Directions Governing Ship Mooring Operations of Taichung Port Promulgated per Order Zong-Gang-Wu-Zi No. 6789 on July 11, 1994. Article 1 To optimize the use of berth areas and increase the port operating efficiency, Port of Taichung Taiwan International Ports Corporation Ltd. (hereinafter shortened as the Branch Office) has specially stipulated the Directions in accordance with Article 23 of Commercial Port Law and Article 11 of Regulations on Port Services at Commercial Ports Article 2 Berth allocation team: in charge of berth allocation related matters. 1. The berth allocation team is formed by harbor master; director of Harbor Management Department; representatives of cargo loading and uploading units, shipping companies and shipping agencies; manager of Vessel Traffic Services (hereinafter shortened as VTS); and VTS duty supervisor. Harbor master is the convener, director of Harbor Management Department is the deputy convener and VTS MANAGER is the executive secretary. 2. Duties of the berth allocation team: (1) Convener: supervising all operations. (2) Deputy Convener: assisting the convener in supervising all operations. (3) Executive secretary: conducting all operations. (4) VTS duty supervisor: assisting the executive secretary in conducting all operations; organize and archive berth related documents (5) Representatives of cargo loading and uploading units: providing supply capacity information, such as information on warehouse capacity, operations, cargo loading and uploading facilities and labor force; and carrying out relevant negotiation and coordination works.

(6) Representatives of shipping companies and shipping agencies: forecasting shipping schedule and providing relevant information. 3. The berth allocation team holds a multilateral conference call every day (except for holidays) to make a berth allocation plan for the next day (or afterwards) according to the berth, ship, cargo loading and uploading, warehouse information. Unless exceptional circumstances, executive secretary, VTS duty supervisor, and representatives of warehouse units, cargo loading and uploading units, shipping agencies. 4. Where negotiation is required due to business needs or matters reported by the participants, the Branch Office related units shall appoint representatives to join the conference call. 5. Berths shall be allocated based on executive secretary provided information such as the ship type, length, draft and depth; the cargo type and quantity; weather; and berth facilities. In the meantime, participants opinions shall also be taken into consideration. Where any significant dispute occurs, convener and deputy convener shall conduct a negotiation to finalize a decision. Article 3 Berth allocation: ships shall enter the port, apply for a prior notice sheet, and commission related parties for harbor operations for berth application. 1. Automatic notification of berth: those who have provided prior notice sheet and all commission related information, and whose qualifications have been approved by the berth automatic response system will receive a notification of berth from the system. 2. Confirmation of berth:

(1) A multilateral conference call takes place every working day from 11:00 am to 11:30 am in the morning for berth negotiation and confirmation. (2) In the conference call made on Monday, Tuesday, Wednesday and Thursday, all berths for the next day until 12:00 pm shall be confirmed. (3) In the conference call made on Friday or on the day before holidays or continuous holidays, all berths until the next working day at 12:00 pm shall be confirmed. Article 4 About port berthing (mooring): 1. Berths shall be allocated according to deep-draft ships at priority, first come first berth, warehouse to warehouse operations and one-stop berthing policies; ships shall berth according to the agreement entered into between the Branch Office and cargo loading / uploading units or other investment and leasing companies; during the rush period, the berthing priority and number of berthing ships shall be decided according to the needs of public sector. However, above conditions shall not be applied in special and emergency circumstances. 2. Types of specialized wharfs are as follows: (1) Wharf 3 is for grain. (2) Wharf 4 is for liquid. (3) Wharf West 1, West 2, West 3, West 4, West 5, West 6, West 7 and West 8 are specialized channels for chemical and oil. (4) Wharf West 9 is for chemicals and bulk-. (5) Wharf West 13 is for liquefied natural gas (LNG). (6) Wharf 21 and 22 are for sand and gravel. (7) Wharf 4A, 27 and 28 are for cement. (8) Wharf 8A is a speedy wharf. (9) Wharf 9 is a deep-draft speedy wharf before being used as a container wharf. (10) Wharf 43 is for heavy, bulk and general. (11) Wharf 9, 10, 11, 31, 32, 33, 34 and 35 are for containers. (12) Wharf 101, 102, 103, 104 and 105 are for coals. (13) Wharf 18 and 19 are spaasener ship wharfs. (14) Wharf 44, 45, 96, 97, 98, 99 and other wharfs are for bulk and

