Management, LLC ( Resilient ) s Motion (the Motion ) for Permission to Participate in the Confirmation Hearing, dated April 19, 2010 [Docket No. 2004] (the OCC Objection ). The SFI Noteholders also object to the Motion of Resilient Capital Management, LLC for an Order Shortening Notice Relating to Resilient Capital Management LLC s Motion for Permission to Participate in the Confirmation Hearing, dated April 15, 2010 [Docket No. 1991] (the Motion to Shorten ). The SFI Noteholders submit that there is no basis for shortening notice here. During the March 26, 2010 telephonic conference with this Court, Resilient raised the issue of presenting an expert in opposition to the plan. (Mar. 26, 2010 Tr. at 32) The Court made it clear that the Scheduling Order previously entered was still in place. (Id. at 42) Such Scheduling Order provided, among other things, that expert reports were due on February 5, 2010 and rebuttal reports were due on February 12, 2010. In light of Resilient s decision not to comply with the Scheduling Order s deadlines, the Court found that Resilient did not have a seat at the table and stated that it was not prepared to hear any evidence from Resilient s expert. (Id.) The Court stated, however, that it would be willing to reconsider such finding and permit Resilient to participate substantively if Resilient filed a motion explaining why such permission would be appropriate. (Id.) The Court also scheduled the confirmation hearing to take place on April 28, 2010. (Id. at 43) Instead of moving promptly, Resilient waited nineteen days, until April 14 (two weeks before confirmation), before filing the Motion. Accordingly, any exigencies that currently exist with respect to the Motion are of Resilient s own making. While Resilient claims that it could not submit the Motion until it completed its expert report, it provides no explanation why it could not prepare an expert report until April 8, 2010, particularly in light of the fact that it had the time to monitor fifteen fact depositions taken in this case in January, as well as one of the NEWYORK 7621156 (2K) 2
expert depositions taken in February. Accordingly, the SFI Noteholders submit that there is no reason why notice should be shortened here. For the reasons set forth above and in the OCC Objection, the SFI Noteholders respectfully request that the Motion and the Motion to Shorten be denied in their entirety. To the extent that the Court is inclined to grant either motion, the SFI Noteholders respectfully request that such determination be made as quickly as possible so that the SFI Noteholders will have an opportunity to depose Resilient s expert in advance of the confirmation hearing scheduled to take place next week.
