5 Introduction Železničná spoločnosť Slovensko, a. s., in accordance with 6-8 Act No. 514/2009 Coll. on the Transport on Railroads and in accordance with the Regulation (EC) No 1371/2007 of the European Parliament and of the Council from 23 October 2007 on rail passengers rights and obligations, defines special condition of carriage and specific tariff for the IC trains. TC ZSSK IC is divided into: PART A. CONDITIONS OF CARRIAGE PART B. TARIFF PART C. APPLICATION OF THE RIGHTS DEFINED IN THE CONTRACT OF CARRIAGE PART D. FINAL PROVISIONS PART A. CONDITIONS OF CARRIAGE Article A.1 GENERAL CONDITIONS A.1.1 TC ZSSK IC defines the conditions under which the carrier provides the services on the trains of the IC category (IC trains), the transportation services to transport passengers, bicycles, luggage and animals in the domestic network managed by the state railway infrastructure manager Železnice Slovenskej republiky, Bratislava. A.1.2 Travel fares for the transportation services on IC trains ( IC fares ) are not subject to the provisions of Public Service Contract and are not governed by the Regulatory Edict A.1.3 Travel fares pricelists defined in TC ZSSK IC are valid for IC trains only. The travel document issued for an IC train according to the pricelist defined in TC ZSSK IC ( IC travel document ) can be used only on the train and for the track section that is stated in the travel document. The travel document issued for a train operated under Public Service Contract is not valid on IC trains (with exception of the cases stated in B.1.2 b) supplement). A.1.4 For the IC travel document purchased online we fully apply the Terms and Conditions of Online Sales in ZSSK published on the ZSSK webpage A.1.5 For the use of the ZSSK Credit Account we fully apply the Terms and Conditions of Credit Account in ZSSK. These are published on the ZSSK webpage www. slovakrail.sk. A.1.6 If not differently defined in TC ZSSK IC, then for transportation of passengers, bicycles, luggage and animals, the same conditions apply as those defined in TC ZSSK. 5

6 Article A.2 CONCLUSION OF THE CONTRACT OF CARRIAGE A.2.1 Contract of Carriage is concluded between the carrier and the passenger in the moment when: a) passenger holding a valid travel document boards the IC train or b) the passenger who boarded the IC train without a valid travel document pays the IC fare forthwith after boarding the IC train in accordance with the conditions in point A.4.2. By closing the Contract of Carriage the contractual relationship between the ZSSK and the passenger is incurred and the contents of this relationship is: Commitment of the carrier to transport the passenger, eventually the belonging bicycle, luggage and animals from the initial boarding station to the arrival station under the conditions defined by TC ZSSK IC, Liability of the passenger to pay the set price for the transportation and comply with the conditions defined by TC ZSSK IC. A.2.2 The Contract of Carriage is based on: GCC-CIV/PRR, TC ZSSK, TC ZSSK IC, the data on the travel document issued for the journey. A.2.3 The Contract of Carriage may be concluded by one or more travel documents. A.2.4 On one travel document only one Contract of Carriage for only one passenger can be concluded. Article A.3 RIGHTS AND OBLIGATIONS OF THE CARRIER A.3.1 By conclusion of the Contract of Carriage, the carrier makes himself liable to transport the passenger and eventually the belonging luggage according to the travel document issued for the journey. A.3.2 The carrier is obliged to ensure the contracted conditions of transport are met, which means, the carrier commits himself to: To transport the passenger and the belonging bicycle, luggage and animals on time according to the valid Timetable, Ensure the seat and appropriate conditions of transport (such as temperature inside the coach, etc.). In case of non-compliance with these conditions, the carrier compensates the passenger according to Article C.2. A.3.3 The carrier has the right to deny to transport or exclude from the transport: A person who, being asked by the authorised employee of the carrier, does not provide a valid travel document (train ticket) and denies to pay the fare and the adequate surcharge in case of onboard purchase of the travel document, A person whose conduct breaks and does not respect the rules or the instructions of the authorised employee of the carrier (instructions to be followed to keep the safety, peace and order during the journey) or a 6

