1 KINGSLEY PARISH COUNCIL MINUTES OF THE MEETING OF THE KINGSLEY PARISH COUNCIL HELD IN THE KINGSLEY COMMUNITY CENTRE ON TUESDAY 21 ST JULY 2009 AT 730PM Present: Councillor D Fletcher (Chairman) Councillor VGwillim (Vice Chairman) Councillor MBarker Councillor ELewis Councillor D Moores Councillor CMaddock Councillor SIreland Councillor RWilson Councillor GWarburton Councillor MGoodridge In attendance Mrs D Woods (Parish Clerk) Cllr ROultram (Cheshire West & Chester Council) Cllr LRiley (Cheshire West & Chester Council) Prior to the main business of the evening Councillors were addressed at 630pm by Nicola McKean (Cheshire West & Chester Council) on the provision of services to Kingsley Nicola explained that with the new Council there was a drive to provide more services at a local level and the meeting was to look at existing services and to see if they could be improved in the future Any progress from the meeting would be fed into the review currently being drawn up Nicola was made aware of the following carried out by the previous Vale Royal: Bin Emptying at the Cemetery Emptying of the Dog Bins Emptying of the Litter bins from the play areas and other locations in the village Collecting the rubbish sacks as a result of frequent litter picks Nicola noted that the Parish Council currently funds the clearing of footpaths Financially support the local Youth Group Maintain the local cemetery Maintain the local play area Issues where Council would like to see some improvements were as follows: Council expressed their concern at the lack of co-operation on occasions when dealing with overhanging trees on highway land 7

2 Lack of progress in dealing with highway issues and being put onto a list for attention It was felt information as to the position on this list would be beneficial In relation to planning it was felt that a progress update giving feedback on some issues was lacking and the Parish Council was not always informed Reference was made to lack of action in dealing with illegal parking on double yellow lines Councillor Riley reported that at present the Police were the only officers who could issue tickets Discussions were currently taking place with a view to decriminalising parking issues so that a Council employee would be able to issue tickets and this could improve the situation She also stated she would be pleased to talk to Council in September on this subject Nicola indicated that the Review into service provision would be taking place between July and October and if any other issues came to mind she would be pleased to incorporate it into the review Councillor Riley reported on items currently being looked at in relation to having a county bank of services which could be bought by the parishes Insurance and Legal services were used as examples Council felt this would be a good idea The Chairman thanked Nicola for attending and looked forward to the outcome of the review MEETING NO 2 09/594 Apologies for Absence Councillor B Brooker 09/595 Minutes of the Meeting held on the 16 TH June 2009 Page 4 Item 09/588 Youth Issues Report Should read Nothing to report not No report Page 4 Item 09/590 Community Liaison Report Should read ~Nothing to report not No report With the above amendments made the Minutes were approved and signed by the Chairman as a true and correct record 09/596 Matters arising from the Minutes Amendment to Standing Orders Council agreed the proposed changes as given below: 26 Members shall declare any pecuniary interests, direct or indirect in accordance with the Code of Conduct Local Government Act 2000 and he or she will withdraw while it is under consideration unless the Council invites him or her to remain 8

3 27 & 28 To remain the same There were no further matters arising 09/597 Chairman s Remarks Hanging Basket Competition 2009 After discussion it was agreed not to host a Hanging Basket Competition in 2009 Councillor Training Frodsham Town Council It was noted that the proposed training session operated by CHALC would take place on 10 th September at 1000am at Castle Park Arts Centre Frodsham Councillors Attending: Councillors Fletcher, Gwillim, Brooker, Wilson At a cost of 2000 per person 09/598 Opportunity for Public to raise issues None received 09/599 Planning Issues Council noted that during August plans would be dealt with by E Mail to all Councillors unless it is felt there is a need to call an extra ordinary Meeting 1, Council noted the Planning decisions made by the Borough Council Acres Crescent PERMISSION Single storey side & rear extensions 09/00570 Trout Fishing Pool Hollow Lane PERMISSION Provision of wardens office and Previously approved car parking facility 09/00614 Rose Bank Cottage Dark Lane PERMISSION Removal of condition 1 AP2003/ Council Considered the following plans: 09/00614/FUL Rose Bank Cottage NO OBJECTIONS Removal of condition 1 of PP2003/ /1084/FUL Old Hall Farm NO OBJECTIONS Hillfoot Lane providing materials in Demolition of two farm buildings keeping with local Erection of a steel portal framed landscape Building 9

