MINUTE The Committee considered the Minute of North East Planning Committee of 10th April, The Committee agreed to approve the Minute /04395/NEA - APPLICATION UNDER SECTION 36 OF ELECTRICITY ACT 1989 FOR THE CONSTRUCTION AND OPERATION OF 2 OFFSHORE WIND FARMS AT SEAGREEN - ALPHA OFFSHORE WIND FARM AND SEAGREEN BRAVO OFFSHORE WIND FARM, FIFE The Committee considered a report by the Head of Enterprise Planning & Protective Services seeking a Committee view on Fife Council s formal response to Marine Scotland in relation to the above application. The Committee agreed to (1) approve the formal response detailed in Appendix 1 of the report, subject to the insertion of an additional comment highlighting concerns of the fishing industry in Fife and a possible condition to protect the sea bed, to be agreed by the Head of Enterprise Planning and Protective Services in consultation with the Chair and Councillor Elizabeth Riches, and (2)/

2 2013.N.E.P.C.7 (2) remit to the Head of Enterprise Planning & Protective Services to submit the Council s formal response to the Scottish Government (Marine Scotland). Councillor Thomson entered the meeting during the above item. 9. APPLICATIONS FOR DETERMINATION The Committee considered reports by the Head of Enterprise, Planning and Protective Services on the undernoted applications, together with associated representations. (a) 12/04409/FULL - Erection of dwellinghouse and creation of new vehicular access South Street, St. Andrews. conditions 1-3 and 5-6 detailed in the report, and an amended condition 4 to ensure a pro-active approach to potential land contamination, to be agreed by the Head of Enterprise, Planning and Protective Services in consultation with the Chair. Councillor Marjoram entered the meeting during the above item. (b) 12/04410/LBC - Listed building consent for partial demolition of existing stone walls South Street, St. Andrews. The Committee agreed that the application be approved subject to the condition detailed in the report. (c) 12/04411/CAC - Demolition of existing pre-cast concrete domestic garage and timber storage building South Street, St. Andrews. referral to Historic Scotland, and the condition detailed in the report. (d)/

3 2013.N.E.P.C.8 (d) 12/01614/FULL - Change of use and alterations to kiln building to form dwellinghouse - Old Kiln Building, Burnside Court, Auchtermuchty. (e) 12/01615/LBC - Listed building consent for alterations and conversion of former kiln building to form dwellinghouse - Old Kiln Building, Burnside Court, Auchtermuchty. (f) 12/02748/FULL - Construction of 3 wind turbines (45 metres to hub, 67 metres to blade tip), associated works and vehicular access track - land at Bonerbo, Balmonth and Drumrack Farms, Bonerbo, Dunino. Motion Councillor Riches, seconded by Councillor Macgregor, moved that the application be approved as recommended in the report. Amendment Councillor MacDiarmid, seconded by Councillor Heer, moved that the application be refused on the grounds of aviation safety. Vote Amendment 6 Motion 8 The Motion was carried. The Committee agreed that the application be approved subject to the 5 conditions detailed in the report. (g) 12/05032/FULL - Erection of 12 dwellinghouses (affordable), associated internal roads, parking and landscaping - land to west of Hall Park, Largoward. /

(h) 13/00280/FULL - Erection of 6 dwellinghouses, 4 maisonettes and 4 apartments and associated landscaping - Westburn House site, Westburn Lane, St. Andrews. a legal agreement relating to the payment of 183,000 towards affordable housing provision within the area, and the 20 conditions detailed in the report. 13/00350/PPP - Planning permission in principle for the erection of dwellinghouse and formation of access road - land to the south of Hillside House, Moor Road, Ceres. the 12 conditions detailed in the report, and further appropriate conditions to ensure there was minimal loss of the existing beech hedge and provision of further planting on site. (j) 12/04560/FULL - Erection of 3-storey building to accommodate 6 flats (including demolition of existing building) - 10 Westview, St. Andrews. (k) 13/00863/CAC Complete demolition of single storey dwellinghouse in a Conservation Area - 10 Westview, St. Andrews. (l)/

The Committee agreed that the application be approved subject to the 5 conditions detailed in the report. (m) 12/03285/LBC - Listed building consent for re-positioning of Mercat Cross, Cupar - St. Catherine Street, Cupar. The Committee agreed that the application be approved subject to the condition detailed in the report. (n) 12/04937/FULL - Relocation of Mercat Cross, St. Catherine Street, Cupar. Motion Councillor MacDiarmid, seconded by Councillor Lothian, moved that the application be refused and the Mercat Cross remain in its current location. Amendment Councillor Marjoram, seconded by Councillor Brett, moved that the application be approved as recommended in the report, subject to the formal recording of the original site of the Mercat Cross. Vote Amendment 7 Motion 5 The Amendment was carried. The Committee agreed that the application be approved as recommended in the report, subject to the formal recording of the original site of the Mercat Cross. 10./