7 person who, by his/her presence causes undue discomfort to the other passengers (is dirty and spreads foul odour, is heavily drunk or intoxicated, etc.). A person excluded from the transport for the reasons described above is not entitled to have the rest of the fare reimbursed or compensated. Article A.4 RIGHTS AND OBLIGATIONS OF THE PASSENGER A.4.1 A passenger has the right to: be transported on time according to the given Contract of Carriage, to have his seat ensured from the boarding station to the arrival station in the coach Class for which the passenger purchased the travel document; this does not apply to the passengers who purchase their ticket onboard the train if the train is fully booked, to have his/her luggage transported if he/she purchases a separate luggage ticket. A.4.2 A passenger is obliged: to board an IC train with a valid travel document and present this document for check to the authorised employee of the carrier, in case the passenger does not possess the valid travel document, he/she is obliged to notify the train personnel before boarding the given train and tell them he/she will need to purchase the travel document for this IC train, in case the passenger purchased the travel document via internet, he/she will be obliged to present also a valid ID, to stick to the provisions stated in TC ZSSK IC, as well as to the provisions of GCC-CIV/PRR and TC ZSSK, to have an appropriate conduct and avoid distorting the safe, peaceful and comfortable journey of the other passengers e.g. by loud behaviour, singing, listening to loud music, etc., when applying his/her entitlement to a reimbursement, claim or compensation, the passenger is obliged to present to the carrier the original of travel document liable to the claim and other necessary documents presenting the liability of the claim (e.g. confirmation of the train delay, confirmation of the temperature discomfort onboard the train, etc.). 7

8 Part B. TARIFF Article B.1 PRICELIST OF THE FARES FOR IC TRAINS B.1.1 IC trains have compulsory seat reservation, the seat-reservation fee is automatically included in the fare. The travel document for IC train is issued separately for each journey and for each passenger. B.1.2 IC fare is set separately for 1st and 2nd Class and depends on: a) The expected train reservation/utilization published in IC trains Calendar, which is regularly updated and published on the webpage separately for the rush days, normal days and weak days, b) Entitlement to price reduction: Regular fare: the passenger is not entitled to any reduction, Reduction: holder of the JUNIOR RAILPLUS, KLASIK RAILPLUS, SENIOR RAILPLUS card, pupil/student, citizen aged 62 and above, holder of the ZSSK card for zero-fare transportation, holder of the ŤZP/ŤZP-S card, Supplement to be paid: A child under 15 years of age, holder of the MAXI KLASIK card, holder of the Season Ticket for Selected Routes ticket, holder of the student Season Ticket for Selected Routes network prepaid ticket, holder of an international train ticket, accompanying person travelling with a holder of ŤZP-S card or a person accompanying a child - holder of the ŤZP card, holder of the railway-employee-benefit card, dog/animal. The supplement for the 1st Class can be purchased on the top of the travel document for the 2nd Class and also for all the categories listed above (with exception of dog/animal as the transportation of dogs/animals in the 1st Class coaches is not permitted). B.1.3 The Judges at the Constitutional Court of the Slovak Republic and the members of the National Council of the Slovak Republic have the guaranteed free transportation in 1st and 2nd Class coaches (with the travel document with zero fee and seat included). B.1.4 Holder of the special cards State peer controller and State peer technical controller are transported free of charge without the seat reservation entitlement. In case of requested seat reservation, these passengers need to buy the requested seat reservation for the selected coach Class. Article B.2 TRAVEL DOCUMENT VALIDITY SUPPLEMENT PAYMENTS UP TO THE ACTUAL TICKET PRICE AND PAYMENT OPTIONS B.2.1 IC travel document can be used only for the train and track section stated on this travel document. B.2.2 Interruption of the journey with IC train travel document is not permitted. B.2.3 If the passenger needs to change the IC travel document (using other IC train and/or using a different coach Class on the same or on other IC train, changing the seat in the same IC train), he/she can return the original IC travel document at the KVC ticket-desk without cancellation fee. This must be done latest prior to departure of the IC train stated on the original travel document if, at the same 11

