1 MINUTES OF WILLINGTON PARISH COUNCIL MEETING HELD ON TUES IN THE OLD SCHOOL, CASTLEWAY, WILLINGTON PRESENT: Mr K. England (Chair), Mr A. Bamford, Mrs C. Carter, Mrs F. Crocker, Mr M. Coxon, Mr J. (part) 25 members of the public. 978 APOLOGIES: Nil. 979 DECLARATION OF INTEREST: Nil. 980 POLICE BUSINESS: Problems with ASB on Twyford Road playing field persist. The Police continue to give Willington their attention on a regular basis. 981 MINUTES OF MEETING HELD : RESOLVE: That the Minutes of the meeting held on were approved and signed by the Chairman. 982 DISTRICT COUNCIL MATTERS: At Mrs Crocker s request Cllr Ford gave details of the inclusion of the green space between Sealey Close and Coach Way in the Strategic Housing Land Availability Assessment (SHLAA). (See also Minute No. 989) 983 COUNTY COUNCIL MATTERS: Mercia Marina - request that a footpath sign be erected at both ends of the footpath in front of the Marina buildings. Cllr Ford to check if this is a definitive footpath. ACTION: MF Repton Pit - Mr Gibbs reported that lorries are delivering to the site with full loads and the site would seem to be being used as a waste transfer station which the owners do not have a licence for. He understood that they were allowed to bring in material for reinstatement but this would seem to be construction engineering rather than landfill. Cllr Ford said the Environment Agency had been informed and that all the relevant authorities would be made aware of the above. Mr Gibbs also said that dust was a problem and was not being controlled. Full loads are covered but empty lorries were not and with the dry conditions of late they create a lot of dust, especially on the access road. He asked if the work was going to continue for the next 30 years or another couple of years as the Parish Council had been led to believe by the current owners. Hall Lane Speed bumps. At a site meeting held last year the DCC officer in attendance agreed to reinstate the surface around the bumps which had worn away making the bumps even more severe. To date this work has not been carried out date for work requested. ACTION: MF/CLERK Picnic Site proposed car parking charges. Petition has been sent to DCC. Cllr Ford encouraged parishioners to write individual letters of objection also.

2 -2- At 7.25pm the meeting closed to allow members of the public present to speak about various matters. Trent Avenue car parking A parishioner reported that buses cannot pull up against the recently improved raised kerbs at bus stops, due to the prolonged parking of cars outside properties at the eastern end of Trent Avenue. Bus bay markings to be investigated by DCC. Castleway on-road parking in the vicinity of the Old School. The Chairman of the OST raised continuing concern about dangerous parking following a recent accident. Meeting requested with DCC/OST/WPC. Footpath along the bank of the River Trent Parishioner requested that a further letter be sent to the County Solicitor urging progress on the matter. Proposed re-provision of doctors surgery Parishioner asked that in view of the fact that Hanson s site is now being considered, will Twyford Road playing field site be dropped. The Chairman said he understood that there was a problem with timing and the development of Hanson s site would not go ahead for some years and the offer of funding for the surgery may not be available in the future. Parishioner asked when the planning application for the playing fields site will be submitted. The Chair referred the parishioner to LSP Developments Ltd. Cllr Ford introduced Maureen Evans, DCC, Dept of Children and Younger Adults to the meeting. Ms Evans gave details of her role and action being taken to work with young people and reduce the amount of ASB in the village. Contact details of the two Parish Councillors who had previously volunteered to work with agencies for this purpose were passed to Ms Evans. Members of the public present were invited to help also and one parishioner kindly volunteered. At 8pm the meeting was closed to members of the public and continued. 984 TWYFORD ROAD PLAYING FIELD REPROVISION OF WILLINGTON SURGERY: (a) Revised layout to suite line of sewer Members were disappointed that only one plan had been received from LSP Developments for their consideration. A plan a lot closer to the final lay-out was required, the one shown was too intrusive on the field. After discussion the following proposal was put to the meeting. That the Parish Council advise LSP Developments that they approve the plan accommodating the sewer but not the location of the building, and that a meeting be held with LSP to set down ideas to discuss the lay-out with the with the Parish Council. A vote was taken 9 in favour, 2 abstentions. LSP Developments to be advised of the above. ACTION: CLERK Mr Bamford gave his reasons for continuing with the proposal (1) More parishioners were in favour than against (2) Income received would enable additional facilities to be provided (3) There were be a larger surgery (4) Acquisition of the land from RWEnpower at the rear of the playing field would compensate for the land lost.

