( Cisco ) and NETGEAR, Inc. ( NETGEAR ) have continued their negotiations with Innovatio IP Ventures, LLC ( Innovatio ) to resolve this litigation and have exchanged drafts of proposed settlement agreements. The parties expect to conclude their negotiations shortly. Innovatio and Hewlett Packard Company ( HP ) are continuing their settlement discussions. The parties will be prepared to provide the Court with an update during the upcoming hearing. Those Customer Defendants represented by Kirkland & Ellis LLP, which are listed on the attached Exhibit A ( KE Customers ), have provided Innovatio with a draft settlement agreement that is consistent with the terms discussed by the parties during and following the December 9, 2013 status conference. The KE Customers are awaiting revisions from Innovatio, if any, and anticipate resolving and dismissing their respective actions shortly. Lowe s Home Center s ( Lowe s ) sent a letter to Innovatio on December 31, 2013, outlining Lowe s current inventory of wireless products and offering to pay the Court s RAND rate for all unlicensed products from parties other than Manufacturer Defendants in this case (i.e. Motorola and Cisco). Lowe s confirmed on January 3 that this information could be provided to Innovatio for purposes of settlement discussions. Innovatio is reviewing Lowe s letter and will respond shortly. 1
