2 APSC FILED Time: 9/25/ :43:41 AM: Recvd 9/25/ :43 :32 AM : Docket R-Doc. 12 ARKANSAS PUBLIC SERVICE COMMISSION IN MATTER OF REVISIONS TO THE ARKANSAS GAS PIPELINE CODE ) DOCKET NO R ) ORDERN0.5 ORDER On April 16, 2014, the General Staff ("Staff") of the Arkansas Public Service Commission ("Commission" or "APSC") filed a Petition ("Petition") to initiate a rulemaking proceeding for the purpose of proposing changes and revisions to the Arkansas Gas Pipeline Code ("Code"), promulgated by the Arkansas Public Service Commission ("Commission") pursuant to the authority of the Arkansas Natural Gas Pipeline Act of 1971, as amended, codified as Ark. Code Ann et seq. The purpose of the proposed changes, additions and revisions, attached to Staffs petition as Attachment A, is to adopt U.S. Department of Transportation changes to the Pipeline Safety Regulations and the need to conform to federal and state law. Contemporaneously with the filing of Staffs rulemaking petition, Staff filed the Prepared Testimony of Robert E. Henry, Chief of the Pipeline Safety Office of the General Staff, in support of the proposed changes. In his Prepared Testimony, witness Henry explains the reason for and the effect of each of the proposed changes. After due notice to an interested parties and public bodies, a public hearing on Staffs rulemaking petition and the amendment thereto was conducted by the undersigned Administrative Law udge on September 25, 2014, in accordance with Ark. Code Ann

Henry, along with Attachment A, and all other matters of record, I hereby make the following findings of fact and conclusions of law: 1. All jurisdictional gas utilities, pipeline companies, and master meter operators have been notified of this rulemaking proceeding in the manner prescribed by law. 2. The Arkansas Legislative Council and the oint Interim Committee on Insurance and Commerce of the Arkansas General Assembly have been notified of this rulemaking proceeding in the manner prescribed by law. 3. The general public has been notified of this rulemaking proceeding in accordance with the Commission's Rules of Practice and Procedure ("RPPs"), Rule From Staffs Petition, Attachment A, and the testimony and exhibits introduced into the record at the hearing on September 25, 2014, I find the proposed revisions and amendments to the A1 kansas Gas Pipeline Code to be necessary, desirable, and in the public interest. IT IS, THEREFORE, ORDERED~ (a) Staffs proposed amendments to the Arkansas Gas Pipeline Code, as reflected by Attachment A, attached to the Petition, are hereby approved and adopted. (b) (c) These amendments shall be effective on the date of this Order. The Secretary of the Commission is hereby directed to compile these amendments to the Arkansas Gas Pipeline Code and shall send a copy of this Order together with the amended and newly-compiled rules, hereby approved
