ET-2, E-002, et al./cn-06-l 115 (d/b/a Xcel Energy) and Others for Certificates of Need for the CapX 345-kV Transmission Project PETITION TO INTERVENE OF THE PRAIRIE ISLAND INDIAN COMMUNITY Pursuant to the Minnesota Public Utilities Commission's November 21, 2007, Notice of and Order for Hearing, and Minnesota Rules and (2005), the Prairie Island Indian Community ("'Community") respectfully files this Petition to intervene in the abovecaptioned proceeding and seeks full party status. As discussed more fully below, the Administrative Law Judge should grant the Community's Petition to Intervene since it has an interest that is not represented by other parties in this proceeding, and the Community can provide relevant information, as well as an independent perspective, to the Commission in its consideration of this matter. Minnesota Rule states, in pertinent part, that a Petition to Intervene: must be granted upon the showing that... the outcome of the proceeding will bind or affect the persons with respect to an interest peculiar to that person as distinguished from interests common to the public or other rate payers in general, or the person's interests are not adequately represented by one or more of the other parties participating in this case.

7 Similarly, Minnesota Rules , subp. 1 (2005) provides that: [T]he Petition shall other petitioners legal rights, notices, or privileges may be determined or affected by the contested case; shall show how the petitioner may be directly affected by the outcome or that petitioners participation is authorized by statute, rule or court decision; shall set forth the grounds and purposes for which intervention is sought, and shall indicate petitioner's statutory right to intervene if one should exist. The Prairie Island Indian Community clearly meets these criteria. The Prairie Island Indian Community, also known as the Prairie Island Mdewakanton Dakota Community of Prairie Island, is located in Southeastern Minnesota and is a federally recognized Indian tribe. As part of this proceeding, the applicants propose to build a 150 mile, 345kV transmission line (Twin Cities-Rochester-LaCrosse 345 kv Transmission Project) between the southeast quadrant of the Twin Cities, beginning at either its Prairie Island substation or the new "Hampton Corner Substation," and continuing through Rochester to LaCrosse, Wisconsin. Although the applicants have determined it "unlikely" that the transmission line will be sited at the Prairie Island substation, it is still considered an alternative which, if selected, could result in the transmission project being sited in the Community's backyard, Due to these facts, and the proximity of the Prairie Island Nuclear Generating Plant, the Community plans to be heavily involved in this proceeding to ensure that the transmission capacity is needed, as well as to ensure that the impact on the Community is minimized. While other governmental entities may purport to require the applicants to meet their burden of proof, these participants do not and cannot represent the unique interests of the sovereign nation of the Prairie Island Indian Community. 1 The Prairie Island Indian Community also has a substantial interest, and plans to participate fully in the discussion of the issues set forth in the Commission's November 21, 2007, Notice of and Order for Hearing, including applicants' representation of the need for the transmission and, more particularly, how that need may relate to planned maintenance and/or the expansion of the Prairie Island Nuclear Generating Plant. 2
