Government 39.3 Review the progress for preparation of Gujarat Coastal Zone Management Plan As per provisions of CRZ Notification 2011, every coastal State Government/SCZMA has to prepare the State Coastal Zone Management Plan for their respective State in accordance with the guidelines and procedures laid down thereunder. The MOEF&CC, GOI has directed NCSCM to demarcate the HTL along the entire Indian coastline. As a part of this study, demarcation of HTL for Gujarat State has been take up by the NCSCM, Chennai. The matter regarding preparation of Coastal Zone Management Plan for State of Gujarat was discussed in the 36th meeting of GCZMA, which was held on 19-07-2017 after receiving proposal from NCSCM, Chennai through Ministry of Environment, Forests and Climate Change, Government of India, and after detailed deliberation and discussion following decision were taken. It was decided to approve the proposal of NCSCM, Chennai and to make necessary payment of Rs. 6,00,00, 635/ from the account of GCZMA for preparation of Coastal Zone Management Plan. Necessary work order in this regard was to be issued by the Department. Accordingly, necessary work order has been issued on 03-08-2017 in the name of NCSCM, Chennai and work for SCZMP has been awarded. Gujarat Ecology Commission, Gujarat has signed detailed MOUs with NCSCM, Chennai alongwith detailed terms and conditions. The GEC has conveyed three meeting have been conveyed with concerned Department of State Government regarding finalization of HTL/ESA/and other features. In the meantime, in the matter Application No- 424/016, the NGT vide order dated 22-11-2017 has directed all the State Government to submit draft SCZMP by 30/04/2018. The GEC and NCSCM, Chennai have been requested to expedite the process for preparation of SCZMP and to ensure that time limit stipulated by the NGT is complied with. 4

The Authority may like to discuss the issue and take necessary decision in this regard. 39.4 Amendment in condition of CRZ Clearance for proposed windmill project at Viilage: Katpar, Doliya, Khared, Gujarada and Naip, Taluka: Mahuva, Dist: Bhavnagar by M/S K.P.Energy Limited M/S K.P. Energy Limited (KPEL), vide its application dated 14-04-2016 had approached the Gujarat Coastal Zone Management Authority for seeking recommendations for obtaining CRZ Clearance from the Ministry of Environment, Forests and Climate Change, Government of India for their proposed project for 34 Wind Mills Infrastructure for Windfarm (50MW) in Mahuva Coast, Dist: Bhavnagar. The proposal of M/S K.P. Energy Ltd (KPEL) was deliberated in the 31st meeting of the Gujarat Coastal Zone Management Authority held on 15-10- 2016. After detailed discussion, the Authority decided to recommend the proposal to the Ministry of Environment and Forests, Government of India to grant CRZ Clearance for proposed windmill project, alongwith following specific conditions conditions: 1. The KPEL shall have to paint all blade of the windmills with orange or red colour as per International Standards to prevent bird hit. 2. The KPEL shall take maximum precautions during construction phase to ensure that the surrounding reserved forests areas are not disturbed and the power lines are placed away from the forests and water bodies. 3. The KPEL shall have to ensure that overhead electrical lines are insulated, spike guard on channels at poles are provided and maximum distance shall be maintained between two conductors. 4. The KPEL shall monitor wind turbine particularly located in Katpar village for bird and bad mortality during the post construction in operation phase for two continuous years for determining the scale of impacts on birds and bats. Upon finding significant bird and bat mortality, mitigation measures shall be taken including curtailment or cut off the generation of power during certain identified period during which maximum impact occurs. A report in this regard shall be submitted to PCCF(WL). 5

Accordingly, the proposal was sent to MOEF&CC, Govt. of India along with recommendation vide letter dt. 01/02/2017. The Ministry of Environment, Forest and Climate Change, Government of India on 12/07/2017 has issued CRZ clearance for this project with the conditions that all the conditions of recommendations letter from the Department shall have to be complied with by the K.P.Energy Limited. The KP Energy Limited, vide letter dated 18-03-2017 has approached this Department requesting to amend at the conditions No- 4 of the recommendations letter dated 01-02-2017 and the word Overhead electrical lines are insulated shall be replaced by the word insulated overhead electric lines jumpers as per their EMP and as suggested by the Expert Appraisal Committee, MOEFCC, GOI. However, it was decided not to amend the conditions by the State The decision of the State Government was conveyed to M/S K.P.Energy Limited vide this office letter dated 04-07- 2017 Again M/S K.P. Energy Limited has requested GCZMA to change/modify the word insulated over-head electrical lines by substituting it as insulated over-head electrical line jumpers in the condition no. 4 of the recommendation letter vide letter dt. 03/06/2017 and the same was sent to PCCF (Wild life) for opinion in the matter. Accordingly, PCCF (Wild life) submitted their Report in the matter vide letter dt. 16/09/2017. Based on the findings of the report submitted by the PCCF (Wild life), Direction under Section-5 of the Environment (Protection) Act-1986 were issued to project proponent on 22-09-2017 and directed to stop the work in ecological sensitive area and in wetland area. Also regional Officer, GPCB, Bhavnagar was directed to file a complaint under section 19 of Environment(Protection) Act, 1986. Then after, M/s KP Energy has approached Department with a request to revoke the direction issued to them and allow to carry out construction work as they have received CRZ clearance vide letter dt.12/07/2017 from Ministry of Environment, Forest and climate Change, GOI. A team of officials from Forests, GPCB, Dir(Env) visited site on 05-10-2017 and submitted it report and the observations of the team was conveyed to the 6

K.P.Energy Limited for compliance. Based on the submission made by the K.P.Energy Limited, it was decided to revoke the directions issued on 22-09- 2017 and to carry out site inspection by a committee for the points which were disputed by the K.P.Energy Limited. Accordingly, the directions issued on 22-09-2017 were revoked on 27-10-2017 with certain conditions. RO, GPCB and a committee visited the site on 11-11-2017and on 15-11-2017 respectively and based on the observations, Directions under Section 5 have been issued on 07-12-2017 to the K.P. Energy. The K.P.Energy limited vide its letter dated 16-03-2018 has again approached The Department requested to amend the conditions of insulating of conductors. The Authority may like to discuss the issue and take suitable decision regarding amending the conditions of earlier recommendations letter dated 01-02-2017. 39.5 Any other item with the approval of the Chair. 7
