter 13 is limited to sworn law enforcement officers who have been deputized by the Sheriff of Jackson County. PARKS AND RECREATION 13.03 13.03 DEFINITIONS In this chapter, the following definitions apply: (1) All-terrain vehicle or ATV has the meaning specified under SS 340.01(2)(g), and is considered to be a vehicle for the purpose of this chapter. (2) Bicycles mean every device propelled by the foot action upon pedals and having one or more wheels. (3) Blind means a non-elevated structure made of native dead and downed vegetation used for hunting which is not removed at the end of the hunting hours each day (4) Camp or Camping means the use of a shelter such as a tent, trailer, motor vehicle, tarpaulin, bedroll or sleeping bag for temporary residence or sleeping purposes. (5) Camper Day means the period beginning at 3:00pm and ending at 1:00pm the following day. (6) Camping Party means any individual, family or organized group occupying a campsite (7) Camping Unit means any single shelter except sleeping bags and hammocks used for a camp by a camping party except those used exclusively for dining purposes (8) Campground means any tract of land officially designated by the department for the purpose of camping that meets State Health and Sanitation standards and is subject to inspection under Wisconsin Administrative Code DHS 178. (9) Campsite means a segment of a campground which is designed for camping use by a camping unit or camping party limited to a maximum of 8 people. (10) County Park means any tract of land which is designated, named and routinely maintained by the department which results in the concentration of people and provides goods services and facilities for the purpose of recreating. County parks are subject to the provisions of Wisconsin Administrative Code DHS 178. Page 2. JACKSON COUNTY Revised 03/18

PARKS AND RECREATION 13.03(11) (11) Department means the Jackson County Forestry & Parks Department (12) Forest Campsite means any undeveloped tract of land outside the boundaries of any County Park or recreation area on which a camping unit can be placed without the removal of live vegetation. (13) Group Campground means a campground designated for use by an organized group that is larger than what a campground can legally accommodate. Limited to a maximum of 16 people on each site. (14) Group Campsite means a campsite limited to parties greater than 8 persons, but less than 16 people. Designation of a group campsite is at the sole discretion of the department. (15) Off-road Motorcycles means a motor vehicle not more than 50 inches in overall width designed to travel on not more than 2 wheels in contact with the ground transporting a maximum of 2 people, having an unaltered U.S. forest service approve spark-arrest muffler emitting a sound level not to exceed 96 decibels (db) measured using testing procedures recommended by SAE. Off-road motorcycles are considered to be a vehicle for the purpose of this chapter. Licensed (street legal) motorcycles using County properties including trails, routes, and or intensive use areas are considered off-road motorcycles for the purpose of this chapter. (16) Picnic Area means any tract of land developed and maintained for picnicking. Included in the definition of picnic area is adjacent playground and play field area. (17) Portable Tree Stand means any removable device used for the purpose of hunting from an elevated position. (18) SCUBA Diving means the act of using a water body with the aid of a selfcontained underwater breathing apparatus. Page 3. JACKSON COUNTY Revised 03/18

PARKS AND RECREATION 13.03(18) (19) Shoreline Zone means that area of sand or gravel beach from the water s edge to the first dune or the tree lie or the terrestrial vegetation, whichever is closest to the water s edge. (20) Snowmobile has the meaning specified in SS 340.01(58a) and is considered to be a vehicle for the purpose of this chapter. (21) Swimming Beach means any water area or adjacent land area designated as a swim area by standard regulatory markers and posted notice. (22) Vehicle means any motor vehicle, trailer, semi-trailer or mobile home and is further defined in SS 340.01(35). For purpose for this chapter, snowmobiles, ATV s, UTV s and off-road motorcycles are considered to be vehicles. (23) Waterfowl means wild geese, brant, wild duck, rails, coots, gallinules, jacksnipe, woodcock, plovers, sandpipers and wild swans. (24) UTV has the meaning specified in SS 23.33(1)(ng) and is considered to be a vehicle for the purpose of this chapter. (25) Youth Group means a group made up of juvenile members of an