Arran Local Plan Area 1.1 N/04/00430/PP: Lamlash: Cordon: Site to the West of Tigh-An-Eilean Sarah Thomson, Kilbride Manse, Lamlash, Isle of Arran, has applied for planning permission for the erection of stables on a site to the west of Tigh-an-Eilean, Cordon, Lamlash, Isle of Arran. An objection has been received from Mrs. E. McLaren, 17 Spylaw Road, Edinburgh (Arthurlie, Cordon). The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:- 1. That the stables hereby approved shall be for the private use of the applicant and no commercial activity shall take place on site. 2. That before the commencement of the development, hereby approved, details of the drainage disposal scheme shall be submitted to and approved in writing by North Ayrshire Council as Planning Authority. 3. That the development, hereby approved, shall not be occupied until the approved drainage disposal scheme is operational in accordance with the details approved in terms of Condition 2. Page 1

That prior to the occupation of the stables hereby approved, a 1.8m high screen fence shall be erected along the position marked blue on the approved plans and shall be retained in this position unless agreed in writing by North Ayrshire Council as Planning Authority. 1.2 N/04/00369/PP: Lamlash: Site to the South of Ardmillan John Thomson Construction Ltd., Lamlash, Isle of Arran, have applied for planning permission for the erection of 3 detached dwellinghouses on a site to the south of Ardmillan, Lamlash, Isle of Arran. Objections have been received from G. Pettigrew (Ardmillan, Bungalow Road), 41 Southbrae Drive, Glasgow, Mrs. Margaret MacAlister, Redhurst Cottage, Shore Road and Mrs. Maureen P. Edwards, Appin, Bungalow Road, both Lamlash, Isle of Arran. The Chief Development Control Officer reported that a late consultation response from West of Scotland Archaeological Service has advised that the site lies within a known archaeological recorded site. Other applicants in this area have been required to undertake archaeological investigations. the application subject to the following conditions:- 1. That foul drainage from the development shall be connected to the public sewer prior to the occupation of the house hereby approved. The applicant shall submit for the written approval of North Ayrshire Council as Planning Authority, exact details of the proposals for connecting foul drainage from the development to the existing public sewer. 2. That prior to the occupation of the dwellinghouses hereby approved, 1) the existing road shall be widened to 5.5m along the site frontage, 2) a 1.5m wide footway shall also be formed along the site frontage and 3) footway crossings to each dwellinghouse shall be completed, all to the satisfaction of North Ayrshire Council as Planning Authority. 3. That the driveways shall be double width (5m) and the first 2 metres of the access, measured from the heel of the footway shall be hard surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway, prior to the occupation of the dwellinghouses hereby approved. 4. That prior to the occupation of a house 3 car parking spaces shall be provided within the site (garage constitutes 1 space) to the satisfaction of North Ayrshire Council as Planning Authority. That the development, hereby approved, shall not commence until the developer has secured the implementation of a programme of archaeological works in accordance with a written scheme of investigation. This scheme shall be submitted to, and approved in writing by, North Ayrshire Council as Planning Authority, following consultation with the West of Scotland Archaeology Service. Thereafter the developer shall ensure that any programme of archaeological works which may be approved shall be fully implemented and that all recording and recovery of archaeological resources within the development site is undertaken to the satisfaction of North Ayrshire Council as Planning Authority. 1.3 N/03/00667/PP: Kildonan: The Garage D. Tait, 'Corriedoon Cottage', Whiting Bay, Isle of Arran, has applied for retrospective planning permission for a change of use from a vacant store to form a Motor Vehicle Workshop at 'The Garage', Kildonan, Isle of Arran. Objections have been received from J.W. Campbell, Laphroaig, Kildonan, Mr. and Mrs. W. Wilshaw, Waters Edge, Kildonan, Mrs. Dorothy Russell, Seaview, Kildonan and Arran Civic Trust per John Roberts, 3 Glen Place, all Brodick, Isle of Arran. the application subject to the following conditions:- 1. The change of use hereby approved shall cease on 30th June At the end of the period of consent referred to in Condition 1, the forecourt area to the front of building shall be restored to its former condition within two months of expiry of the date of consent. 3. No vehicular repairs or external storage of any related equipment shall take place outwith the building. 1.4 N/04/00429/PP: Machrie: Douglas Cottage Brian Money, Douglas Cottage, Machrie, Isle of Arran, has applied for retrospective planning permission for the erection of 2 side conservatories on a detached dwellinghouse at that address. An objection has been received from John Roberts, Arran Civic Trust, 3 Glen Place, Brodick, Isle of Arran. The Sub Committee, having considered the terms of the objection, agreed to grant the application. Page 3

