1 Approved by Decree No 38, of Board of the Freeport With amendments of: Port Dues and Charges of the Freeport of Riga I GENERAL PROVISIONS 1. Port dues and charges of the Riga Freeport (hereinafter - "the Port Dues") define the amounts to be paid by a ship for entering and leaving the Port, as well as the maximum tariffs of charges for the services specified in Paragraph Definitions of the terms used: 2.1. GT of a ship - an indicator of the total capacity of a ship, which is determined in compliance with the International Convention on Tonnage Measurement of Ships 1969 and indicated in Tonnage Certificate of the ship; 2.2. yacht - a floating craft meant for sports, leisure and tourism with water-borne displacement under 80 tons; 2.3. hospital ship - a vessel so defined in her classification certificate; 2.4. calendar year - the time period between 00:00 hours on January 1 st and 24:00 hours on December 31 st ; 2.5. coaster - a vessel flying the National Flag of Latvia that performs shipments or sails in ballast between Latvian ports; 2.6. container ship - a vessel so defined in her classification certificate; 2.6. *container ship - a vessel so defined in her classification certificate and which carries containerised cargo not less than 50% of its total cargo volume; (*With amendments of , in force as of ) 2.7. sailing list - a schedule of ships traffic between two or more ports indicating the date of ship's arrival at each serviceable port; 2.8. shipping line - a regular service approved by the Freeport Authority involving a definite traffic of ships between Riga and one or more ports overseas in conformity with the approved sailing list 2.9. liner schedule - a timetable of liner vessels specifying the weekday or the date of arrival and departure of each vessel involved; charity vessel - a ship on a charity mission or carrying humanitarian aid cargoes for the State of Latvia with total weight thereof exceeding 50% of the cargocarrying capacity of the ship or the amount of the charity goods to be unloaded in the Port exceeding half of the total amount of the cargo to be discharged in the Port;

2 State service ships of Latvia - naval and coastguard ships, Customs', environment protection, hydrographic vessels, research and rescue ships; liner - a vessel trading between the ports serviced by a shipping line; small tonnage - any vessel of less than 200 GT in total capacity; training ship - - a vessel so defined in her classification certificate; harbour craft - a vessel performing services of the Port, such as an icebreaker, tug, barge, floating crane, bunkering vessel, sewage, bilge water and waste collector, diving boat as well as other floating craft owned or leased by the Port Authority or port operators; force majeure - the ship's crew or cargo or passengers or the ship actually endangered ; passenger ship - a vessel so defined in her classification certificate; Ro-Ro ship - - a vessel so defined in her classification certificate; linked ships - a tugboat with a barge or a ship having an engine failure in tow; foreign trade - ships traffic between the Port of Riga and any foreign port; tanker - a vessel so defined in her classification certificate; reefer - a vessel with refrigerating installations for prolonged storage of freight in her cargo holds or carrying perishable goods (foodstuffs); short-sea ship - a vessel trading between ports within national territory; fishing vessel - a ship of any size engaged in fishing for profit-making purposes; craft in fishery trade - a ship performing fishing or fish processing. 3. The Riga Freeport Authority (hereinafter - "the Freeport Authority") shall determine the upper limits of tariffs for the following Port services: 3.1. execution of mooring operations; 3.2. use of tugboats and other harbour craft; 3.3. removal of garbage and polluted water; and 3.4. the firemen's services; 3.5. charge for fresh water supply. 4. The Port Dues and maximum charges for the services referred to in Paragraph 3 shall be determined in US dollars. 5. The Port Dues shall be received by the Freeport Authority. 6. The Freeport Authority has the right to change the Port Dues and the upper limits of tariffs for the services, or Port Dues rebates, determined herein. 7. The Port Dues and the tariffs as well as amendments thereof shall come into effect in 45 days since announced in the newspaper Latvijas Vestnesis.

