Minutes of the last meeting 15/89P The minutes of the last Planning Committee meeting on 14 July 2015 were approved and signed as correct. Proposed by Cllr Trebilco seconded by Cllr Burtenshaw. 6 in favour. 4. Matters Arising 15/90P 14/141P NFDC Enforcement investigation EN/13/0493 Linbrook Lake West; officer has advised a further complaint has been received this year and the cases will be merged under EN/15/0069. A planning application has been received for the meeting on 8 th September. 14/159P - North Ibsley Lakes; the width reduction of the bell mouth junction as per the approved scheme has been completed. 15/86P Picket Post parking on verge. The clerk has received correspondence from Burley Parish Council relating to the continued parking on the verge at Picket Post, their suggestion is for the Highways Agency to hard surface the verge in order to provide safe parking HGVs are currently parking on the two way road. Clerk has sent a letter and email to Highways Agency to request a joint onsite meeting (Cllr Spark will happily attend). Chairman Planning Committee 1 11 August 2015

5. Public Forum none 6. Development control and TPO applications: Please note: applications are minuted in the order they were discussed. 15/91P NFDC 15/11022 Hamer Warren Landfill Site, Somerley removal of condition 1 of PP 12/99086 to allow continued use of land for model aeroplane flying. Cllr Errington took the chair. Cllr Spark explained the location, showed aerial photos and maps of the flying zone and no-fly zone. During discussions it was established that:- - The previous application granted had a condition for it to be a temporary permission for two years to enable the activities to be monitored and reviewed. This application is to remove that condition. Cllr Stainton-Burrell arrived at 7.42pm. - The current permitted flying zone should prevent flying over the public footpath and a neighbour s paddock to the east of the no fly zone. - The nearest property is approx. 500m to the east of the fly zone. - The manager of the flying club, Darren, advised there are 16 members of the club, who are generally retired, and no more than 3 fly at the same time. He brought along an aircraft to demonstrate the noise of one running at full power. He advised how it is difficult to control an aircraft from a great distance, and indicated a pilot would not want his aircraft more than 50-75m away as the visibility is seriously reduced. - A resident has complained that aircraft have been flown over his paddock and conservatory, which is clearly out of the permitted flying zone, however no complaints or evidence have been made directly to NFDC. - Other residents have noted aircraft flying over the footpath to the north of the permitted flying zone. The following concerns were raised:- - The resident s complaints of aircraft being flown over his home and how to mitigate these issues. It was suggested the runway could be moved further south in order to stop the flying over the footpath and the pilots field shelter be re-sited to the lower part of the X runway, as this would then adjust their flying pattern. Note: this minute should read The Resident s complaints of aircraft being flown over the corner of their paddock. Updated on 6 October 2015. It was proposed to recommend refusal under option 2 to NFDC, with the following comments:- - The Parish Council would prefer for the condition to remain in order for the activities at this site to be monitored for a further 2 or 3 years. - The Parish Council are happy to work with the flying club to produce a flying area and acceptable conditioning that would reduce the impact of the club on local residents and users of the footpath in order for the applicant to resubmit. Seconded, 6 voted in favour, 1 against. The Chairman resumed as Chair and brought forward the following agenda item 7. Agenda item 7 - Consider Application for a Certificate of Lawful Development for Existing Use (LDCE): 15/92P Chairman Planning Committee 2 11 August 2015

NPA 15/00533 LDCE Newlands Farm, Moyles Court, Rockford application for a Certificate of Lawful Development for existing use of a dwelling in breach of Condition 1 (Agricultural Occupancy) of PP RFR 10608. Having shown the location and aerial maps of the site and dwelling (to the north of the barns), Cllr Errington advised that Newlands Farm bungalow had been granted permission in 1965 to facilitate agricultural activities at the farm, as an exception to the Green Belt policy in place at that time. The permission had been conditioned: 'Occupation of the dwelling shall be limited to a person employed or last employed in agriculture as defined in Section 221(1) of the T&CP Act 1962, or in forestry, or the dependant of such a person.' In her Statutory Declaration, Mrs Karen Smith (previously Warn) states that she purchased Newlands Farm in 1995. She moved out of the bungalow in 2000/2001 and lived near Wimborne thereafter. Following retirement from his occupation as a welder, Mrs Smith's father, Mr Ronald Cox, moved into the bungalow in 2001 and has lived there continuously on his own since then. He does not have any employment connection with the businesses at Newlands Farm, bar being available to oversee it at night. Statutory Declarations from others are submitted in support of these statements. Mrs Smith further states that her main business is running the equestrian livery in the buildings (barns), which she says is not an agricultural activity. The (Symonds and Sampson) Planning Statement contends that Condition 1 (Agricultural Occupancy) has been in breach for more than 10 years and that, arguably, has been in breach since Newlands Farm was purchased by Mrs Smith in 1995. - The applicant, Mr Smith (in attendance), stated that no-one other than Mr Cox lives on site. - The Parish Council has evidence that Mrs Smith (previously Warn) was listed at Newlands Farm on the electoral register from (at least) 1998 until 2010, and at a Wimborne address thereafter. Mr Ronald Cox has been listed at Newlands Farm since 2002. - It was commented that the