Advice that would not be supportive of continuing the centre line marking into the skate park as it could create safety issues and potential traffic collisions. 85 Great Ocean Road, Aireys Inlet Copies of correspondence from rigbycooke to VCAT, together with copies of expert witness statements from Jason Walsh, Traffic Engineer at Traffix Group and Tim McBride-Burgess of Contour Town Planners. Their conclusions are: 1. Jason Walsh - The extension of the restaurant, incorporating an additional 30 seats, has a statutory requirement to provide for 12 car spaces. - Based on survey data, there were never fewer than 28 available car spaces in the vicinity of the site, suitable for patrons of the proposed use. The parking surveys demonstrate that the availability of car parking would comfortably accommodate the projected increase in car parking demands. (TO BF)

Tim McBride-Burgess - The proposal represents a suitable town planning outcome having regard to the applicable planning controls and policies. - He supports the proposal. A summary of the opinions upon which the conclusion is based states: - The review site is located within a designated commercial precinct within the Aireys Inlet township. - The use of the land as a restaurant is as-ofright in the Business 1 zone. - The review site is separated from any residentially zoned land. - The introduction of the restaurant use fronting the Great Ocean Road will increase activity and interest within the surrounding commercial precinct. - The proposal will not result in a net increase in the number of licensed premises within the surrounding area. - The proposal will not result in a saturation of similar licensed premises. - The extended licensed restaurant area and additional patrons will not cause an unreasonable detrimental impact to the surrounding area. - The hours of operation are limited to standard restaurant hours. Notification of intersection modification at the intersection of Federal Street and Lighthouse Road to commence on 20/5/13. Vehicle access parking Painkalac Lane Letter providing the background to usage of the laneway and that in recent times the role of the laneway for low speed vehicle movement to access parking has been confirmed via planning permit 12/0349 for 83 GOR. The laneway can be accessed by traffic until the benefits/negative impacts of closing the laneway are determined in the context of the parking studies. The conclusions were: - The development will generate an additional car parking demand for 6 spaces during the day and 19 spaces of an evening. - Available parking, supplemented by the provision of the proposed additional car parking adjacent to the skate park, would adequately accommodate the projected car parking demands. - Should the Tribunal be of the view that it is inappropriate to account for the Council proposed additional parking, then it would be equitable to reduce the proposed number of seats from 52 to 40. - There are no traffic engineering reasons why a planning permit for the proposed residential development should be refused, subject to appropriate conditions.
