MINISTRY OF INFRASTRUCTURES AND TRANSPORT HARBOUR MASTER S OFFICE OF RAVENNA ORDER NO. 97/2017 The Head of the Maritime Compartment and Harbour Master of the Port of Ravenna: the Regulation for the towing service for ships in the roads and port of Ravenna currently in force issued by the Head of the Maritime Compartment and Harbour Master of the Port of Ravenna on 4 April 2012 and approved with decree by the Ministry of Infrastructures and Transport on 8 May 2012, article 14, paragraphs 1bis and 1ter of the Law 84/94 on 28 January 1994 (Reorder of port legislation) and subsequent amendments, its order n. 88/2015 on 27 November 2015, which approved and enforced the rates for the towing service in the port and roads of Ravenna for the 2016-2017 period, the documented request to start proceedings to review rates presented by S.E.R.S. S.r.l., which provides the towing service in the roads and port of Ravenna, received on 28 September 2017, whose purpose is to revise the two-year 2018-2019 rates, the licence granted on 6 March 2000 reference no. 20/00 to S.E.R.S. S.r.l. and successive additional provisions to the licence, reference no. 01/07 of 2 April 2007, reference no. 40/08 of 10 December 2008, reference no. 02/2011 of 28 September 2011, reference no. 07/2016 of 5 April 2016 and reference no. 06/2017 of 25 July 2017, the circular DEM3 no. 1589 of 17 June 2003 issued by the Ministry of Infrastructures and Transport and subsequent amendments and additions, regarding the criteria and mechanisms for drawing up rates for towing services in ports and subsequent amendments and additions, 1

EXAMINED EXAMINED CONSIDERING THAT the dispatch no. 14201 of 26 October 2011 issued by the Ministry of Infrastructures and Transport, entitled "Method of calculation of the tonnage of the convoys for the application of port towing and pilotage rates, the dispatch no. 16680 of 9 June 2017 issued by the Ministry of Infrastructures and Transport, on "Criteria and mechanisms for the formation of the rates for the port towing service. Index numbers for 2017 ", the development of the tariff scheme drawn up by the concession company, following the criteria indicated in the circular DEM3 n. 1589 the correspondence of the documentation attached to the application presented by the S.E.R.S. S.r.l., which provides the towing service in the roads and port of Ravenna, the sheet no. 23135 of 12 October 2017, by which this Harbour Master's Office forwarded the above instance to the trade union associations concerned, for those of competence, the favourable opinions received from trade associations, the opinion in agreement of the Ravenna Port Authority, expressed in note no. 7380 of 24 November 2017, the new percentage rate of tariff variation stems from a correct application of the tariff revision scheme, HAVING CONSIDERED the above-listed deeds, all of which are part of the preliminary investigation procedure, envisaged by current regulations, each in itself and as a whole, complete and suitable for placing the Harbour Master's Office in the conditions to issue a new tariff provision, article 101 of the Italian Navigation Code and article 59 of the related Implementing Regulation (Maritime Section), DETERMINES a reduction of 6.54% to be calculated on the rates in force. 2

ORDERS Article 1 The enclosed Rates for the towing service in the port and roads of Ravenna are approved and come into force as of 00:01 hours on 1 st January 2018, and are an integral part of this Order. Article 2 Order no. 88/2015 dated 27 November 2015 (Rates for the towing service in the port and roads of Ravenna) ceases to have effect at the same date and time. Article 3 Everybody concerned shall comply and make others comply with this Order. If transgressors violate this Order, they will be prosecuted pursuant to article 1173 of the Italian Navigation Code. HARBOUR MASTER S OFFICE OF RAVENNA Enclosed with Order no. 97/2017 dated 21 December 2017 ORGANISATION OF THE TOWING SERVICE IN THE PORT AND ROADS OF RAVENNA AND RELATED RATES Article 1 Working hours In order to determine services and rates (except those in Article 6, no. 2), the working hours of tow boats (tugs) are divided as follows: 1) working hours on weekdays a) normal from 06:01 hrs to 20:00 hrs Mondays to Fridays b) normal on Saturdays from 06:01 hrs to 20:00 hrs Saturdays c) overtime from 00:01 hrs to 06:00 hrs and from 20:01 hrs to 24:00 hrs every day 2) working hours on Sundays and public holidays a) normal from 06:01 hrs to 20:00 hrs b) overtime from 00:01 hrs to 06:00 hrs and from 20:01 hrs to 24:00 hrs Article 2 Towing services Costs and times The services rendered by each tug in the port and roads of Ravenna are charged by applying the base rate and the surcharges shown in the following Articles. The times of services are calculated from the moment the tug arrives alongside the ship (it must not be earlier than the arrival communicated by the ship) until the moment it is left free to return. 4