4 1.5 N/03/00240/PP: Brodick: Auchrannie Road: Site to the Northeast of Auchrannie Country House Auchrannie Leisure Ltd., Auchrannie Country House Hotel, Brodick, Isle of Arran, have applied for planning permission for the erection of 12 detached dwellinghouses and the formation of an access road on a site to the northeast of that address. Objections have been received from Gwen and Alex Mutch, Gushet Neuk, Brodick, P. S. and K. M. M. Hall, Findlay House, Auchrannie Road Brodick, Arran Civic Trust per John Roberts, 3 Glen Place, Brodick, Michael Main, Oakbank House, Auchrannie Road, Brodick, Ms. Lisa Griffiths, Pennyghael, Auchrannie Road, Brodick, Dr. D. W. Campbell and Mrs. B. P. Campbell, The Rustlings, Auchrannie Road, Brodick, Mrs. M. Smith, Rowan Cottage, Auchrannie Road, Brodick and Robert Hanna, Cnoc Brec, Corrie, all Isle of Arran. Representations were also received from the Isle of Arran Community Council. The Sub Committee, having considered the terms of the objections and representations, agreed to grant the application subject to the following conditions:- 1. That prior to commencement of the development, hereby approved, details of the drainage arrangements shall be submitted to and approved in writing by North Ayrshire Council as Planning Authority. That the surface water arising from the site shall be treated in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000" to the satisfaction of North Ayrshire Council as Planning Authority. 2. The developer shall undertake recording of archaeological resources within the development site to the satisfaction of the Planning Authority. No development shall take place within the development site until the developer has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation, this scheme to be submitted for approval by North Ayrshire Council as Planning Authority following consultation with the West of Scotland Archaeology Service. 3. That the developer shall secure the implementation of an archaeological watching brief, to be carried out by an archaeological organisation acceptable to North Ayrshire Council as Planning Authority, during development work. The retained archaeological organisation shall be afforded access at all reasonable times and allowed to record and recover items of interest and finds. Terms of Reference for the watching brief will be supplied by the West of Scotland Archaeology Service. The name of the archaeological organisation retained by the developer shall be given to North Ayrshire Council as Planning Authority and to the West of Scotland Archaeology Service in writing not less than 14 days before the development commences. That the roadway, junction details and parking shall be completed in accordance with the details shown on drawing No 2056/A1/03 Rev A dated 4 August 2003 prior to the occupation of the houses on plots 11 and 12. In addition the following details shall be addressed:- (1) The Spa access road shall be upgraded from the existing limit of the adopted public road to a point 15 metres beyond. The standards shall be a 5.5m wide carriageway with a 1.5 metre wide footway on the south side of the Spa Road and a 1.5 metre verge/footway on the north side of the road with positive drainage and street lighting; (2) The traffic calming measures shall be redesigned to provide chicane type detail as agreed with the road services; (3) The junction into the new development shall be via a ramp shared surface design as detailed in the Council's Roads Development Guide; (4) Site lines at this junction with the Spa Road shall be 2.5 metres by 60 metres and (5) The new shared surface road shall be 5.5 metres wide with two 1.5 metre wide service strips. 5. That prior to any works commencing on site details of the remediation measures for the surface water flow through the site shall be submitted to and agreed in writing with North Ayrshire Council as Planning Authority. The approved measures shall be implemented prior to the occupation of any of the houses hereby approved and thereafter maintained to the satisfaction of North Ayrshire Council as Planning Authority. 6. That prior to the occupation of any of the dwellinghouses and where Council adoption of landscaped areas and trees is not to be pursued, there shall be submitted for the approval of North Ayrshire Council as Planning Authority, details of the proposed factor or management agency and a landscape management plan, including long term design objectives, management responsibilities and maintenance schedules for all landscaped areas and trees. The landscape management plan shall be carried out as approved and the agreed agency shall only be changed with the consent of the majority of householders and the agreement of North Ayrshire Council as Planning Authority. 7. That the treatment of the boundary enclosures or plot divisions shall be agreed in writing with North Ayrshire Council as Planning Authority prior to the commencement of any works. Page 5