general. In general, specialized ships shall berth in specialized wharfs; before being used according to its approved use, specialized wharfs shall be allocated flexibly. 3. Where the ship berthing extends to the neighboring wharf that is coconstructed or for leasing, the extended length shall be within 50 m. 4. Where ship in port and arrival ship apply for the same berth, and the berth shall be allocated according to the following order: (1) For ships moving from general cargo wharf to specialized wharf, the loading completion time shall be considered as the port arrival time for berth allocation. (2) For ships moving from general cargo wharf to general cargo wharf, berths shall be allocated firstly to ships in port as a priority. (3) For ships moving between specialized wharfs, the loading completion time shall be considered as the port arrival time for berth allocation. (4) For ships moving from specialized wharf to general cargo wharf, berths shall be allocated firstly to ships in port as a priority and based on the actual situation. (5) When specialized wharf is crowded, ships that carry out operations in bulk and general cargo wharf shall have their berths in specialized wharf allocated according to port arrival time. (6) When ships under repair process in port or berthing area apply for loading liquid in west wharf area, the repair completion time reported to VTS plus 6 hours shall be considered as the port arrival time for berth allocation. 5. After berth allocation, ships must not change berth or shift freely. Where a ship that has its berth automatically allocated by dedicated or specialized wharf desires to change berth or move, its respective shipping company or agency shall make relevant amendments through the computer network before the ship enters the port. Any berth change or shift in bulk and general cargo wharf shall be applied to VTS and be notified to pilot office. In the circumstances of emergence, ships may, upon receipt of VTS approval, berth first and submit the application through the computer network afterwards. 6. Where a ship needs to be moved to outside the port for the tank cleaning process or while waiting for a berth, the shipping company or

agency shall make a request in advance and notify relevant units before applying to the Branch Office for a shift. 7. When ships in port apply for a free shift berth, the said shift shall be made in a good weather condition with wind force below 6, and the distance for shifting berth shall not exceed 100 m. It is also a must to notify VTS and Port of Taichung Pilot Office before the shift, and report it to VTS after the shift. 8. The application of double banking shall be limited to one ship only. The ship on the outer side shall be shorter than the ship on inner side. Double berthing operations of chemical tanker in west wharf area shall be carried out in day time only. 9. Ships with special missions as follows will be firstly allocated with berths: (1) Sightseeing ships, passenger ships and regular passenger cargo ships. (2) Ships that plan to hold a ceremony for maiden voyage Article 5 Ship arrival and departure 1. Ships that arrive at or depart port shall truly declare the estimated arrival time, depth of draft, ship length, cargo type and quantity, estimated time of arrival, and number of crew and passengers. The said information will be used as the basis for berth allocation. Any untrue information or false declaration will be handled according to relevant regulations. 2. No ship shall anchor in turning basin, except for those with a special permission (for example, emergency incidents; waiting for special quarantine or examination). Ships with the said special permission shall pay attention to the safety of other ships when anchor and, once the reasons for special permission disappear, immediately berth in designated wharf or leave the port. 3. Gangway net and rat guard shall be placed on the ship after berthing. 4. Ships in port that desire to carry out tank and machine maintenance works in port area shall receive an agreement from the Branch Office. Ships carrying dangerous cargo shall not carry out a maintenance work in port area, and shall complete the maintenance work during the loading and/or uploading process.

