1 RESOLUTION NO Adopted by the Sacrame nto C ity Counc fl Nove mber 1 5, DECLARING, CHANGING AND REESTABLISHING PRIMA EAGIE AND MAXIMUM SPEED LIMITS ON VARIOUS STREETS AND RESCINDING RESOLUTION BACKGROUND A. Or) December 7, 2004, Council adapted Resolution that declared prima face speed limits and maximum speed limits on identified City streets. B. Staiftypically requests Council approval periodically, to establish, change, or re establish speed limits on various new or existing City streets. C, Speed limits are established using Engineering and Traffic Surveys.. As directed by State law (CVC 627), the 85th percentile methodology and engineering judgment was used to determine the appropriate speed limit for each roadway segment. Li Speed surveys are typically enforceable for a period of seven years. Evidence of speeding by radar is inadmissible in court unless a current Eng ineer ing and Traffic Survey justifies the speed limit. Thus, the Engineering and Traffic Surveys must be re-established before their expiration date, E. The previously adopted Council resolution (Resolution ) will need to be rescinded in order to incorporate the new or changed speed limits with a new resolution.. Exhibit A provides a table which summarizes the new, changed, and re-established speed limits within the City. Exhibit B identifies the Citywide speed limit list that will be adopted as part of this resolution. BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS: Section t Pursuant to California Vehicle Code Sections 32, 627, 22352, , 22357, and 22358, the following declared prima fade speed limits (and maximum speed limits) have been established with an Engineering and Traffic Survey within seven years and are established as shown in F Exhibit A: List Summari zi ng the Resolution s Engineer i ng and Traff ic Surveys; and Exhibit B: Resolution Speed Limits,.
