Sir/Madam, In exercise of the powers conferred on it by Article 324 of the Constitution and Section 20B of the Representation of People Act, 1951, the Election Commission hereby appoints the Observers as in the enclosed list for the General Election to Lok Sabha 2009 and simultaneous Assembly elections 2009 being held in March-May 2009. 2. The Observers will be appointed for the Assembly segments of the Parliamentary Constituency as in the list enclosed. 3. This allocation is subject to change, if the situation so warrants. Any such change shall be emailed to the Observers directly or through the Nodal Officers and would be made available on the Observers Portal. 4. Under Section 1C of the Representation of the People Act, 1950 and Section 28A of the Representation of the People Act, 1951, the Observers will be deemed to be on deputation to the Election Commission during the period they are working as Observers to the Election Commission and subject to the control, superintendence and discipline of the Election Commission. 5. The Observers shall report to their constituencies not later than 9 th April, 2009 and remain deputed till the completion of polls and repoll, if any. Before leaving the constituencies the Observers shall intimate the Secretary, the Election Commission of India, incharge of the State in which Observers are deployed. The Observers will report back to the Constituencies on 15 th May 2009. Under no circumstances the Observers shall make return travel plan on the next day of poll and the day of counting. This is to ensure that any instruction for the scrutiny of certain documents after the conduct of poll is properly carried out. 6. The Observers kits have already been sent to the Constituencies and shall be made available to the Observers by the district administration. The reference material placed in the kit can also be found on Observers Portal. Details of duties are indicated in the guidelines supplied to the Observers in the kit alongwith other documents/cd. During the briefing session, certain details have already been indicated. 7. The Observers of the Commission are entitled for TA/DA as admissible on tour. The Observers draw TA/DA from their Ministry/Department/Office. The expenditure will be debitable to the Budget grant of their Ministry/Department/Office. The Observers are also
entitled to travel by air by any scheduled commercial flight of any airlines. When the Observers travel by train, it shall be as per entitled class. 8. In case the Observers make any subsequent request for exemption, change in deployment, permission for temporary absence, leave etc., it shall be taken up with the Zonal Deputy Election Commissioner/Secretary concerned. In all such cases, unless a reply is received in that regard, the permission shall not be deemed to have accorded. 9. The Observers on completion of duty shall send a final report to the Commission and intimate this directly that the Observers have completed their duty. Unless specifically required by the Commission to continue on duty the Observers shall automatically released from the duties of Observer after that date.
