1 Minutes subject to approval at the next meeting MINUTES OF THE MEETING OF BREEDON PARISH COUNCIL HELD IN THE COMMUNITY CENTRE, BREEDON, ON MONDAY 7 TH AUGUST 2017 Open Forum: Members of the public attended to discuss the hedge removal at Worthington Lane. It has created much upset to the neighbour adjacent to the field as no consultation took place and this now exposes her property. The Parish Council has already raised the matter with NWLDC who have stated that no rules have been broken. Not satisfied with this LCC were approached and officials have advised that LCC would continue to follow this up as access to a classified road must have planning approval. However, the Parish Council has encouraged residents/neighbours to write into LCC individually ) Attendances and apologies: Present: Parish Councillors: S Jones, J Melen, D Camp, J Morrison and D Keith. PSPO Kevin Bradley Apologies: Cllr R Morris and County Cllr N Rushton ) Code of Conduct - Councillors Declarations of Interest 17104) To approve the minutes of the previous meeting of the Council RESOLVED: The minutes of the meeting held on Monday 3 rd July 2017, having been previously circulated, were signed by the Chairman as a true and correct record of that meeting ) Any matters to be raised with the County Councillor ) Any matters to be raised with the District Councillor ) Police Matters (a) Police Report Emerging trends / Incidents of note:- We continue to see thefts from vehicles across the area this month we would encourage people to consider where they park, removing valuables from vehicles overnight. The team recently held a number of Free Tool Marking and Crime Prevention Advice events on the beat. It was an opportunity to have power tools, hand tools, and garden equipment marked and personalised helping with their safe return should they be stolen. The security marking is almost impossible to remove. If you missed the chance to have your valuables marked, please contact a member of the beat team to make an appointment. Crime Prevention Advice Leicestershire Police takes vehicle crime very seriously and understands that the effects of such crime can be distressing and cause a lot of inconvenience for the owner. The more security you are able put in and around your vehicle, the less attractive it will be to thieves. Consider adopting some of the following security measures in order to try to reduce the likelihood of becoming a victim of future crime. Protect your vehicle. Don t give thieves an easy ride. leave it on show expect it to go! Always remove valuables from your vehicle remove sat nav s including the support cradle and cables. Wipe away any suction pad marks don t leave tools in vans overnight 1

2 make sure that doors are locked, windows are closed and keys are removed when you leave the car, even if it s only for a moment on icy mornings, never leave your vehicle unattended with the engine running park your vehicle in a well-lit spot that is visible to others, or covered by CCTV if you have a garage, use it. Always lock your vehicle and garage consider fitting a metal cage to your catalytic convertor or have it etched register any vehicle equipment such as CD players, in-car DVD payers, and sat nav s, for free with immobilise.com Garden Crime Don't let green fingered thieves spring clean your shed. Many people take a great deal of trouble securing their house and the property within...but what about sheds and garages? With the array of lawnmowers, power tools, garden equipment, bicycles, sports and other valuable equipment kept in them, security measures should certainly be put in place. Property Gardening tools and garden furniture are not cheap - what's more they are very saleable items for the thief. Don't make it easy for them to be stolen and remember that tools stolen from your shed could be used to burgle your house. Postcode or property mark anything in your shed or garage that is of value and might be stolen, for example, lawnmowers, garden furniture, bicycles, sports equipment. Take photographs of expensive items - they may be useful to police to identify the goods and return them to you, should you be unfortunate enough to have them stolen. Never leave garden tools and equipment outside, even if you are just popping back into the house. It only takes minutes for an opportunist thief to strike. Consider fitting a pair of garage door locks that are fitted either vertically or horizontally and can be locked both from the inside and outside of the garage. He has said that incidents like this really need to be reported directly through to 101 or online through the Leicestershire Police online reporting page (Clerk to put information on the Parish Council website) to create evidence for the Police to investigate and to get a crime number. The Clerk is going to liaise with the Vicar and hope that this information will get passed on through to the Church Wardens. 2

