The Chairman welcomed members and visitors to the December meeting. PUBLIC QUESTION TIME Members attention was drawn to the state of the roads within the parish and in particular to the four large puddles on the road near Pixie Gardens, to the dangerous pothole in the road between Brill crossroads and Treculliacks and to the patches along the road the road to Port Navas which have again broken down to the inconsiderate (and potentially dangerous) parking outside the school and to the large puddle (which has been created by farm vehicles) on the footpath leading up to the Doctors surgery. Mr Boote said that he was present to voice residents opposition to the building of a new dwelling in the garden of Comfort Farmhouse (PA12/10024). He drew members attention to problems of access, parking and safety already experienced by residents living on Well Lane. He also reminded members both of the problems experienced by one family in Well Lane who, earlier in the year, had had their garden flooded with raw sewage and of the findings of Planning Inspector Miles in refusing an earlier application. He asked the Parish Council to seek refusal of planning permission for this application. Agreeing with all that Mr Boote had said, Mrs Atkins stated that rain water run-off already floods down the lane and that a new dwelling would exacerbate this state of affairs. She added that the proposed entrance is very narrow and on a blind corner. Acknowledging that the number of windows overlooking her property had been reduced, Mrs Scatchard stated that nevertheless the amended plans for the two dwellings in Fore Street (PA11/10868) now included larger windows which still meant a loss of privacy for her home. Mr P.Rowe stated that he and his brother had made every effort to incorporate the views expressed about their earlier application into the amended plans. The roof-line had been lowered; there was now on-site parking; the houses were now granite faced (in keeping with the older dwellings along Fore Street) and the number of windows in the rear elevation had been reduced. In answer to a question, he stated that the Planning Authority had insisted that the granite walling facing Fore Street should be preserved and that therefore the ground levels should be retained. Members noted that the recent road closure between Brill and Falmouth had not been notified as is usual and that the owner of The Waymarker had experienced a consequent loss of trade. Mr Webber stated that he was very sorry that there had been so much ill-feeling about the removal of telephone equipment from the kiosk at Port Navas which is sited on his land. The equipment has been now been replaced, contracts for the land on which the telephone box stands will be exchanged tomorrow and he understands that the new owner will permit the kiosk to remain on site. 347

Cllr Wiseman proposed, Cllr Gray seconded, all in favour to accept their apologies. 2 DECLARATIONS OF INTEREST in items on the agenda There were no declarations of interest in items on the agenda. of gifts (received as a result of being a member of the Council) of a value greater than 25 There were no declarations of gifts of a value greater than 25. 3 CONFIRMATION OF THE MINUTES OF THE LAST MEETING Cllr Gray proposed, Cllr Bolt seconded, all others in favour that, with the hand-written amendments, the minutes of the held on Thursday November 15, 2012 are a true record and the Chairman signed them as such. 4 MATTERS ARISING FROM THE MINUTES BUT NOT INCLUDED ON THIS AGENDA Cllr Wiseman stated that he is still looking for chain link fencing suitable for use around the Garden of Remembrance in the Lawn Cemetery. 5 POLICE REPORT There was no report from the police. 6 CORNWALL COUNCILLOR S REPORT CCllr Hatton reported that a new Planning Enforcement file has been opened concerning an allegation that an annexe at Trewardreva is being used for residential purposes a Tree Preservation Order has been place on land at Bosryn, Port Navas resurfacing the road down to Merthyn will be carried out in early February the Primary Care Trust has replied to letters about the Constantine Dental Practice explaining that the NHS contract is not transferable but has to be won by tender the application for a new dwelling at Ponsaverran, Port Navas was refused by the Planning Committee Cornwall Council Cabinet recognises the need for new housing and is supportive of the figure of 48,000 originally