3 House Bill 1176 Applicable Provisions Budgetary Projections With the passage of House Bill 1176 in the summer of 2006, a new section of law was codified in the Oklahoma Statutes as Section 507 of Title 69. This law effectively creates the County Improvements for Roads and Bridges (CIRB) program and reads as follows: A. There is hereby created in the State Treasury a revolving fund to be known as the County Improvements for Roads and Bridges Fund. The fund shall be a continuing fund, not subject to fiscal year limitations, and shall consist of all appropriations and transfers made by the Legislature and the apportionments made pursuant to subsection L of Section 1104 of Title 47 of the Oklahoma Statutes. All monies accruing to the credit of said fund are hereby appropriated and may be budgeted and expended beginning with the fiscal year ending June 30, 2008, and each fiscal year thereafter pursuant to subsection B of this section. Expenditures from said fund shall be made upon warrants issued by the State Treasurer against claims filed as prescribed by law with the Director of State Finance for approval and payment. B. The funds apportioned pursuant to subsection L of Chapter 74, Section 1104 of Title 47 of the Oklahoma Statutes shall be in equal amounts to the various Transportation Commission districts. The funds shall be used for the sole purpose of construction or reconstruction of county roads or bridges on the county highway system that are of the highest priority as defined by the Transportation Commission. Counties may accumulate annual funding for a period of up to five (5) years for a specific project, with such funding to be held by the Transportation Commission to the credit of the county project. The Transportation Commission shall promulgate rules for the administration of the process and the development of criteria for determining the level of priority for projects and include such projects in a five-year construction plan that will be updated annually. Projects in the five-year construction plan shall be contracted as provided by law and awarded by the Transportation Commission. C. The fund shall be invested in whatever instruments are authorized by law for investments by the State Treasurer and the interest earned by any investment of monies from the fund shall be credited to the fund which shall earn the same, if there is any unexpended balance of such fund to which to credit the interest. The interest credited herein shall be expended pursuant to this section. Key Provisions of the CIRB Program Ultimately, 20 percent of the Motor Vehicle Tax will be directed to the County Improvements for Roads and Bridges (CIRB) fund which is administered by the Department. Previously, this portion of the taxes and fees went to the General Revenue Fund. The apportionment for the County Improvements for Roads and Bridges (CIRB) has increased from 5% percent in SFY 2008 to 18 percent as of the beginning of S. When fully implemented in SFY 2015, the estimated annual amount provided to county roads is estimated to be $120 million. The funds are directed to be equally distributed by the Department s eight (8) Transportation Commission Districts and administered by the Department through the utilization of a Transportation Commission approved five-year construction work plan for projects on the county road system. The five-year CIRB plan is developed through careful coordination with the County Commissioners along with the assistance provided by their respective Circuit Engineering Districts. Projects included in the CIRB plan consist of the highest priority, most critical projects as identified and validated by the cooperative project recommendation, selection and approval process. 1

5 Selection and Balancing Process The balancing and management of the CIRB Construction Work Plan is progressed in accordance with the roles and responsibilities generally defined in the following outline: County Commissioners The development of the CIRB Construction Work Plan begins with the identification of potential projects by the County Commissioners and is guided by their knowledge of the transportation needs and priorities in their respective Districts. They and their staff work to maintain an understanding of the condition of the roads and bridges in their areas of responsibility and typically consider the following general project selection characteristics as applicable and listed in no particular order: Surface condition Bridge condition Geometrics (horizontal and vertical alignment) Average annual daily traffic (AADT) Percentage of truck traffic Accident history Local, regional and sometimes national traffic patterns Capacity The further understanding gained from these considerations is coupled with the definition of a critical, high priority project to guide the Commissioner s recommendations. As a result, recommended CIRB projects are anticipated to be comprised of improvements to the county transportation system that advance the safety and mobility benefits realized by the traveling public and commerce and the extent that the projects will enhance the overall level of service and longevity of these facilities. For example: Given the current condition of Oklahoma s State and County bridge infrastructure, an easily supported critical, high priority project could consist of a structurally deficient and/or functionally obsolete bridge in excess of 200 in length and on the county collector system. These facilities number in excess of 140, typically inhibit safe and efficient travel and are also most often load posted. In addition, these bridges are very difficult for the County Commissioners to replace as part of their regular transportation program due to the expense and magnitude of the endeavor. A single bridge of this type constitutes an unfunded, long term problem and, if addressed through conventional funding sources, represents a tremendous drain on a County s already limited resources. Roadway and/or bridge improvements that represent county mobility corridors might also be considered as critical, high priority projects as long as the proposed solution is of sufficient design and is supported by sound engineering judgment. A project of this type could include several contiguous miles of roadway, culvert and bridge improvements and might even span and be recommended by multiple counties.