3 17108) Chairman s Report. RESOLVED: I have not got a great deal to report this month. As you know the Breedon Priory planning application has been submitted by Cameron homes and will be discussed later in the meeting, however having spent some time looking at the plans I can't find any houses with less than four beds and two are five bedded. I was hoping there would be some lower cost houses for our young people. We have had a letter of complaint from Mrs Cole of Worthington Lane who is very concerned about the removal of the hedge abutting her property, she feels threatened because it has made her home vulnerable from the rear. Mrs Cole also wrote to NWLDC who replied that the proper procedures had been carried out and no rules had been broken. However, the PC wrote to LCC who replied that any access onto a classified road has to have planning approval. The Deputy Director Ann Carruthers informed us that she will be contacting Staunton Harold Estate to inform them of the law. I would like to thank Breedon Group for the continued progress with the wall on Wilson Road it is looking better by the week. Sadly, I have been informed that Tim Hall the MD at Breedon is moving to pastures new. On behalf of the PC I would like to wish him all the best for the future and thank him most sincerely for the invaluable help he has given to the village since his arrival. I am sad to see him go and hope that we can forge an equally good relationship with his successor ) Administration & Finance (a) Clerk's Report. RESOLVED: CLERK S ADMINISTRATION REPORT 7 th August 2017 Breedon, Tonge and Wilson Signage Project Cllr Morris and I have been requesting funding for many months now and whilst we have received funds towards our project it s not been as successful as we d have hoped. We still have a few more companies to try in the next couple of months and request that at the meeting in October we have a final decision on the next stage based on the funds we have received and to discuss what the Parish Council can contribute towards the total cost of the project. Transparency Fund The Transparency Fund application for the Smaller Authorities has been successful the Parish Council has received War Memorial LCC have confirmed that works to the War Memorial as discussed at a site meeting, would be eligible for assistance under Leicestershire County Council War Memorials Project Grant Scheme. Under the terms of the scheme, a contribution of 50% of actual eligible expenditure, up to a maximum of 2000, is currently available. LCC has recommended that in the meantime, the PC should contact James Mattley, Principal planning officer at NWLDC, in addition to James White regarding the need for planning/listed building consents for the proposed works. This has been done and the information I have received from NWLDC Planning is as follows: The contractor has quoted to remove all the external joints. This would not constitute minor repair. I would expect a listed building consent application for works on this scale. The installation of natural stone paving and the reinstatement of the circular stone walls would require Planning Permission. 3

4 NWLDC has said that we can submit a combined application for listed building consent and planning permission. The PC will need to prepare scale drawings to describe the proposals and will need to prepare a statement explaining how the proposals would conserve the significance of the memorial (a heritage statement ). There would also be a planning application fee of 195. The application would take up to eight weeks to determine. Roundabout The Parish Council asked LCC to visit the traffic lights at Donington Park when they attended a site meeting at Breedon. This was to discuss having a mini roundabout here instead of traffic lights. LCC told us that a mini roundabout is not an option in the area, however. On a positive note as the traffic signals have reached their end of life. As part of the replacement assessment they look at the functionality and suitability of the existing facilities. As part of this county council is currently finalising proposals to replace the existing traffic signals and having assessed the site the method of operation at the site will be simplified and red / green man pedestrian displays will no longer be provided. This will simplify the operation of the signals and reduce the amount of street furniture reducing the visual impact of the installation whilst still providing positive control for road users. With reference to the above correspondence regarding the traffic signals at A453 Walton Hill, Castle Donington. The scheme proposals have provisionally been programmed and the works are due to start 23 rd October. This date avoids the school half term holiday period which is likely to generate additional traffic for the airport, major events at the Donington venue and avoids additional HGV traffic generated by the plant auctions held at Donington Park. LCC currently discussing the construction programme with the appointed contractor and would expect the works to be completed within a three-week period. Bulb Planting Application sent off. (b) To confirm the quarterly bank reconciliation with all current bank statements. RESOLVED: All bank accounts have been checked against the bank reconciliation for June 2017 and all balance. All Councillors have a copy of the recent accounts. (c) To note the report received by all Cllrs on the 2017 Breedon Summer Sunday event and to plan for an open meeting to discuss the event in detail, including those that contributed. RESOLVED: All members present at the meeting agreed they were happy with the report put together by Cllr D Keith and would take this as the final document to be published on the Parish Council website and be sent to all those involved in the event. A meeting now needs to be agreed to start preparing the event for next year. The Clerk to get some available dates from the school and report back to Council. Cllr S Jones will chair the meeting. (d) To discuss financial contribution to the repainting works required at Wilson Village sign. RESOLVED: The Clerk received an requesting that the village sign in Wilson be repainted which could be done at a cost of The person who originally painted it has offered to redo it? Apparently, this was some time ago. The Parish Council has asked that the Clerk finds out further details to this request; the identity of the painter, how they intend to paint it and ideally to receive a formal quote with the breakdown of the works required, which will then be discussed at the next Parish Council meeting in September. (e) Recruitment of Parish Lengthsman; To discuss minor works required following Councillors six-monthly checks on parish assets. RESOLVED: There was much discussion on this topic with differing opinions, therefore, it was resolved that each Councillor s a list of jobs that need to be carried out by a lengthsman, if recruited. A response is required by ALL members. This will help to establish what the Parish Council intends to achieve by employing a lengthsman and what hours would be required. (f) NWLDC Green Shoots Application: To note the application completed by Cllr R Morris. RESOLVED: Parish Council agreed for the form to be sent. 4

