AIDA COMMITTEE MEETING FRIDAY 2 AUGUST 2013 CORRESPONDENCE REPORT CORRESPONDENCE IN NO DATE SOURCE DESCRIPTION ACTION RECEIVED 1 7/5/13 Susan Lewis Amendment C78 Advice that the Panel report on C78 has been received and recommendation of the Panel is that Council adopt the Amendment subject to some changes. Report will be available for public inspection as from 8/5/13. 2 9/5/13 Libby Coker Painkalac Creek Car Access Acknowledgement of receipt of AIDA letter and advice that it has been forwarded to the relevant departments. Written response to be provided in 3 9/5/13 Aoife Corcoran 4 10/5/13 Peter McLean 5 16/5/13 Aoife Corcoran 6 16/5/13 Rigby/cooke Lawyers 14 working days. Landscaping at Aireys Inlet Top Shops Copy of letter regarding complaints about the poor visibility at the intersection of Albert Avenue and the Great Ocean Road. Request for AIDA s comments on the proposal to replace the existing medium height grasses with low storey plants. Aireys Inlet Lighthouse Precinct Signage Advice of the actions agreed to following a review of the signage audit on 10/5/13. Confirmation that all relevant correspondence will be sent to BF, AP, MJG and FW. Advice that would not be supportive of continuing the centre line marking into the skate park as it could create safety issues and potential traffic collisions. 85 Great Ocean Road, Aireys Inlet Copies of correspondence from rigbycooke to VCAT, together with copies of expert witness statements from Jason Walsh, Traffic Engineer at Traffix Group and Tim McBride-Burgess of Contour Town Planners. Their conclusions are: 1. Jason Walsh - The extension of the restaurant, incorporating an additional 30 seats, has a statutory requirement to provide for 12 car spaces. - Based on survey data, there were never fewer than 28 available car spaces in the vicinity of the site, suitable for patrons of the proposed use. The parking surveys demonstrate that the availability of car parking would comfortably accommodate the projected increase in car parking demands. (TO BF)

7 16/5/13 Mark Gibbons 8 20/5/13 Libby Coker 9 23/5/13 Susan Lewis - There are no traffic engineering reasons why a planning permit for the proposed residential development should be refused, subject to appropriate conditions. 2. Tim McBride-Burgess - The proposal represents a suitable town planning outcome having regard to the applicable planning controls and policies. - He supports the proposal. A summary of the opinions upon which the conclusion is based states: - The review site is located within a designated commercial precinct within the Aireys Inlet township. - The use of the land as a restaurant is as-ofright in the Business 1 zone. - The review site is separated from any residentially zoned land. - The introduction of the restaurant use fronting the Great Ocean Road will increase activity and interest within the surrounding commercial precinct. - The proposal will not result in a net increase in the number of licensed premises within the surrounding area. - The proposal will not result in a saturation of similar licensed premises. - The extended licensed restaurant area and additional patrons will not cause an unreasonable detrimental impact to the surrounding area. - The hours of operation are limited to standard restaurant hours. Notification of intersection modification at the intersection of Federal Street and Lighthouse Road to commence on 20/5/13. Vehicle access parking Painkalac Lane Letter providing the background to usage of the laneway and that in recent times the role of the laneway for low speed vehicle movement to access parking has been confirmed via planning permit 12/0349 for 83 GOR. The laneway can be accessed by traffic until the benefits/negative impacts of closing the laneway are determined in the context of the parking studies. Amendment C78 Advice that Council will consider the report of the Panel and recommendation to adopt the Amendment with changes on 25/6/13 at the Chambers.

10 24/5/13 Jason Walsh TraffixGroup 11 27/5/13 Susan Lewis 85 Great Ocean Road Copy of Statement from the TraffixGroup in support of the application to VCAT. The conclusions were: - The development will generate an additional car parking demand for 6 spaces during the day and 19 spaces of an evening. - Available parking, supplemented by the provision of the proposed additional car parking adjacent to the skate park, would adequately accommodate the projected car parking demands. - Should the Tribunal be of the view that it is inappropriate to account for the Council proposed additional parking, then it would be equitable to reduce the proposed number of seats from 52 to 40. - There are no traffic engineering reasons why a planning permit for the proposed residential development should be refused, subject to appropriate conditions. Amendment C78 Advice that the Panel has released an addendum to the Panel Report which will be available for public inspection on 27/5/13. Advice that GJ s comments on the plant species 12 6/6/13 Petar Zivkovic would be forwarded to Aoife. 13 6/6/13 As Above Information about the bollards and rope fence for the Aireys Inlet to Fairhaven link. Information about the plant species Goodinia Ovata which is to replace the grasses at the top shops 14 6/6/13 VCAT 85 Great Ocean Road Advice of VCAT s decision. The application is to be allowed subject to amendments: - Permit allows buildings and works associated with alterations to the existing building; use for commercial display area and the sale and consumption of liquor in association with restaurant and a waiver in on-site car parking. Amended conditions in the permit: - Condition 5: Tables and chairs must be placed in position on the licensed premises to as to be available for at least 75% of patrons attending each of the first floor and ground floor areas of the licensed premises at any one time - Condition 6: No more than 82 patrons are permitted at the licensed premises at any one time. - Condition 9: All external windows and doors of the licensed premises facing the Painkalac Creek reserve and the Great Ocean Road must be fully closed from 10 pm each day.