3 -3-8. The upper limits of tariffs for the Port services shall come into effect in 45 days since announced in the newspaper Latvijas Vestnesis. 9. "Port Dues and Charges of the Riga Freeport" shall be published by the Freeport Authority in Latvian and English. In case of a dispute, the Latvian text shall prevail. II CALCULATION AND COLLECTION OF THE PORT DUES AND SERVICE CHARGES 10. The following dues are determined at the Port of Riga: Tonnage Dues, Canal Dues, Anchorage Dues, Small Tonnage Duty, Sanitary Dues, Ice Dues, Berthing Dues, Cargo Dues, Pilotage Dues and Passenger Toll. 11. In accordance with the International Convention on Tonnage Measurement of Ships of 23 June 1969, the gross tonnage of a ship shall be applied to the calculation of port dues and charges. 12. All port dues and the charges for port services rendered shall be represented in disbursement accounts. 13. Upon calculation of port dues and charges the time of the ship's stay at the Port shall be rounded off to full hours. The time under 30 minutes shall be rounded down to a full hour while the time above 30 minutes, rounded up to a full hour. 14. The charges for services rendered by the Port and the Port Dues shall be collected from ships by a ship agent with whom the Freeport Authority has entered into an agreement. 15. The Freeport Authority may grant the shipping line status to a ships service within the limits of one calendar year by concluding an agreement after the following documents have been received by the Freeport Authority from the ship owner or operator, or a line operator: an application of the shipping line claimant, specifying the name of the line and the list of serviceable ports; a liner schedule for at least three months; the kind of cargo to be carried; and a list of ships servicing the relevant line. 16. Ship owners or operators shall yearly submit to the Freeport Authority a list of liners, a list of serviceable ports and liner schedules for the next year within a specified term in order to enter into an agreement for the next calendar year. 17. Starting from the beginning of a year, the Freeport Authority shall grant rebates for liner vessels, if the owner or operator of respective shipping line retains the service from the previous year and enters into an agreement with the Freeport Authority undertaking to maintain the last year' number of calls or to increase it and/or to increase the gross tonnage of inbound ships of the line. 18. A ship may be granted rebates as provided for liners under the following conditions: the liner schedule has been announced in the newspaper Latvijas Vestnesis or in any other daily newspaper; the ship is included in the announced liner schedule or amendments thereto; and the liner arrives to or departs from the Port in accordance with a sailing list of respective shipping line, or allows deviation from the schedule not exceeding 12 hours if in service to European ports and 36 hours if in service to the ports of other continents. 19. A liner vessel shall retain her status and Port Dues rebates granted in the following cases:

4 the vessel of respective shipping line is substituted by another one; her time of arrival or departure fails to comply with the announced liner schedule submitted due to force majeure. 20. The Port Dues and Charges for tankers with separated ballast tanks shall be calculated by taking into account the reduced gross capacity indicated in International Tonnage Certificate. 21. The Port Dues and Charges levied on a ship shall be paid before her departure from the Port. 22. In accordance with legal enactments of Latvia, the Harbour Master may detain a ship in cases specified and in accordance with procedures prescribed by the Maritime Code and other regulatory enactments. 23. In accordance with legal enactments of Latvia, the Harbour Master has the right to prohibit departure of a ship, if the Port Dues or charges for services have not been paid. III TONNAGE DUES 24. Tonnage Dues shall be calculated separately for each ship's arrival to and departure from the Port. 25. The standard rate of Tonnage Dues at the Port of Riga is fixed for the following ships: container vessels-0.16 USD/GT reefers USD/GT; Ro-Ro ships USD/GT; passenger ships USD/GT; linked vessels USD/GT; and other ships-0.28 USD/GT. IV CANAL DUES 26. Canal Dues shall be calculated separately for each ship's arrival to the Port, shifting within the Port limits and departure from the Port If a ship during calling a Port uses one berth, Canal Due shall be calculated on a basis of the standard rate of Canal Due; If a ship during calling a Port uses two or more berths: Canal Due shall not be levied on second berthing; Canal Due shall be levied as 25% of the standard rate of Canal Due on third or fourth berthing; Canal due on the fifth and every next berthing shall be calculated separately for each as 50% of the standard rate of Canal Due. 27. The standard rate for Canal Dues at the Riga Port is fixed for the following ships: container vessels USD/GT reefers USD/GT; Ro-Ro ships USD/GT;

