Old Business New property manager: Ricardo Rios introduced from PMI Tampa He appreciates turn-out and asks for future participation Web page: the president has set up the account, but it has just started. The agenda and the approved minutes will be posted. Information will be rotated off. Residents can find CC&R, bylaws, and make payments. You can pay through the website. You will be taken to a 3 rd party which charges about $3 for the service. Please send Roger Mitchell an email once paid. You can also send payment through your bank. Secretary for Board
Motion: Approve Carole Seevers as Secretary for HOA by Dennis Mueller Resolved: Carole Seevers is Secretary V. New Business Reimbursement of $350 for attorney s fee for consultation (1 hour) Resolved: Roger Mitchell will be reimbursed $350 Adopt an amendment to add Fining procedures (per two Frisca & Ross, P.A. emails dated 16 March 2017) Resolved: adoption Comments on procedure for fines: Our documents allow any member of the association to receive fines. The infraction and a time limit for correction is stated. When Board levies a fine, it is maximum $100/day. There are 30 days to correct infraction. Recipient of fine has 30 days to correct infraction. Recipient of fine has 2 weeks to appear before the fining committee to appeal. This appeal may include a request for a modification of terms such as I am disabled and I need 2 months to comply or I have a plan (The fining committee is made up of 3 members who are not Board members nor related to a Board member). Once the fine is levied, residents have 2 weeks to appeal to PMI (no longer the Board). Suggestions:
Although some issues do take time, 30 days to correct is too long for certain infractions, example: a car parked in the wrong place. 30 days had been put forth as the standard and recommended by attorney, but president will investigate. If infraction can be displayed in a photo (parking on grass, party-goers parked in wrong place ) immediately take a picture includes time and date. Be flexible with people who are unloading as they move in. Make more use of towing company. Put tags on car windows. Sheriff can give out tickets. Spread the word/forewarn people in our community. Certainly, there are OSHA violations now. Note date when violation starts. There are large families with no place to park. The notices going to the Owners and a curtesy copy is sent to the Renters. The letter comes from Mr. Rios (PMI). The fine can be levied against the owner, renter, or anyone there. If a car is parked inappropriately for 3 days straight, make sure that the violation is given. The offender can be identified through Mr. Rios. Sheriff Patrol Since parking violations are OSHA violations these are the sheriff s responsibility. Inform the sheriff. It is a Florida violation if a car is parked on the wrong side of the street the sheriff can issue a warning. Violations Committee Yard of the month Again, try to warn your neighbors before they have to go through the official violation procedures. Mr. Rios expects that we are not restricted in fining on county-owned roads, but will investigate to make sure, including who receives parking fines if you live on a corner lot.
Even if you have 3+ cars, do not park across sidewalks. Do not park with your car facing the wrong direction. If our community is sued $10,000, with 144 homes that would be about $69 per household. Residents cannot claim ignorance of the deed restrictions: 1. By state law our entranceway sign stating Wildewood Village, a deed-restricted community is notification. 2. Residents sign a package with the deed restrictions when they move here. 3. Our web page has all the information. Approve Fining Procedures Install Community Flagpole at maximum $350 and $60/year for flag replacement Discussion regarding community flagpole, concrete, solar light, flag: Shows that we respect our nation. Can fly various flags. Sets off the entrance. Put up high so not vandalized. Can fly in the rain. Dennis Mueller has done the research and is willing to monitor with community help. A certain WV house is being used as an office for a business. The business vehicles park here, including overnight. The president has already sent them a letter. Mr. Rios is now informed and will follow through. Emergency vehicles need to be able to get through. Drive like your kids live here sign is appreciated. It was purchased and installed by Anthony Montgomery.
Problem with people not picking up after their dogs. Suggestion: Get county to put out sign that says No parking from here to corner to give sheriff legality to help. Vans and cars parking on the road have created dangerous blind spots, especially during the day. VI. Committee Reports Welcome Committee Need procedure for being informed when new neighbors move in. Architectural Committee Area between wall and the road at one address needs attention blacktop suggested. If an architectural review form is submitted, but not responded to within 2 weeks, according to resolution #4, you may go ahead with your plans without the Board s approval. Regarding a resident s concern about the wall damage: The president spoke to the head of the insurance company who stated some difficulties with taking care of the issue. He said that we need estimates, if the Board approves. The resident will be reimbursed for the plywood he bought. No reply, yet, on the estimates from the two masons. Will follow through as soon as get estimates. Resident is concerned that it is a safety issue. After 44 days, the president complained to Rafael Soto, top in that company. Sheriff Patrol Two no-shows last week. One man did not get paid. Communication problem between the old and new HOA (need solid contact for Diane). The pay is $90 for 3 hours, but is off-duty/voluntary, and someone does not always opt to take the job. VII. Public Comments One resident whose check had still not cleared through the old HOA (March or April) was told to cancel that check and write a new one to the new HOA. If it is a deed restriction that has been violated, take a picture of the violation and the address and send it as a MP3 file to Mr. Rios.
If a dog barks for an hour, call the sheriff. If the dog is still barking when the sheriff arrives, the sheriff takes over. PMI, our property manager makes payments, comes once a month, contacts attorneys, fills in blanks on contracts with businesses, gets estimates. The president will request that their website be accessible. If concerned about uncalled-for repercussions from a neighbor with a violation, inform the violations committee instead. Some residents need to replace their grass. If there s a violation, the owner is notified and the renter receives a curtesy copy. The owner is not absolved; it is the owner s responsibility to inform the renter. More people might come to these meetings if there were food. VIII.
