1 MINUTES OF THE MEETING OF KELSALL PARISH COUNCIL HELD AT THE COMMUNITY CENTRE CHESTER ROAD, KELSALL ON THE 13 th SEPTEMBER PRESENT: Cllr Leather (Chairman), Cllr Dutton, Cllr Mrs Cowell, Cllr Armstrong, Cllr Mrs Berry, Cllr Mrs Lacey, Cllr Mrs Caney. IN ATTENDANCE: Unitary Councillor Bailey, Unitary Councillor Deynem, Unitary Councillor Parker, Police Constable Trow, PCSO Netherton, Mrs Reynolds, Mrs Diggle and one member of the public. 65/10 APOLOGIES: Cllr Lowden, Cllr Castle. 66/10 DECLARATION OF INTERESTS: Members are invited to declare any personal or prejudicial interest in any item of business on the agenda or notes, and, if necessary to leave the meeting prior to discussions on the item. Cllr Mrs Cowell declared a prejudicial interest on the discussion regarding planning application 10/11915/FUL. 2 68/10 MATTERS ARISING: 1. Cllr Mrs Cowell sent the following report on the recent meeting concerning the closing of Day Centres. The Broxton Forum was attended by Parish Councillors, ACDC volunteers, Jill Walters (CEO AC Cheshire) Cathy Reynolds (independent consultant, brought in by AC to try to find a new provider) and members of CWAC. Those present strongly supported Day Care support for the older members of our communities and were not too happy with Age Concern's shift in focus to providing exercise activities for those over 50 (now the new old!) and stopping the day care facilities for the most aged and vulnerable. The feeling was that a one2one service did not cater for social interaction, a day out with friends, a freshly cooked meal, and gave carers very little respite. Mrs Reynolds attended the meeting and gave the following report:- At present the Day Centres are funded by CWaC through Age Concern plus daily charge to members of 7.50, the current cost of keeping the Day Centre open is 13,800 per year which pays for the Age Concern organiser and support staff, the food, rent and overheads. The Centre is for residents aged over 55 who have low or moderate social care need; at present Kelsall has 11 members, 5 of whom come from Ashton so this is not just a Kelsall issue. The Centre provides transport, a social group and a meal with tea and coffee. The proposed closure is an Age Concern policy decision supported by CWaC to move to personal support provision. In a bid to try and keep the Centre open there has been a huge amount of Community Support expressed through petitions etc. Volunteers are working on alternatives and community reps from rural centres are working together potentially to form Community Trust/Consortium with cheaper options being works up. Cllr Leather said the Parish Council would continue to monitor the situation and Cllr Mrs Cowell agreed to be the Parish Council representative at meetings. Cllr Leather said it would be helpful to have an official position paper from CWaC. He thanked Mrs Diggle and Cllr Mrs Cowell for their work in the Day Centre over many years

3 2. Unitary Councillor Deynem said he was still awaiting confirmation from Cheshire West and Chester Council regarding the ownership of the land around the War Memorial. 3. Another branch has come down on the allotments from the trees at the top end of the footpath. Also the tap at the allotments has stopped working. The Clerk has asked Abbotswood Garden Services to remove the branch. The Clerk has contacted United Utilities to report the water fault. Concerns have been expressed by an allotment-holder over numerous fallen branches from the trees on to his plot and the allotment footpath. It was agreed the Clerk will contact a Tree Surgeon to inspect the trees. 4. Police Constable Steve Trow introduced himself to the Parish Council. PC Trow has taken over from the recently retired PC Elliot who for the past two years covered the Kelsall Area. PC Trow said he now covers the largest beat area on the Western Rural which previously had two Officers and one PCSO. He covers Ashton Hayes, Clotton, Duddon, Kelsall, Hargrave, Huxley, Mouldsworth, Tarvin and Willington. PC Trow confirmed that the Police and PCSO s no longer issue parking fines for parking on yellow double lines unless the vehicle is causing an obstruction. This is now carried out by Council Parking Wardens. 69/10 KELSALL GREEN: 1. A meeting was held on the 6 th September with the following points discussed and raised:- - The recreation committee have again requested a wire fence be place around the bottom of Playground fence to stop dogs from getting in. Cllr Dutton agreed to look into the cost and discuss with Mr Nixon - Dog fouling continues to be a problem on the land. The Clerk will contact the Dog Warden for advice. - Mrs Edelman is waiting to hear if her grant for 15, from the Rural Support Programme has been successful. Mrs Edelman reported that she has had some very positive feedback from them. - Mrs Grover has organised a Folk Night to be held on the 18 th September as a fundraiser

