The following observations and opinions are submitted regarding items cited under Schedule B - Section II, Specific Exceptions in said commitment for title insurance: Items No. 1-89, 100, and 103 are standard exceptions or are not survey related. No representation is made herein regarding said items. Item No. 90 refers to a mortgage recorded as Instrument Number 1996-0001779. Said mortgage was not provided to this surveyor. No representation is made herein regarding this item. Items No. 91 and 92 refer to liens recorded in Instrument Number 2009-0119546 and Instrument Number 2010-00003111. The properties listed in said documents include Lots 9 and 10 in Block AA of Augusta Park, 3rd Section. Item No. 93 refers to a lien recorded as Instrument Number 2008-137559. The properties listed in said document include Lots 1, 2, and 13' off of the North end of Lot 8 in Block V of Augusta Heights, First Section. Item No. 94 refers to a Grant of Perpetual Right-of-Way and Easement (Sewer), recorded as Instrument Number 1998-0009090. Said easement affects Lots 1-7 in Block C of Augusta Heights, First Section. The limits of said easement have been shown on the accompanying plat of survey. Item No. 95 refers to an Electric Line Easement recorded as Instrument Number 1998-0014019. Said easement affects Lots 1-7 in Block C of Augusta Heights, Section One. The limits of said easement have been shown on the accompanying plat of survey. Item No. 96 refers to Consent to Encroachment recorded as Instrument Number 1989-002989. There is no specific, retraceable description contained within said document. However the approximate location of the encroachment is given in said document. Said approximate location is labeled on the accompanying plat of survey. Attention is called to the fact that the garage referred to in this document has been removed. Items No. 97 & 98 refer to an Agreement for Construction of Sanitary Sewer under Private Contract recorded as Instrument Number 1997-0169009 and a Sewer Service Agreement recorded as Instrument Number 1997-0169010. These documents affect Lots 1-7 in Block C of Augusta Heights, First Section. Item No. 99 refers to a Sewer Service Agreement recorded as Instrument Number 1984-0004372. Said agreement affects Lots 10 through 13, except 5 feet by parallel lines off of the North end of Lot 13, all in Block C of Augusta Heights, First Section. Items No. 101 and 102 refer to the record plats for Augusta Heights, First Section and Augusta Heights, Third Section. Easements and setback lines as shown on said plats have been shown on the accompanying plat of survey. Attention is called to the fact that the plat referred to in item 102 is actually titled Augusta Park, 3rd Section on the record plat. Attention is also called to the fact that a portion of the surveyed premises lies within the plat of Augusta Heights, Second Section. 2.) The zoning classification for the surveyed real estate, as established by governmental record and its corresponding setback requirements have not been shown on this survey. 3.) The described real estate does lie partially within a Special Flood Hazard Area (Zone AE) as plotted by scale on the Federal Emergency Management Agency, National Flood Insurance Program, FIRM Flood Insurance Rate Map Community-Panel Number 18097C0039 E, effective January 5, 2001. Flood Plain information is provided solely based upon a review of the Flood Insurance Rate Maps (FIRM), and shall not be construed as a confirmation or denial of flooding potential. Attention is called to the fact that there are substantial uncertainties associated with said map and with information taken therefrom. No inquiry was made to determine the existence of Letters of Map Amendment or Letters of Map Revision which may affect the described real estate or be currently under review. Attention is also called to the fact that the FIRM maps are periodically revised and may be superseded by subsequent revisions. 4.) Underground utilities were not located as a part of this survey, and are hereby specifically excluded therefrom. Said underground utilities may be caused to be marked upon the ground by calling the Indiana Underground Plant Protection Agency at 1-800-382-5544. 5.) Possession lines referenced at monumented corners only. Possession lines may vary between said corners. 6.) Attention is called to the existence of a number of refuse and debris piles in the area of the surveyed parcels. Such piles have been shown where they lie upon the surveyed lots. Attention is also called to the fact that most of the site is heavily wooded. 7.) A Harrison Monument was found by Marion County Surveyor's Office Ties at the Northwest corner of said Section 29. A Harrison Monument was found by Marion County Surveyor's Office Ties at the NW corner of the Northeast Quarter of said Section 29. No monument was found at the Northwest corner of the East Half of the Northeast Quarter. Ties obtained from the Marion County Surveyor's Office were utilized to re-establish said Northwest corner of the East Half of the Northeast Quarter. A Harrison Monument was found by Marion County Surveyor's Office Ties at the Northeast corner of said Section 29. A stone was found by Marion County Surveyor's Office Ties at the Southeast corner of the Northeast Quarter of said Section 29. A stone was found by Marion County Surveyor's Office Ties at the Southwest corner of the East Half of the Northeast Quarter of said Section 29. A Harrison Monument was found by Marion County Surveyor's Office Ties at the Southwest corner of the Northwest Quarter of said Section 29. An iron pin was found by Marion County Surveyor's Office Ties at the Southwest corner of the Southeast Quarter of said Section 29. No monument was found at the center of said Section 29 and no ties were available from the Marion County Surveyor's Office. The center of said Section 29 was reestablished at the intersection of a line connecting the North and South quarter corners with a line connecting the East and West quarter corners. The locations of the various streets within said plats were established based upon the various section corners as discussed above, the record plats, and various monuments found along said streets in positions as shown on the accompanying