Successfully achieving early structured settlement with owner developer. Claim value USD 24 million. Al Salam Resort & Spa, Bahrain Advising owner developer on inherent design deficiencies in its early stage constructed project to include cost benefit analysis of value engineering options, demolition, redesign and rebuild or initiation of arbitration proceedings as against designer architect and contractor. Claim value USD 140 million. Nakheel Resort & Spa, Bahrain Drafting amended form FIDIC construction contracts for construction and completion of an iconic 5 star hotel for a leading Bahrain high end owner developer and to be operated by a prominent Far East hotel operator. Villamar, Hotel & Spa, Bahrain Advising owner developer on the completion of construction and handover to a prominent Far East hotel operator amidst a stalled project scenario to include liaison as between the contractor and operator seeking early resolution. Bahrain Tourism Company, Bahrain Advising on the refurbishment, demolition and rebuild of a master planned 5 phase hotel development on a prime Bahrain hotel site to include negotiating hotel operation agreement, design phase liaison as between owner and operator, district cooling network facilitation and concession as well as advice as to financial backdrop to development and funding requirements Durrat Resort Hotel Project, Bahrain Front end early project procurement advice for the developer in advance of tendering to market to include consultancy agreements and supply chain issues as to localised professional practice structures, securing of third party rights as between design consultants, sub consultants and developer. The work involved advising on the most effective corporate and development structure in relation to the project along with advising on the heads of terms. Hotel and Branded Residences, Bahrain Advising a US based luxury hotel and hospitality group with the initial due diligence aspects in relation to the proposed development of hotel and branded residences. Hotel Redevelopment, Bahrain Advising an internationally renowned luxury branded hotel group on all necessary legal permits to operate a five star hotel license in Bahrain. Part of our reviews considered the land title and corporate structuring options for the separation of sharia h compliant and non-sharia h h compliant income. Multiple Hotel Development, Bahrain Advising a government owned real estate development company on the initial aspects of its proposed multiple hotels development project along the West coast of Bahrain. Ascott Hotel and Residences, Bahrain Advising one of Asia's largest real estate companies with its USD 750 million iconic mixed use development known as Raffles City, Bahrain including a hotel and serviced apartments. Boutique Hotel, Bahrain Drafting and negotiating the suite of hotel management documents relating to a boutique hotel in Bahrain to a recognised operator. Hotel Project, Bahrain Advising a Saudi based HNW individual with the appointment of a hotel operator following the refurbishment of hotel premises in Bahrain. Work included assisting with the procurement of the operator (the world s largest hotel group, the Wyndham Group) to finalising the suite of the hotel management contracts. Iraq Hotel Development, Iraq Advising an Iraqi developer on the initial structuring aspects of the development and management of a hotel in the Kurdistan region, including the drafting and negotiation of design and construction management contracts. Oman Ministry of Tourism Reviewing a hotel management agreement for a government owner in relation to a five star property on the Muscat coastline. In particular our review assessed owner obligations in connection with the royalties and incentive payment policies. Kempinski @ The Wave, Muscat Drafting amended form of FIDIC construction contract and consultancy suite for use in the procurement, construction and completion of the prime Kempinski hotel facility as part of The Wave development. Shangri-La Resort, Muscat Advising owner developer as to design and negligence issues in the design and construction of its 5 star Bar Al Jissah Resort including front end structured negotiations with the contractor and the lead design consultant. United Arab Emirates The World Islands Advising an international developer on the development of an island on The World Islands in the Emirate of Dubai comprising a 5 star hotel and residences to be operated by an international hotel operator. Hotel Syndicated Financing, Dubai Advising a regional bank as part of a syndicated project financing in relation to the development of a hotel in Dubai. Palazzo Versace, Dubai Advising an international developer on the first Palazzo Versace resort including the D1 residential tower to be developed in the Middle East. Sowwah Island, Abu Dhabi Advising international hotel operators on their respective developments compromising 5 star hotels and private residences on Sowwah Island, Abu Dhabi. The Palm, Dubai Advising a long standing Bahrain based client on its proposed sale of a 4 star hotel in Dubai to a Far East investor. Other regions Africa Hotel Developments Advising a leading emerging markets fund manager in relation to numerous commercial real estate projects in Africa, including hotel, office and retail developments. Hotel Development, Morocco Advising a large real estate sovereign wealth fund based in Qatar in relation to existing hotel project agreements for a resort development in Morocco. Work involved identifying the main risk areas involved in relation to the project and formulating an agreed strategy to resolve/mitigate such risks. Hotel Development, Nigeria Advising on a USD 200 million project for a four star hotel and conference centre in Nigeria based on a turnkey construction contract (based on the FIDIC Yellow Book terms & conditions). Having been based in the Middle East since 2008, Simon specialises in real estate and development matters, including large scale mixed use developments, city centre re developments, real estate management, real estate investment and finance (both conventional and Islamic). Simon has significant experience and expertise in relation to the hotel sector having acted for numerous owners and operators over the last 10 years. Simon has worked on both sides of the table in relation to the development of new hotels as well as the refurbishment of existing hotels (including the change of operators). Paula Boast, Partner Paula is the Head of Construction, Engineering & Projects for the Middle East Region. Paula has over 10 years of experience in the Middle East specialising in construction, projects and engineering law across Bahrain and the region. Her extensive projects experience includes real estate and development, regeneration, infrastructure and utilities, residential, industrial and commercial, education and healthcare as well as hotel and hospitality both in the private and public sectors. Paula has acted on a number of hotel projects either in relation to the initial procurement strategy and supporting construction contracts or in relation to construction disputes which are specific to this sector. Ghassan El Daye, Partner Ghassan is the Head of Arabic Dispute Resolution and Litigation for the Middle East. Ghassan has nearly 25 years of experience in litigation and dispute resolution and heads the Arabic Regional Dispute Resolution team.