4 Cllr Mrs Caney asked again about the footpath stile which was on the corner of the field next to Windy Ridge House. It was agreed that all the Councillors should inspect the location ready for further discussion at the next meeting. 70/10 OPEN FORUM: Members of the public are invited to speak for no more than 10 minutes to the Council. 1. Mrs Read raised concerns about the Tarporley School Busses and their condition. Cllr Deynem asked Mrs Read to her concerns to him. 71/10 PLANNING: 1. Applications received to date: 10/11928/FUL Erection of timber storage building and greenhouse and change of use from Agricultural field to paddock. 91 Quarry Lane, Kelsall 10/12087/FUL Single storey conservatory to rear, 10 Carter Ave, Kelsall. 2. Decision notices to date: 10/11725/FUL Retention of fencing installed to front, Valley View, Quarry Lane, Kelsall. Temporary permission valid until the 30 th April PERMISSION -749-

PERMISSION 10/11614/FUL Detached double garage, 22 Church Street, Kelsall. REFUSED 72/10 OTHER PLANNING MATTERS: 1. The new planning committee for the coming month is Cllr Dutton and Cllr Armstrong. 2. Cllr Leather confirmed that a request to the Unitary Councillors to call in planning application 10/11915/FUL had been made and as a result the Planning Officer had sent Unitary Councillor Parker a detailed report detailing the reasons why he had recommended the application for permission. Cllr Dutton said he felt the application was within the letter of the law but not the spirit. Unitary Councillor Parker felt that he had no argument to use against the application at a planning board. It was agreed to continue to have the application considered by the planning board and to let the Parish Council's objections stand

6 3. Cllr Mrs Caney was asked to review the Tree Preservation Orders in the village. 73/10 CLERKS AND CHAIRMANS REPORT: 1. The Clerk is increasingly finding it a problem to store all the Parish Council's documents at her house and would like the councillor's to consider a permanent solution for future storage of documents, especially planning applications. The Clerk will make enquires about the legal time limits of keeping documents. 2. The Clerk has applied for the 2010/2011 graveyard grant. 3. Cllr Leather said he had been approached by the Cheshire Landscape Trust to provide an endorsement of the help we received on the Village Design Statement. It was agreed that Cllr Leather will write the letter as Chairman of the Parish Council. 4. It was confirmed that both Cllr Mrs Berry and Cllr Armstrong attended the recent Parish Council training course which they found interesting and helpful. 74/10 CORRESPONDANCE: 1. The next Gowy Community Forum will be held on Tuesday 14 th September at Christleton High School starting at 6.30pm. 2. No need for Nuclear House of Commons Early Day Motion 557. Campaign newsletter. 3. The new Parish Council Street Orderly Scheme Grant Agreement has been signed and returned. 4. ScottishPower will be replacing the meter in the Parish Rooms on the 8 th September between 12.00pm 5.00pm. The Clerk has arranged for a phone call 15 minutes before the electrician arrives to enable her to open up the rooms

7 5. County Playing Fields Association annual general meeting to be held on the 19th October 2010 at the Cheshire Football Association starting at am. 6. Information regarding the Rural Touring Film Scheme. It was agreed to see what ideas KADRAS had on the scheme. 7. Cheshire Community Action Retirement and Re-Election of Trustees. The AGM will be held on the 27 th October at the Freemasons Hall in Christleton starting at 6.30pm. Cheshire West and Chester have reimbursed the Parish Council 2, for the street cleaning. 6, Cheshire West and Chester 4000 grant has been received to go towards the Queens Swing. 7. Bank of Ireland proposed transfer of part of our banking business to a new subsidiary, Bank of Ireland (UK) plc. 8. Permission was given to transfer 2,000 from the Lloyds TSB Business Account to the Lloyds TSB Current Account
