1 Thursday 12 October 2017 SCOTTISH GOVERNMENT Economy Fulton MacGregor (Coatbridge and Chryston) (Scottish National Party): To ask the Scottish Government what representations it will make to the UK Government regarding the future of agricultural support in light of the reported comment by the president of NFU Scotland that changes to the existing model of rural support could result in an annual loss of 250 million to the sector. (S5W-11631) Fergus Ewing: I continue to press the UK government for confirmation and clarification regarding funding guarantees post Brexit. In my letter of 6 October 2017 to Mr Gove, the latest in an ongoing correspondence on this matter, I asked for written confirmation of these funding guarantees, both in terms of what they cover and their financial parameters, which were discussed at a ministerial meeting of the devolved administrations on the 25 September Kate Forbes (Skye, Lochaber and Badenoch) (Scottish National Party): To ask the Scottish Government, in light of the establishment of the new board in March 2017, whether the Crofting Commission has prepared and submitted to ministers a plan setting out its policy on how it proposes to exercise its functions. (S5W-12017) Fergus Ewing: I can confirm that, in accordance with the Crofting Reform Scotland Act 2010, the Crofting Commission has submitted its Policy Plan, which I approved on 5 October A copy of the Plan can be viewed at Education, Communities and Justice Angus MacDonald (Falkirk East) (Scottish National Party): To ask the Scottish Government what action it is taking to ensure that the office of the Judicial Complaints Reviewer is adequately resourced. (S5W-11493) Michael Matheson: The office of the Judicial Complaints Reviewer (JCR) is a demand led role and consequently the budget for the JCR is not cash limited. My officials are working with the JCR to ensure that he has the necessary support and resources. The current expectation is that the role will require approximately three to four days per month but the Scottish Government will fund additional days where that is necessary to perform the functions of the office. In addition to the daily fee paid to the JCR, the Scottish Government pays for all the JCR s office and travel expenses and funding has also been provided for larger expenditure such as the cost of setting up a website. (S5W-11546) Michael Matheson: The operational deployment and promotion of police officers is a matter for the Chief Constable. The Scottish Government does not hold the requested information.

6 Alison Harris (Central Scotland) (Scottish Conservative and Unionist Party): To ask the Scottish Government what its response is to the report in the Mail on Sunday of 24 September 2017 of claims of lawlessness, drug-taking and staff shortages at HMP Addiewell, and whether it will hold an inquiry. (S5W-11563) Michael Matheson: I have asked Colin McConnell, Chief Executive of the Scottish Prison Service (SPS), to respond. His response is as follows: SPS has a Contract in place with Addiewell Prison Limited (APL) for the design, construction, management and financing of HMP Addiewell. APL has a sub-contract in place with Sodexo Justice Services for the operation of the Prison. The Contract is in Performance Year 9 of the 25 year Contract. SPS takes its obligations within the Criminal Justice and Public Order Act 1994 seriously and we ensure that appropriate resources and robust processes are in place to monitor the contracted service provided at HMP Addiewell. A SPS Contract Management Team is responsible for the monitoring and management of the Contract at HMP Addiewell. Quarterly Business Review meetings, with the Contractor and Sub-Contractor are held in order to review performance. A SPS Contract Management Team undertakes regular audits and reviews of Operational Procedures at HMP Addiewell and this team have unrestricted access to the establishment at all times. The Contract requires the Contractor to report all incidents that may give rise to Performance Measure penalties, no later than 9am on the day proceeding any incident. All reportable incidents are fully reviewed and if any failure to meet a Performance Measure is identified, then performance penalties are applied. The Contract includes a number of Performance Measures, which include violence reduction and the detection of prohibited items. I can advise that whilst the management team at HMP Addiewell increased the complement of Prisoner Custody Officers over the past year, 23 vacancies remain to be filled. HMP Addiewell are training new staff and undertaking further recruitment to fill these vacancies. Progression towards this target will be closely monitored by SPS. HMP Addiewell has recently introduced additional security measures to prevent the introduction of illicit substances and they continue to work with partners to support those in their care to address any existing substance misuse problems. Gordon Lindhurst (Lothian) (Scottish Conservative and Unionist Party): To ask the Scottish Government, further to the answer