1 EAST PENNSBORO TOWNSHIP BOARD OF COMMISSIONERS REGULAR MEETING, APRIL 3, 2013 Regular Meeting 7:00 p.m. The Regular Meeting of the East Pennsboro Township was held on Wednesday,, at 7:00 p.m. at the Community and Municipal Center, 98 S. Enola Drive, Enola, Pennsylvania. Those present were: Commissioners - Scott Dardick, President; Amy Gish, Vice President; Wayne Melnick, and John Kuntzelman; John Pietropaoli, Township Manager; John Beinhaur, Esquire, Assistant Township Solicitor; Joseph Bonarrigo, Township Engineer; John Owen, Codes Enforcement Officer; Chief Todd Bashore, Police Department; and Erik Owen, Fire Marshal. I. CALL TO ORDER President Dardick called the meeting to order at 7:00 p.m. A moment of silent meditation was observed, followed by the Pledge of Allegiance to the Flag. II. APPROVAL OF MINUTES MOTION approving the minutes of the Regular Meeting of March 20, 2013, was made by Ms. Gish, seconded by Mr. Melnick, and was carried by a majority of aye votes, with Mr. Dardick abstaining. III. APPROVAL OF REPORTS MOTION approving the following itemized reports: 1. Police Department Report - February All Permit Summary Report - March 2013 was made by Mr. Melnick, seconded by Ms. Gish, and was carried by a unanimous aye vote. President Dardick thanked the police for holiday weekend traffic enforcement, providing for a very safe holiday. No traffic accidents were reported, 73 traffic citations were given, 4 for DUI, and 1 for a criminal violation. He commended the officers for participation in a proactive speed detail: Officer Ebersole, Officer Epting, Officer Morris, Officer Ressler, Sgt. Spencer and Sgt. Shope.

2 Page 2 IV. BUSINESS FROM THE FLOOR Mr. Byron Jacobs, 1295 Oyster Mill Road, addressed the board concerning a water problem on his property from Floribunda that has been going on for years. He noted none of the storm sewer drains installed work because they sit too high. He also added that there must be something wrong with the swale, which has to be addressed and taken care of. Mr. Pietropaoli stated the last time Mr. Jacobs was in they checked on the drain boxes and the location of the boxes are collecting some water but not a lot of water. They were to extend sewer the entire length on that road, but because of the prices that came in, they were only extended partial way. He believes once the road goes all the way in the drains will be raised a little bit. As far as Floribunda's swales, they will check them again, as construction is ongoing above Mr. Jacobs' property. He noted Mr. Jacobs' concerns have been a long process and numerous engineers have looked at it. Other than maintenance, they are out of solutions. Mr. Owen noted the GTS report from six or seven years ago showed there were no problems in that area, and some of the stormwater requirements involve new lots not in Mr. Jacobs' drainage basin. Each individual lot is required to be designed by an engineer and inspected before an occupancy certificate is granted. Mr. Pietropaoli stated the township has spent a lot of money on engineers to look at the problem and they indicate Mr. Jacobs' property is in a wetland area. Floribunda has been designed and redesigned meeting county and township standards. They are meeting the guidelines they were approved to meet. He noted township staff will do a property inspection again and contact Mr. Jacobs to walk with them. He will also have the highway people talk to Mr. Jacobs about a temporary fix, since the sewer probably will not be going through this year. Mr. Jim Massey, 221 Glenn Road, reported that the builders of The Overlook have not cleared out any of the material that went into the wetland all winter. Additionally, he is starting to see people pulling in and out of the development and people trying to cross the road at the entrance. Further, he is also concerned about completion of the sewer lines behind his house, as the work is not finished. As of today there is water leaking where they dug up to do the new sewer line. Mr. Pietropaoli noted CET will be at the next township meeting and can address those concerns. He will meet with them on Tuesday. With spring weather coming, the contractors will be coming back to do clean-up work. He will have them check whatever moisture is coming out of the ground to make sure there is not a problem.

