PROPERTY CHANGES AND MAINTENANCE Changes you want to make to the exterior property you own are governed by River Bend Covenants, By Laws and Architectural Control Committee Rules and Regulations. The adherence to these regulations is what keeps our park attractive and protects every property owner from neighbors who do not respect the rights of others. The Property Owners Association (POA) Board of Directors appoints an Architectural Control Committee of five property owners who approve changes you wish to make and assure adherence to our park regulations. Working together, we can keep our park beautiful and maintain our property values. The following pages summarize our regulations. Keep in mind, all changes must be approved before you have work done. If you re not sure of the rules, check with The Architectural Control Committee before proceeding. Applications for changes can be picked up at the POA Manager s Office located in the clubhouse. 1

RIVER BEND RESORT RULES AND REGULATIONS ARCHITECTURAL APPROVAL: Any structural changes, shed building, remodeling of any sort, bringing in new park models, pouring of cement, removal of bushes, shrubs or trees, yard ornaments or structures must first submit request to The Architectural Control Committee. Forms may be picked up in POA Manager s Office located in the clubhouse. ANY CHANGES AND/OR ADDITIONS WITHOUT PRIOR WRITTEN APPROVAL WILL BE SUBJECT TO REMOVAL, AT YOUR EXPENSE. REVISION 12/05/07 AUTOMOBILES: Speed limit in the park is 15 miles per hour. Light tune ups or tinkering with Owner s car or trailer is permitted on the Owner s driveway if not objectionable to neighbors. RESTRICTIONS: Only paid golfers are allowed on the golf course. No walking, jogging, bikes, roller blades, skates, etc. allowed on the golf course or cart paths. Golfers must start on #1 tee, unless approved by Pro Shop. PARKING: NO PARKING ON THE GRASS IN ANY DEVELOPED AREA. No on street parking is permitted. No vehicle shall extend beyond the paved driveway. No vehicle shall remain on streets overnight. Only your RV/Park Model plus one other vehicle (car, truck, etc) can be parked on your lot. EXCEPTION: two automobiles may be parked on your lot if you have enough concrete pad or driveway to accommodate both. EXCEPTION: Upon entering the park you have (3) days to unload your RV or trailer. When leaving the park, you have three (3) days to load your RV or trailer. During these three (3) days you may park in your driveway or on the street in front of your house or RV lot, as long as you don t interfere with traffic flow. NO BOATS, BOAT TRAILERS, RECREATION EQUIPMENT, TRUCK OR HEAVY EQUIPMENT SHALL BE STORED ON ANY LOT OTHER THAN DESIGNATED STORAGE AREAS. Boats, boat trailers, and recreational equipment may be stored on lots during the summer months at the discretion of the POA Manager and as long as there are no other recreation vehicles on the lot, (such as; RV s, Park Models Utility Trailers, Boats, Dollies, etc.). PETS: Pets are NOT allowed on the golf course or cart paths. ALL PETS MUST BE KEPT ON A SIX F00T (6 ) LEASH WHEN NOT CONFINED TO OWNER S PROPERTY RESIDENCE AND OWNER SHALL BE RESPONSIBLE FOR WASTE REMOVAL. Animals shall not be tied on the outside of your residence and left alone. Barking dogs will not be tolerated. Pets are not allowed on other owners Property unless permission is granted by said Owner. No pets are permitted in the clubhouse, including game room, laundry room, bathrooms or swimming pool area. After two warning of a nuisance pet, the Owner will be asked to remove pet from Rio Bravo Subdivision ENFORCEMENT: If dues are late, your name will be posted in the clubhouse, DUES ARE LATE AFTER THE 10 TH OF THE MONTH. THE RIGHT OF THE POA MANAGER TO SUSPEND THE RIGHT TO USE THE RECREATIONAL FACILITIES BY AN OWNER FOR ANY PERIOD DURING WHICH ANY ASSESSMENT AGAINST HIS LOT REMAINS UNPAID OR FOR ANY INFRACTION OF THE PUBLISHED RULES AND REGULATIONS. GUEST: Any Owner may extend his right of enjoyment of the Common Area to the members of his immediate family (those related by blood or marriage), his tenants or contract purchasers who reside on the property. ALL GUEST must register in the clubhouse office when using the facilities. Anyone under the age of eighteen (18) is not permitted in the swimming pool or spa without being accompanied by owner. FOR SALE and OPEN HOUSE SIGNS: No sign of any kind shall be displayed to public view on any lot of structure without The Architectural Control Committee s approval. No sign may be affixed to palm trees lining the streets. The Architectural Control Committee has approved the following: Signs, maximum size 18 x 24, may be mounted on front or in the window of park model or homes. Signs must be placed thirty five (35 ) back from the center of the street on RV lots and twenty five feet (25 ) back from the center of the street on the home and garden home lots. Signs must be placed nine feet (9 ) from backside of curb on home lots facing cul de sac. 4

