Conditions of carriage Regulation of the general conditions of carriage for tram and bus transportation as well as regular service by means of motor vehicle dated 27 February 1970, amended by the regulations dated 13 May 1981 and 30 June 1989, last amended by the Act dated 15 October 2002 (Federal Law Gazette I p. 4046). 1 Scope The general conditions of carriage apply to carriage in regular service and special routes with motor vehicles. The responsible authorising body can accept applications for deviations from the provisions in this regulation, taking into account special conditions. These conditions of carriage apply to the Autokraft GmbH KIELIUS. 2 Right to carriage A right to carriage exists if there is an obligation to carry according to the provisions of the German Passenger Transport Act and the legal provisions passed due to this law and if there are sufficient seats available and the safety of the individual guests and the company can be ensured accordingly. With Rail & Fly and Online tickets, the right to carriage only exists if there are sufficient seats available. Property is only carried pursuant to 11 and 12. 3 Persons excluded from carriage (1) Persons who represent a danger to the safety and order of the company or the passengers are excluded from carriage. If these conditions apply, the following persons in particular are excluded 1. Persons under the influence of alcoholic beverages or other intoxicating substances 2. Persons with contagious diseases, 3. Persons with loaded firearms unless they are authorised to carry firearms. (2) Children who do not have to attend school and have not yet celebrated their 6th birthday may be excluded from carriage if they are not accompanied by persons who are at least 6 years old for the entire journey; the provisions in paragraph 1 remain unaffected. 4 Passenger conduct (1) When using the operations facilities and vehicles, passengers must conduct themselves as the safety and order of the company, their own safety and consideration to other persons demand. Instructions by operational employees must be complied with. (2) In particular, passengers are prohibited from 1. Talking to the vehicle driver in buses while the vehicle is moving. 2. Opening the doors without authorisation while the vehicle is moving. 3. Throwing items out of vehicles or allowing items to protrude out of vehicles. 4. Jumping on or off while the vehicle is moving. 1

5. Entering a vehicle that is designated as occupied. 6. Impairing use of operating facilities, passageways, entrances and exits with bulky objects. 7. Smoking in vehicles in which smoking is not expressly permitted. 8. Using sound reproduction devices or radio receivers. Also prohibited are: smoking, transporting objects or carrying out activities that could contaminate vehicles or passengers, harassing fellow passengers, consuming food or drinks during the journey if this inconveniences other passengers. (3) Passengers are only allowed to enter and exit vehicles at designated stops. Passengers must board and alight quickly and move through the vehicle interior quickly. All passengers are required to use a seat in the vehicle. (4) Children must be supervised by their companions. In particular, they are responsible for ensuring that children do not stand or kneel on the seats. Child car seats can be provided if reserved in good time. (5) Passengers must always use the restraint systems and seat belts provided. (6) If a passenger violates the incumbent obligations according to paragraphs 1 to 5 despite warning, the passenger can be refused carriage. (7) In the event of contamination of vehicles or operations facilities by the passenger, the passenger is charged fixed cleaning costs by the company; further claims remain unaffected. The cleaning costs incurred or at least 40.00 must be paid. In the event of damage to vehicles or operations facilities, the passenger is charged the repair costs plus contingency costs. (8) Complaints should include date, time, carriage and route number as well as the ticket where possible and should be sent to the company administration at: Autokraft GmbH, Bunsenstr. 2, 24145 Kiel or to e-mail address kielius@deutschebahn.com (9) Improper use of safety equipment results in a charge of 100.00 notwithstanding criminal or summary proceedings and further civil claims. 5 Allocation of carriages and seats (1) The operational employees can assign passengers to specific carriages if this is required for operational reasons or in order to fulfil the obligation to carry. (2) The operational employees are authorised to assign passengers to seats if required. 6 Fares, tickets (1) The stipulated fares must be paid for carriage. Ticket types can be found in the tariff regulations. (2) If a passenger does not have a valid ticket for this journey when boarding the vehicle, the passenger must purchase the required ticket immediately and without being asked. If the passenger has a valid ticket, the passenger must show this to the driver without being asked during controlled boarding. 2