3 Page 3 Ms. June Rudeck, 30 Pine Ridge Circle, read a letter from her husband, who could not attend the meeting tonight because of work, pertaining to the merger of Midway and West Enola Fire Companies and the possible name of the new company. Mr. Rudeck objects to the proposed name of Enola Fire Company, as he believes the name would be confusing to the residents of the township who might think it is the fire company for the entire township, which would cause a problem since all companies depend on donations from township residents. The Enola Fire Company formed in 1906 was the first fire company in East Pennsboro Township. In 1941, the Enola Fire Company reorganized and became Citizen's Fire Company No. 1 of Enola. Enola was kept in the name to honor and preserve the fire company's history. Shortly after the Enola Fire Company was formed, Midway Fire Company No. 2 of Enola was formed. Citizen's Fire Company and Summerdale Fire Company merged effective January 1, 2011, forming Northeast Fire and Rescue. He noted he is not against the merger and wishes them well, but feels the name Enola Fire Company is deep in tradition and history and should stand alone. Mr. Kuntzelman stated there have been several names considered, and confusion with being considered a township-wide company is a consideration that will be reviewed before it is finalized. V. ITEMS FOR DISCUSSION AND APPROVAL MOTION authorizing payment of invoices and payroll pending review and signatures of Commissioners was made by Mr. Melnick, seconded by Ms. Gish, and was carried by a unanimous aye vote. MOTION to approve payment of Requisition no. 206 from the 2010A General Obligation Bond - Sewer to CET Engineering Services in the amount of $ for professional services related to the Southwest Pumping Station upgrade project, was made by Mr. Kuntzelman, seconded by Mr. Melnick, and was carried by a unanimous aye vote. MOTION to approve payment of Requisition No. 207 from the 2010A General Obligation Bond - Sewer to CET Engineering Services in the amount of $1, for professional services related to the Southeast Trunk line and Southwest Pumping Station Force Main replacement project was made by Mr. Kuntzelman, seconded by Mr. Melnick, and was carried by a unanimous aye vote. MOTION to approve payment to Curcillo Law LLC, Township Solicitor, for professional services rendered during the period of January 1 through February 28, 2013, in the amount of $2,484.00, was made by Mr. Kuntzelman, seconded by Ms. Gish, and was carried by a unanimous aye vote.

4 Page 4 MOTION to approve payment to Rhoads & Sinon, LLP, for professional services relative to police contract negotiations in the amount of $35.00, was made by Ms. Gish, seconded by Mr. Melnick, and was carried by a unanimous aye vote. MOTION to approve Scott Mundis of Troop 51 to complete his Eagle Scout project within the boundaries of Pine Hill Arboretum, with the direction of Gene Wingert, was made by Ms. Gish, seconded by Mr. Kuntzelman, and was carried by a unanimous aye vote. MOTION to approve the East Pennsboro Township Tobacco-Free Parks and Playgrounds Policy, Young Lungs at Play, in conjunction with Penn State Extension and the Pennsylvania Department of Health, by policy only, was made by Mr. Kuntzelman, seconded by Ms. Gish, and was carried by a unanimous aye vote. Mr. Pietropaoli noted this is not an ordinance or a resolution, strictly a policy. By adopting this policy, the State, along with Penn State Extension, provides signage and ideas for advertising of it to try to make youth sports or youth play areas tobacco-free. Only six municipalities in Cumberland County have adopted the policy. Allegheny County and the State College area have a lot of participation. The goal from the Recreation Board was to try to get something in place before the parks get busy this summer. Mr. Kuntzelman stated he and Commissioner Gish were at the Recreation Board meeting and found out the school district and EPYAL have the same policy. He noted the parks crew cleans up cigarette butts every day out of Adams-Ricci Park from a lot of Highmark employees who take their cigarette breaks at the park, since their campus is tobacco-free. Mr. Pietropaoli cautioned that that is a fire hazard with the upcoming dry season. VI. NEW BUSINESS Mr. Pietropaoli received a call this morning from Governor Corbett's office that there will be a press conference tomorrow at 10:00 a.m. at the Holy Spirit Hospital main atrium to announce they were awarded a $3,250,000 grant for their electronic data center. Last June the board sent a letter in support of the data center, and the board has been invited to attend tomorrow's press conference. The 88th annual PSAT convention in Lancaster is the 14th of May. The township will participate with an advertisement in their booklet, as they have always done. There is a request from the East Pennsboro Democratic Club to hold a 5-K walk at Adams-Ricci Park on Saturday, July 6. The Recreation Board has no problem with the date, as long as they are out by noon.

5 Page 5 Mr. Pietropaoli received a copy of a resolution from the West Shore ALS today and will forward it to the board. Mr. Kuntzelman attended the safe school meeting recently where it was discussed that by new State law, Act 126, all school crossing guards will have to undergo child abuse training before they can be a crossing guard next year. It will be the responsibility of the Police Department to control it. Mr. Pietropaoli noted there is an Intergovernmental Meeting April 23, and an agenda item will be how to handle the cost, if a few school districts and townships can band together to hold a class and share the costs. MOTION to adjourn the meeting at 7:50 p.m., was made by Mr. Kuntzelman, seconded by Ms. Gish, and was carried by a unanimous aye vote.
