Rule Making Activity The statutory power to make Civil Aviation Rules rests with the Minister of Transport under Part 3 of the Civil Aviation Act 1990. The CAA is contracted to the Ministry of Transport to develop rules for the Minister. Under the contract the Minister of Transport approves a programme of new rules, and changes to existing rules for the financial year. The programme is based on the CAA proposals and proposals from other interested parties. See Summary of Rule Development Projects attached. Notification of Emergency Rules Under section 31 of the Civil Aviation Act the Director may make emergency Civil Aviation Rules as may be necessary to alleviate or minimise any risk of the death of or serious injury to any person, or of damage to any property. Nil Notification of Ordinary Rules Nil 4

Pending Rules Pending rules are those rules which have been signed by the Minister of Transport and will come into force on the prescribed date. These rule amendments can be viewed on the CAA web site, www.caa.govt.nz, under Rules Development and Pending Rules. Nil Draft Final Rules Draft final rules are reviewed by the Ministry of Transport before being referred to the Minister of Transport for his consideration and signature. Although editorial changes may be made to draft finals rule prior to being signed by the Minister, the technical requirements are unlikely to change. The following draft final rules have been forwarded to the Ministry for review: NPRM 10-04 Part 125 Training and Competency Docket 10/CAR/1 This Draft Final Rule was submitted to the Ministry of Transport on 27 February 2013. The purpose of this rulemaking proposal is to: review and update various requirements in Subpart H of Part 125, regarding crew member requirements; review and update the requirements of Subpart I of Part 125, regarding training and training programmes for crew members; and review and update the requirements in Subpart J of Part 125, regarding crew member competency programmes and checks. Notice of Proposed Rule Making (NPRM) The following notices of proposed rulemaking are available on the CAA web site, www.caa.govt.nz under Rules Development. They will either be under the subheading of Notices of Proposed Rule Making (NPRMs) Open for Submissions or if the submission period has expired, Notices of Proposed Rule Making (NPRMs) Closed for Submissions. Submissions received to these NPRMs are reviewed by the CAA and responded to. A summary of public submissions for each NPRM is prepared and notified in the CARRIL and published on the CAA web site under Notices of Proposed Rule Making (NPRMs) Closed for Submissions. NPRM 09-02 Part 61 Review Stage II Pilot Licences and Ratings Docket 4/CAR/4 (Closed for submissions) The purpose of this rulemaking proposal is to update Part 61 as follows: Revise the structure of Part 61 to improve clarity Introduce PPL (balloon) and CPL (microlight) and associated ratings Introduce new ratings for agricultural aviation pilots Revise requirements for English language proficiency Reorganise the system of ratings (and introduce authorisations ) Revise and clarify requirements for flight tests Revise and clarify requirements for flight instructor ratings Introduce requirements for mountainous terrain training Revise instrument rating, flight time logging, and co-pilot requirements Revise requirements for written exams, including higher pass-marks 5