5. In principles, ships shall enter the dry dock in day-time. Article 6 Speedy wharfs: 1. Wharf 8A is a speedy wharf 2. Wharf 9 is a deep-draft speedy wharf before being used as a container wharf, and shall be provided firstly to deep-draft speedy ship with draft of 10.5 m to 13.5 m. The order of berthing in deep-draft speedy wharf is as follows: (1) Deep-draft speedy ships. (2) Deep-draft ships; (3) Speedy ships. 3. There are three types of speedy ships: (1) Class A speedy ship: is the first priority and shall complete the loading and/or uploading process within 12 hours. Its level of priority is higher than ships that have arrived in port 48 hours ago. (2) Class B speedy ship: is the second priority and shall complete the loading and/or uploading process within 24 hours. Its level of priority is higher than ships that have arrived in port 24 hours ago. (3) Class C speedy ship: is the third priority and shall complete the loading and/or uploading process within 48 hours. Its level of priority is higher than ships that have arrived in port 12 hours ago. 4. There are three types of deep-draft speedy ship: (1) Class A deep-draft speedy ship: ships that have signed investment and/or leasing contract with the Branch Office will be listed as the first priority and shall complete the loading and/or uploading process within 24 hours. Its level of priority is higher than ships that have arrived in port 48 hours ago. (2) Class B deep-draft speedy ship: is the second priority and shall complete the loading and/or uploading process within 48 hours. Its level of priority is higher than ships that have arrived in port 24 hours ago. (3) Class C deep-draft speedy ship: is the third priority and shall complete the loading and/or uploading process within 72 hours. Its level of priority is higher than ships that have arrived in port 12 hours ago.

5. Speedy ships or deep-draft speedy ships shall complete the loading / uploading and depart the port within the prescribed period and regardless of the weather and any conditions. Those who violate this term will have the right to apply for speedy wharf suspended for two months. 6. Speedy ships shall submit the application and announce the shipping schedule three days before their arrival in port; deep-draft speedy ships shall do so five days before their arrival in port. Their arrival time in port shall be confirmed 24 hours beforehand and any change to berth must not affect speedy ships that have been allocated with a berth; temporary applicant will be allocated with a berth at the last according to the order of speedy ships. 7. Regarding the estimated time of arrival (ETA) at the port, speedy ships that have been late for more than 4 hours from April to September of the year, or 8 hours from October of the year to March of the next year will be deemed as violating the regulation and will no longer hold the right of priority to berth. Those who violate this term will have the right to apply for speedy wharf suspended for one month. 8. Speedy ships that fail to complete the loading and/or uploading within the prescribed time shall shift, if another speedy ship is waiting to berth in that wharf. 9. Where a speedy ship that has been allocated with a speedy wharf cancels the berth, its right to apply for speedy wharf will be suspended for two months. 10. Speedy ships that already arrived at the port shall immediately berth if there is any vacant berth in speedy wharf; those who fail to do so will be banned from applying for speedy wharf for one month. 11. Where there is a vacant berth in deep-draft speedy wharf or speedy wharf, general ships may apply for berthing. However, when a speedy ship needs to berth, the said general ships shall shift at their own expenses. Article 7 Wharf 43 is a heavy, bulk and general cargo wharf: 1. Heavy cargo ship refers to ships with a cargo distributed load of over 3 tons per square meter.

2. Heavy cargo ship is the first priority ship and shall complete the loading and/or uploading within 48 hours. 3. The berth allocation order for Wharf 43 is: (1) Heavy cargo ships; (2) Deep-draft speedy ships; (3) Deep-draft ship; (4) Speedy ships. 4. Heavy cargo ships shall submit the application and announce the shipping schedule seven days before their arrival in port, and shall confirm the port arrival time 24 hours beforehand. Article 8 Wharf 2, 29 and 30 are public bulk and general cargo deep-draft wharfs (shall apply mutatis mutandis to Wharf 9 and 31): 1. In general, public bulk and general cargo deep-draft wharfs are for deep-draft ships (with a draft over 10.5 m) to berth. 2. When a deep-draft ship applies for public bulk and general cargo deepdraft wharf, it shall submit the application and announce its shipping schedule three days before its arrival in port, and confirm the port arrival time 24 hours beforehand in order to have the priority to berth. Those who fail to do so as regulated will have the said right of priority cancelled. 3. Regarding the estimation of port arrival time, deep-draft ships that have been late for more than 4 hours from April to September of the year, or 8 hours from October of the year to March of the next year will be deemed as violating the regulation and will no longer hold the right of priority to berth. Article 9 Wharf 19 is a passenger ship wharf: 1. Generally, passenger ships or passenger cargo ships that are below 186 m in length shall be allocated with a berth in Wharf 19. The same condition may be applied to ships that are 187 m to 230 m long, if the wind force is below Beaufort Scale Number 5; tugboat can be sent depending on the situation; the captain agrees to berth in Wharf 19; and the berthing will take place after the sunrise and before the sunset. 2. Regular cruises of international or domestic lines are the first priority, and non-scheduled cruises of international or domestic lines are the