established non-profit organization under the leadership of at least one competent, mature adult for each 10 juveniles in the group and using any number of camping units or occupying a group campground. PARKS AND RECREATION 13.04 13.04 GENERAL RULES (1) COUNTY PROPERTY (a) (b) (c) (d) The department may close, by posted notice, any land, structure or property owned or administered by Jackson County and under the management, supervision and control of the department. No person may enter or be in any building installation or area that is closed to public use or entry and contrary to posted notice without a written permit from the property superintendent. Diving or jumping into the water from rocks, cliffs, banks, trees or any other natural feature or man-made structure, on property owned, under easement, leased or administered by Jackson County and under the management, supervision and control of the department shall be prohibited in any area posted by department against such activities. No person may engage in underwater diving with the use of self-contained underwater breathing apparatus (SCUBA equipment) within the waters of the Wazee Lake Recreation Area, unless the location of such diving or swimming is distinctly marked by a diver s flag. The flag must not be less than 12 inches high and 15 inches long, and display one diagonal white stripe 3 inches wide on a red background, and be displayed at a height above the water surface so as to be completely apparent at a distance of 100 yards under normal conditions, and so designed and displayed as to be visible form any point on the horizon. Except in the case of an emergency, no person shall rise to the surface outside of a radius of 50 feet from such flag. No person may erect signs which prohibit and/or discourage public access, or that may interfere with any otherwise lawful use of lands owned by Jackson County or which the right of public access for hunting and fishing are owned by Jackson County, without obtaining the express written consent of the Jackson County Forestry & Parks Committee, or if posting cranberry beds and the dikes immediately adjacent to such beds as specified in 13.09(5)(a). PARKS AND RECREATION 13.04(1)(e) (e) No person may bring firewood on to County lands unless: 1. The wood originates from Wisconsin 2. The wood originates from within a 25 mile radius of where it is burned. 3. The wood originates from outside a quarantined area (specified by the Wisconsin Department of Natural Resources) unless the property is under identical quarantine restriction. (2) CLOSING HOURS (a) No person may enter or be within the boundaries of any county park, campground, picnic area, beach, wayside, parking lots, boat landings, headquarter sites or other use areas established by Jackson County between the hours of 11:00pm and the following 6:00am except: 1. Registered campers in or en-route to designated campsites 2. Hunters entering department lands within established hunting seasons, provided the entry is no earlier than one hour prior to the opening of hunting hours established in Chapter 10 of the Wisconsin Administrative Code 3. Enter any of the locations listed in park (a) for the sole purposes of fishing. 4. Persons entering an area to provide information, goods or services that if not delivered may have a detrimental effect on those persons legally present. (b) This section does not apply to individuals with written authorization from the department or to those projects or parts of projects where the department has waived these hours and established different hours for special events or programs Page 6. PARKS AND RECREATION 13.04(3) (3) PERSONAL CONDUCT (a) (b) (c) (d) (e) (f) EVICTIONS- The department may expel any person or persons from land under the management, supervision and control of the department for violation of any state law, ordinance or posted rule or regulations. The period of time for which a person shall be expelled is 48 hours, or for the period of their camping permit, whichever is longer. No expelled persons may return to the property before the eviction period has elapsed. Persons expelled are not eligible for refunds for unused camping fees or vehicle admission fees. People charged with violent, assaultive or disorderly behavior may be expelled until after the case is adjudicated in court. HOUSEHOLD DUMPING PROHIBITED- No person may dispose of any waste or recyclable material in any waste or recyclable receptacles or at any location if waste or recyclable material is generated from a permanent residence, seasonal residence, business or other commercial operation. SOLICITING- No