Bids received after the appointed time set for receipt will be considered non-responsive. All work completed for the Metropolitan Park District will be considered a public works project with prevailing wage documentation required. 2 INSTRUCTIONS TO BIDDERS Northwest Trek Asphalt Overlay, SWR Bid T SUBMISSION OF BIDS Bids must be delivered no later than Wednesday, July 23, 2014 at 4:00 PM. Informal bids will be received by the Northwest Trek Wildlife Park, Metropolitan Park District of Tacoma, Tacoma, Washington, and to be delivered to Trek Drive East, Eatonville WA or faxed to (360) or ed to (must have signature). Bids submitted by fax or will be accepted if they are received prior to the scheduled bid opening (confirm receipt). Bids received by fax or will be placed in sealed envelopes and opened at the scheduled bid opening with all other bids. There will be a mandatory prebid meeting on site Friday, July 11, 2014 at 10:00 AM. For more information, contact Chip Heinz, Project Manager at (360) or to chip.heinz@nwtrek.org. 2. BIDDING PROCEDURE AND FORMS Bidders shall submit their bids on the bid proposal and signature sheet form included in this invitation to bid. Forms shall be filled in completely in ink or typewritten. The signature sheet must be signed by a responsible company official with their designated title. Bidders may submit additional product information with their bid as desired. 3. BIDDER S REPRESENTATION Each bidder by making his bid represents that he has familiarized himself with the General Conditions for Metropolitan Park District of Tacoma Public Works Projects, Small Works Master Agreement, Metro Parks Tacoma Master Contract for Work Awarded From Small Works Roster and the attached Instructions to Bidders and Specifications. 4. REJECTION OF BIDS & ACCEPTANCE OF BID The MPD shall have the right to reject any or all bids or any items of the bid and to reject a bid, which is in any way incomplete or irregular. Any or all bids may be rejected for good cause. It is the intent of the MPD to award one contract to the lowest responsible bidder, provided the bid does not exceed the funds available. The MPD shall have the right to waive any informality, irregularity, or technical defect in any bids or bids received and to accept the bid or bids which, in its judgment, is in its best interests. 5. AGREEMENT BETWEEN OWNER AND CONTRACTOR A Bidder whose proposal is accepted shall sign the written agreement between MPD and Contractor within ten (10) days from the date of mailing of a Notice from MPD to Bidder of acceptance of his proposal. 6. WARRANTY AND GUARANTEE Bidder warrants and guarantees to MPD that all work will be in accordance with the plans and specifications and will not be defective. If within one year after the date of delivery, any material is found to be defective, the Contractor shall promptly and without cost to MPD, correct such defect. 3 7. PUBLIC WORK & PREVAILING WAGE RATES Please be aware when submitting a bid that this project is classified as "public work" and is subject to Washington State Prevailing Wage Law. The law requires in part that the following conditions be met: All workers or laborers must be paid the prevailing wage rate for their job classification as determined by the Department of Labor & Industries. A copy of current prevailing wages is attached to this notice. The prime contractor and each subcontractor must file a Statement of Intent to Pay Prevailing Wages with the Department of Labor & Industries, ESAC Division, in Olympia. Statements of intent are to be filed prior to beginning work. The prime contractor and each subcontractor must file a corresponding Affidavit of Prevailing Wages Paid with the Department of Labor & Industries at project completion. Weekly certified payroll forms must be completed by prime contractor and each subcontractor and submitted to the Metropolitan Park District. Industrial Insurance: All Industrial Insurance premium payments must be current for prime contractor and each subcontractor working on the project. The Metropolitan Park District will check with the Department of Labor & Industries to verify current premium status. No progress payments will be made to the prime contractor until approved Statements of Intent to Pay Prevailing Wages have been received by the Metropolitan Park District. Final payment will not be made until approved Affidavits of Prevailing Wages Paid have been received along with determination that the prime contractor and each subcontractor is in a current premium status. Please note that it is the responsibility of the contractor to forward the statements and affidavits. On public works projects, the hourly rate must be not less than the prevailing rate of wage minus the hourly rate of the cost of fringe benefits actually provided for the worker. 