second priority in terms of berth allocation. 3. After the application of regular cruises are approved, cruises of other passenger ships or passenger cargo ships (including the following regular cruises) shall avoid using the same time-slot or use the spare wharf. Ships of each cruise shall not berth in Wharf 19 for more than 12 hours. 4. When regular cruises change the schedule, it is required to submit a written notification three months prior, except for provisional change that does not affect other passenger ships or passenger cargo ships. 5. When more than two passenger or passenger cargo ships (including supplied warships forecast the time period for non-schedule cruises, the non-scheduled cruises of international line shall be deemed as the first priority. However, the Branch Office may adjust the berth allocation depending on the international customs clearance facilities and its capacity of providing passengers with services. 6. Upon completion of the loading and/or uploading of passengers and/or, passenger or passenger cargo ships shall, if other passenger or passenger cargo ships apply for berthing in Wharf 19, shift as instructed for the applying ships to operate. 7. Regarding the estimation of port arrival time, passenger or passenger cargo ships that have been late for more than 2 hours and resulted in an influence to the operations of the following ship will lose the right of berthing in Wharf 19 and shall berth only in spare wharf. 8. When the shipping schedule of an supplied warships contradicts with that of a passenger and passenger cargo ship, the former shall berth in spare wharf. 9. Apart from allocating a berth depending on the needs of replenishment oilers, the priorities for passenger ship spare wharf are: Wharf 8A as the first priority; Wharf 9 as the second priority; 5A as the third priority. Article 10 Specialized wharfs for cement, coal, grain, sand and gravel : 1. Where a cement, coal, grain, sand and gravel or other specialized ship that carries out the loading and/or uploading operations with machines applies for berthing in specialized wharf, it shall submit the application and announce the shipping schedule seven

days before its arrival in port, and confirm the port arrival time 24 hours beforehand to keep the right of priority to berth. Those who fail to do so will have the said right cancelled. 2. Regarding the estimation of port arrival time, specialized ships that have been late for more than 4 hours from April to September of the year, or 8 hours from October of the year to March of the next year will be deemed as violating the regulation and will no longer hold the right of priority to berth. Their right of priority to berth will also be cancelled. 3. Sand and gravel ships shall berth in Wharf 21 and Wharf 22, whereas Wharf 23 will be the spare wharf. Article 11 Ships that enter the port by awaiting the tide shall immediately conduct the loading and/or uploading operations after the berthing. The said ships must complete floating off before the low tide. Where there is any safety concern, ships must not enter the port. Article 12 Restrictive measures for berth allocation: 1. Cape-size bulk carrier shall not be longer than 300 m and shall have a maximum draft of 14.5 m. 2. Liquefied natural gas (LNG) carriers shall not be longer than 300 m or wider than 50 m, and shall have a maximum draft of 12 m and transportation capacity of 149,000 m 3. 3. Vehicle carriers that are shorter than 160 m shall be allocated with a berth in Wharf 19 or Wharf 15 in principle; those with a length over 160 m shall be allocated with a berth in Wharf 8A. 4. To protect the environment and fulfill the need for holding activities, some wharfs are not available for ships that carry pollutant cargo (that is, that can easily produce dusts and strange smell, such as million iron, coal, coke, silica sand, slag, soda ash, magnesium oxide, wheat bran, rapeseed meal, soybean meal, bulk cement, cement clinker, phosphate fertilizer, refined copper and so on). (1) Ships that transport silica sand may be allocated with a berth in Wharf 9 during summer (from April 1 to September 30 every year) when the weather condition is good, and besides that, ships carrying high-pollutant shall not be arranged with a berth