to question S5O by John Swinney on 27 September 2017, what effect the new guidance on managing incidents involving weapons in schools has had. (S5W-11598) John Swinney: The Scottish Government published its refreshed national guidance, Included Engaged and Involved Part 2: A Positive Approach to Preventing and Managing School Exclusions on 19 June This refreshed guidance contained a new section on managing incidents in schools that involve weapons. Since the publication, Education Scotland have been working with local authorities to reinforce the key messages, including the need for local guidance on managing incidents involving weapons. Many local authorities have updated or are in the process of updating their guidance relating to this and have taken into account the key messages which are contained in the refreshed guidance. This includes: the need for staff to be trained and supported in de-escalation and in managing incidents involving weapons; the need to record incidents and for incidents to be referred to the Headteacher, and where necessary, referral to the police to ensure the safety of all. In addition, at the Scottish Learning Festival, over 100 delegates registered for the implementation session on Included Engaged and Involved Part 2. Education Scotland officials discussed our national approach, North Ayrshire Council presented their local authority policy and Renfrew High School showcased a specific approach that they have taken in developing their own policy on knives and

7 offensive weapons. Education Scotland are also planning further implementation sessions with Local Authorities in the coming months. Elaine Smith (Central Scotland) (Scottish Labour): To ask the Scottish Government on what date it will provide an update to the Parliament on the merging of Police Scotland and the British Transport Police. (S5W-11635) Michael Matheson:The Scottish Government is working towards making a further report to the Parliament later this month. Elaine Smith (Central Scotland) (Scottish Labour): To ask the Scottish Government whether secondary legislation will be required in the UK Parliament to fully implement the provisions of the Railway Policing (Scotland) Act (S5W-11637) Michael Matheson: As explained in the Policy Memorandum to the Railway Policing (Scotland) Act 2017, passage of that primary legislation by the Scottish Parliament now enables a substantial programme of work with key partners to deliver integration in practice. Key legislative elements of the overall programme were summarised in the Annex to the Policy memorandum, and include legislative provisions in the UK Parliament to underpin railway policing on cross-border services and the transition of officers and staff from the BTP in Scotland into Police Scotland. Miles Briggs (Lothian) (Scottish Conservatives and Unionist Party): To ask the Scottish Government how many applications by householders for grants to help adapt housing there have been in each year since 1999, broken down by local authority, and how many have been approved. (S5W-11653) Kevin Stewart: The information requested is not held by the Scottish Government. Housing Statistics for Scotland provides a breakdown by local authority of adaptations that received grant funding through the Scheme of Assistance for years to Individual local authorities may keep records of the number of applications received for adaptations grant funding. Mark Ruskell (Mid Scotland and Fife) (Scottish Green Party): To ask the Scottish Government by what date it will determine the planning appeal PPA at Airthrey Kerse, Bridge of Allan. (S5W-11689) Kevin Stewart: Ministers received the report and recommendations from the reporter on this planning proposal on 1 June Ministers are currently giving full and proper consideration to it. Neil Findlay (Lothian) (Scottish Labour): To ask the Scottish Government what discussions it has had with COSLA regarding the future of pest control services in local government. (S5W-11694) Kevin Stewart: The Scottish Government has had no discussions with COSLA regarding the future of pest control services in local government. Pauline McNeill (Glasgow ) (Scottish Labour): To ask the Scottish Government what action it is taking to ensure that Syrian refugees receive the support required under the refugees action plan, and what plans it has to review whether the support offered by the assigned integration support teams is meeting their needs. 8 Angela Constance: The operation of refugee resettlement schemes is reserved to the UK Government and managed by the Home Office. Support for refugees arriving under the Syrian Resettlement Programme is provided by local authorities, who report to the Home Office on delivery of the programme in their areas. The New Scots refugee integration strategy provides a framework for the integration of all refugees and asylum seekers in Scotland. The Scottish Government is working with COSLA and the Scottish Refugee Council and a wide range of other partners to develop the next New Scots strategy for publication in early 2018.
