Jamal El-Din Meknas Summary The study was on the theme of "the law applicable to the arbitration," that is a subject of Especially with the spread of a system of arbitration as a way to resolve disputes, so it is undoubtedly a legal phenomenon worth studying. This topic has been discussed in a comparative framework between the two legislatures Kuwaiti and Jordanian and guided by the Egyptian law whenever possible and this through five chapters. The study shows that the legal rules applicable to the dispute have a great importance in all stages of the arbitration; these rules may play an important role in determining whether the arbitration judgment is a national or foreign rule. For this, the study called for the choice of the parties to be explicit and clear to the applicable law on their dispute replace the application, as well as for the rules that govern the arbitration procedures hoping to fill all the gaps and procedures that required by the arbitration dispute. Also the study showed that The authors of the laws organizing the arbitration process should give the parties of the arbitration the whole freedom in the recourse to law or rules to govern procedures of the arbitration dispute, not inconsistent with the fundamental principles relating to public order and which relates to ensuring the right to defense and respect for equality between the parties. The law applicable to the dispute have been chosen by the parties, or leave it to the arbitral tribunal, also in this case you should respect the freedom of the parties and this by choosing the closest laws to theirs. (It may be the law of the state in dispute).