YARD ORNAMENT: 1. Yard ornaments need to be eye appealing, preferably less than 6 feet in height (exceptions in height may be made at the discretion of the Architectural Control Committee). 2. Owners must have the ability to store decorations when away for an extended period of time. Anything that can blow in the wind must be stored when away. 3. Any item not of substantial weight, to remain standing, needs to be temporarily secured as not to fall over in case of brisk winds. 4. Ornaments that fit into a 3 foot cube, need no approval from the Architectural Control Committee, but ornaments must be tasteful, eye appealing and socially acceptable. 5. All yard ornaments, must be stored in a structure such as sheds or Park Models before the Owner leaves the resort for an extended period of time. If left outside and strongs winds blow in, these items could become projectile missles and would become very dangerous and cause a lot of damage. Items such as tables chairs, grills, etc. can not be left outside with tie downs, items must be stored. DECORATIONS: Holiday decorations are permitted during any recognized holiday, but must be removed within two (2) weeks following the end of the holiday season. Fasteners that penetrate the bark of the trees lining the street are not allowed. STRUCTURE: Definition of a structure is something you can store items in or have the ability for people to walk inside (e.g. SHEDS AND GAZEBOS). GAZEBOS SECTION 19.02 UNDER STURCTURES. REQUEST FOR GAZEBOS NEED TO BE SUBMITTED TO THE ARCHITECTURAL CONTROL COMMITTEE FOR APPROVAL/DISAPPROVAL. IF THE OWNER IS HERE THE GAZEBO WOULD NEED TO BE ANCHORED DOWN, BUT WHEN THE OWNER IS AWAY, THE GAZEBO INCLUDING THE FRAME NEEDS TO BE TAKEN DOWN AND STORED. THE GAZEBO NEEDS TO BE TASTEFUL, SOCIALLY ACCEPTED, AND EYE APPEALING. GAZEBOS MUST MEET REQUIRED SETBACKS WITH NO HINDERANCE OF NEIGHBORS SIGHT. ALONG WITH REQUEST TO SET UP A GAZEBO, THE OWNERS MUST SUBMIT TO THE ARCHITECTURAL CONTROL COMMITTEE A SIGNED COPY OF HIS NEIGHBORS (BOTH SIDES) APPROVAL. ALL GAZEBOS NEED TO BE APPROVED BY THE ARCHITECTURAL CONTROL COMMITTEE PRIOR TO SETTING UP. 5