in Wharf 9 unless necessary. (2) Wharf 31 shall be restricted to pollutant that can easily produce dust and order. (3) Restrictive measures for other wharfs shall be notified by the executive secretary separately. 5. Please refer to Annex 1: Basic Data of Port of Taichung for detailed information of all wharfs, and Annex 2: An Overview of Berthing Limitations of Port of Taichung for restrictive measures of these ports. Article 13 Ship arrival and departure at night 1. Arrival at night (1) Shall be permitted by the weather; the captain and pilot shall negotiate and decide whether to enter the port or not. (2) The captain shall fully understand the weather and hydrology of the port, and the ship shall be equipped with the AIS (automatic identification system) and good radar performance. In this way, the captain will be able to sail the ship to areas close to breakwater shelter at night and let the pilot get on board. (3) The length of bulk and general cargo ships and tankers that do not carry hazardous oil products (non-imo restricted items) is restricted to 200 m in length for berthing in Wharf 1 to Wharf 8 and Wharf 12 to Wharf 25, and 236 m for berthing in other wharfs. (4) Ships that carry chemicals shall not exceed 190 m in length and shall receive the Branch Office s prior consent. (5) Ships will be checked by port state control inspector(s) of Maritime Port Bureau. In case of finding any deficiency, the Harbor Office will be notified and the ship shall not enter the port at night. 2. Departure at night: no restriction except for bad weather or ship condition, or bulk and general ships / dangerous good carrier with a length overall (LOA) of over 260 m. Article 14 Mooring of working vessels 1. Types of working vessels: (1) Construction working vessels: ships that implement engineering works in port areas to fulfill the demand of Port of Taichung. (2) Other working vessels: non engineering working vessels for

loading / uploading engineering materials or machines, supplying, maintenance works, sheltering (for wind or winter), sampling, investigation and so on. 2. Regarding the application of port arrival or departure, working vessels shall conduct relevant regulations according to that of merchant ships. 3. Working vessels may apply for multiple entrances Visa in accordance with Operation Directions Governing Multiple Entrance Visa for All Types of Working Vessels, Tenders and Public Service Ships, Port of Taichung ; working vessels shall receive an approval from VTS before entering and leaving the port. 4. Working vessels towing with floating objects are prohibited to sail in or enter / leave the port without an approval. 5. Where a working vessel enters or leaves the port towing with a barge, both ships shall conduct relevant regulations according to that of merchant ships and specify their relationship in the purpose(s) of entering / leaving the port. 6. Working vessels shall berth in the location appointed by the Branch Office and berth shift shall be conducted only upon receipt of an approval. Construction working vessels may, depending on the project requirements, implement relevant works in project area. However, relevant operations shall be reported to VTS and the ship shall keep in contact with VTS. 7. For the requirements of berth allocation, transportation control, safety and disaster prevention, shipping vessels shall have crew left on board and shall be equipped with communications equipment to check the information of Channel 14 (VHF CH14, 156.7MHz) as regulated. The ship shall also be equipped with the automatic identification system (AIS) and keep the system functioning for 24 hours. 8. Whether in day or at night, working vessels shall show appropriate signs and marks according to International Regulation for the preventing Collision at Sea. 9. Any sewage, oil, mud, trash and other waste produced during the berthing or operations of working vessels shall be collected and handled appropriately, and shall not be freely discharged or abandoned.

Article 15 Where vessels need to enter or leave the port during typhoon period or under emergency incidents, relevant works shall be conducted according to Taiwan International Ports Corporation (TIPC) Regulations Governing the Berthing Operations during the Typhoon Period An Overview of Berthing Operations of Taichung Branch Company and Port of Taichung for Passenger Ships (domestic, international and cross-strait lines), Dangerous Good Carriers, Container Ships, LNG Carriers and Other Ships, Table of Summary on Operating Regulations governing Vessels Entering and Exiting and Mooring/Berthing During Typhoon Period and Regulations Governing the Ships Entering and Exiting and Mooring/Berthing at the Port of Taichung During Typhoon Period. Article 16 LNG carrier relevant procedures shall refer to Port of Taichung Regulations Governing the Port Entrance and Berthing Operations for LNG Carriers. Article 17 Those who violate the Directions will be handled according to relevant regulations and laws. Article 18 The Directions shall be enacted from the date of promulgation. Amendment may be made to any other unspecified matters.