6 8. That existing trees to be retained are protected in accordance with the methods set out in BS3998/1989 and BS5837/1991 during, and until completion of, all site operations and building works. 9. That development shall not begin until detailed plans, illustrating in cross-section form, the existing and proposed ground levels, finished floor levels of the proposed houses and the extent of any underbuilding proposals, have been submitted to and agreed in writing by North Ayrshire Council as Planning Authority. 2. Ardrossan, Saltcoats and Stevenston Local Plan Area 2.1 N/04/00255/PP: Saltcoats: 59 and 61 Moffat Wynd (Plots 31 and 32) Acre Developments Ltd., Melvin House, Dalry Road, Kilwinning, have applied for planning permission for the erection of 2 detached dwellinghouses and a double garage (amendment to previous consent No. 01/00412/PP) at 59 and 61 Moffat Wynd (Plots 31 and 32), Saltcoats. An objection has been received from W. McMillan, 45 Moffat Wynd (Plot 24), Saltcoats. The Sub Committee, having considered the terms of the objection, agreed to grant the application. 2.2 N/04/00027/PP: Stevenston: 123 Glencairn Street Tony Smith, 123 Glencairn Street, Stevenston, has applied for planning permission for the erection of an extension to the rear of the dwellinghouse at that address. Objections have been received from R. Smith, 121 Glencairn Street and Ms. Sarah Conway, 125 Glencairn Street, both Stevenston. the application. 2.3 N/04/00437/OPP: Saltcoats: Jacks Road: Site at Laighdykes Playing Fields and St. Andrews Academy Keppie Planning Ltd., 160 West Regent Street, Glasgow, have applied for outline planning permission for the demolition of a secondary school and the erection of a new denominational secondary school and associated works on a site at Laighdykes Playing Fields and St. Andrew's Academy, Jacks Road, Saltcoats. Objections have been received from Mr. and Mrs. K. Cunningham, 2 Waverley Place, Mr. and Mrs. H. A. Smets, 4 Waverley Place, W. Mitchell, 14 Mitchell Place, John and Carol Hopkins, 12 Mitchell Place, Ms. Morag S. Lamb, 11 Mitchell Place, W. Iain A. Lamb, 11 Mitchell Place, Ms. Catherine M. G., Adams, 11 Waverley Place, Mrs. Annabelle D. O'Hanlon, 9 Waverley Place, Wm. and A. F. McPhail, 7 Waverley Place, Ms. Lorraine Vogwell and Paul Tulloch, 27 High Road, Paul and Stephanie Burns, 13 Owen Kelly Place, Mr. and Mrs. W. Stewart, 39 St. Mary's Place and Mr. and Mrs. A. & M. 7 A further 3 late objections were received from Mrs. E. Conlan, 43 St. Mary's Place, Mr. and Mrs. M. Gregory, 1 Welsh Place and Mr. and Mrs. McNicol, 35 Caledonia Road, all Saltcoats. The Chief Development Control Officer reported that a late consultation response from West of Scotland Archaeological Service has advised that the site lies within an area of known archaeological sensitivity. the application subject to (a) notification to the Scottish Ministers in terms of the Town and Country Planning (Notification of Applications) (Scotland) Directions 1997; and (b) the following conditions:- 1. That the approval of North Ayrshire Council as Planning Authority with regard to the siting, design and external appearance of, landscaping and means of access to the proposed development shall be obtained before the development is commenced. 2. That the surface water arising from the site shall be treated in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000" to the satisfaction of North Ayrshire Council as Planning Authority. 3. That the presence of any significant unsuspected contamination that becomes evident during the development of the site shall be brought to the attention of Environmental Health, together with a suitable investigation strategy and remediation works that shall be implemented thereafter. 4. That the reserved matters required by condition 1 shall include a revised Transportation Assessment and Travel Plan considering the following issues: (a) access and parking arrangements for staff, school buses and parents/visitors attending the school; (b) pedestrian routes into the campus; (c) the provision of new traffic signals and pedestrian crossings at the Jack's Road/High Road junction; (d) the internal layout of the school campus which should endeavour to segregate children from vehicles; and (e) arrangements for construction traffic. 5. That the reserved matters required by condition 1 shall include details of the layout and specification of the playing fields at the site, following consultation with sportscotland, and shall include two full-size synthetic pitches, positive proposals for the remaining playing fields at the site, including enhanced specifications, drainage and layout, and shall not result in significant additional loss of playing fields. 6. That there shall be no vehicular access to the site from any of the roads adjoining the southern boundary of the site. Page 7