5 passenger ships-0.01 USD/GT; other ships-0.19 USD/GT; and linked vessels USD/GT. V SANITARY DUES 28. Sanitary Dues shall be calculated for each call of a ship, except for passenger ships. Sanitary Dues shall not be collected from passenger ships. Sanitary Dues shall cover costs for removal of any garbage and segregated water, except for segregated ballast water or tank cleaning waters. 29. Sanitary Dues at the Riga Port shall be determined as follows: - For ships equipped with garbage and segregated waters treatment facilities USD/GT; - For other ships USD/GT. VI BERTHING DUES 30. Berthing Dues shall be collected for usage of any berth from all ships laying alongside If a ship during calling a Port uses several berths of one lessee or owner, only for using the second berth Berthing Dues are calculated as 50% of the standard rate of Berthing Dues. 31. Berthing Dues at the Port of Riga are fixed at 0.10 USD/GT. 32. The following additional Port Dues shall be determined for usage of a berth without performing cargo handling and/or passenger operations, per one hour: - Ro-Ro ships USD/GT; - passenger ships USD/GT; - fishing vessel and craft in fishery trade USD/GT; and - other ships USD/GT. 33. Berthing Dues at 0 rate are fixed for the period of the vessel repairs while laying at the berths indicated by the Freeport of Riga Authority. In case if prior or/and after repairing, cargo handling operations has been performed on the vessel laying alongside the same berth, the Berthing Dues shall be calculated at rate as established by the paragraph No.31. VII PILOTAGE DUES 34. Pilotage Dues shall be calculated separately for each ship's arrival to the Port, shifting within the Port limits and departure from the Port. 35. Pilotage Dues at the Port of Riga are fixed at 0.10 USD/GT. VIII SMALL TONNAGE DUTY

6 Small Tonnage Duty shall be calculated separately for each ship's arrival at and departure from the Port. 37. Small Tonnage Duty at the Port of Riga is fixed at 0.05 USD/GT. 38. Small tonnage vessels shall be exempted from other Port Dues payment at the Port of Riga. IX ANCHORAGE DUES 39. Anchorage Dues shall not be charged at the Port of Riga. X ICE DUES 40. Ice Due at the Freeport of Riga is fixed at rate 0.05 USD/GT The Ice due is collected of a vessel calling in the port or staying at an outer road, and the due is collected for the first six calls in the calendar year. Beginning with the seventh call during the calendar year the Ice due is not collected. The calls for specialized vessels are counted regarding only tugboat calls in the port The Ice due is reduced by: % for passenger ships; % for ro - ro ships and container vessels The Ice due is exempted for: vessels that are stated in 46 th paragraph of the Port Dues and Charges of the Freeport of Riga; vessels that call to the port, in order to receive fuel of other supply materials and is not performing any cargo handling or passenger operations, or in order to carry out repairs as well. XI CARGO DUES 41. Cargo Dues shall not be charged at the Port of Riga. XII PASSENGER TOLL 42. Passenger Toll shall be collected from passengers entered in the passenger list submitted by the master of a passenger or cruise ship separately upon her arrival at and upon her departure from the Port, either with or without embarking or disembarking passengers there. 43. The following Passenger Toll is fixed at the Port of Riga: - USD 1.50 for each passenger upon arrival of the ship; - USD 1.50 for each passenger upon departure of the ship. 44. The following Passenger Toll shall be charged from cruising passenger ships: - USD 1.00 for each passenger upon arrival at the Port; - USD 1.00 for each passenger upon departure from the Port. 45. Children under 12 years shall be exempted from Passenger Toll.

7 -7- XIII REBATES ON PORT DUES 46. The following ships shall be exempted from Port Dues: Latvian and foreign ships in State service; foreign ships paying an official visit; hospital ships; short-sea ships and yachts; harbour vessels; training ships; research ships; charity ships; sailing ships; small tonnage ships with the engine capacity under 100 kw; and ships calling the Port due to extraordinary circumstances. 47. Liners shall enjoy rebates on all Port Dues: - upon 10 th to 20 th call at the Port - 10%; - upon 21 st to 50 th call at the Port - 20%; - upon 51 st and further calls at the Port - 40% % rebate on all Port Dues shall be granted to Latvian flag fishing vessels and craft in fishing trade with fish catch or with processed fish products on board or sailing in ballast. 49. Tonnage Dues shall be reduced: By 25%, if volume of cargo loaded or discharged by the ship does is under 50% of the total cargo-carrying capacity of the ship (DWT); By 50%, if a ship arrives or departs in ballast. 50. In case the vessel has in possession the Harbour Master permission to navigate in the port without a pilot, the Pilotage dues shall be granted 50% rebate. 51. If a ship enters the Port for the purposes of bunkering and replenishment of ship's stores, without performing cargo operations, or makes for repairs at the shipyard, a 75% rebate on all Port Dues shall be granted % rebate on tonnage and canal dues shall be granted to passenger ships. 53. If several Port Dues rebates are provided for a ship, only the highest one shall apply. THE UPPER LIMITS OF TARIFFS FOR THE PORT SERVICES

