For an exemption (U.S. - EU Open Skies ----------------------------------- Docket OST-2009-0023 APPLICATION OF C.A.I. SECOND S.p.A. FOR AN EXEMPTION Pursuant to 49 U.S.C. 40109 and Subpart C of the Department's Procedural Regulations, C.A.L Second S.p.A. ("CAl Second", hereby requests an exemption from 49 U.S.C. 41301 and such other relief as may be necessary to permit it to conduct scheduled and charter foreign air transportation of persons, property, and mail to the full extent authorized by the Air Transport Agreement Between the United States and the European Community and the Member States of the European Community ("US-EU Agreement". Specifically, CAl Second requests exemption authority to the extent necessary for it to engage in: 1. scheduled and charter foreign air transportation of persons, property, and mail between any point or points behind any member state of the European Union via any point or points in any member state and via intermediate points to any point or points in the United States or beyond; 2. scheduled and charter foreign air transportation of persons, property, and mail between any point or points in the United States and any point or points in any member of the European Common Aviation Area; 3. other charters pursuant to the prior approval requirements set forth in Part 212 of the Department's Economic Regulations; and 4. transportation authorized by any additional route rights that may be made available to European Union carriers in the future. In support of this application, CAl Second states as follows:

1. C.A.I. Second was granted open skies exemption authority in this docket on February 20,2009, for a period of two years. Due to an administrative oversight C.A.I. Second did not submit a timely renewal application. 2. C.A.I. Second remains operationally and financially fit to perform the foreign air transportation services encompassed by this authority. 3. C.A.I. Second's services continue to be consistent with the US-EU Agreement and, therefore, grant of this authority will serve the public interest. 4. Grant of the authority sought herein will not result in a near term increase in fuel consumption often million gallons or more, and therefore will not comprise a "major regulatory action" under the Energy Policy and Conservation Act of 1975, as defined in 14 C.F.R. 313(a(1. WHEREFORE, C.A.I. Second S.p.A. respectfully requests that the Department of Transportation promptly grant its application for an exemption as more fully described herein.