person may peddle or solicit business of any nature or distribute handbills or other advertising matter, or post unauthorized signs on any lands, structures or property under the management, supervision and control of the department or such lands, structures or property for commercial operations, for soliciting or conducting business, peddling or providing services within or without such lands, structures or property unless first authorized in writing by contractual agreement with the department. NOISE VIOLATIONS - No person may cause unnecessary noise which would affect others enjoyment of recreational activities. All radios and other sound amplifying devices must be completely shut off at the start of closing hours specified in 13.04(2)(a) within the boundaries of any County Park. Unnecessary or loud noise that interferes with the enjoyment of the facility by others is prohibited at any time while in the boundaries of any County park. METAL DETECTORS - The use of metal detectors is prohibited except by written permit issued by the property superintendent. SKI TRAILS - No person may hike or snowshoe on designated cross country ski trails when the trails are snow covered Page 7. JACKSON COUNTY Revised 04/14

PARKS AND RECREATION 13.05 13.05 VEHICLES (1) MOTORCYCLE, ATV and UTV RACES No person may conduct or engage in motorcycle, ATV or UTV races on any land under the supervision, management or control of the department (2) SNOWMOBILE RACES No person may conduct or engage in snowmobile races on any land under the supervision, management or control of the department (3) PHYSTICAL DISABLITIES- The department may authorize by permit persons with physical disabilities to use a motorized vehicle as a mode of personal conveyance. (4) BICYCLES Bicycles are permitted in areas and on trails except where posted against such use. (5) ICE BOUND WATERS No person may use or operate a motorized vehicle, on the ice bound waters of Wazee Lake. (6) CLOSED TRAILS ATV s, UTV s, motorcycles and snowmobiles are prohibited from operating on designated trails owned, leased or administered by Jackson County when the trails are closed. a) TEMPERATURE RESTRICTIONS ATV S AND UTV S-ATV S and UTV s are prohibited from operating on trails from December 15 th through March 15 th when temperatures are above 28 degrees Fahrenheit. The official temperature is recorded at the Black River Falls, WI municipal airport (KBCK) and is reported on the National Weather Service website. (7) OPERATE MOTOR VEHICLE IN UNAUTHORIZED AREA- No person may operate a motor vehicle on lands administered, owned or leased by Jackson County, unless the area is approved for such use. All motor vehicles using department approved areas, trails and roadways must be registered for use on public highways as required in SS.341, excepting ATV s, UTV s and snowmobiles and off-road motorcycles which are restricted to operating on designated and marked trails approved for their respective use during the period when those trails are open for such use. No person may remove from a trailer any ATV, UTV or off-road motorcycle in any County Park, except where specifically authorized. No person may operate a motor vehicle as specified in SS 341 on any designated ATV, UTV, hiking, bicycle, ski or snowmobile trail unless such trail is posted open for such use. Roads and trails which are gated or bermed (with earthen material) across the visible tread of the trail are considered closed to motor vehicle use and do not need to be posted with departmental signs. Areas that are not bermed or gated and are posted with departmental signs prohibiting motor vehicles are considered closed to motor vehicle use. Page 8. JACKSON COUNTY Revised 03/18

PARKS AND RECREATION 13.05(8) (8) MOTORCYCLE USE STICKERS All motorcycles are prohibited from operating on any trail open to motorcycle use, unless the motorcycle has completely affixed, by its own adhesive, a valid County motorcycle use sticker. This section applies to both off-road and street legal licensed motorcycles. 