Background Applications for telecommunications facilities are under the jurisdiction of Industry Canada. Industry Canada requires that the proponent of a new telecommunication facility must consult with the municipality and indicate whether the municipality concurs with the application. It is noted that telecommunications facilities are not subject to municipal zoning regulations and municipal concurrence is not necessarily required in order for Industry Canada to issue a licence. Kevin Fowke Acting Chief Administrative Officer Digitally Signed Feb 10, 16 Eastlink is proposing the construction of a 45.7m (150 ft.) high monopole telecommunications tower on lands located at 1506 Fairburn Street in Sudbury. The tower is to be setback approximately 90 metres from Fairburn Street in the rear yard behind the existing multi-unit industrial building on the lot. The subject lands are zoned M1, Light Industrial Service Commercial. To the north is a Canadian National rail line and Canadian Tire retail store. To the east, west and south are M1 zoned industrial developed properties fronting onto Fairburn Street, with Junction Creek and residential dwellings further to the south. The closest residential zone is approximately 200 m (656 ft.) from the base of the tower being the residential lots to the south which have frontage onto Hawthorne Drive. Eastlink has advised that as part of their expansion into the Sudbury market, the subject tower is being proposed to provide wireless service to customers in the New Sudbury, Barrydowne Road and the surrounding area. Co-location Opportunities

2 As required by Industry Canada and the City s Telecommunications Policy, existing communication towers and other structures need to be considered by proponents prior to a new tower being installed. Eastlink has advised that the Bell Mobility tower located at Lasalle Boulevard and Notre Dame Avenue was considered for collocation, however upon review it was determined that the Bell tower is at its structural capacity with insufficient space available for installation of Eastlink s antennas at a height which would achieve their coverage objective for the area. The proposed Eastlink tower on Fairburn Street will provide capacity for Eastlink s immediate and future needs as well as providing collocation opportunities. Tower Proposal Below is a summary of the details of the proposed tower. Tower type 45.7 m (150 ft.) monopole tower; Base of tower and equipment shelter to be enclosed with security fencing (approximately 12 m X 12 m fenced area) and the tower will be equipped with anti-climb apparatus; Access to the tower will be through an existing driveway from Fairburn Street; and Transport Canada and NavCan approvals are pending Eastlink has advised that once the tower is built it monitors the power of its equipment remotely to ensure that Health Canada s Safety Code 6 compliance is maintained. Public Consultation In accordance with the Council adopted Telecommunication Facilities Policy, this tower is classified as "significant" as it is greater than 16.6 m in height and is located within 300 m (984 ft.) of a residential dwelling, residential zone or Living Area Designation in the Official Plan. In accordance with the City s policy for "significant" structures, the proponent was required to hold a neighbourhood meeting and provide notice in the following manner: - newspaper notice - a notice mailed to all property owners within metre radius from the base of the tower, (3 times the height of the tower) - notice to the Ward Councillor - notice to the Director of Planning Services - notice to Industry Canada Eastlink has advised that the Ward 8 Councillor attended and that no members of the public attended at the information session and that they received no comments from the public prior to the February 2, 2016 comment deadline. Summary In conclusion, Eastlink has completed the consultation requirements under the City s Telecommunications Facility Policy. No members of the public attended the public information meeting and no written comments were received by Eastlink by the February 2, 2016 deadline. In conclusion it is recommended that Industry Canada be advised of the City s concurrence with the licence application.