That the development, hereby approved, shall not commence until the developer has secured the implementation of a programme of archaeological works in accordance with a written scheme of investigation. This scheme shall be submitted to, and approved in writing by, North Ayrshire Council as Planning Authority following consultation with the West of Scotland Archaeology Service. Thereafter, the developer shall ensure that any programme of archaeological works which may be approved shall be fully implemented and that all recording and recovery of archaeological resources within the development site is undertaken to the satisfaction of North Ayrshire Council as Planning Authority. 3. Garnock Valley Local Plan Area 3.1 N/04/00311/PP: Kilbirnie: 36 Cochrane Street Mr. and Mrs. A. Paul, c/o 22 Southneuk, Kilbirnie, have applied for planning permission for the demolition of the stair enclosure and attached porch and the erection of a 2 storey extension to the rear of the dwellinghouse at 36 Cochrane Street, Kilbirnie. Objections have been received from W. McKinnon, 3 Rosebery Court and H. McKinnon, 2 Rosebery Court, both Kilbirnie. the application. 3.2 N/04/00208/PP: Kilbirnie: Plan Farm Stephen Downie, Plan Farm Bungalow, Kilbirnie, has applied for planning permission for the erection of a single storey dwellinghouse at that address. The Sub Committee agreed to grant the application subject to (a) the applicant entering into an Agreement in terms of Section 75 of the Town and Country Planning (Scotland) Act 1997 to limit occupation of the house to the applicant or a person employed in the applicant's business or a dependant of such a person or a person solely or mainly employed or last employed, in the locality in agriculture as defined in Section 277 of the Town and Country Planning (Scotland) Act 1997 or in forestry, or a dependant of such a person residing with him or her, or a widow or widower of such a person; and (b) the following conditions:- 1. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority: i) exact details or a sample of the proposed roof finishes; and ii) revised proposals for the windows to create a more traditional appearance. 2. That any significant contamination which becomes evident during the development of the site shall be brought to the attention of North Ayrshire Council as Planning Authority together with a scheme of remediation prior to any further work taking place. That prior to the commencement of the development the applicant shall submit for the written approval of SEPA and North Ayrshire Council as Planning Authority exact details of the proposed drainage arrangements which, if a septic tank and sub-soil soakaway system is employed, will involve percolation testing and the exclusion of surface water from the septic tank. 4. That if a septic tank is installed, it shall be located in such a position as will enable it to be emptied by road tanker. 5. That notwithstanding the permission granted by Article 3 of and Classes 1 and 3 of Part 1 of Schedule 1 of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (or any Order revoking or re-enacting that Order) the express approval of North Ayrshire Council as Planning Authority shall be required in respect of any development within the curtilage of the dwellinghouse. 6. That notwithstanding the permission granted by Article 3 of and Class 7 of Part 2 of Schedule 1 of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (or any Order revoking or re-enacting that Order) the express approval of North Ayrshire Council as Planning Authority shall be required in respect of any gates, fences, walls, or other means of enclosure within the curtilage of the dwellinghouse. 3.3 N/04/00014/PP: Beith: 83 Eglinton Street John and Janice Mann, Beith Christian Centre, 46 Manual Avenue, Beith, have applied for planning permission for the change of use from a garage to a Church at 83 Eglinton Street, Beith. Objections have been received from John Torrens, 64 Eglinton Street and Miss J. Nixon, First Floor Flat, 72 Eglinton Street, both Beith. the application subject to the following conditions:- 1. That prior to the commencement of the use of the building as a church, the applicants shall: i) submit for the written approval of North Ayrshire Council as Planning Authority a revised parking layout showing the provision of a minimum of 14 car parking spaces within the site; and ii) form the approved car parking facility to the satisfaction of North Ayrshire Council as Planning Authority. 2. That the access shall be designed to ensure that no surface water shall issue from the site access on to the public road. 3. That the nursery shall be used only for purposes ancillary to the use of the building as a church. Page 9

10 3.4 N/04/00086/PP: Beith: 2-6 Mitchell Street G. & N. Conrathe, Moorpark House, School Road, Kilbirnie, have applied for planning permission for the erection of a hotel and restaurant and the formation of a car park at 2-6 Mitchell Street, Beith. Representations have been received from Kirk View Owners Association, per Frederick G. Monk, 8 Kirk View and Miss Ailsa Lockhart, 6 Kirk View, both Beith. The Chief Development Control Officer reported on the terms of written representations submitted by the Local Member. The Sub Committee, having considered the terms of the representations, agreed to grant the application subject to the following conditions:- 1. That, prior to the commencement of the hotel use, car parking for 36 vehicles shall be provided and shall be maintained thereafter, to the satisfaction of North Ayrshire Council as Planning Authority. 2. That the car park shall take vehicular access only off New Street and shall have adequate lighting and CCTV installed, to the satisfaction on North Ayrshire Council as Planning Authority. 3. That a footpath link with adequate lighting shall be formed from the rear of the hotel to the car park. 4. That a 2 metre wide footway shall be formed across the full frontage of the site on Mitchell Street and a 12 metre long service/drop-off layby shall be formed at that frontage. 