D/B/A TACA PERU, LINEAS AEREAS COSTARRICENSES S.A., and AVIATECA S.A. for renewal of exemption and statement of authorization JOINT APPLICATION FOR RENEWAL OF EXEMPTION AND BLANKET STATEMENTS OF AUTHORIZATION TACA International Airlines S.A. ( TACA, Trans American Airlines S.A. d/b/a TACA Peru ( TACA Peru, Lineas Aereas Costarricenses S.A. ( LACSA, and Aviateca S.A. ( Aviateca (together, the TACA Group along with Aerovías del Continente Americano S.A. ( Avianca (collectively, the Joint Applicants hereby request renewal of their exemption under 49 U.S.C. 40109 permitting them to register a joint trade name under 14 C.F.R. Part 215 for their collective use of the trade name Avianca and use of the designator code AV for their services in foreign air transportation to and from the United States. Additionally, the TACA Group hereby requests renewal of the blanket statements of authorization issued pursuant to 14 C.F.R. Part 212 in order to display the AV* designator code. In support of this Application, the Joint Applicants state as follows: 1. On December 13, 2012, the Department issued to the Joint Applicants: (1 an exemption permitting them to register under 14 C.F.R. Part 215 their collective use of the trade name "Avianca" and use of the designator code "AV" for their services in foreign air

Part 212 to display the AV designator code on flights operated by the TACA Group in U.S. markets in which both the operator and Avianca hold current Department authority to conduct scheduled foreign air transportation of persons, property and mail, further to the proposed common branding arrangement. 1 2. The Department subsequently approved renewal of the exemption and blanket statements of authorization for a one year period, and these authorities expire by their own terms on February 12, 2015. By this Application, the Joint Applicants respectfully request renewal of these authorities for a period of at least one year. 3. Since the Department first granted these authorities, the Joint Applicants have continued to strengthen the Avianca brand in order to seamlessly deliver expanded service offerings to the travelling public, thereby enhancing competition. In addition, the Joint Applicants have observed the conditions of the Department s approvals, including providing appropriate disclosures to ensure that consumers are informed of the operator s identify for any flight operated pursuant to the authorities at issue. 4. Renewal of these authorities is clearly in the public interest. In its February 12, 2014 Notice of Action Taken, the Department again noted that the bilateral air transport agreements between the U.S. and the respective homelands of each of the Joint Applicants provide a basis for the approval. Moreover, the underlying authorities have provided significant consumer benefits, as the Joint Applicants have been able, under a single brand, to leverage their 1 The Department also approved Aviateca and LACSA's registration of the "TACA" trade name. In exercising these authorities, the Joint Applicants have complied with and will continue to comply with the conditions set forth in Appendices A, B, and C of the Department's February 12, 2014 Notice of Action Taken in this docket. 6. Pursuant to Section 377.10(a of the Department's regulations, the Joint Applicants state their intention to rely on 5 U.S.C. 588(c, as implemented by Part 377, to continue in effect the authority for the services specified in this Application, pending a final determination by the Department. 2 2 To the extent necessary, the Joint Applicants respectfully request a waiver from the advance filing requirements of 14 C.F.R. 212.10(d and 377.10(c with respect to the renewal of the blanket statements of authorization.
