Regulations for civil aviation BL 9-10 Regulation on the Danish Transport Authority s fees and charges in the aviation area etc. Edition 14, 16 December 2014 In pursuance of 148 of the Air Navigation Act, cf. Consolidation Act No. 1036 of 28 August 2013, the following is stipulated on authority in pursuance of 152 (1): 1. Definitions Safety contribution: Charge financing the Danish Transport Authority s continuous supervision levied by the air operators for each passenger transported as stipulated in 148 (1) of the Air Navigation Act. : The payment for the Danish Transport Authority's access control, including any direct and indirect costs, in connection with issues, approvals and specific business transactions, e.g. holding of examinations. 2. Scope 2.1 This BL lays down regulations on the Danish Transport Authority's fees and charges for tasks, including public business transactions and inspection activities in the aviation area. 2.2 This BL does not apply to the Faroe Islands and Greenland. Note: BL 9-13, Regulations on the Danish Transport Authority s fees and charges in the aviation area for the Faroe Islands and Greenland, 2 edition, shall apply to the Faroe Islands and Greenland. 3. General 3.1 The rates in this BL, including Appendix 1, are in Danish kroner. 3.2 Charges after this BL shall be paid by the one in whose interest the business transaction is made. 3.3 If payment according to this BL and the Air Navigation Act has not been made after the last due date of payment, a service charge of DKr. 100 will be collected per reminder. Note 1: Interest will be added in accordance with the rules in 5 of the Interest Act, cf. 148 (5) of the Air Navigation Act. BL 9-10 / Edition 14 / 16-12-2014 / 1

Note 2: In accordance with Act on Collection of Debts to the Public Sector amounts due and accrued interest may be collected by the arrears collection authority under this act and the arrears collection authority may collect amounts due by distraint, stopping of wages etc. and by set-off in overpaid tax as well as remit amounts due. Further arrears collection authority may permit payment by instalments or respite for the payment. Note 3: Charges for registration of rights to aircraft shall be paid according to the rules stipulated in pursuance of the Act on registration of rights to aircraft in force at the time in question. Note 4: Charges to Skat, the Danish Customs and Tax Administration, for registration of owners of aircraft or parts thereof in the Register of Danish Aircraft and for registration of liens, except for equitable liens, in aircraft in the Register of Rights to Aircraft shall be paid in accordance with the existing rules at any time stipulated in pursuance of Act of charge for recording and registration of ownership rights and mortgages etc. Note 5: Charges for issue of call sign/aircraft radio licence shall be paid in accordance with the existing rules at any time stipulated by the Danish Business Authority in Order on tests, certificates, call signs and identification numbers. 3.4 For business transactions undertaken in the Faeroe Islands or in Greenland, payment shall be made for the Danish Transport Authority's travel and accommodation expenses in addition to the fee or charge. 3.5 Business transactions outside Danish area may be undertaken after specified agreement with the Danish Transport Authority. For such business transactions payment shall be made for the Danish Transport Authority's travel and accommodation expenses in addition to the fee or charge. The Danish Transport Authority may collect a sum on account to be paid in advance of commencement of the business transaction. Note 1: The travel expenses mentioned in paragraphs 3.4 and 3.5 include expenses for use of travelling time. Note 2: For continuing surveillance the expenses in connection with the actual business transaction, cf. paragraphs 3.4 and 3.5, are covered by the safety contribution (the charge). 4. 4.1 s shall be paid in accordance with appendix 1 to this BL. 4.2 s and specific payments in pursuance of paragraphs 3.5, 4.3 and 4.4 shall be paid when the business transaction is concluded (time of issue). The Danish Transport Authority may, however, collect payment on account to be paid before the business transaction is commenced and in the course of the business transaction concurrently with the carrying out of the transaction. 4.2.1 As regards business transactions for which no issue fee has been fixed according to Appendix 1 to this BL and for exemptions, the issue fee shall be fixed as per account rendered. This implies that the charge will be fixed on the basis of the Danish Transport Authority's consumption per hour. Note: The one who requires the business transaction undertaken may ask the Danish Transport Authority in advance for an estimate of the expected total consumption per hour. 4.2.1.1 Where the charge is fixed as per account rendered, the price per hour is DKr. 985, cf. however, paragraphs 3.4, 3.5 and 4.3. 