A RATED FLOOD PLAIN WOOD OR ANY PERMANENT STRUCTURE IS NOT PERMITTED (RV SIDE OF LEVY). C RATED FLOOD PLAIN WOOD STRUCTURES ARE PERMITTED (HOUSE SIDE OF LEVY/WITH ARCHITECTURAL CONTROL COMMITTEE APPROVAL). OWNER S MAINTENANCE OF YARD: The owner shall keep and maintain his yard (including the area between the right of way line and the curb) in good condition and will keep the grass cut and not allow excess amount of weeds and undergrowth to grow on the lot. Owner must notify staff in the POA Manager s office of person responsible of lawn maintenance including trimming of shrubs and bushes. In the event owner should fail to keep this condition and covenant, the POA Manager is hereby authorized to maintain Owner s yard and the owner agrees to reimburse the POA Manager for the cost hereof one hundred dollars ($100.00). Do not blow clippings into the street. Rock or patio stone lawns are to be kept free of grass and weeds. All flower beds are to be kept free of grass and weeds. Shrubs and bushes are to be kept trimmed to (6 ) six feet or less. Radio or television antennas, aerial wires or guidelines shall not be maintained on any lot. Ladders may not be hung on the outside of the sheds at any time. TRIMMINGS: Trim bushes and shrubs after 12 noon Wednesday or Thursday. All trimmings must either be tied in bundles [no longer than five feet (5 ) or heavier than fifty pounds (50#)] or placed in garbage bags and tied [no heavier than fifty pounds (50#)]. DO NOT PUT TRIMMING IN THE GARBAGE DUMPSTERS. GARBAGE: All garbage and trash must be put into plastic bags, tied and disposed of in trash receptacles located at the front of the park by golf maintenance shop. DO NOT PUT TREE, BUSH OR SHRUB TRIMMINGS IN THE DUMPSTERS. ALUMINUM CANS: Remove all cans from plastic bags, before putting cans in the recycle bin. (NO PLASTIC BAGS IN THE RECYCLE BIN). WOODEN HURRICANE SHADES: Wooden shades must be painted if left up all summer. POOL HOURS: 9:00 A. M. UNTIL 10:00 P.M. NO EXCEPTIONS 6

CONSTRUCTION STANDARDS CONCRETE PADS: 1. A property change request explaining the property owners request must first be submitted to The Architectural Control Committee (forms of request may be picked up at the POA Manager s Office, located in the clubhouse). Architectural Control Committee meets every Wednesday afternoon (if change request are pending). 2. Cover letter: Sign and submit to the POA Manager s Office. 3. Plot plan to scale [one square equals two feet (2 )] showing what is requested, along with all buildings, slabs, trees, park models, etc. 4. City building permit is required if the curb is to be cut. Approval of the Architectural Control Committee must be presented to the City Permit Office to maintain a permit. A copy of the City Permit must be filed in POA Manager s Office before work is to start. 5. No lot can be occupied until concrete slab is in place. 6. Curb backs must be cut on all new RV pads and driveways on the home lots. 7. Curb backs must be cut on all alternations on existing driveways if the alteration butts up against the curb. 8. Side property line setback: Three feet (3 ) on RV lots. Five feet (5 ) home lots. 9. Rear property line setback: Seven and one half feet (7 ½ ) on both RV lots and home lots. 10. Under concrete, pipes will be allowed up to ¾ in diameter. 11. Electric conduit only will be allowed to extend up through the concrete. NO WATER PIPES. 12. The elevation of concrete pad must be at least level with top of curb. Concrete pads that extend to the curb and that are part of the driveway must not exceed the height of the curb or level with the existing ground surrounding the pad. PARK MODELS: 1. A property change of request explaining the property owners request must first be submitted to The Architectural Control Committee (forms of request may be picked up at the POA Manager s Office, located in the clubhouse). Architectural Control Committee meets every Wednesday afternoon (if change request are pending). 2. Cover letter: Sign and submit to the POA Manager s Office. 3. Plot plan to scale [one square equals two feet (2 )] showing what is requested, along with all buildings, slabs, trees, park models, etc. 4. City building permit is required. Approval from the Architectural Control Committee must be presented to the City Permit Office to maintain a permit. A copy of the City Permit must be filed in POA Manager s Office before work is to start. 5. No larger than 400 square feet and must have the RVIA (Recreation Vehicle Industry Association) seal attached. 7

