Poor condition of the land adversely affecting the amenity of the area. 1) Remove from rear garden loped branches, hedge cuttings and any other rubbish that has accumulated through neglect. 2) Clear brambles and other self seeded plants and trees from the rear garden. 3) Remove the following items of rubbish from the front basement:- paper, plastic bottles, drinks cans, polystyrene, pieces of wood, binliners, a rubber glove and any other items of rubbish that have accumulated through neglect. 4) Clear self-seeded trees from the front basement. 5) Fit a new front door. 6) Fit a rear door and frame to the basement. 7) Fit a rear window and frame to the basement. 8) Fit glass to all the side windows and paint the frames accordingly. Section 215 Notice issued on 20-6-06. The Notice took effect on the 19-7-2006 with a five months compliance period. On the 3-11-06 the owner appealed the Notice at Mid Sussex Magistrates Court. A new date has been arranged for the 5-12-08. This is to enable the Council to obtain documentation from Lewes Crown Court confirming that the owners appeal was dismissed. 5-12-08 Summary Trial hearing at Mid Sussex Magistrates Court. Case proven. 200 fine imposed with 950:35 cost to be paid within 28 days. 17-3-09 a letter was sent to the owner informing him that the Section 215 Notice was still in force and that he had until the end of the month to provide the Council with a satisfactory schedule or works to comply with the Notice. He was advised that the Council would consider a further prosecution if he failed to comply with the Notice. There has been no response to this letter. 3.0 Comment 3.1 The performance figures for the fourth and final quarter to the year build on the excellent performance for the earlier part of the year. The development control service has exceeded all three national targets by a significant margin. 3.2 The Service has achieved top quartile nationally (local target) across all three categories of planning applications, which is highly commendable. This represents a consistently high level of performance. 3.3 Planning appeal performance is no longer a national performance indicator. It is however a good indicator of the quality of decisions taken by the Council and as such this will continue to be monitored and reported to members. Performance in the first half of the year was extremely good. Performance in the second half of the year was not so good so that overall 31% of appeals were allowed.
