ENERGY AND WATER UTILITIES REGULATORY AUTHORITY (EWURA) In the matter of an Application by the BABATI URBAN WATER SUPPLY AND SEWERAGE AUTHORITY ( BAWASA ) For a Tariff Application, Submited on 22 nd May 2007 (TR-W-07-005) ORDER 07-011 On 22 May 2007 EWURA received an application dated 16 May 2007 from Babati Urban Water Supply and Sewerage Authority ( BAWASA ) for an increase in its tariff and charges for water supply services. The Applicant requested for a tariff adjustment on water supply service at a weighted average increase of 31% for metered and un-metered customers, and a connection charges increase ranging from 0% to 44.4%. BAWASA s proposed tariff and charges increase aims at covering its costs of distribution and maintenance of the water supply networks; water production; and replacement and pipe extensions for improvement of services. EWURA has been empowered by the Energy and Water Utilities Regulatory Authority Act, Cap 414 ( EWURA Act ) to regulate tariff adjustments in the water and sewerage sector. EWURA conducted an Inquiry into the reasonableness of the proposed tariff and charges increase. This inquiry included an economic and a technical evaluation of the Application and a Public Meeting that was held at Babati on 7 th August 2007 to hear the views of stakeholders including EWURA s Consumer and Government Consultative Councils and the public. The public inquiry raised several issues that led to further discussions with BAWASA and provision by the Applicant of supplementary materials in support of the tariff application. As a result of the Inquiry, EWURA concluded that, the tariff and charges proposal was reasonable. The approved tariff and charges will enable BAWASA to cover its costs of distribution and maintenance of the water supply networks; water production; and replacement and pipe extensions for improvement of services. 1

The Board of Directors of EWURA having met on 5 th October 2007 to consider this matter decided as follows: 1.0 BAWASA s water tariff for various categories of customers shall increase as shown on Tables 1 and 2. The approved tariffs and connection charges will take effect from 1 st November 2007. Meter all its customers by June, 2009; 2.2. Increases the number of connections to attain a ratio of 10 employees per 1000 connection; and 2.3. Complete Customer Service Charter and disseminate it to the public by January, 2008. 3.0 On or before 30 th June 2008 BAWASA must provide evidence to EWURA that it has designed and is implementing a water source protection to prevent water pollution and illegal entry at Mrara water source. 4.0 On or before 31 st January 2008 BAWASA must provide evidence to EWURA that it has designed and is implementing a pro-active program of customer outreach. A status report on the implementation of that program shall be included with all future applications for tariff adjustment and considered by EWURA in evaluating the reasonableness thereof. 5.0 BAWASA shall continue to provide EWURA with information about its financial and operating condition in accordance with the requirements of EWURA. information will be used by EWURA to evaluate BAWASA s performance in comparison with other utilities and the improvement of its performance over time. This evaluation will be considered by EWURA in evaluating the reasonableness of all future requests for tariff adjustment. Simon F. MAMLAKA YA UDHIBITI WA HUDUMA ZA NISHATI NA MAJI (EWURA) Ombi la Mamlaka ya Majisafi na Majitaka Babati (BABATI URBAN WATER SUPPLY AND SEWERAGE AUTHORITY) la Kurekebisha Bei ya Huduma ya Majisafi lililowasilishwa tarehe 22 Mei, 2007 (TR-W-07-005) AGIZO Na. 07-011 Mnamo tarehe 22 Mei, 2007 Mamlaka ya Udhibiti wa Huduma za Nishati na Maji (EWURA) ilipokea ombi la kuongeza bei ya huduma ya majisafi kutoka Mamlaka ya Majisafi na Majitaka Babati (BAWASA) la tarehe 16 Mei 2007. BAWASA iliomba ongezeko la wastani wa asilimia 31 kwa wateja wenye dira na wasio na dira, na ongezeko la kati ya asilimia 0 hadi 44.4 katika i ada za maunganisho ya maji.. Ombi hilo litaiwezesha BAWASA kuboresha huduma ikiwa ni pamoja na kulipia gharama za usambazaji na ukarabati wa miundombinu; gharama za uzalishaji wa maji; na gharama za kuongeza na kubadilisha mabomba yaliyochakaa. Sheria iliyounda EWURA, imeipa Mamlaka uwezo wa kisheria wa kudhibiti marekebisho ya bei ya huduma za majisafi na majitaka. EWURA ilifanya taftishi kuhusu uhalali wa ombi hilo la ongezeko la bei ya huduma ya majisafi. Taftishi hiyo ilihusisha tathmini ya masuala ya kiuchumi na ya kiufundi pamoja na kufanya mkutano wa utafiti (public inquiry) tarehe 7 Agosti 2007 katika mji wa Babati ili kupata maoni toka kwa wadau ambao ni Baraza la Watumiaji Huduma zinazodhibitiwa na EWURA, Baraza la Ushauri la Serikali na wateja wa BAWASA. Hoja hizo zilizotolewa katika taftishi, ziliwezesha EWURA kuitaka BAWASA itoe maelezo zaidi kuhusu ombi lake la kuidhinishiwa bei za maji. Kufuatia kukamilika kwa taftishi hiyo, EWURA imefikia uamuzi kwamba ombi la nyongeza ya bei lina mantiki na ni halali.. Bei hii mpya itaiwezesha BAWASA kutimiza malengo yake ya kuboresha huduma ikiwa ni pamoja na kulipia gharama za usambazaji 5