3 985 TWYFORD ROAD PLAYING FIELD VILLAGE GREEN APPLICATION: -3- Letter received from DCC advising that an application had been submitted and returned for rectification, and requesting details of other bodies who may wish to be informed of the application. Reply sent with this information. It was understood that the application had been re-submitted successfully. Free legal advice has been sought which reveals that the land owner (WPC) must object or the application will automatically be approved. The application will consider use over the last twenty years and the onus of proof is by the applicant, costs must be borne by the applicants themselves and each side must pay their own costs. Estimate of land owner s costs 5,000-20,000, applicants costs could be greater. More applications are rejected than approved. The use and maintenance of the playing field is well documented, there are bye-laws, rent is charged to the FC, requested for use granted and refused by other bodies etc. Discussion took place on the need to protect and preserve its current use. The following proposal was put to the meeting: That legal help be employed to object to the village green application. A vote was taken 9 in favour, 2 against. 986 PICNIC SITE CAR PARK PROPOSED CHARGES: A letter of objection has been sent to Cllr A. Lewer, Leader of DCC, in respect of the proposal to impose charges at the Picnic Site car park and the complete lack of consultation and communication with WPC and requesting that they reconsider their decision. Details of users other than railway users also provided. 987 MINUTES/REPORTS FROM SUB COMMITTEES/OTHER GROUPS: Joint Meeting with Parish Councils Mrs Crocker gave a resume of matters raised at the meeting, including a request to encourage a revival of Neighbourhood Watch schemes and details of the Mobile Visiting Service available to assist the elderly with completion of forms etc. Finance S/C 15/6/10 Notes from the meeting Circulated to all Parish Councillors, copy on file. The following recommendations were accepted by the full Council. RESOLVE: Twyford Road playing field height barrier estimate of DSK Engineering Services Ltd. of VAT for a new barrier be accepted. ACTION: CLERK RESOLVE: Clerk s hours over the last two months. Ten hours be paid as overtime. The Finance Regulations were reviewed and no amendments considered necessary. (See Minute No. 988) John Allsop Foundation The Chair attended his first meeting of the above and gave the meeting details of grants available to young parishioners and educational establishments in the village.

4 FINANCE REGULATIONS: RESOLVE: That the current Finance Regulations be adopted unchanged. Next review June 989 SEALEY CLOSE/COACH WAY OPEN SPACE SITE MEETING: Mrs Crocker gave details of the site meeting attended by Zoe Sewter, Open Space & Facilities Development Manger SDDC, Mrs Oakley and herself on It was noted that until the SHLAA has undergone assessment the site cannot be offered for lease or sale. Recreation & Amenities Committee to consider what improvements could be made to the green space. 990 PLANNING MATTERS: (a) Planning applications received and dealt with as follows: FH Amended scheme to previously approved 9/2010/0026 for the erection of an extension, balcony and chimney at 1 Spilsbury Close Willington (Bowcott) No comments CM9/0610/43 Proposed application for a new planning permission to replace extant planning permission CM9/695/28 for permission to vary conditions of planning permission code 9/287/883 to win and work sand and gravel from land at Potlocks House Farm, Twyford Road, Willington for Hanson Quarry Products Europe. Comments/queries as detailed below: 1. NTS What measures are to be put in place to protect archaeological interests? 2. NTS Will SDDC/DCC ensure that the design of the entrance be such that it will be physically impossible for hgv s to access/egress the site through Willington? 3. NTS Will appropriate drainage and oil separators and penstocks and sampling chambers be put in place? 4. NTS What is the maximum height of the stocking area compared to the A5132? 5. NTS Sampling points required who will test, what frequency and what is the fine imposed if limits are breached? 6. NTS Groundwater is relatively free to travel in sandy gravels. However, imported materials, especially if lined with clay, will introduce a volume of impermeable ground that imposes into the flood plain, albeit beneath the groundwater level. An estimated amount of 2.3 million tonnes roughly equates to 1 million m³ which will be lost from the floodplain. A possible solution would be for the gravel pits to be left as flood balancing ponds disguised as well planted fishing lakes? 7. NTS Based on 2.3m tonnes to be exported and imported this equates to a total of 230,000 20t lorry movements. A staggering amount, are Hanson s going to pay to improve and maintain the A5132? 8. NTS The A5132 in wet weather has deep puddles and water across half the road at certain points. With the estimated number of hgv s travelling into and from Willington the road will only deteriorate. Highways need to ensure a long term plan for this road. 9. NTS 6.10 What are the benefits to Willington?

5 -5- IPC (Infrastructure Planning Commission) Proposed Gas Pipeline to supply Willington C Power Station Derbyshire Proposal by RWE Npower plc Infrastructure Planning (Environmental Impact Assessment) Regulations 2009 SI 2263 Comments (a) Cemetery to be avoided (b) Transport/storage of pipeline to be brought in from the east, thus avoiding the village centre. 991 CLERK S REPORT & CORRESPONDENCE: Report: 1. Repton Restorations telephone reply to WPCs letter requesting erection of appropriate signs to warn of the dangers of swimming in the gravel pit. Advised that signs are damaged by air gun pellets or torn down within days of erection, however they will replace them again. 2. Proposed re-siting of Recycling Centre. SDDC request a site meeting with WPC representatives and Cllrs Ford & Hood to consider a suitable alternative location. Meeting to be arranged. ACTION: CLERK 3. Car boot sale, Sports & Social Club (a) Parking concerns. Police will monitor, they suggest asking for some advisory white lines. (b) Grass verge selling referred to Planning Dept, SDDC. 4. Beech Ave/Repton Road junction. DCC have advised they will reinstate the verge. 5. Bargate Lane/Hall Lane junction exiting and parking. DCC to carryout Highway Search re ownership of the land before proceeding. Correspondence: 1. Mr J. Stevens, Playing Field Protection Group advising WPC that their Village Green application has been submitted on and details of the legal advice that had received regarding the Parish Council leasing the land. 2. Derby & Derbys Minerals Core Strategy Issues & Options. Comment submitted, acknowledgement received. 3. SDDC re Illegal Encampments/Travellers South Derbyshire.