plat of survey. Sapphire Boulevard was established based upon a best fit linear regression of various center line monuments found in positions as shown on the accompanying plat of survey. The Center line Garnet Avenue was established parallel with Northwestern Avenue passing through a copperweld found at Sapphire Boulevard. Crooked Creek Parkway East Drive was established based upon the record plat, and a curve fit through various calculated points along its length. Northwestern Avenue (now known as Michigan Road) was established based upon the current physical location thereof. Block E: Block E is bounded on the North by Turquoise Street (now known as 79th Street), on the East by Amethyst Avenue, on the South by Topaz Street (now known as 78th Street) and on the West by Crooked Creek Parkway East Drive. Block M: Block M is bounded on the Northeast by Crooked Creek Parkway North Drive, on the Southeast by South End Avenue, on the South by Apex Lane, and on the Southwest by Parallel Street. No monumentation was found within the limits of said Plat. The exterior boundaries were established based upon the record plat. The common lines between Augusta Heights, Second Section and Augusta Heights, First Section were utilized as a basis of bearings. The internal streets were established based upon the record plat of Augusta Heights, Second Section. Augusta Park, 3rd Section Block AA: Block AA is bounded on the North by Turquoise Street (now known as 79th Street), on the East by Onyx Street, on the South by Topaz Street (now known as 78th Street), and on the West by High View Avenue. The center line of Onyx Street was established by proration of the North and South lines of said Subdivision. The remaining streets around the perimeter of Block AA were established as described above under other blocks. Block BB: Block BB is bounded on the North by Turquoise Street (now known as 79th Street), on the East by Tremont Street (now known as Township Line Road), on the South by Topaz Street (now known as 78th Street), and on the West by Onyx Street. Tremont Street (now known as Township Line Road) was established based at the platted width from the East line of the Northeast Quarter of Section 29. The remaining streets around the perimeter of Block BB were established as described above under other blocks. Availability and condition of reference monuments The record plat for Augusta Heights, First Section calls for a stone at the Southwest corner of the subdivision. No stone was found in the position called for on the plat. Section corners cited in the perimeter description on said plat were reestablished as discussed above under theory of location. There are three stones called for along the perimeter of the plat of Augusta Heights, Second Section. None of these three stones were found during the field survey. Section corners cited in the perimeter description on said plat were reestablished as discussed above under theory of location. The record plat for Augusta Heights, 3rd Section does not call for any monumentation within said plat. Section corners cited in the perimeter description on said plat were reestablished as discussed above under theory of location. A number of other monuments (not referenced on the above described plats) were found within the limits of the above referenced subdivisions with a maximum variance of 10.2 feet in a North-South direction and 5.0 feet in an East-West direction from a calculated position. 2.) Clarity and/or ambiguity of the record descriptions A mathematical analysis of the record descriptions for adjoining real estate as obtained from the Office of the Recorder of Marion County, Indiana was conducted and resulted in the following observations and opinions: Augusta Heights, First Section Block A: None of the surveyed lots are situated within Block A. Block B: None of the surveyed lots are situated within Block B. Block C: No conflicts were found in the record descriptions within this block. Block E: No conflicts were found in the record descriptions within this block. Block F: No conflicts were found in the record descriptions within this block. Block G: No conflicts were found in the record descriptions within this block. Block H: No conflicts were found in the record descriptions within this block. Block I: No conflicts were found in the record descriptions within this block. Block J: No conflicts were found in the record descriptions within this block. Block K: No conflicts were found in the record descriptions within this block. Block L: No conflicts were found in the record descriptions within this block. Block N: No conflicts were found in the record descriptions within this block. Block O: No conflicts were found in the record descriptions within this block. Block P: No conflicts were found in the record descriptions within this block. Block Q: No conflicts were found in the record descriptions within this block. Block R: No conflicts were found in the record descriptions within this block. Block S: No conflicts were found in the record descriptions within this block. Block T: No conflicts were found in the record descriptions within this block. Block U: Instrument Number 2002-0010532 conveys to Crossmann Communities Partnership twenty-five feet off the east end of lot 5 in Block U. The Marion County GIS shows Crossmann Communities Partnership owning the Northwest portion of said Lot 5. Said GIS indicates that the Southeast portion of said Lot 5 is in the name of Empire Development, LLC. A deed to said Empire Development was found recorded as Instrument 1997-0023011 which conveys AUGUSTA HTS 25FT SE SIDE L5 BU, creating a complete title overlap. No deed was found for the Northwest portion of said Lot 5. It is recommended that research into the respective chains of title be conducted to make a final determination regarding the ownership of the Southeast Portion of said Lot 5. Block V: The description in the Title Commitment includes all of Lot 8 in Block V. The description contained in the most recent deed includes only 13 feet off of the North end of Lot 8 in Block V. The rest of said Lot 8 is a remainder parcel in the name of Eric T. Wampner (Inst. #1999-006299). Block W: No conflicts were found in the record descriptions within this block.