12 time, the passenger purchases the new IC travel document with the requested changes implemented. B.2.4 The passenger without a valid IC travel document who, prior to boarding the IC train, makes himself/herself known to the train personnel of the given IC train, will purchase the IC travel document directly on the train from the train personnel, where the fare will be calculated according to the pricelist and the Minor Surcharge for purchase on the train will be paid - which is 3 EUR. B.2.5 The passenger who purchased the ticket onboard the IC train after the capacity was sold out and thus he /she gives up the seat-entitlement, can only occupy the areas outside the seating-designated areas and outside the area of the dining coach. B.2.6 Supplement payment up to the actual price of the IC fare (supplement for 1st Class for the holder of the IC travel document for 2nd Class, respectively supplement payment up to the correct IC fare if the passenger cannot present the entitlement for reduction) onboard the train will be calculated as the difference between the required IC fare and the already paid IC fare before applying the discount from the Credit Account (if existing). Article B.3 TRANSPORTATION OF CHILDREN B.3.1 Each travelling child is required to have a separate seat and the appropriate IC train travel document for the given coach Class (supplement). Article B.4 TRANSPORTATION IN THE PRM COMPARTMENT B.4.1 The special compartment on the IC trains is designated primarily for transportation of the wheelchair passengers, according to TC ZSSK. In this compartment, two wheelchair passengers can travel simultaneously. A holder of ŤZP-S card is entitled to be accompanied by maximum one person and both of them need to have the appropriate IC travel document purchased according to the IC train pricelist. Article B.5 TRANSPORTATION OF LUGGAGE B.5.1 Hand luggage is transported free of charge. B.5.2 Transportation of luggage in PÚB compartment is possible only with the conditional compulsory reservation for PÚB. The travel document for luggage or bicycle transportation with PÚB reservation is to be purchased at KVC equipped ticket-desk and the fees are: 2,50 EUR/pc bicycle and 2 EUR/pc luggage. B.5.3 The luggage (except bicycle) can be checked-in directly on the train (if PÚB capacity allows) for the price 2 EUR/pc. Holder of the travel document for 1st Class can transport the belonging luggage (in case of available capacity and 12

13 with exception of the bicycle) free of charge. B.5.4 The daily ticket, weekly ticket or monthly ticket for a bicycle or luggage and the Season Ticket for Selected Routes for bicycles are not accepted on the IC trains. Article B.6 TRANSPORTATION OF DOGS AND LIVING ANIMALS B.6.1 Transportation of dogs and living animals on IC trains is only allowed in 2nd Class coaches. B.6.2 A passenger travelling in a 2nd Class coach can transport small animals in appropriate boxes, cages or baskets or in other types of boxes that can be properly closed and have impermeable bottoms (hereinafter box). Only leashed dogs wearing muzzles can be transported without the box. B.6.3 Transportation of small animals in the boxes is free of charge providing that the animal is inside the box during the whole journey and the box is placed under the passenger s seat or on the passenger s lap. Shall this not be the case, the passenger will be asked to pay the regular IC fare according to the pricelist (without entitlement to the seat for the animal). B.6.4 Transportation of a dog without the box is charged and the dog is not entitled to occupy a seat. If the passenger does not present the appropriate dogtransportation ticket, he/she is required to pay the regular IC fare according to the pricelist (without entitlement to the seat for the dog). B.6.5 It is not necessary to purchase the IC travel document for a dog with the international train ticket. B.6.6 In cases where the passenger travelling with an animal breaches the rules and instructions for travelling with dogs and animals, will he/she be required to pay the fine 30 EUR. PART C CLAIMING THE RIGHTS FROM THE CONTRACT OF CARRIAGE Article C.1 REIMBURSEMENT C.1.1 Passengers can return an IC travel document at any ticket-desk equipped with KVC latest 60 minutes after the scheduled departure of the IC train from the boarding station stated on the ticket. Partially unused travel document or fully unused travel document not returned within the time limit, or inappropriately used travel document cannot be returned.. C.1.2 If the reimbursement of the travel document is based on the reasons on the side of the passenger, the carrier will reimburse the sum after deduction of the 10 % from the original price of the IC travel document. C.1.3 The reimbursement will be realized only in the cases where, after deduction of the cancellation fee, the remaining sum will be 1 EUR and more. C.1.4 In case, that the coach, for which the passenger purchased his travel document 13

