We welcome Visit Pensacola partners and non-partners to join us in this 3-day festival which will attract guests from around the world. I understand that a cleanup fee is required and non-refundable if any of the agreed to rules are broken and/or not met ot the satisfaction of the committee chairperson. Check each box to indicate you have read and agree with the following: My application is NOT complete until I submit the application including photos, application fee is paid in full including the cleanup deposit. Submission of an application, does NOT guarantee acceptance. All accepted vendors will be notified in writing.

Vendor fees are due at the time of submission. Fees can be paid at the Visit Pensacola office or by mail. If you are not accepted, all fees are refundable less an admin fee of $25.00. Insurance certificates must be submitted within 24 hours of acceptance. All vendors must be covered by a $1,000,000 limit per occurrence Commercial General Liability insurance policy that names Visit Pensacola Inc. dba Tall Ships Pensacola Festival, Tall Ships America and The City of Pensacola, as additional insured. Applications are not complete without the certificate evidencing this coverage. I must also maintain a copy of the certificate at the festival site. I agree to only operate during the festival hours April 13 15, 2018. Note closing times may vary. To accept the location assigned by the committee, stay within the allotted space assigned to ensure there are no leaks into the food service areas. Vendors may NOT request a specific spot. I understand I must set up and break down at my assigned time. To be out of the park in a timely manner after the festival concludes Sunday night. Vendors have until midnight to remove all trash and thoroughly clean their area to the satisfaction of the committee chair. To sell only APPROVED items from the proposed menu list on the application. To pay a deposit of to ensure compliance with the rules of the festival. Deposit will be refunded by mail, within 60 days following the event if all rules are honored. Under no circumstances are you to tie into any electrical resource other than those provided to you specifically by the site manager. Requests for additional electricity can be considered if submitted by March 1, 2018 but are not guaranteed. There is no reserved parking for vendors onsite. All vendors will have access to public parking. RVs and Large rigs are strictly prohibited in downtown Pensacola due to a City ordinance. All vehicles must be removed from the site at the scheduled time(s). On-site signage and advertising is restricted to signs attached to your booth. Prices must be clearly marked and only approved items may be sold. No placards or additional signage are allowed in the pedestrian areas. No outside drinks may be sold. Soft drinks and water can be purchased from the event. I am required to cover the street area under my setup with tar paper to protect the cleanliness of our parks. I will not be allowed to open if I do not comply with this condition, nor will I receive a refund or credit. The vendor must supply their own tar paper. Tar paper must be disposed of before departing after the festival is over. To provide appropriate containers for bleaching, washing, hand washing and rinsing. I must properly dispose of grey water during the Festival in the appointed water holding tanks (where applicable). I must ensure that the paved area around my vendor location is grease free.

A member of the food committee will judge the cleanliness of the area at the end of the festival. Refunds are contingent upon this inspection. To provide a working, up to date, class ABC fire extinguisher in my unit/tent. If frying I will provide an up to date class K fire extinguisher. ALL PROPANE DEEP FAT FRYERS MUST BE SELF CONTAINED (ENCLOSURE OF OPEN FLAME) AND BE CONTROLLED BY AN ACCURATE THERMOSTAT (if applicable). All tanks must be secured at all times. The Fire Marshall will be onsite to monitor all required elements and will write citations for those not complying. To properly dispose of grease during the festival in the appointed grease disposal unit. Failure to comply and to properly clean up any grease spills will result in me forfeiting my clean up deposit. to have adequate protection from flies and other pests. Screening, mesh flaps, or fly fans are acceptable. To provide a large trash barrel and empty is as needed during the entire festival. I must keep the area around my location clean of litter during festival hours and at the close of each day. To cooperate with all matters related to the electrical and plumbing connections of my unit. I am responsible for any additional expenses that require any repairs, such as an electrician to repair my connection or festival power poles. To NOT use any generator that my food service unit may be equipped with. (City Ordinance Sec. 8-116 Noise Ordinance) To cooperate at all times with the Tall Ships Pensacola Festival staff and the staff of Visit Pensacola. The event reserves the right to close any vendor not complying with festival rules. Failure to comply with any of the above rules will result in the loss of my cleanup deposit. YOU MUST BRING YOUR OWN EXTENTION CORDS, MALE PLUGS. All 110volt cords must be round grounded 12-3 and are furnished by vendor. Deluna park is equipped with 20 am, single phase power only. Total # 20amp receptacles requested: Water service is provided by a limited number of hose bibs with male threads. All hoses must be approved for potable water and are furnished BY VENDOR. ACKNOWLEGEMENTS: I understand and agree with the rules and regulations that are set forth in this application and agree to abide by and fully comply with said rules. I understand and agree that the Tall Ships Pensacola Festival and Visit Pensacola, its related entities, sub-contractors and committee are not responsible in any way for damage, loss or theft of my, my firm, or of my customers and employees, and agree to indemnify and defend and hold harmless the Tall Ships Pensacola Festival, Visit Pensacola, Tall Ships America Committee, against such loss, damage or theft. I hereby submit my application for the 2018 Tall Ships Pensacola Festival. I understand that failure to follow all rules to the satisfaction of the committee may result in the forfeit of my deposit and the closing of my booth. In the event that the Tall Ships Pensacola Festival and Visit Pensacola are unable to hold the 2018 Festival as scheduled for any reason of war, acts of God, or acts of nature (rain, inclement weathers, etc.) or any other reason, or the Festival is interrupted in any way, no refund shall be made and it is agreed that all contracts are null and void. There shall be no responsibility or liability on the part of the Tall Ships Pensacola Festival and Visit Pensacola, and the Tall Ships Pensacola Committee its related entities for any losses sustained by any person caused by such an event. The Tall Ships Pensacola Festival and Visit Pensacola in no way guarantees any return or benefits to vendor. It is further understood that the Tall Ships Pensacola Festival and Visit Pensacola, its related entities and the Tall Ships Pensacola Committee assume no responsibility for any injury or death to person, property or any other damages or losses occurring in the Festival premises during the Festival. I agree to forever indemnify and defend and hold harmless the Tall Ships Pensacola Festival, Visit Pensacola, and the Tall Ships Pensacola Committee, officers, directors, staff, employees, and volunteers from any and all claims for loss, death, damage of person, property and any other loss whatsoever arising out of any act, omission, or negligence, in the operation or conduct of myself/business, including violation of any law, ordinance, code, rules and regulations, and all attorney s fees and costs incurred by those parties. All the foregoing is agreed to in consideration of and as a condition precedent to the Tall Ships Pensacola Festival, Visit Pensacola and the Tall Ships Pensacola committee providing to me/my business the applied for vendor space.