The proposal includes consequential amendments to Parts 1, 91, 103, 133 and Part 137. The NPRM was published on the CAA website 29 November 2012 for public consultation. The submission period closed on 01 February 2013. The CAA is preparing a summary of submissions and when completed it will be published on the CAA website. NPRM 11-02 Part 139 Aerodromes Certification and Operation Docket 8/CAR/3 (Closed for submissions) Notice of Proposed Rule Making (NPRM) 11-02 was issued for public consultation on 15 March 2012. Submissions have been received and are being considered. When the summary of submissions is completed it will be made available on the CAA web site. The purpose of this rule-making proposal is to improve safety at all New Zealand aerodromes through the expansion of certification and operational requirements. This proposal incorporates: A complete review of Part 139. A certification framework that extends to aerodromes that support scheduled aircraft having a certified seating capacity of more than 9 passengers, and general aviation aerodromes having flight movements above specific thresholds, and Requirements for all aerodromes published in the Aeronautical Information Publication (AIP), including those not requiring certification, to meet minimum standards for aerodrome design, limitations, public protection, movement data reporting, and publication of aerodrome information. These requirements also extend to unpublished aerodromes if deemed necessary in the interest of safety, and Provision of Air Traffic Services (ATS) consistent with CAA policy, and Additional measures for the protection of Air Traffic Services (ATS), and Requirements for maintaining good runway surface friction characteristics and standardised realtime runway surface condition reporting, and Introduction of a new aerodrome rescue fire fighting category and a requirement for an expanded rescue fire fighting communication and alerting system, and Relocation of minimum standards contained in advisory circulars into the rule, and Updated International Civil Aviation Organization (ICAO) standards and recommended practices (SARPs) and international best practice. This proposal included consequential amendments to Rule Parts 1, 121, 125, and 129. Submissions closed Friday 29 June 2012. The CAA is preparing a summary of submissions and when completed it will be published on the CAA website. Rule Development Omnibus 2013 Docket 13/CAR/1 This amendment will correct editorial errors and minor technical matters that are: not a policy change, have no significant cost or safety impact, are not contentious, and have little or no regulatory impact. The final draft of the NPRM has been reviewed internally by the relevant technical groups, and is now undergoing legal review. 6

The NPRM final draft is being refined with new items added to the list. Policies will be clarified to form a firmer base as to the determination of the omnibus items. ICAO Equipment Compliance Docket 8/CAR/7 This project will update various rules in Part 91, Part 121, Part 125, and Part 135 by aligning the aircraft equipment requirements with current ICAO standards and recommendations, as well as corresponding equipment requirements of other national aviation authorities. The CAA proposes to update the equipment requirements for international commercial air operators with regards to IFR pressure sensitive altimeters, forward looking wind shear warning systems, IFR/Night single pilot operations, and aircraft landing lights. The CAA further proposes to amend the equipment requirements and specifications for flight data recorder and cockpit voice recorder systems, flight data recorder parameters, LOC/VOR receiver FM broadcast station interference immunity, and ACAS II for certain Part 91 turbine-engine aeroplanes. A draft NPRM has been prepared, along with a draft regulatory impact statement. The draft NPRM is undergoing review and refinement within the CAA and Ministry of Transport. In addition, an industry survey is being developed to quantify anticipated costs associated with the proposed amendments. The survey will accompany the NPRM when it is published. The survey questions are undergoing review. Once the survey content is complete, it will be sent to the relevant aviation organisations. Safety Management Systems Group 1 Docket 8/CAR/1 The objective of this project is to establish new rules in Parts 119, 139, 145 and 172 requiring operators certificated under these rule parts to implement a safety management system appropriate to the size and scope of the organisation. Work on the draft NPRM has paused pending further policy work being developed by the Ministry of Transport and the CAA. In the meantime, an advisory circular has been developed and will be published on the web site on a dedicated page along with supporting material. The following background documents are also available on the CAA web site: Project Scope Statement Rule Design Document Project Working Group minutes for the meetings held on 4 Aug 2009 and 23 June 2010 Advisory Circulars Advisory Circulars Published AC65-7.1 Revision 2, AC65-7.2 Revision 2, and AC65-7.3 Revision 2, Air Traffic Service Personnel Licences and Ratings, Docket 13/ACR/3. These revisions were published on the CAA web site on 05 February 2013. The revisions insert a revised Appendix A to the respective advisory circulars which present the respective syllabus in the objective performance verb format. Advisory Circulars under Development AC91-16 Rules of the Air and General Operating Rules Normally Aspirated Piston Engine TBO Escalation Procedures Docket 8/ACR/34 This new advisory circular will provide procedures for the escalation of piston engines beyond the manufacturers recommended TBO. A draft was published on the CAA web site for comment on 26 April 2010. Comments closed 30 June 2010 and a final draft is being prepared. 7