1. ALL HOURS WORKED IN EXCESS OF EIGHT (8) HOURS PER DAY OR FORTY (40) HOURS PER WEEK SHALL BE PAID AT ONE AND ONE-HALF TIMES THE HOURLY RATE OF WAGE. B. Any shift starting between the hours of 6:00 pm and midnight shall receive an additional one dollar ($1.00) per hour for all hours worked that shift. The employer shall have the sole discretion to assign overtime work to employees. Primary consideration for overtime work shall be given to employees regularly assigned to the work to be performed on overtime situations. After an employee has worked eight (8) hours at an applicable overtime rate, all additional hours shall be at the applicable overtime rate until such time as the employee has had a break of eight (8) hours or more. Each week, once 40 hours of straight time work is achieved, then any hours worked over 10 hours per day Monday through Saturday shall be paid at double the hourly wage rate. F. All hours worked on Saturday shall be paid at one and one-half times the hourly rate of wage. All hours worked on Sunday shall be paid at two times the hourly rate of wage. All hours worked on paid holidays shall be paid at two and one-half times the hourly rate of wage including holiday pay. H. All work performed on Sundays between March 16th and October 14th and all Holidays shall be compensated for at two (2) times the regular rate of pay. Work performed on Sundays between October 15th and March 15th shall be compensated at one and one half (1-1/2) times the regular rate of pay. I. All hours worked on Saturdays shall be paid at one and one-half times the hourly rate of wage. In the event the job is down due to weather conditions during a five day work week (Monday through Friday,) or a four day-ten hour work week (Tuesday through Friday,) then Saturday may be worked as a voluntary make-up day at the straight time rate. However, Saturday shall not be utilized as a make-up day when a holiday falls on Friday. All hours worked Monday through Saturday over twelve (12) hours and all hours worked on Sundays and holidays shall be paid at double the hourly rate of wage. 4. SCOPE The project involves an asphalt overlay and an asphalt drainage swale on a portion of the existing roadbed in the Free Roaming Area of Northwest Trek Wildlife Park, Trek Drive East, Eatonville, WA The Free Roaming Area contains approximately 94,000 square feet of roadbed requiring upgrades; 75,000 square feet is included in the Base Bid scope. The road currently consists of four inches (4 ) of asphalt over a crushed rock base. The original two inches (2 ) was laid in A two inch (2 ) overlay was applied in Over the years, various asphalt repairs have been made to the approximately twelve feet six inch wide road system. Provide methods, means, and facilities to prevent contamination of soil, water, and atmosphere from discharge of noxious, toxic substances, and pollutants produced by construction operations. B. Provide dust control, erosion and sediment control, noise control, pest control and rodent control to allow for proper execution of the Work PRODUCTS A. Products: Means new material, machinery, components, equipment, fixtures, and systems forming the Work, but does not include machinery and equipment used for preparation, fabrication, conveying and erection of the Work CLOSEOUT PROCEDURES A. Submit written certification Contract Documents have been reviewed, Work has been inspected, and Work is complete in accordance with Contract Documents and ready for Architect/Engineer's inspection. B. Submit final Application for Payment identifying total adjusted Contract Sum/Price, previous payments, and amount remaining due FINAL CLEANING A. Execute final cleaning prior to final inspection. B. Clean debris from site, roofs, gutters, downspouts, and drainage systems. C. Remove waste and surplus materials, rubbish, and construction facilities from site PROTECTING INSTALLED CONSTRUCTION A. Provide temporary and removable protection for installed products. Control activity in immediate work area to prevent damage. B. Protect finished floors, stairs, and other surfaces from traffic, dirt, wear, damage, or movement of heavy objects, by protecting with durable sheet materials. C. Prohibit traffic or storage upon waterproofed or roofed surfaces. When traffic or activity is necessary, obtain recommendations for protection from waterproofing or roofing material manufacturer. D.
