1 Minutes Orangevale Community Planning Advisory Council August 7, 2001 The meeting was called to order by Chair Robert Crawford at 6:45 PM. The Sacramento County was represented at this meeting by Robert Sherry and Surinder Singh. Patricia Winget explained the purpose, limitations, and procedure with which this meeting would follow. 1. Presentation Mr. Charles Hite Parcel of land in Orangevale area Mr. Hite was not in attendance. This item was not covered. 2. 2 Location: Request: The property is located on the west side of Almond Avenue, feet north of Elm Avenue, in the Orangevale community. 1. A Tentative parcel map to divide acres into four (4) lots on property zoned RD-2 and RD-2 (NS). 2. An exception to public street frontage to allow more than two lots to be served by a private drive. 3. A Use Permit to allow development in the Natural Streams (NS) Combining Zone. Investigating member: This project was postponed for two months (October CPAC meeting) due to flooding concerns. Robert Sherry will provide county expert at that meeting to handle concerns of the neighborhood. Council Action: Vote : Yes 0 No 0 Absent 0 Abstain 0 4. Control No. 01-PMR-0288 APN: Owner: Michael W. Korn, 6628 Santa Juanita Avenue, Orangevale, CA Applicant: Barbara Korn, 6628 Santa Juanita Avenue, Orangevale, CA Architect: John Terry, rd Street, Suite 201, Sacramento CA Developer: Wes Construction Services, 2050 Stockton Boulevard, Sacramento CA Project Name: Korn Accessory Dwelling Use Permit and Variance Location: The project is located on the northeast corner of Central Avenue and Santa Juanita Avenue, in the Orangevale community. Request: A Use Permit to allow a residential accessory dwelling on acres in RD-2 zone and a Variance to allow the accessory dwelling to be served by a septic system. Investigating member: Mary Bair This item was brought up previously to the council, but was postponed due to the problem with septic. The Korns had attempted to get sewer with Folsom, since they are on the immediate edge of Orangevale/Folsom boundary line. Folsom would not allow that, however. It was requested that they solve the problem with sewer/septic and then return to the council. Page 2 of 8

3 Mary Bair had visited neighbors who had no serious concern about an additional home at this location; but they were concerned with potential flooding and if a septic tank could work for the Korns. John Terry, the architect, represented the Korns at this meeting who were out of town. He presented the Soil Log from Sacramento County Environmental Health Division showing the soil profile and approving a septic for this property. However, Shelbie Rue commented that this land looked marshy and worried that a septic would indeed be a problem. She worried about back up in the leach lines. Neighbor Mike Johnson would like to be able to prevent the house from becoming a rental at the event of the mother-in-law passing away or moving. Pat Winget was also concerned about the home becoming a rental in the future. She stated that she used to support accessory dwellings for parents, but now has changed her mind due to the lack of control over the house once it is no long used for that purpose. Council Action: Ron Marcus made a motion to deny the use permit. It was seconded by Pat Winget. Vote : Yes 3 No 2 Absent 1 Abstain 0 5. Control No. APN: Owner/Applicant: Ivan and Nadezhda Venikov, 6300 BeechAvenue, Orangevale, CA Co-Applicant: Clifford H. Catlett, Sun Center Drive, #600, Rancho Cordova, CA Project Name: Venikov Community Plan Amendment and Rezone Location: East side of Beech Avenue, 600 feet north of Greenback Lane in the Orangevale community. Request: A Use Permit to allow an accessory structure to exceed 50% of the habitable floor area of the primary residence. Investigating member: Ron Marcus (See also Orangevale CPAC minutes from May 2001) This structure is an existing barn that was built in the early 1970s. It had not been built with a permit, but was used as a barn, storing hay for a feed store in Orangevale that was owned by they homeowners. Hay was brought in and hauled out. Page 3 of 8

4 Mr. Venikov is the new owner and bought this home, land, and barn expecting to be able to use the barn in like manner. His purpose, however was not for hay, but for saleable items for his thrift store and for charitable shipments that he made to Russia and other disadvantaged nations. A neighbor, Lisa Hall, said that some curtailment has taken place with the items in storage on the property, but that saleable items are still being stored in the barn. She objected to a commercial use of the barn. Barbara Sessions was concerned that this use would drag down the neighborhood. Shelbie Rue spoke in favor of Mr. Venikov saying that we all accumulate things in our homes to sale at garage sales or benefits. She would like to see him have the benefit of the doubt. Bob Crawford sought assurance that Mr. Venikov would cease the commercial storage, but was not satisfied that this would take place. Mary Bair asked what the alternatives are if this use permit were not granted. It appeared the barn would have to be removed. Council Action: Chuck West made a motion to deny the use permit. It was seconded by Ron Marcus. Vote : Yes 4 No 1 Absent 1 Abstain 0 6. Control No. 01-UPP-PAS-0422 APN: Owner/Applicant: David Finkelstein, 1013 Danielle Drive, Roseville, CA Engineer: Steve Jones, 108 Zachary Court, CA Project Name: Golden State Collision Use Permit and Development Plan Review Location: North side of Greenback Lane, 500 feet east of Main Avenue in the Orangevale community. Request: A Use Permit and Development Plan Review to allow storage of towed vehicles in the Greenback Lane Special Planning Area Zone. Note, the underlying zone GC, General Comercial Investigating member: Mary Bair Mary Bair visited Golden State Collision and found the business to be exceptionally clean and debris free considering the type of business this is, i.e. auto body repair. Page 4 of 8 The storage area in question is at the very back of the property and is surrounded with a chain link fence in good condition with blue slats in it to shield view of the interior.