14 (reservation), will not be coupled in the IC train and the passenger refuses to travel, the original price of the IC travel document will be reimbursed to the passenger affected and no fees will be deducted. Article C.2 COMPENSATION C.2.1 In case of a delay of an IC train the passenger is entitled to the following compensation: a) In case of a delay minutes the passenger is entitled to reimbursement of 25 % from the price of the IC travel document and to refreshment at the cost of 1 EUR, b) In case of a delay longer than 120 minutes the passenger is entitled to reimbursement of 50 % from the price of the IC travel document and to refreshment at the cost of 2 EUR, c) In case of missed connection caused by the IC train delay (only the last connection of the day), if it is necessary to transport the passenger to the arrival station by other public transport mean, the carrier will reimburse the costs up to the maximum of 10 EUR, d) In case of missed connection caused by the IC train delay (only the last connection of the day), if an overnight is necessary, the carrier will reimburse the accommodation costs up to the maximum of 20 EUR. C.2.2 In case that the temperature in the area of the passenger s seat drops under 15 ºC or ascends above 30 ºC, the passenger becomes entitled to compensation of 25% form the price of the IC travel document. C.2.3 In case, that the coach, for which the passenger purchased his travel document (reservation), will not be coupled in the IC train and the passenger insists to travel although there is no other seat available, the passenger will be transported with no seat entitlement and compensation of 100 % from the IC travel document price will be reimbursed. C.2.4 In case, that the 1st Class coach, for which the passenger purchased his travel document (reservation), will not be coupled in the IC train and the passenger insists to travel, he/she will be offered a seat in 2nd Class coach and will be entitled to compensation of 50% from the IC travel document price. C.2.5 In case that the passenger becomes entitled to various compensations, the percentage proportions of the separate compensations will be added up. The total sum of compensations can go up to the sum of the original IC travel document purchased for the given journey. C.2.6 The carrier will reimburse the compensation latest within 30 days from acceptance of the request. The process will be performed via Rail Clearing 14

15 Section.. C.2.7 The entitlement to a compensation/reimbursement must be claimed latest 12 months after completing the journey and based upon the originals of the travel documents. Article C.3 EXPIRY OF THE ENTITLEMENT TO COMPENSATION C.3.1 The carrier does not accept responsibility for not fulfilling the criteria described in Article C.2: a) If the reasons for delay were external, the reasons that are not in coherence with the railway operations and that could not have been avoided or prevented (vis major such as natural calamities, suicidal cases, accidents at the railway crossings, removing of the accrued damages), b) If the reasons are caused by the passenger (e.g. not observing the time limit for changing the trains, waiting on the wrong platform, coming late to board the train/missing the train, exclusion of the passenger from transport), c) if there is a strike with previous warning, d) if the restrictions causing the delay of the train were made public in advance as well as the substitute transport options were provided and the passenger was informed on those to make use of them. Article C.4 CLAIMS C.4.1 The passenger can claim reimbursement, compensation or submit a claim at any ticket-desk of the carrier, or in writing at the following address: Železničná spoločnosť Slovensko, a. s., Sekcia odúčtovania tržieb železníc, Rožňavská 1, Bratislava. PART D FINAL PROVISIONS D.1 TC ZSSK IC is elaborated according to the 7 Act No. 514/2009 Coll. on the Transport on Railroads and is also published at the webpage of the carrier: D.2 TC ZSSK IC is valid from 11th December D.3 The carrier reserves the right to amend the General Conditions of Carriage, Tariffs and the Conditions of Claiming the Rights from Contract of Carriage for the operation of the IC trains. 15