6. Side yard property line setback: Three feet (3 ) on RV lots 7. Rear property line setback: Seven and one half feet (7 ½ ) on RV lots. 8. Front property line (Center of the street) setback: Thirty five (35 ) on RV lots. 9. Air conditioners can be roof mounted, window mounted or placed on a concrete pad adjacent to the park model, but inside the property line. 10. Trailer tongue, with hitch and axles, must be attached to park model at all times. 11. Wheels must remain attached and in place. 12. Wheels must be placed in position on the concrete slab only. 13. Tie downs must be mounted to the concrete slab. 14. A photo or picture brochure and specifications of the park model has to be on file at the POA Manager s Office. PARK MODEL WITH PORCH: A Park Model with a porch coming from the manufacturer must first meet all the requirements for a park model without a porch. NOTE: See requirements for a park model from the Architectural Control Committee. The following additional requirements apply to park models with porches. 1. The park model hitch must be on the street side of the park model and easily accessible. 2. The porch must be on the same frame as the park model. 3. The porch must be built by the original manufacturer at time of park model construction. 4. The porch must move with the park model as a unit. 5. The porch cannot be used as living space i.e. no air conditioning, no heat, no water or sewer lines installed etc. 6. The porch may be screened, but windows or window/screen combinations are not allowed. 7. The porch length must not exceed eight feet beyond the basic park model living are and cannot exceed the width of the park model. TEXAS ROOMS (Screens, Sliding Glass Doors, Wall with Windows), PATIOS, CARPORTS: 1. A property change request explaining the property owners request must first be submitted to The Architectural Control Committee (forms of request may be picked up at the POA Manager s Office, located in the clubhouse). Architectural Control Committee meets every Wednesday afternoon (if change request are pending). 2. Cover letter: Sign and submit to the POA Manager s Office. 3. Plot plan to scale [one square equals two feet (2 )] showing what is requested, along with all buildings, slabs, trees, park models, etc. 4. City building permit is required. Approval of the Architectural Control Committee must be presented to the city permit office to obtain a permit. A copy of the city permit must be filed in the POA Manager s office before work is to start. 5. Texas rooms are limited to 400 square feet. 8

6. Texas rooms, patio roofs or carports shall be of self supporting, free standing type. 7. The fourth side wall of the Texas room is the outside wall of the park model. 8. The walls and roof of the Texas room may be butted up against the park model, but may not be fastened to the park model, 9. Partitions or walls of any type are not permitted inside the Texas room. 10. Park Models or recreational vehicles shall not be used as a support for Texas rooms, patio roofs or carports. 11. Carports and structures to house or cover RV s will not be approved or allowed. 12. No toilets will be allowed in the Texas rooms. 13. Raised floors will not be allowed in the Texas rooms. EXCEPTION: Three and one half inch (3 ½ ) concrete slab may be poured on top of an existing concrete pad. The depth of that part of the adjacent concrete pad shall be whatever it takes to make the slab level for the Texas room. 14. Side yard property lines setback: Three feet (3 ) on RV lots. 15. Rear property line setback: Seven and one half (7 ½ ) on RV lots. 16. Front property line (center of the street) setback: Thirty five feet (35 ) on RV lots. 17. Any extension of existing sewer system (washing machine sewer) a permit must be submitted and approved by the city and the architectural control committee. 18. Under concrete, pipes will be allowed up to ¾ in diameter. 19. Electric conduit only will be allowed to extend up through the concrete. NO WATER PIPES. 20. Toilets are not allowed in the Texas Room. 21. Carport limited to eleven feet (11 ) in total height. RV ROOM CONSTRUCTION ON RV LOTS: 1. A property change request form explaining the property owners request must first be submitted to the Architectural Control Committee (Request forms may be picked up at the POA Manager s office, located in the clubhouse). Architectural Control Committee meets every Wednesday afternoon during the winter season (if request of changes are pending). 2. Cover letter: sign and submit to the POA Manager s office. 3. Plot plan to scale (one square equals 2 feet (2 ) showing what is requested, along with all buildings, slabs, trees, park models, etc. 4. City building permit is required. Approval of the Architectural Control Committee must be presented to the city permit office to obtain a permit. A copy of the city permit must be filed in the POA Manger s office before work is to start. 5. RV rooms are limited to 400 square feet. 6. RV rooms shall be of the free standing self supporting type. 7. The RV shall not be used as any type of support. 8. Structures to house or covers for RV s will not be approved or allowed. 9. Under concrete, pipes will be allowed up to ¾ in diameter. 9