5 A representative from American River Plaza (corner of Greenback and Madison) stated that their plaza is spending $2 million to remodel the shopping center and would hope that Orangevale would follow their lead. Dean Rue, a business owner in the area, has no problems with the use permit being granted. He stated that Golden State is a clean business and that the storage area is not visible from the street. Bob Salvo, of Orangevale, is familiar with Golden State Collision and supported the use permit. Robert Sherry was curious as to why this permit was being requested since it is already a storage area. David Finkelstein, owner/applicant, stated that the business next to him currently has the CHP sending tow trucks to that facility and is trying to prevent competition. Robert Sherry read from the code book that for a storage area to be acceptable, it has to be screened or in a building. Also, GC, General Commercial, only allows storage of operable cars. Mary Bair requested explanation of operable cars. Is a car inoperable if the fender is bent into the tire to prevent it from turning, but is otherwise in good condition? Is it considered inoperable if it is being worked on? Council Action: Chuck West made a motion to accept the use permit with the agreement that the storage would be short term and/or vehicles that are intended for repair. It was seconded by Mary Bair. Stan Samiec, 3009 Douglas Blvd., #150, Roseville CA Engineer/ Applicant: Wood Rogers, Inc., Attn. Ken Topper, John Hodgson, 3301 C Street, Bldg B, Sacramento CA Project Name: Ottomon Hills General Plan Amendment, Community Plan Amendment/Rezone, and Tentative Subdivision map. Location: Ease side of Main Avenue, 600 feet south of Oak Avenue, in the community of Orangevale. Page 5 of 8

6 Request: A General Plan Amendment from Agricultural-Residential to Low Density Residential; A Community Plan Amendment/Rezone from AR-1, Agricultural- Residential to RD-4, Residential; and a Tentative Subdivision Map for 81 lots. Site is 30 acres in size. Investigating member: Robert Crawford Page 6 of 8 Robert Crawford turned the time over to Brian Hollaway with Beazer Homes to present the project to the community. This project would be a subdivision of 81 homes with two streets opening onto Ottoman Way. Ottoman Way is a street that dead ends into Ottoman Elementary School. It would also have two streets opening onto Main Avenue. The new prospective homes would be square feet and range from $250, ,000. The land planner, Ken Topper took a few moments to show the drawings. John Hodgson explained that the drainage would be handled and the sewer and water would connect on Main Avenue. There have not been FEMA studies or an environmental impact report done at this time. The plans included a buffer zone for the school on the south edge of the school property. They also planned to widen Ottoman Way from 40 to 50. Main Avenue would also be widened and have curb and gutter put in. Community input: Bill Cameron spoke in favor of the project. He works for Beazer Homes and has found them to be good quality builders and would like the community to give consideration to the ideas being presented. The objections to the project were: 1. This is a rural area. Building new homes on small lots does not lend itself to roosters crowing and other animals living. This is horse country as well. Jan Johnston, 9291 Central Avenue, was concerned with new neighbors being bothered by Orangevale lifestyle. New people may find it objectionable to be awakened by roosters every morning houses on 30 acres if far too many homes for Main Avenue to handle. The traffic is already heavy in an elementary school area. Ottoman Way Elementary already has a problem with parking space whenever they have a program for the parents to attend. 3. With 81 new homes, Ottoman Way would have an increase of children wanting to attend the school. Ottoman is already full 4. Water/sewer capacity was a concern uttered by Jerry Loverin, 8380 Alaterna Court, Orangevale.

7 5. Flooding. Donald Rinde, 7018 Anice, Orangevale, whose father lives on Elm Avenue, was concerned with Linda Creek flooding down stream. His father s property already gets too much water on Elm Avenue. More homes would result in more run off, causing more flooding. 6. Trisha Burns who lives west of Main Avenue lives in a subdivision the size that is proposed and stated that it was poorly planned and floods often. 7. Traffic is a concern. Main Avenue could not handle cars in addition to what is currently using the street. 8. Voting influx. Earl Wallis, 9185 Elm Avenue, said 81 homes on small lots would be 162 votes against a country lifestyle. 9. Water pressure for existing homes may be lessened if adding 81 more homes. 10. Water rates may rise to handle a large subdivision. 11. Taxes may be raised to handle flooding problems. 12. More people may be forced to buy expensive flood insurance. 267 Orangevale residents were in attendance, many of whom spoke in opposition to the project, but were not directly quoted in the minutes. Council comments: Chuck West felt an 81 home subdivision was not appropriate for this area. Patricia Winget was surprised that Beazer Homes would propose such a large development in rural Orangevale and request a rezoning from RD1 to RD4. Ron Marcus was glad to see Orangevale residents in attendance to support Orangevale lifestyle. Robert Crawford echoed the remarks of Ron Marcus. He had been concerned in his investigation that some Orangevale residents were not concerned about the changes being presented. Council Action: Ron Marcus made a motion to deny the submitted request for rezoning and amending the community plan. Patricia Winget seconded. Vote : Yes 5 No 0 Absent 1 Abstain 0 Page 7 of 8