13.06 ANIMALS (1) RESTRICTED AREAS No person may allow any animal entry into any building, swimming beach, picnic area or playground. Dogs, cats and other pets shall be kept on a leash not more 8 feet long and under control at all times in all other county parks areas headquarters areas, ranger stations, campgrounds and posted trails. (2) TRAINING/HUNTING AREAS Nothing in this section shall prohibit or restrict the use of dogs for hunting purposes in any area which is open to hunting. The use of dogs for dog trails and dog training shall be restricted to areas designated by the property superintendent. (3) SKI TRAILS- No person may allow any animal on any cross-country ski trails during that period of the year when such trails are used for cross-country skiing, or any time on nature trails. (4) WASTE CLEANUP- Person bringing in or allowing any animal into designated use areas not covered under 13.06(1) shall be responsible for proper removal and disposal in sanitary facilities of any waste produced by these animals. (5) HORSES- No person may ride, lead or fail to prevent a horse from being on any beach, posted or marked hiking trail, nature trail, picnic area, campground, or contrary to posted notice unless written permission is granted by the department (6) PERSONS WITH DISABILTIES- Notwithstanding the provisions of this chapter, service animals as defined in SS.174.056, may accompany persons with disabilities. (7) UNATTENDED ANIMALS- No animals are allowed to be left unattended. Animal are not allowed to create unnecessary noise or otherwise interferes with the enjoyment of the area by others. Page 9. PARKS AND RECREATION 13.07 13.07 FIRE (1) UNAUTHORIZED AREA- No person may start, tend or maintain any fire on the ground or to burn any refuse except in designated fire rings while within the boundary of any County Park. All campfires on forest campsites must be surrounded by a 3 foot mineral break and are subject to restrictions of 13.07(2-4). (2) UNATTENDED FIRES- No person may leave any fire unattended, or throw away any matches, cigarettes, cigars, pipe ashes or any embers without first extinguishing them, or start, tend or use in any manner any fire contrary to posted notice on any lands or property under management, supervision and control of the department. (3) EMERGENCY REGULATIONS The department, in the event of threat to natural resources by the presence of fire hazard, may establish emergency use and burning regulations by posted notice. (4) COUNTY FOREST CAMPING RESTRICTIONS No campfires are allowed during the period of March 1 to June 1, except in County Parks designated fire rings 13.08 BEACHES (1) USE OF SOAPS/DETERGENTS- No person may use any soap, detergent or shampoo on any bathing beach or in the water adjacent to any bathing beach in any county park or recreation area. (2) SWIM BUOYS No person may swim beyond or disturb or molest a bathing beach boundary buoy or marker in any beach in the County park, or County recreation area. (3) PROHIBITED AREAS- The department may prohibit swimming in areas adjacent to water access sites by posted notice. No person may swim within this area delineated by the posted notice. (4) GLASS CONTAINERS No person may possess or use any glass containers in any bathing beach or in the water adjacent to any bathing beach in any county park or recreation area Page 10. PARKS AND RECREATION 13.09 13.09 FIREARMS AND HUNTING (1) RESTRICTED AREAS- No person may take, catch, kill, hunt, trap or pursue any wild animal or bird, or discharge any firearm or have in possession or under control any firearm or air gun as defined is SS. 939.22, unless it is unloaded and enclosed in a carrying case, or any bow, slingshot or spring-loaded device designed for shooting a projectile unless the same is unstrung or enclosed in a carrying case while in any county park, within 100 yards of any county campground, picnic area or other special use area designated by the department with posted notice prohibiting the discharge or firearms in these areas. Those persons with a concealed carry permit are exempt from the provisions of 13.09(1). Concealed carry permit holders must keep their weapon concealed or in their vehicle while in the areas specified in 13.09(1) as to not cause unnecessary disturbance to other park visitors. All weapons are subject to the provisions of County Ordinance 9.01(1) if the requirements of 9.01(2) are met. (2) AUTHORITY The Jackson County Forestry & Parks Committee shall have the authority and option to open county parks to public hunting and trapping at the Committee s discretion. Said designations shall be made by the Forestry & Parks Committee and shall specify the exact areas to be opened and the exact dates that public hunting and trapping will be allowed. The Forestry & Parks Committee may make any other restrictions or requirements within the restricted areas as specified in 13.09(1) as they may deem necessary with respect to any hunting or trapping notice. (3) PORTABLE TREE STANDS AND GROUND BLINDS- Two (2) portable tree stand or blind (per DNR Customer Identification Number) may be erected and left in place between April 1st and May 31st or between September 1st and