bungalow had been permitted (contrary to planning policy at that time) specifically to support agricultural activity on the farm, and that it would be a significant loss for it now to be separated from the farm, and could affect the viability of other types of agricultural activity there in the future. It was agreed the following response be made to the NPA:- While Mrs Karen Smith states that she moved out of Newlands Farm bungalow in 2000/2001, the Parish Council has evidence that Mrs Smith (previously Warn) was listed at Newlands Farm on the electoral register until 2010, though this is not evidence of occupancy. Mr Ronald Cox has been listed at Newlands Farm from 2002 until the present day. The Parish Council can offer no direct evidence in support of or contrary to the claimed breach of Condition 1 (Agricultural Occupancy) of PP RFR 10608. Permission for the bungalow having been granted against prevailing policy of the time in order to support agricultural activity on the farm, the Parish Council feel it would be a significant loss for it now to be separated off. In order to protect the need for agricultural occupancies on holdings within the New Forest and preserve the diversification of agricultural activity within the parish, the Parish Council would urge the National Park Authority to investigate whether, in the event that the claimed breach cannot be contested, Condition 1 (Agricultural Occupancy) could be suspended, rather than removed in perpetuity; this might be for a period of 3 or more years, and could be conditioned or reviewable to suit the circumstances in this case. Cllr Spark explained the location, showed aerial photos of the house and the elevations already approved in 2011 and proposed elevations. During discussions it was established that:- - The application approved in 2011 has elapsed, and this application is identical with an amendment of removing two roof lights to the front of the property and the addition of one dormer on the rear of the property. - The increase in habitable floor space is 30.6% (the 2011 application was approved at 31.1% increase). - The Case officer has requested clarification from the architect regarding the reduction n size of the rear dormers. It was proposed to recommend permission under option 1 (with delegated powers to the NPA), with the following comment:- - The Parish Council are happy with the proposals subject to the Case Officer being satisfied with the architect s response regarding the dormers. Seconded and all in favour (7). 15/94P NPA CONS/15/0634 Mockbeggar Cottage, Mockbeggar fell cypress tree. Cllr Spark explained due to a mix up on response dates, a decision has already been issued by the NPA as raise no objections. Cllr Spark resumed as chair. 15/95P NPA 15/00458 & 00459 Moyles Court School, Rockford sun canopy; fencing (00459 is Application for Listed Building Consent). Cllr Errington explained the location, showed photos of the existing outdoor play area. The following was established and discussed:- - The application is for a free standing sun canopy, on timber posts and it will be immediately adjacent to the preschool/nursery classrooms with a picket fence surrounding it. A cherry tree would need to be removed to install the sun canopy; a mature cherry will be planted in the garden as a replacement. - Ofsted have recommended shade needs to be immediately accessed from the classrooms. - The whole site is listed, even though the classrooms were a 1970s addition. It was proposed to recommend permission under option 3 to the NPA. Seconded, all voted in favour (7). 15/96P NPA 15/00591 Land at Rockford Farm, Rockford installation of new timber post & four strand barbed wire fence. Cllr Shand explained the location, advising the land had been purchased by Hampshire County Council as back up grazing land to support commoning activities in the New Forest. This application is for the installation of new fencing to allow the area to be designated as a SINC (Site of Importance for Nature Conservation). It was suggested the removal of the old fence slightly south of the proposed new fence should be requested in order to prevent a narrow strip of land being created. It was proposed to recommend permission under option 3 to the NPA, with the following comment: - The Parish Council would like to request the old fence south of the proposed new fence be removed, to prevent a narrow strip of land being created. Seconded, all voted in favour (7). 8. Quiet Waters, Ivy Lane appeal for single storey side extension (awaiting appeal start date). 10. Consultations: 15/99P New Forest Dostrict Local Plan Review Sustainability Appraisal-response by 12 August. Cllr Webster has reviewed this consultation and feels it is a good opportunity for raising the wish of the Blashford Lakes Strategic Management Plan (BLSMP) being made into a formal Supplementary Planning Document (SPD). Cllr Burtenshaw suggested also raising the need for a formal Conservation Plan for Harbridge and Ibsley Conservation Area. Cllr Webster to forward respnse to clerk, Clerk to respond. 11. NPA Training Event Tuesday 22 September 2pm in Lyndhurst Community Centre 15/100P Members were asked to commit to attending; 6 members confirmed their attendance. Clerk to rsvp to NPA. 12. New Forest National Park Building Design Awards 2015 new annual Building Design Awards scheme 15/101P All were asked to consider if any properties should be put forward. Clerk to keep on agenda each month until 30 October 2015. 13. Correspondence: 15/102P All were advised the Latchmore EIA Public Exhibition event will be held on a new date of 6 October 2015 4-8.30pm Hyde Church Community Centre. 14. Other Business 15/103P Cllr Burtenshaw wanted to express very grateful thanks to the volunteers who helped at the Ellingham Show stand, John Stokes, Raymond Elias, Anne Craft and Steve Adams, to her fellow councillors who volunteered throughout the day to make this event so successful and to the Clerk for organising the event. 15/104P The Clerk advised she is on annual leave from 17 August to 1 September.