5 (g) Does the Parish Council wish to comment on the following consultations: - DRAFT Leicestershire Communities Strategy - Working Together to Build Great Communities - - Strategic Housing and Economic Land Availability Assessment (SHELAA) and Brownfield Land Register. RESOLVED: The Parish Council agreed it didn t want to make comment on Leicestershire Communities Strategy, however, stated that there were two potential areas of land in Breedon that could be developed and therefore would reply to the Strategic Housing and Economic Land Availability Assessment (SHELAA) and Brownfield Land Register, which gathers together information on potential sites for housing and economic development and assesses their suitability. The two potential areas that could be developed are the following - one area is at the top of Southworth drive (off Main Street, Breedon) it is thought that this area belongs to NWLDC the other abuts that site and has access from Main Street, it is owned by the Wheatley family who farm land on the south side of Nottingham / Ashby road. (a) Flooding - Cllr D Camp to provide a brief update of actions undertaken by The Flood Working Group since the last Parish Council meeting. RESOLVED: On 10 th July LCC cleared everything under Worthington Lane/Lime Kilns culvert, the flow is much better and now hopefully working efficiently. LCC officer has reported that the public meeting has been put back slightly and is hoped to take place in September. Riparian Ownership letters will also be sent out again very soon as a reminder of responsibilities. (b) To receive an update from the Clerk regarding the Community Signage Project. RESOLVED: Please see above in the Clerk s report ) Planning Applications: (a) Planning Applications: consider and respond to the following: 16/01120/FULM: Removal of existing buildings and erection of 26 dwellings, a new Village Hall, new Commercial/Retail units, new agricultural building together with associated access at Breedon Priory Nurseries, Ashby Road, Breedon On The Hill, Derby, DE73 8AZ. NO OBJECTIONS, in principle, to the development as many, including the Parish Council, are enthusiastic to have this area upgraded, however, the Parish Council have a few concerns including house type, flooding and the proposed Village Hall that need to be addressed prior to approval. - The Parish Council would have preferred more affordable type houses 2/3 bedroomed properties to provide opportunities for the young parishioners, encourage families into the village so ensuring a sustainable future for the school. - Cllr D Camp, who is also the village Flood Warden, has concerns that the flood risk data being used by NWLDC is out of date and with the recent flood events that took place in June 2016 the Parish Council needs to be reassured the plans include adequate flood resilience measures. - The approval of the development is conditional on the provision of the Village Hall and therefore the PC would seek confirmation of this in accordance with previous discussions with the developer. 5

6 17/00967/FUL: Change of use of field for paintballing (D2) including erection of netting and ancillary buildings at Land Off Roundabout, Gelscoe Lane, Diseworth. - No OBJECTIONS; However, the Parish Council has concerns for the way the site will operate. (b) Planning Decisions notified since the previous meeting: 17/00577/FUL: Replacement garage roof: from dual gable to single gable to enable joining of two single garages to form a double garage at Worthington Lane, Breedon On The Hill, Derby, DE73 8AR. PLANNING PERMISSION. 17/00816/AIR: Proposed corporate aviation hangar (Revised Scheme) at Land Adjacent To Vanguard Road/Anson Road, East Midlands Airport, Castle Donington, Derby, Leicestershire. - NWLDC has NO OBJECTIONS to this proposal subject to a note to the applicant in respect of the surface water drainage are brought to attention and as such due consideration should be given to mitigating the potential impacts of surface water run-off from the side. 17/00916/DEM: Demolition of building 47 (former Aeropark) (Prior Notification) at Building 47 Ambassador Road, East Midlands Airport, Castle Donington, Derby, DE74 2SA. NWLDC has NO OBJECTIONS to the proposal. 16/00360/OUTM: Erection of 27 dwellings (Outline application - all matters reserved except for part access) at Land At Worthington Lane, Breedon On The Hill, Derby. Appeal decision: Appeal Ref: APP/G2435/W/17/ REFUSED ) Representatives Reports (a) Cllr D Camp to provide an update on the War Memorial Restoration Project. RESOLVED: We have made our application to the War Memorials Trust and the next step is based on what the response is from the WMT. Please see above in Clerks report for more information. However, it seems like we may have to meet with NWLDC Planning officials initially and maybe modify the pointing works? (b) Cllr D Camp to provide and update regarding proposals of new equipment at Breedon Play Area, which were discussed at a recent meeting with the head teacher and school governors. RESOLVED: We have just received some of the school children s play area sketches to establish what they would like to see in the play area. More are to come once we have received these we will then start to receive quotes from play area specialist suppliers. (c) Cllr J Morrison to update the Parish Council with any progress on the Berry Ave PROW Application. RESOLVED: The Parish Council had received a letter regarding the PROW and the trees along Tonge Lane. Cllr J Morrison had drafted a response for discussion at the meeting, however, the Parish Council objected to sending the letter. It was resolved that the Parish Council would respond to the letter stating that it would continue along the legal enforcement route, with LCC, with regards to the PROW and to request further information as to why the trees are causing concern, as after a site visit, the Parish Council is unable to see an issue ) Correspondence (a) Planning and development Team Structure at NWLDC. - (fwd Cllrs) (b) HS2 Announcement and future consultations. - (fwd Cllrs) - HS2 Phase 2b draft Environmental Impact Assessment Scope and Methodology Report - 29/09/17. - HS2 Phase 2b draft Equality Impact Assessment Scope and Methodology Report 29/09/17. - Crewe Hub: options for building on existing connectivity 12/10/17. - HS2 Phase 2b: Eastern leg rolling stock depot 12/10/17.