January 7th of the following year. All portable tree stands and ground blinds and associated hardware must be removed within 7 days of the final date of the range listed above (May 31st or January 7th). All other blinds or portable tree stands for the same DNR Customer Identification Number must be clearly visible and legible from the ground. For the purpose of this Chapter, all hardware associated with the use of the tree stand or blind erected outside of the date range listed above which is not removed at the closing of hunting hours each day will constitute a violation of this Chapter. No person may cause damage to the trees by the placement or erection of the portable tree stand and/or ground blinds, or by any manner while climbing or hunting from the tree. Any device that penetrates the bark of a tree will render the entire stand site as illegal and the stand, steps and all associated hardware will be removed at the owner s expense and liability. The subsection does not apply to the use of blinds constructed entirely from dead vegetation found on the property. Live vegetation may not be cut and used as part of any blind or stand. Commercial ground blinds which conceal occupants must have a minimum of 144 square inches of solid blaze orange visible from all directions during all firearm deer season. PARKS AND RECREATION 13.09(4) (4) GAME CAMERAS- No person may place a camera on any lands, structures or property under the management, supervision and control of the department unless the camera is secured using methods which do not penetrate the bark of trees and the owners DNR Customer identification number is legible and visible on the outermost portion of the camera or housing. The department reserves the right to remove all cameras not in conformance with this provision and to view and retain images on the camera or secure digital media that may be used as evidence. (5) AUTHORITY TO REMOVE- An elevated scaffold or game camera placed on county owned property in violation of 13.09(3-4) is considered a public nuisance. The department may seize all such nuisances and may destroy or sell the blind, elevated scaffolds or game camera in the name of the county. The department and its deputies are exempt from all liability to the owner for the seizure and destruction or sale of these items. (6) HUNTING, FISHING AND MINERAL RIGHTS- Jackson County shall retain its interest in hunting, fishing and minerals unless Jackson County has the otherwise transferred these rights by deed and the deed has been filed with the Jackson County Register of Deeds. (a) Jackson County will not exercise its hunting and fishing rights on land that is currently being cultivated as cranberry beds, or land that is being developed as a cranberry bed and the banks immediately next to said beds. The owner of the land may post this land to prohibit public hunting and fishing. Upon abandonment of the land for the purpose of cultivation of cranberries Jackson County shall exercise its right to hunting and fishing and all posting of said lands shall be removed. Page 12. PARKS AND RECREATION 13.10 13.10 CAMPING (1) GENERAL RULES (a) (b) (c) (d) (e) (f) (g) (h) (i) (j) No person may camp in designated camping areas, or on undeveloped lands specified in 13.09(9) under the control and supervision of the Department without a permit and the payment of the prescribed fees. A camping permit shall be obtained and the proper fee remitted prior to setting up camp, unless otherwise posted. No camping party shall move from its assigned campsite to another campsite without prior approval All camping permits expire at 3:00PM on the last day of the permit period. No person may set up or take down a camping unit between the hours of 11:00pm and 6:00am if the provisions of 13.04(3)(d) are violated. Violation of any state law, county ordinance, or any rules of the department by a member or guest of a member of a camping party is cause for revocation of the camping permit and eviction from the property under the provisions of 13.04(3)(a). The department reserves the right to reject or cancel camping reservations when necessary to protect either campers or the natural resources. No person may use family campground shower facilities in any county park or county recreation area unless that person pays the required day use fee for that park or is a registered camper in the park. No person may camp in undeveloped areas posted against such use, or in designated State Natural Areas. No person may obtain a camping permit unless they are at least 18 years of age. No person may cause the discharge of sanitary waste, including grey water, unless the water is properly disposed of in a sanitary dump station. Page 13. JACKSON COUNTY Revised 04/14

