Hellenic Cadastre: So that we know what we own! The Hellenic Cadastre is a unified and constantly updated information system that records legal, technical and other additional information about real estate properties on the State s responsibility and guarantee. Its establishment aims at creating a modern, fully automated record of properties. The record s details are of an evidentiary nature, ensuring the largest possible publicity and security of transactions. The amendment of Law 3481/2006 laid new foundations for the Hellenic Cadastre by securing its funding parallel to simplifying and accelerating the cadastral survey procedures. The first generation of cadastral surveys is being currently completed and the Hellenic Cadastre now covers 322 regions and 7,7 million stremmas, has 6,2 million registered property rights and 94 operational Cadastral Offices. At the same time, the Hellenic Cadastre is expanding to 107 new regions of Attica and Thessaloniki prefectures and the capitals of prefectures that have not been surveyed during previous programmes. It is the most important cadastral programme carried out to date, with which 3,1 million stremmas will be surveyed and 6,7 million property rights registered. Upon completion of this cadastral programme, the Hellenic Cadastre will have covered 2/3 of the country s population. Thus, together we are taking a big step closer to the materialisation of a major national project which sets things right and facilitates our lives, since: Its records are based on the property s information and not the proprietor s. So, everything becomes simpler and clearer. The property of citizens is not simply recorded but consolidated For the first time, state and municipal property is demarcated irrevocably. Forests and coastal zones are protected for good, so that they cannot be trespassed, squatted or encroached.. The registered information is guaranteed. Be briefed now Get ready in time The Ministry of the Environment, Physical Planning and Urban Works and Ktimatologio S.A. are carrying out the project of active titles within the 3rd Community Support Framework and the Operational Programme «Information Society»: a large central digital database is created and all rights on properties of the 107 new regions incorporated in the Hellenic Cadastre will be recorded there. Along the lines of this project, about 3 million citizens will soon be requested to submit a declaration (Law 2308/95) regarding the rights they have on properties within the 107 new regions officially announced to be under cadastral survey. The exact dates for the submission of declarations will be announced by the Ministry of the Environment, Physical Planning and Urban Works. Beginning from these dates, citizens living in Greece will have at their disposal a time period of three (3) months while expatriates and foreigners living abroad will have six (6) months to submit their declaration(s). The necessary documentation that you must attach to the declaration of L.2308/95 about the property rights you have. Necessary Documentation We note that the necessary documentation that you must attach to the declaration of L.2308/95 is the following: a) Simple photocopies of the titles that substantiate your rights on properties (e.g. contracts, deeds etc.) b) Simple photocopies of the land registry transcription certificates regarding the aforementioned titles c) Any topographic diagrams you may have depicting the properties declared d) A simple photocopy of your Identification Card or Passport Furthermore, upon the submission of the declaration you will also need to produce an official document that reads your Tax ID Number (e.g. revenue statement, power bill etc.). It is underlined that if the property s titles are not attached to the declaration, then there is official reason for refusing to collect the declaration.
Get ready in time Starting from now, gather all necessary documentation that needs to be attached : Look for the copy of your deeds (or other documents) that substantiates your property rights. In case you do not have the pertinent copies you must seek them by addressing the Notary who drew the deed. The land registry transcription certificates can be found at the official Land Registry Office. Should you not have transcribed the deeds of your properties to the official Land Registry Office, you must proceed with the necessary actions promptly In case you have acquired your right by means of usucaption, if there is not a court decision, you must submit documents that prove this usucaption right (e.g. power or telephone bills, leases, evidence of subsidies, official boundary adjudication documents, affidavits etc.). In case you have inherited your right, you can declare it even if you have not officially accepted your inheritance. Look for the necessary documentation to be submitted together with the declaration of L.2308/95, depending on whether there is a will or not. Furthermore, you should know that: 1. The declaration of Law 2308/95 that you are asked to fill in concerns a right and not a piece of property. This means that in case you have a property that belongs to more than one person, everybody that has a right on it must submit a declaration. 2. You will be asked to declare if your property is within a city plan or not. 3. You can submit a declaration (L. 2308/95) in person or via a third party. In case a third party submits your declaration, they must provide a simple authorization document. In case a third party fills in, signs and submits the declaration, then a proxy drawn by a Notary is required.