(3) If the passenger boards the vehicle with a ticket that requires validation, the passenger must immediately hand over the ticket to the operational employees for validation without being asked. (4) The passenger must keep the ticket until the journey has been completed and must show and hand over the ticket to operational employees on request for checking. (5) If the passenger does not comply with an obligation as per paragraphs 2 to 4 despite being asked to do so, the passenger may be refused carriage; the obligation to pay a penalty fare as per 9 remains unaffected. (6) Ticket complaints must be raised immediately. Subsequent complaints will not be taken into account. 7 Means of payment (1) The fare shall be kept ready in exact change. (2) If the on-board staff cannot provide change, the passenger is issued a receipt for the amount retained. It is the passenger s responsibility to collect the change from the company administration by presenting this receipt. If the passenger does not accept this arrangement, he must discontinue the journey. (3) Complaints regarding change or the receipt issued by the on-board staff must be raised immediately. 8 Invalid tickets (1) Tickets that are used contrary to the specifications of the conditions of carriage or the transport tariff are invalid and will be confiscated; this also applies to tickets that 1. Are not filled out correctly and despite a request are still not filled out immediately. 2. Are torn, cut or badly damaged in another way, very dirty, laminated or illegible meaning that they can no longer be checked. 3. Have been modified without authorisation. 4. Are used by unauthorised persons. 5. Are used for journeys other than those permitted. 6. Have expired due to effluxion of time or other reasons. 7. Do not exhibit an affixed validation stamp. 8. Are used without the required photograph. In these cases, the fare paid is not reimbursed. (2) A ticket that only authorizes carriage in conjunction with an application or a valid photo ID designated by the transport tariff is invalid and can be confiscated if the application or the valid photo ID are not presented on request. (3) Students must present their student transit pass and a valid photo ID. 9 Penalty fare (1) A passenger is obligated to pay a penalty fare if he 1. Has not purchased a valid ticket. 2. Has purchased a valid ticket but cannot present this in the event of a check. 3. Has not validated the ticket or has not had the ticket validated or has not done so immediately for the purposes of 6 paragraph 3 or 3

4. Does not present or hand over the ticket for checking on request. Criminal or summary proceedings remain unaffected. The provisions under numbers 1 and 3 are not applied if the purchasing or validation of the ticket was not possible for reasons outwith the passenger s control. (2) In the cases in paragraph 1, the company owner can charge a penalty fare of 60.00. However, he can charge twice the fare for a one-way trip for the route taken by the passenger if this is a higher amount than the penalty fare in sentence 1; if the passenger cannot prove the route taken, the penalty fare is calculated using the start point of the route. (3) In the event in paragraph 1 point 2, the penalty fare is reduced to 7.00 if the passenger can prove to the administration of Autokraft GmbH, Bunsenstr. 2, 24145 Kiel within a week of the date of detection that the passenger held a valid personalized time-based pass at the time of detection. (4) Further company claims remain unaffected if invalid time-based passes are used. 10 Fare reimbursement (1) If a ticket is not used for a journey, the fare is reimbursed on application upon submission of the ticket. The passenger is responsible for proving that the ticket has not been used. (2) If a ticket is only used for part of the route, the difference between the paid fare and the fare required for the route covered is reimbursed on application upon submission of the ticket. The passenger is responsible for proving that the ticket was only partially used. (3) If a time-based pass is not used or is only partially used, the fare for the time-based pass minus the fares for the individual journeys made is reimbursed on application upon submission of the ticket. In order to identify the point in time by which the individual journeys (two journeys per day) are considered to be completed, it is the day on which the time-based pass is returned or deposited or the date of the postage stamp on the consignment of the time-based pass by post that is significant. An earlier point in time can only be considered if a certificate from a doctor, hospital or health insurance company is submitted certifying an illness, accident or death of the passenger. When deducting the fare for the individual journeys made, a reduction is only used if the required conditions apply, otherwise the fare for a one-way trip is used. (4) Applications according to paragraphs 1 to 3 must be made to the administration of Autokraft GmbH, Bunsenstr. 2, 24145 Kiel immediately, within one week of ticket validity expiring at the latest. (5) A processing fee of 2.00 and a possible transfer fee are deducted from the amount to be reimbursed. The processing fee and a possible transfer fee are not deducted if the reimbursement is applied for due to conditions that are the responsibility of the company owner. (6) In the event of exclusion from carriage, there is no right to reimbursement of the paid fare except 3 paragraph 1 sentence 2 point 2. (7) With the Rail & Fly ticket, use of KIELIUS is an additional offer, meaning that if the ticket is not submitted, there is no reimbursement after travel commencement. 4