5. That the surface water arising from the site shall be treated in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000" to the satisfaction of North Ayrshire Council as Planning Authority. 6. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority details or samples of the proposed external finishes. 7. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority details of boundary treatments and landscaping at the proposed car park. 11 4. Irvine/Kilwinning Local Plan Area 4.1 N/03/01155/PP: Dreghorn: 165 Main Street R. Gale, 15 Barbadoes Road, Kilmarnock, has applied for planning permission for the erection of a dwellinghouse on plot 1 at 165 Main Street, Dreghorn. Representations have been received from John Robb, 156A Main Street, Robert Rodger, 167 Main Street and Ms. Sarah M. Stevenson, 165B Main Street, all Dreghorn. The Sub Committee, having considered the terms of the representations, agreed to grant the application subject to the following conditions:- 1. That vehicular access to the site shall be provided with a drop kerb footway crossing to be formed as detailed in sections 5.2 and 10.8 ( and fig ) of North Ayrshire Council's Roads Development Guidelines. 2. That the first 2 metres of the access, measured from the heel of the footway shall be hard surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway. 3. That prior to the commencement of the development a revised layout plan shall be submitted for the written approval of North Ayrshire Council as Planning Authority showing how plot 2 can be provided with an adequate driveway layout, including a turning area. 4. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority details or samples of the proposed external finishes. 5. That the treatment of the boundary enclosures shall be agreed in writing with North Ayrshire Council as Planning Authority prior to the commencement of any works. 4.2 N/03/01063/PP: Irvine: 4 Renton Park A. McCulley, 4 Renton Park, Irvine, has applied for planning permission for the erection of a 2 storey extension to the rear of the detached dwellinghouse at that address. An objection has been received from Keith and Kirsty MacDonald, 12 Hepburn Way, Lawthorn, Irvine. The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:- Page 11

That prior to the commencement of the development the applicants shall: i) submit for the written approval of North Ayrshire Council as Planning Authority details of proposals for the erection of screen fencing along the north-west boundary of the site; and ii) construct the approved fence and maintain it thereafter, all to the satisfaction of North Ayrshire Council as Planning Authority. 2. That the existing garage and double width driveway shall be retained for vehicle parking and shall not be altered or used for any other purpose without the prior written approval of North Ayrshire Council as Planning Authority. 4.3 N/02/00681/ADC: Irvine: 64A Ayr Road Auto One, 64A Ayr Road, Irvine, have applied for retrospective advertisement consent for the erection of various illuminated signboards at that address. The Sub Committee agreed (a) to refuse the application on the following ground:- 1. The advertisements are contrary to the Council's adopted Policy on Advertisements as set out in RET 13 in the Adopted Irvine/Kilwinning Local Plan and TC 8 in the finalised North Ayrshire Local Plan (excluding Isle of Arran) due to the excessive clutter and their dominance on the front elevation of the building which are both detrimental to the amenity of the area and visual appearance of the building. and (b) to take enforcement action under Section 24 of the Town and Country Planning (Control of Advertisements) (Scotland) Regulations North Coast and Cumbraes Local Plan Area 5.1 N/04/00452/PP: West Kilbride: 5 Jacks View G. McDougall, 43 Snowdon Terrace, West Kilbride, has applied for planning permission for alterations and a one and a half storey extension to form a new lounge and en-suite bedroom at 5 Jacks View, Kilbirnie. Objections have been received from Keith Howie, 20 Douglas Place, Largs, M. McCorrison, 6 Well Street and Mr. and Mrs. Whittingham, 7 Jacks View, both West Kilbride. the application. 5.2 N/03/00900/PP: Largs: 108 Irvine Road A. Bainbridge, Haylie Hotel, 108 Irvine Road, Largs, has applied for planning permission for the erection of a 2 storey detached dwellinghouse with detached double garage, alterations to an existing hotel to form new access and the erection of 1.2 metre and 1.8 metre high timber fencing at that address. Objections have been received from Mr. and Mrs. F. Martinelli, 14 Anthony Road, C. Hendry, 16 Anthony Road and F. Faealey, 7A Rockland Park, all Largs. Page 12

13 the application subject to (a) the applicant entering into an agreement under Section 75 of the Town and Country Planning (Scotland) Act 1997 to formalise vehicle and pedestrian access to the proposed house and servicing and staff parking arrangements for the hotel; and (b) the following conditions:- 1. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority full details of proposals for the attenuation and disposal of surface water from the development.