Article 4 Base rate for special services When the towage service is carried out in the conditions hereinafter described, the base rate is the same as the one stated in Article 3 above, plus a percentage surcharge shown next to each case: 4.1 towage of ship without engine propulsion +30% 4.2 stern towage with engine propulsion and for a distance exceeding 1000 metres (only in the port canal and only on the rate referring to tugs which carry out this service) +15% Article 5 Base rate for various services 5.1 supply of electric power or compressed air: for the first hour 431,99 for every hour thereafter 324,95 5.2 Assistance to ships moored in port for security needs, on the order of Harbour Master s Office or at the request of the interested parties, for each hour or fraction of an hour (in the hours 08:01-17:00, from Monday to Friday). For the services rendered to ships at anchor off the canal port: increase of 50% Article 6 Base rate for services not carried out For tugs requested but not used for causes not attributable to the tugs: 6.1 if the tugs have arrived at the location requested, the rate is: inside the harbour 266,85 within the roads (outside the breakwaters) 442,16 6.2 if the tugs (with the exception of the tug on duty) are requested for hours which differ from the normal weekday times, as stated in Article 1.1 point a) and are not cancelled before 15:00 hrs on weekdays Mondays to Fridays, or by 10:00 hrs on Saturdays, Sundays and public holidays, the rate shown here in point 6.1 shall be applied without additional surcharges. 8

Article 7 Surcharges on the base rate 7.1 Besides normal working week hours, the base rate is increased by the following percentages as per Article 3 points 3.1.1, 3.1.3 and 3.2.1 (for ships up to 12,500 GT) and Articles 4 and 6: normal working hours on Saturdays 26% overtime on weekdays 35% normal working hours on Sundays and public holidays 35% overtime on Sundays and public holidays 80% 7.2 Regarding services described in Article 5.2 (assistance to ships that have been moored in the port for safety reasons following orders from the Maritime Authorities or upon request of the interested parties): for overtime on weekdays from 00:01 hrs to 08:00 hrs and from 17:01 hrs to 24:00 hrs of all weekdays, a 50% surcharge for overtime is applicable; for overtime on Sundays and public holidays from 00:01 hrs to 08:00 hrs and from 17:01 hrs to 24:00 hrs on Sundays and public holidays, a 100% surcharge for overtime is applicable; for normal working hours on Saturdays from 08:01 hrs to 17:00 hrs, a 40% surcharge is applicable; for normal working hours on Sundays and public holidays from 08:01 hrs to 17.00 hrs, a 50% surcharge is applicable. Article 8 Surcharge for late payment If invoices for towing and all other services, including extras as per this Order, are not settled within thirty days from the date of issue of the invoice, the consignee that received the service can be charged for late payment. The surcharge will be effective from the date of issue of the invoice and will be 0.8% for each month or fraction thereof of the late payment. Article 9 Services not included in the rates For towing services provided and not included in these rates, the parties must agree upon a lump sum payment before services are carried out. Article 10 Calculating international gross tonnage (GT) In order to apply the correct rate, the international gross tonnage (GT) of the ship shall be calculated as follows: 9

10.1 For ships holding an International Tonnage Certificate issued according to the 1969 London Convention (Tonnage 69), the rates will be applied according to the international gross tonnage value (GT) stated on the certificate; 10.2 For ships not holding the above-mentioned certificate, the rates will be calculated according to the value of the gross tonnage (GT) obtained using the following formula prepared by the Italian Shipping Registrar (Registro Italiano Navale, R.I.N.A.). The GT values obtained using this formula are very close to those obtained applying the criteria for calculating international gross tonnage as set out in the above-mentioned convention. GT = K 1 x V where V = 2.832 x total gross volume in tons where K1 = 0.2 + 0.02 log 10 V If the above formula cannot be applied due to missing data, the following formula elaborated by IMO, albeit less accurate than the previous one, can be used to obtain a temporary calculation of the gross tonnage of ships which do not have an International Gross Tonnage Certificate: where VE = L x B x H; GT = VE x a L = length in metres as per the Loadline Certificate B = maximum width in metres measured outside the framework, as stated in the registers or the documents on board the ship (also in the Capacity Plan); H = height from the bottom up to the highest complete deck, in metres, as stated in the registers or the documents on board the ship; a = F (VE) to be calculated with the linear interpolation according to the following table: VE a Up to 400 0.58 1,000 0.43 5,000 0.35 10,000 0.34 25,000 0.33 50,000 0.32 100,000 0.31 150,000 0.30 200,000 0.29 250,000 and over 0.28 10

Article 11 Calculation of gross tonnage for convoys Calculation of gross tonnage for convoys results by the sum of gross tonnages of individual components making up the convoy, or to the vessels not in possession of certification of international gross tonnage, it results by the sum of gross tonnages of individual components making up the convoy, obtained by applying the criteria in Article 10.2.