6 County road intersection improvements at locations that have poor sight triangles, sight distances, or other safety related deficiencies are good candidates. Often these locations are also noted by high traffic volumes and accident occurrences and may be proposed in combination with and as a component of county mobility corridor solutions. Circuit Engineering Districts The Circuit Engineering Districts (CEDs) are established by the County Commissioners to provide common engineering and project support services to the member Counties. The CEDs are governed by a Board with a County Commissioner representative from each participating County and each CED also elects a Board Member to a Statewide Circuit Engineering Board. The individual CEDs are not organizationally identical and may be staffed differently dependent on the desires and needs of the member Commissioners. The available resources that may be provided through a CED currently range from engineers to bridge and construction inspectors to management, production and support personnel. A CED may also choose to utilize the services of Consultants to assist with meeting the needs of their members. As related to the recommendation and delivery of CIRB projects, all potential projects are initiated by the County Commissioners and are coordinated with the appropriate Circuit Engineering District for further preparation, consideration, evaluation and screening. Each CED ultimately assists with the compilation of the proposed individual project request forms and directs the development of the recommended list of projects to be considered by the Department for addition to the CIRB Construction Work Plan. Concurrently and to the extent possible, the scope, schedule and budget of projects that previously existed in the Construction Work Plan are re-validated to determine the need for modifications. For projects that exist in the Construction Work Plan and that are being actively progressed, the CEDs assist with the facilitation of any necessary modifications to the scope, schedule and/or budgets of approved projects as more detailed information becomes available during the course of project development. The continuous assessment of these projects is accomplished through drive outs and/or other project team meetings conducted with the complete participation of appropriate Department, County and CED personnel as deemed necessary. The CEDs may also assist with the scheduling, coordination and documentation of these meetings and the larger project development process. Department of Transportation The responsibility for the expenditure of the CIRB funding has been placed with the Department of Transportation and the Transportation Commission has promulgated rules to guide the administration of the program. The simple role of the Department is to work with County Governments and their representatives to insure the long term budgetary integrity of the CIRB Construction Work Plan and the continuity of the projects it encompasses.

7 In summary of the process, the County Commissioners identify and consider potential CIRB projects. The CEDs then assist with the completion of the project request forms and with the preparation of the recommended list of projects. Upon receipt of the CED recommendation and supporting documentation, the Department conducts an independent review of the proposed projects as determined necessary. The individual project evaluations are completed as appropriate drawing on the expertise of a team of Department personnel knowledgeable in the subject matter. When the proposed projects are validated, each requested project phase (Engineering, Right-of-Way, Utility Relocation, Construction) is then budgeted, scheduled and packaged for addition to the CIRB Construction Work Plan. The project additions are balanced to and fiscally constrained by the Transportation Commission District s boundary and the projected allocation of the available CIRB funding. Based on the information generated by the described process, the Department will compile, prepare and present the CIRB Construction Work Plan for Transportation Commission consideration and approval annually. Ultimately, the Transportation Commission will consider the Department s evaluation of the proposed CIRB projects and the resulting Construction Work Plan recommendation with a Statewide perspective. When the CIRB Construction Work Plan is approved, the Department coordinates and cooperates with the Counties and the CEDs in the active management of the project development and delivery process. As the projects develop, the Department also facilitates the regular maintenance, modification and adjustment of the Plan as necessary.