AC43-1 Aircraft Maintenance Docket 6/ACR/14 This advisory circular is being significantly revised to reflect recent changes to Part 43 rules. A revised draft was published on the CAA web site for comment and comments are currently being reviewed. AC145-1 Aircraft Maintenance Organisations, Revision 5 Docket 9/ACR/22 This is a significant revision to this advisory circular and will include updating to incorporate relevant rule amendments since 2007. A draft is being developed and will be published on the CAA web site for comment. AC91-4 Reduced Vertical Separation Minima, Revision 2 Docket 10/ACR/16 This revision will update the CAA procedures for RVSM approvals. AC61-18 Pilot Licences and Ratings Flight Instructor Ratings, Revision 6 Docket 8/ACR/44 This revision will amend the experience requirements for the Category E Flight Instructor rating, and update details of the approved instructional techniques course. AC121-4 Training and Assessment of Human Factors and Crew Resource Management, Revision 0 Docket 10/ACR/22 This new advisory circular will provide a means of compliance for operators to meet the proposed rules for training flight crew and cabin crew members in human factors and crew resource management. Additionally it will provide a means for operators to assess the competence of instructors and flight examiners in assessing non-technical skills. An initial draft has been prepared and has undergone legal review. Comments arising from that review are undergoing a management review before being published for public comment. AC121-5 Automated External Defibrillators, Revision 0 Docket 10/ACR/25 This new advisory circular will provide an airline operator with guidance in carrying out a risk assessment on the need for automated external defibrillators (AEDs) for their air operations. An initial draft has been prepared and is being internally reviewed before being published for public comment. AC21-7 Light Sport Aircraft-Manufacturer s Requirements, Revision 0 Docket 10/ACR/6 This new advisory circular will provide guidance for a light sport aircraft manufacturer to achieve certification of the aircraft. A final draft is under review. AC21-4 Special Category-Amateur-Built Aircraft Airworthiness Certification, Revision 2 Docket 9/ACR/1 This is a major revision to align the advisory circular with recent rule amendments to Part 21 and Part 91. AC121-1 Air Operations-Large Aeroplanes-Extended Diversion Time Operation, Revision 1 Docket 8/ACR/35 This revision has been developed to support the revised rules governing aeroplane diversions greater than 60 minutes flight time from an adequate aerodrome. The revised rules encompass the operation of all turbine powered multi engine Part 121 aeroplanes, and replace the previous ETOPS rules which applied only to extended range operations in twin turbine engine aeroplanes. Final draft being further reviewed to assess whether recent ICAO Standards and Recommended practices require incorporation. AC119-3 Air Operator Certification-Part 135 Operations, Revision 6 Docket 11/ACR/15 This revision will revise and correct an error in the Landing P-Charts. 8

AC21-9 Airworthiness Certificates-Special Category-Light Sport Aircraft, Revision 0 Docket 10/ACR/4 This is a new advisory circular that will provide an acceptable means of compliance to an applicant for the issue of an Airworthiness Certificate-Special Category-Light Sport Aircraft. A final draft is under review. AC43-7 General Maintenance Rules-Calibration of Compasses and Surveying Compass Swing Sites, Revision 2 Docket 11/ACR/18 This is a general revision and also includes electronic compass calibration. An initial draft is being developed. AC115-1 Revision 0 Adventure Aviation-Certification Docket 12/ACR/3 Draft published for comment on the CAA web site 14 December 2012. Comments closed 31 January 2013 and are being reviewed. Draft prepared for consultation including material to support pending drug and alcohol requirements. Comments incorporated from the legal review and final review being conducted by management in light of experience gained from initial certification approvals. The revised draft will undergo a further final legal review before a draft is published on the CAA web site for comment. Comments following the legal review are being reviewed and are in the process of being incorporated into a revised draft. An initial draft has been prepared and is undergoing a legal review before being published on the CAA web site for comment. This is the first in a series of new advisory circulars being developed to support the Part 115 adventure aviation rulemaking. AC61-3 Revision 19, Pilot Licences and Ratings Private Pilot Licence Docket 12/ACR/1 A final draft is being prepared for sign-off.