proposed in the Core Strategy document (now known as the Cornwall Plan). In the Falmouth and Penryn Community Network Area this figure equates to 3,500 new homes in the urban area and 500 in rural locations (these numbers refer to both affordable and open market homes). The Cornwall Plan goes out for consultation in January, but in the meanwhile property developers are relying on the National Planning Policy Framework document to justify their applications. This is resulting in applications for development on land that the Cornwall Plan will protect but which the Planning Authority is currently unable to prevent. Wishing everyone present a very happy Christmas, CCllr Hatton left the meeting. 7 PARISH COUNCIL MATTERS Co-opted members The Clerk reported that expressions of interest in standing for co-option as a Parish Councillor had been received from Mrs D Alton, Mr Lewis and Mrs Scott. Cllr Mrs Dunstan proposed, Cllr Williams seconded all others in agreement that Mrs D Alton should be co-opted as a Parish Councillor. Cllr Bolt proposed, Cllr Gray seconded all others in agreement that Mr Lewis should be co-opted as a Parish Councillor. Cllr Wiseman proposed, Cllr Bolt seconded all others in agreement that Mrs Scott should be co-opted as a Parish Councillor. Cllr Mrs D Alton, Cllr Mrs Scott and Cllr Lewis all signed and then read aloud their declarations of acceptance of office before Mr Chapman, Clerk to Constantine Parish Council, the Proper Officer. The Chairman welcomed Cllr Mrs D Alton, Cllr Mrs Scott and Cllr Lewis as members of Constantine Parish Council. 348

Following discussion, it was agreed to defer the matter to the next meeting. In the meanwhile, Cllr Lewis and the Clerk offered to seek further information. Constantine Lawn Cemetery Following discussion, Cllr Wiseman proposed, Cllr Gray seconded, all others in favour that that the Lawn Cemetery Regulations should be amended to allow memorial tablets to be laid over buried cremated remains. A copy of the amended regulations is appended to these minutes. Following further discussion, Cllr Gray proposed, Cllr Mrs Scott seconded, all others in favour that Constantine Parish Council should purchase two A3 sized copies of the regulations to be affixed to the wall of the Lawn Cemetery. 9 PLANNING APPLICATIONS AND DECISIONS Applications PA11/10868 Mr M.Rowe Demolition of dwelling and erection of 2 dwellings (amended plans) 36, Fore Street Constantine. Cllr Bolt proposed, Cllr Wiseman seconded, all others in favour that this application should be returned with the following observation Constantine Parish Council is minded to support this application, although it would have preferred levels to be lower. PA12/10024 Ms Sandra Boreham Outline planning for single three bedroomed two storey residential dwelling Comfort Farmhouse, Well Lane. Cllr Bolt proposed, Cllr Wiseman seconded, Cllr Mrs Scott, Cllr Mrs D Alton and Cllr Lewis abstained, all others in favour that this application should be returned with the following observation Constantine Parish Council believes the proposed development in the garden of Comfort Farmhouse will have an adverse effect on the area as a whole. The cumulative effect of the developments permitted along Well Lane already makes access along it challenging and the turn out on to Fore Street is a constant cause of complaint. Additionally, the Planning Authority should note that larger vehicles are unable to turn and must back out up the lane. Despite what South West Water has to say there are considerable issues with the sewer which backs up and spills out onto a Well Lane resident s garden. Constantine Parish Council requests the Planning Authority to refuse permission for development. A copy of that statement is attached to these minutes. Members considered the Precept for the year from April 1, 2013 to March 31, 2014. Following discussion, it was proposed by Cllr Williams, seconded by Cllr Bolt all in favour that the Precept for the year 2013/2014 should be set at 34,000 Members considered a request from Cornwall Air Ambulance for help with funding. Following discussion, Cllr Williams proposed, Cllr Gray seconded, all in favour that the sum of 100 be forwarded to the Cornwall Air Ambulance Trust under the terms of Section 137 of the Local Government Act 1972. It had been a most enjoyable community event and he publicly offered his thanks to Ms Ellen Worth for making the arrangements.