4 Councillor D Moores Declared an Interest in the following item and took no part in any discussions 09/01130/FUL Methodist Church NO OBJECTIONS The Hurst Kingsley Replacement front doors 09/600 Finance (A)Council approved payment of the following: Cheque KMSutton (Grass cutting) *** Hough & Co (Legal fees) 11500(VAT1500) *** KMSutton (Footpaths) *** Pure Safety (Dog Signs) 6434 (VAT839) *** DFletcher (Lock playing field) Scottish Power (Cemetery) 7080(VAT337) DMoores (Repairs seat) Audit Commission (Extaudit) (VAT4275) Picture Garden (Cemetery) Picture garden (installing dog bins) British Telecom 10910(VAT1364) DWoods (July) A Walker (July) (B)Council NOTED receipt of the following payments Nat West Bank (Bank interest) 255 (C) Council Received the Financial Report & Bank Reconciliation as at Standing Orders were suspended for ten minutes 09/601 Borough Councillor s County Councillor s Remarks Councillor R Oultram Pavement in Scotland s Lane No further progress with acquisition A site visit had been made to see what was possible It was proposed to get an Engineer to come out and try to design a path on the inside of the hedge 09/602 Affordable housing Councillors expressed their concern at the changes in facts given by Cheshire West and Chester and a lengthy discussion took place on the three proposed sites (Pike Lane) (Westbrook Road)(Chapel Lane) Following the above a paper ballot was taken and the preferred Site by a majority vote was Pike Lane 10

5 The Clerk was instructed to inform Phil Addison at Cheshire West & Chester and to request a speedy response back from them as residents are now waiting for the public consultation Details of time scale would be beneficial 09/603 Survey update (CllrMoores) deferred from previous meetings This matter now incorporated in the proposed :Parish Plan and to be removed from future Agendas 09/604 Parish Plan Councillor Grwillim reported she had commenced looking into grant funding and reported she would like to act as Secretariat for this project and to head up Section heads This was agreed by Council 09/605 Playing Field Report The Clerk reported on maintenance information obtained from Norley Parish Council and Northwich Town Council Following discussion it was agreed that Northwich Town Council be asked to carry out future repairs at a cost of ~ 2100 per hour plus parts The Annual Independent inspection to be carried out by Wicksteeds At a cost of 4500 Councillor Fletcher reported on the tree that had a fallen branch onto a residents shed This had been attended to by the Old Vicarage Concern had been expressed at the loss of light through the density of some trees and it was agreed that The Old Vicarage Nursery be approached to see what could be done to improve the area It was noted the ~Lock/Chain had now been fitted to the gate and the residents had been given copies of the lease/licence in relation to the opening/closing of the gate 09/606 Cemetery Report Councillor Warburton reported that the new cemetery gates have now been fitted and secured A letter of thanks to be sent to Mark Lewis from the Council for making the gates free of charge A letter of thanks also to be sent to Steve Wales the Landlord of the Red Bull for facilitating the collection for funds to pay for the materials A photo shoot had taken place and should be in the Chester Chronicle in the near future 09/607 Footpath Report 11

6 No report 09/608 Traffic & Transport Report Councillor Moores reported that he had held a meeting with Ian Woodward from Highways at Cheshire West and Chester Issues discussed: 1 Make sure that all highway signed in the village are cleaned 2 Parking outside the post office Possible making more of the grass verge with introduction of additional planters 3 Brook outside Red Bull Road edging starting to slip into the brook 4 Vegetation overhanging the stream Brookside road/red Bull Cheshire West would try to establish ownership of the stream/ It was also noted that the bench on Top Road had now been repaired and painted Reference was also made to the bottom of Dark Lane/Top Road/Brookside where there used to be an open grid this covered over some years ago by the then Parish Council railings at this point need repair Old Cheshire Railings now discussing with Scottish Power who appear to own the land Councillor Wilson stated that the report received from County in relation to Kingsley Road indicated that no action was to take place into introduction of speed limits When approached they indicate that some improvements have been made in this are with additional signs and chevrons, Following some discussion the Clerk was requested to arrange a site meeting with Richards Flood to discuss The Clerk was also requested to look into the Disabled parking outside the Community Centre which had still not taken place 09/609 Kingsley KU 17 Club Report Nothing to report 09/610 Youth Issues Report Councilor Wilson reported he had attended the last meeting but there were current difficulties with lack of officers attending due to changes in personnel Would keep an eye on it, 09/611 Website Report Councillor Goodridge reported still going well 09/612 Community Liaison Report 12

7 Councillor Barker referred to the community support recently received in relation to the supply and provision of the new cemetery gates and the repairs to the bench It was noted that a couple of groups were querying details of the carnival scheduled for /613 Community Pride/Litter Picks/Orchards Councillor Gwillim reported that the dog bins were being used and had been added to the list for emptying Nettles along the stream needed to be strimmed Council General Assistant to be requested to carry out the work (Councillor Warburton to arrange) The litter pickers on holiday during August It was agreed to purchase an additional 6 pitter pickers Damaged Phone Box to be removed 09/614 Carnival 2010 Councillors Lewis and Ireland reported that despite putting out posters they had not received any details of volunteers as yet It was noted that unless this help came forward they would be unable to lead the 2010 carnival Some discussion took place following which it was agreed this would be held over until September/October meeting 09/615 Correspondence Received Since last Meeting: Council noted receipt of the following correspondence (a) (b) Cheshire West & Chester Council None received Miscellaneous Neuro Muscular Centre (Summer newsletter) SLCC (details of conference 2009) Allianz Cornhill (Proposal form re libel & slander indemnity) Land Registry (Guide to registering parish land) (Councillor Fletcher) Meeting closed at 920pm Signed Date 13