na ukarabati wa miundombinu; gharama za uzalishaji wa maji; na gharama za kuongeza na kubadilisha mabomba yaliyochakaa.. Bodi ya Wakurugenzi ya EWURA ilikutana tarehe 5 Oktoba 2007 na kutoa maamuzi yafuatayo: 1.0 Bei za BAWASA zitaongezeka kama inavyoonekena katka Jedwali Na.1 na Na.2.. Bei na ada hizo zitaanza kutumika rasmi tarehe 1 Novemba 2007. Taasisi 45,000 50,000 50,000 3 Biashara 45,000 60,000 60,000 4 Viwanda 45,000 65,000 65,000 5 Magati - - - 2.0 Ifikapo tarehe 31 Januari 2008, BAWASA itatakiwa kuwasilisha kwa EWURA mpango wake wa jinsi ya: 2.1 Kuwafungia wateja wote dira za maji ifikapo Juni 2009; 2.2 Kuongeza idadi ya wateja hadi kufikia asilimia 80 ya kaya ifikapo Juni 2009; na 2.3 Kumaliza utayarishaji wa Mpango wa Huduma kwa Wateja (Customer Service Charter )na kuusambaza kwa umma ifikapo Januari 2008. 3.0 Ifikapo tarehe 30 Juni 2008, BAWASA inatakiwa kuleta uthibitisho wa kutosha wa namna ambavyo imesanifu na kutekeleza mpango wa kulinda chanzo chake maji cha Mrara; 4.0 Ifikapo tarehe 31 Januari 2008 BAWASA iwe imetoa uthibitisho wa kutosha na jinsi inavyotekeleza mpango wake wa kuimarisha mahusiano, mawasiliano, utoaji habari, na uelimishaji wa wateja (customer outreach). Taarifa ya utekelezaji wa mpango huo iwasilishwe EWURA katika maombi yote yajayo ya kurekebisha bei za huduma hiyo na taarifa hizo zitazingatiwa wakati wa kufanya tathmini ya uhalali wa ombi husika; 7

5.0 BAWASA itaendelea kuwasilisha kwa EWURA taarifa zake za fedha na za utendaji kwa mujibu wa mwongozo wa EWURA. Taarifa hizi zitatumwa kwa EWURA kama ilivyoainishwa kwenye taratibu na sheria za EWURA katika kufanya tathmini ya utendaji wa BAWASA na uboreshaji wa huduma zake ikilinganishwa na vyombo vingine vya utoaji wa huduma za maji. EWURA itazingatia tathmini hiyo katika kufanya maamuzi ya maombi yatakayofanywa na BAWASA katika siku zijazo. Simon F.