11 Carriage of property (1) There is no claim to carriage of property and objects. Hand baggage and other items are only carried in the vehicle interior at the same time as the passenger if they do not put the safety and order of the company at risk and do not inconvenience other passengers. (2) Dangerous substances and dangerous objects are excluded from carriage, in particular 1. Explosive, highly flammable, radioactive, malodorous or corrosive substances. 2. Loose or exposed items that could injure passengers. 3. Bulky items such as bicycles and water sports equipment (e.g. surfboards). 4. Items that protrude outside of the perimeter of the carriage. (3) It is not permitted to carry infants in pushchairs. Child car seats can be provided if reserved in good time. The pushchairs are transported in the luggage compartment. Where possible, operational employees should ensure that passengers with infants are not turned down. The decision regarding whether they can be transported lies with the operational employees. Otherwise, carriage conforms to the provisions of 2 sentence 1. (4) The passenger must stow and supervise luggage so that the safety and order of the company is not put at risk and other passengers are not inconvenienced. (5) The operational employees decide on a case-by-case basis whether items are permitted for carriage and where these should be stowed. No fees are charged for the carriage of hand baggage and pushchairs or other passenger property. The charge for the carriage of bicycles and water sports equipment (e.g. surfboards) which must be packed is 5.00/bicycle regardless of the distance travelled; the fee for the carriage of animals corresponds to the price of a child s ticket. As a general rule, the passenger is responsible for his own luggage, etc. Suitcases and other large items are transported in the luggage compartment provided for this purpose. Liability is excluded in all cases. This excludes instances of intent or gross negligence. 12 Carriage of animals (1) 11 paragraphs 1, 4 and 5 applies to the carriage of animals. (2) Dogs are only carried when supervised by a suitable person. Dogs that pose a risk to fellow passengers must wear a muzzle. Dogs that are by race fighting dogs are excluded from carriage. (3) Carriage of guide dogs accompanying a blind person and therapy dogs (entered in the disabled person s pass under B in both cases) is always permitted. (4) Other animals may only be transported in suitable carriers. (5) It is not permissible to place animals on seats. 13 Lost property According to 978 of the German Civil Code (BGB), lost property must be handed over to the operational employees immediately. It is permissible for the operational employees to return the property to its owner immediately if this person can clearly identify themselves as the owner. The owner must confirm receipt of the item in writing. Lost property is returned to the owner by the company s lost property office in exchange for payment of a storage fee. No liability is assumed. 5

14 Liability The company owner is liable for the death of or injury to a passenger and for damage to property that the passenger carries or transports in line with the generally applicable provisions. For damage to property, the company owner is only liable up to the maximum amount of 1200.00 for each person carried. The liability limit does not apply if the damage to property is caused by intent or gross negligence. The company owner is not liable 1. In the event of damage caused by property or animals transported by a passenger. 15 Statute of limitations (1) Claims from the contract of carriage fall under the statute of limitations after two years. The statute of limitations starts on emergence of the claim. (2) Otherwise, the statute of limitations conforms to the general provisions. 16 Exclusion for compensation claims Deviations from timetables as a result of traffic obstructions, disruption to or interruption of operations and insufficient space do not justify compensation claims; in this respect no liability is taken for catching connections. The company is not liable for mistakes in the timetable or for the issuing of incorrect information or the cancellation of journeys if it is not responsible for the cancellation. 17 Place of jurisdiction The place of jurisdiction for any legal disputes resulting from the contract of carriage is the company s registered office. 6