10. Electric conduit only will be allowed to extend up through the concrete. NO WATER PIPES. 11. Toilets will not be allowed in the RV room. 12. All RV rooms shall be of the slide in, slide out or retractable type technology (federal regulation). 13. Raised floors will not be allowed in the RV room (federal regulation). Exception: Three and one half inch (3 1/2 ) concrete slab on top of existing concrete slab. 14. Side yard property line setback: Three feet (3 ) on RV lots. 15. Persons purchasing properties with existing RV rooms must consider the following: A. The lot must be able to accommodate their RV and satisfy items 12, 13, and 14. B. If the property cannot satisfy items 12, 13, and 14, it must be modified to accommodate their RV while satisfying items 12, 13 and 14. 18. RV rooms may have four walls constructed as per above stipulations. 19. The roof of the RV room cannot extend over the RV. 20. If a park model is moved onto the property the following applies: A. The RV room may be demolished OR B. The RV room may become a Texas room and following applies: a. The park model must be moved against the RV room. b. The fourth wall of the RV must be removed and the park model becomes the fourth wall of the Texas room. STORAGE BUILDING (SHED) CONSTRUCTION ON RV LOTS: 1. One shed per RV lot. 6. Maximum 100 square feet (10 x10 or 8 x12 ). 7. Side property line setback: Three feet (3 ) on RV lots. 8. Rear property line setback: Seven and one half feet (7 ½ ) on RV lots. 9. Front property line (center of the street) setback: Thirty five feet (35 ) on RV lots. 10. If shed door opens toward the rear of property, sufficient room must be left for turning so as not to trespass on other owners private property. NO DRIVING ON GOLF COURSE PROPERTY. 11. Must be capable of being moved toward the street. 12. Must have two (2) 4 x 4 treated lumber skids aligned toward the street. 10

13. Minimum eight foot (8 ) heavy chain or 3/8 steel cable attached to the front of the skids. 14. 4 x 4 spacer (treated lumber) between the skids where the chain or cable is attached. 15. Floor joists shall be 16 on center. 16. 2 x 4 wall studs, maximum 24 on center. 17. Exterior siding shall be ½ minimum tongue and groove plywood; pre painted masonite grooved siding or ¼ concrete siding board. Vinyl siding, steel siding or aluminum siding with 3/8 plywood under layment. 18. No chipboard or pressboard will be allowed. 19. SIDE WALLS WILL NOT EXCEED EIGHT FEET (8 ) IN HEIGHT MEASUERED FROM THE TOP OF THE SKIDS. 20. TOTAL BUILDING HEIGHT WILL NOT EXCEED NINE AND ONE HALF FEET (9 ½ ) MEASURED FROM THE TOP OF THE SKIDS. 21. Storage building shall be painted to match the color of the park model or RV. Vinyl, steel or aluminum siding color to match the park model or RV. 22. Under concrete, pipes will be allowed up to ¾ in diameter. 23. Electric conduit only will be allowed to extend up through the concrete. NO WATER PIPES. 24. TOILETS NOT ALLOWED IN THE STORAGE BUILDINGS. FENCES: 1. Decorative fences MAY BE allowed, but MUST BE approved by The Architectural Control Committee. 5. Must be approved in writing by all affected neighboring property owners (consent forms may be picked up at the POA Manager s Office located in the clubhouse). 6. Side yard property line setback: Three feet (3 ) on RV lots. Five feet (5 ) on the home lots. 7. Rear property line setback: Seven and one half feet (7 ½ ) on RV lots and home lots. 8. Side yard fences shall not be closer than thirty five feet (35 ) to the center of the street on RV lots and twenty five (25 ) to the center of the street of home lots. 9. No fence will be constructed along the front of any property. (EXCEPTION: Around a swimming pool). Garden fences up to eighteen inches (18 ) in height or less may be used around gardens or trees. 10. Side yard and rear yard fences will not exceed a maximum height of six feet (6 ). 11. Smooth side of any fence shall be exposed to the neighboring properties. 12. Fences shall not be made of any kind of metal except the garden variety (eighteen inches (18 ) or less in height). 11

13. See through protective netting, approved by The Architectural Control Committee, may be installed on the rear or side of the property for golf ball protection following the setback requirements and approval of the neighboring properties. 14. All fences must be of removable construction (Federal Requirement). 15. Live fences (shrubs, bushes, etc.) must be trimmed to not more than six feet (6 ). SHOULD THERE BE A CONFLICT BETWEEN INFORMATION IN THIS BOOKLET AND THE COVENANTS, BYLAWS AND RESTRICTIONS. THE LATTER PREVAILS. 12