4.2.2 In connection with reorganisation of a company, e.g. from a personally owned company to a limited company where the ownership till then is not changed, an issue fee shall be paid calculated on the basis of consumption per hour. 4.2.3 In connection with an issue transaction where there is a previous dialogue with the Danish Transport Authority, the Danish Transport Authority may demand in advance that the work done by the Danish Transport Authority until an application is submitted, will fully or in part be included in the transaction and that this part of the transaction shall be counted in the issue fee on the basis of consumption per hour. 4.3 Business transactions outside the Danish Transport Authority s opening hours may only be carried out in extraordinary cases and upon agreement with the Danish Transport Authority. If the business transaction is carried out outside opening hours upon request from the claimant, and unless the transaction concerns practical tests covered by Table 4F - 4M in appendix 1 to this BL, the amount of DKr. 15,000 shall be paid in addition to the fee or charge as well as DKr. 2,000 per hour commenced beyond the first 7 hours after the commencement of the business transaction. Note: The Danish Transport Authority is open on Mondays-Thursdays from 09.00 to 16.00 and on Fridays from 09.00 to 15.30, however not on holidays or days where the Danish Transport Authority has announced to be closed. 4.4 In case of discontinuation of a business transaction before conclusion, a proportional part of the issue fee shall be paid in accordance with an estimate on the proportion of the business transaction accomplished at the time in question, cf. however, paragraphs 4.4.1 4.4.3. The payment constitutes a. 25% of the issue charge if less than 50% of the business transaction has been accomplished, b. 50% of the issue charge if 50% or more, but less than 75% of the business transaction has been accomplished, or c. 75% of the issue charge if 75% or more of the business transaction has been accomplished. 4.4.1 In connection with discontinuation of a business transaction for which the issue fee is fixed as per account rendered, an amount shall be paid for the work done up till then. 4.4.2 Tests concluded before the prescribed time limit for reasons that are not due to the Danish Transport Authority or force majeure shall be regarded as finished and therefore the entire issue fee, cf. Tables 4F-4K in Appendix 1 to this BL, shall be paid. 4.4.3 Tests shall be regarded as commenced transactions when signing up for the test has been made. In case of cancellation of a test, cf. Tables 4J 4K in Appendix 1 to this BL, due to the student s illness, no charge shall be paid if the cancellation is made in writing by the opting training organization before the time for the test in question and if the illness has been documented to the Danish Transport Authority in a medical declaration. 4.5 Payment shall be made in accordance with the charges and fees, cf. Appendix 1 to this BL, valid at the time when the business transaction is concluded (time of issue), cf., however, paragraph 4.5.1. 4.5.1 For business transactions as per account rendered that have not been concluded at the time of the implementation of this BL, and for on-going business transactions where the fee to be paid is changed from a fixed fee to fee as per account rendered at the time of imple- BL 9-10 / Edition 14 / 16-12-2014 / 3

mentation of this BL, the fee shall be calculated until this time according to the regulations in force until the implementation of this BL. After this time the fee shall be calculated in accordance with the regulations in this BL. For business transactions where there has been no requirement of fee under the valid up till now, no fee will be collected for consideration of cases made until the implementation date. 5. Safety contribution 5.1 The charge (safety contribution) stipulated in 148 (1) of the Air Navigation Act has been regulated in accordance with 148 (3) of the Act as stated in appendix 1 to this BL. 5.2 Aerodromes from which flights with air operators depart who is liable to pay safety contribution in accordance with 148 (1) of the Air Navigation Act, shall for each month submit the basis for collection for these air operators to the Danish Transport Authority not later than the 10 th day of the subsequent month. 5.2.1 The collection basis shall include the following information: a. Name, address and CVR number of the air operator. b. Number of passengers for which the safety contribution shall be paid. 5.3 If the Danish Transport Authority so requests the aerodromes shall make up the number of passengers, cf. paragraph 5.2.1 b., on departures from the aerodrome. 5.4 The Danish Transport Authority shall collect the safety contribution from the air operators with a credit of 30 days. 6. Exemption The Danish Transport Authority may in exceptional cases grant exemption from the regulations in Parts 3 and 4 and in paragraphs 5.2 and 5.4 of this BL. 7. Access to complain Decisions taken by the Danish Transport Authority in accordance this BL cannot be brought before the minister of transport or any other administrative authority. 8. Implementation 8.1 This BL comes into force on 1 January 2015. 8.2 At the same time BL 9-10, 13 edition of 17 December 2013 is repealed, cf. however, paragraphs 4.8 and 4.8.1 in the mentioned BL. Appendix 1 to BL 9-10 Fee and charge rates for 2015 1. Introduction This appendix contains the fee and charge rates valid for 2015. The charge (safety contribution) in table 2 B is fixed in 148 (1) of the Air Navigation Act. The amount has been regulated as per 1 January 2015 in pursuance of 148 (3) of the Air Navigation Act.