PARKS AND RECREATION 13.10(2) (2) CAMPING (a) (b) (c) No more than one camping party may occupy a single campsite. No camping party may exceed 8 persons unless prior approval has been granted by the department. EXCEPTION: Group sites defined under 13.03(14). No person may camp and no camping unit shall remain for a period of greater than 21 days in any 4 week period in the same site from May 1 to Labor Day except in East and West Arbutus Parks on designated long term campsites. After 21 days the camping unit and camping party shall be removed from the site. Extension of the 21 day limit may be granted on camping permit at the sole discretion of the department. Extensions shall be obtained prior to 10:00am on the expiration date of the permits unless a reservation is pending for the campsite at which time the reservation is given priority. The department reserves the right to move vehicles to a designated parking area if the number of vehicles on a site is causing damage to the property or creates a hazard to other campers. (3) FAMILY CAMPSITE RESERVATIONS (a) The department may grant reservations for campsite at campgrounds designated to take reservations. Reservations for campsite at these campgrounds may be granted under the following conditions: 1. Reservations shall be accepted for camping for a minimum of 3 consecutive days. 2. Reservations may be accepted based upon dates set by the department. 3. Refunds for campsite reservation cancellations will be in the form of a camper credit or cash at the sole discretion of the department. Page 14. JACKSON COUNTY Revised 04/14

PARKS AND RECREATION 13.11 13.11 BOATS (1) STATE BOATING LAWS ADOPTED Except as otherwise specifically provided in this code the statutory provision in Chapter 30, subchapter V-Regulation of Boating of the Wisconsin State Statues, describing the defining regulations with respect to boating, exclusive of any provision therein relating to penalties are hereby adopted and by reference made part of this code as fully set forth herein. Any act required to be performed or prohibited by any statute is incorporated herein by reference and is required or prohibited by this code. Any further amendments, revisions, or modifications of the statues incorporated herein are intended to be made part of this code in order to secure uniform statewide regulation of boating on waters within the State of Wisconsin. (2) No person may bring into the landing sites, or onto any shoreline within the Wazee Lake Recreation Area, any gasoline powered motor designed for use or operation of boats and/or other crafts. 13.12 FEES AND CHARGES (1) ADMISSION FEES No person may operate or park any automobile, motor truck, motor delivery wagon, bus, motorcycle or other similar motor vehicle or trailer or semi-trailer in the East and West Arbutus County Park, or within the Wazee Lake Recreation Area, without a permit, unless the vehicle has directly and completely affixed by its own adhesive a valid admission sticker. (a) Admission fees shall be waived at all County parks, and County recreation areas as follows: 1. Persons with disabilities and their personal care attendants brought by a nonprofit organization recognized by the internal revenue service under 26 USC 501(c)(1) or (3) whose primary purpose is the improvement of the mental or physical health of the individual. 2. For vehicles in which persons are covered under the provisions of 13.04(2)(a)(4) 3. For motorcycles as defined in 13.03(15) and mopeds, when trailered or towed into the property. (2) SCUBA DIVING FEES No person may enter the water for the purpose of scuba diving in the Wazee Lake Recreation Area without prior payment of the posted fee for such activity. Page 15. PARKS AND RECREATION 13.13 13.13 EXCEPTIONS Nothing in this chapter shall prohibit or hinder the department, its supervisors, managers, foresters, wardens, rangers or other duly authorized agents, or any law enforcement officer from performing their official duties. 13.14 PENALTIES (1) Bond Schedule Whoever violates any terms of this ordinance shall incur the forfeiture listed in the following bond schedule, plus court costs and any applicable penalty assessments. The forfeiture shall not be less than the minimum, nor shall it exceed the maximum of the range listed for each violation. (2) Violation Notices The department and all of its employees may issue violation notices for failure of a visitor to remit posted fees as required under 13.12(1-2) and 13.10(1)(a).