8 -8- XIV USE OF THE PORT TUGBOATS 54. The maximum levels of charges for the use of tugs in mooring and unmooring operations shall be determined at the following rates, irrespective of the number of tugs engaged: mooring and unmooring : USD 0.17 per each GT; shifting from one berth to another: USD per each 0.22 GT; and shifting within limits of one berth: USD 0.17 per each GT. 55. The maximum levels of charges for the use of the port tugs shall be reduced by 25% in the following cases: If the ships specified in Paragraph 46 make use of tugs upon mooring; and If liners make use of tugs upon mooring. If tugboats or other self-propelled craft are used for operations other than mooring of a ship, the maximum level of charges for their use shall be charged at the following rates: Table 1 Engine Capacity (HP) USD/h under from 101 to from 201 to from 3 01 to from 401 to from 501 to From 601 to From 701 to From 1001 to From 1501 to From 2001 to From 2501 to From 3001 to From to and more The maximum levels of charges for the services of tugs for passenger ships shall always be determined at an hourly rate.

9 -9- XV HARBOUR CRAFT HIRE 57. The maximum levels of charges for the use of a floating crane shall be determined at the following rates: Table 2 Dumb craft hoisting capacity (t) USD/t per hour under over The chargeable period of a harbour craft's employment shall count from the moment of its departure from its permanent berth or actual position until the moment of its arrival back to its permanent berth. 59. The maximum levels of charges for the work of a floating crane as well as its passage or tow to the working place and back shall be chargeable at the following rates: Table 3 Hoisting capacity of the floating crane (t) Ch ( S /h) for the crane's work Without tug With a tug for the crane's shifting under XVI FIREMEN'S SERVICES 60. The maximum levels of charges for the services of fire-watchers on board or alongside a ship shall be determined at the rate of USD 9.00 per hour. 61. The maximum levels of charges for the fire-fighting units attendance by the ship shall be collected at the following rate (USD/h): Fire boat's attendance alongside a ship - 324: fire engine's attendance on the berth XVII GARBAGE AND POLLUTED WATER REMOVAL 62. The maximum levels of charges for removal of polluted ballast water, sewage as well as oil containing water to specially equipped recovery vessels or coastal purification stations within the Port shall be determined at the following rate:

10 bilge, sewage and oil containing water: - to recovery vessel - 12 USD per 1 cub. m - to coastal station - 7 USD per 1 cub. m polluted ballast water: - to recovery vessel - 12 USD per 1 cub. m; - to coastal station - 6 USD per 1 cub. m; water used for tank cleaning: - to recovery vessel - 12 USD per 1 cub. m; - to coastal station - 6,5 USD per 1 cub. m; 63. Dry garbage shall be collected in a packaged way at the berth where the ship made fast, at the rate of 20 USD per 1 cub. m. 64. Charges for garbage and polluted water removal shall be collected from passenger ships and the ships exempted from Port Dues. XVIII LINESMEN SERVICES 65. No charge shall be levied at the Port of Riga for linesmen services upon mooring operations. XIX FRESH WATER SUPPLY 66. The maximum levels of charges for fresh water supply to vessels within the Port shall be determined at the following rate: - if water is supplied from berth 2,00 USD/ t; - if water is supplied by floating crafts 4,50 USD/ t; - if water is supplied to vessels staying on outer roads 2,00 USD/ t, expenses for using tugs are not included. 67. Supply of fresh water by floating crafts shall be done only after request of the Master. Minimum amount of supplying fresh water by floating crafts is 15 tons.
