NEWQUAY TOWN COUNCIL Planning Committee Meeting Minutes of the Meeting held on Monday 21 st January 2013 at 2pm in the Council Chamber, Municipal Offices, Marcus Hill, Newquay. Action Present: Cllrs Mrs J Bunt (Vice Chairman), D Sleeman (Vice-Chairman), S Carter, J Fitter, Miss J Kenny and Mrs J Crocker Also attending: Mr J Piwecki (Senior Assistant to the Town Clerk) and 6 members of the public. P18/13 - Declarations of Interest: None P19/13 - To Approve the Minutes of the Meeting held on 7 th January 2013 It was Proposed by Cllr Miss J Kenny, Seconded by Cllr S Carter and RESOLVED unanimously that the minutes of the meeting held on 7 th January 2013 were correctly recorded and they were adopted and signed by the Chairman P20/13 - Matters Arising: P21/13 - Matters Referred: P22/13 Footpath, Weed Control and Priory Wood: The committee were briefed on the site visit to Priory Wood by Cllr D Sleeman through a written report. Cllr D Sleeman said that the path has completely overgrown and there are issues with the drainage channels as there is a leak from a nearby disused Silver mine. Cllr D Sleeman informed the committee that their current footpath contractor does not have the equipment to carry out the work however a local contractor is prepared to quote the council for the work. The contractor will hand into the office a copy of his risk assessment and public liability insurance with the quote. It was proposed by Cllr Mrs J Bunt, Seconded by Cllr Miss J Kenny and RESOLVED unanimously to move items 9 and 10 of the agenda for discussion. P24/13 Public Question Time Ms Kelly Ms Kelly spoke on behalf of the residents of Lawton Close in regards to planning application PA12/11637. She would like to firstly thank Newquay Town Council for inviting her to speak and for their comments on the previous application which was withdrawn. The previous application had received approximately 40 objections and the residents, along with Newquay Town Council, felt very strongly against it. The proposed building would be overlooking neighbouring properties and is not in keeping with the area. Ms Kelly spoke with the planning officer who informed her that the applicant has decided to resubmit the application. Ms Kelly briefed the committee on the differences to the application from the previous one submitted in October 2012. Ms Kelly would like to firstly mention that she believes the scale of the plans to be inaccurate. The apparent differences are; The roof has been reduced in the middle section only by ½ metre The sides of the building have been reduced by 2 metres The back of the building has been reduced by 1 ½ metres and moved back from the lane however this results in it being closer to the building behind Size of the windows have been reduced slightly Ms Kelly does not believe that any of the changes have addressed the concerns of the residents or Newquay Town Council. Residents still feel very strongly against the application and would urge Newquay Town Council to consider this when reviewing the application. Ms Foster Ms Foster would also like to comment on her objection to the proposed development. At present her residence would sit behind any new development and completely occupy her front viewing area. There is still an issue with the lane as at present there is little room for traffic to manoeuvre and with the proposed development there will be an extra 6 car park spaces. There is evidence already that delivery drivers, refuse collectors and Royal Mail have difficulty in using the lane and accessing the site. Cllr Miss J Kenny enquired as to whether the plans indicate how far the potential build will be to Ms Fosters property. Ms Kelly responded in saying that the plans are not accurate. Ms Foster and Ms Kelly would like to reiterate that there is still a strong local objection and this will be the same for any future applications for this site as it is not in keeping with the area. P25/13 To reinstate the meeting At this point, it was Proposed by Cllr Mrs J Bunt, Seconded by Cllr Miss J Kenny and RESOLVED unanimously to reconvene the meeting. CO7309-12-C1 Newquay Zoo Consultation This item was discussed in a following item. Cllr Miss J Kenny asked if Gemma Halstead could be reminded to forward the guidance on Hostels to Newquay Town Council. b. Licensing (if any) Cllr Mrs J Bunt informed the committee that the hearing date on the SEV license application for the Attic Night Club has been delayed. Cllr Fitter responded in saying that there does not have to be a set date and there is no deadline for the hearing. Members agreed that either the Mayor or Cllr Mrs J Bunt will speak at the hearing. c. LSTF Consultation Edgcumbe Road, Newquay Cllr Miss J Kenny updated the committee on a presentation she attended regarding the consultation. The aim of it is to introduce new bus shelters which will give easier access to wheelchairs and buggies. They will do this by raising the pavement in certain areas. Members feel they would like to submit the following comment. The committee are minded to support aspects of Phase 1 of the consultation and would like to support in principle Phase 2 providing the bus shelters match on either side of the road d. LSTF Consultation Porth 4 Turns, Newquay The committee would like to support the consultation and forward the same comment they gave previously. e. Pharmaceutical List Petroc Group Practice Members agreed that this item does not apply to Newquay Town Council. P24/13 Pre-application Advice Process This item is on-going. At this point, it was Proposed by Cllr Mrs J Bunt, Seconded by Cllr Miss J Kenny and RESOLVED unanimously to move application PA12/11637 to the top of the list for discussion P28/13 To consider Planning Applications and Correspondence relating to Applications 1. Application No. PA12/11637 Removal of existing dwelling to provide 6 No. new apartments ranging from 1 bed to 3 beds with associated parking, landscaping and bin store. Revised and footprint reduced following consultation with Highways and Planning Departments. 7 Lawton Close Newquay Cornwall TR7 1QF Hub Homes Ltd 179763/61378 We have concerns on overlooking of the gardens and neighbouring properties. This is an overdevelopment of the site. The narrow, partially Object Page 4 of 7

adopted lane is much used by the residents. There are serious concerns over health and safety of those residents whose properties back onto this lane. This particular area is highly residential with mostly small bungalows and two-storey buildings and this overpowering development would not be in-keeping and have a negative impact on the surrounding properties. This could set a precedent. The precedent set by the block development fronting on Pentire Crescent does not apply to this development. There is a significant amount of local objection to this and any future applications on this site. The committee do not feel as though there has been any significant changes to the application to warrant a change in their decision from objection.
