17 The Role of the FAA The FAA has oversight over all civil unmanned aircraft systems (UAS). Definition of UAS in FAA Modernization and Reform Act of 2012 is: an aircraft that is operated without the possibility of direct human intervention from within or on the aircraft.

18 Distinction between Recreational Use and Commercial Use The FAA exercises discretion not to enforce its regulations against recreational use of model aircraft. Section 336 of the Act prohibits the FAA from promulgating any rule or regulation regarding a model aircraft or an aircraft being developed as a model aircraft if certain conditions are met. Section 336 defines model aircraft as: an unmanned aircraft that is (1) capable of sustained flight in the atmosphere; (2) flown within visual line of sight of operation; and (3) flown for hobby or recreational purposes. The FAA considers flying for recreational purposes to be flying for personal interest and enjoyment and not for business purposes or compensation. The FAA may still exercise enforcement power against operation of model aircraft if the model aircraft is operated in a careless or reckless manner.

19 FAA Modernization and Reform Act of 2012 Section 336. Special Rule for Model Aircraft. (a) In General Notwithstanding any other provision of law relating to the incorporation of unmanned aircraft systems into the Federal Aviation Administration plan and policies, including this subtitle, the Administrator of the Federal Aviation Administration may not promulgate any rule or regulation regarding a model aircraft, or an aircraft being developed as a model aircraft, if (1) the aircraft is flown strictly for hobby or recreational use; (2) the aircraft is operated in accordance with a community-based set of safety guidelines and within the programming of a nationwide community-based organization; (3) the aircraft is limited to not more than 55 pounds unless otherwise certified through a design, construction, inspection, flight test, and operational safety program administered by a community-based organization; (4) the aircraft is operated in a manner that does not interfere with and gives way to any manned aircraft; (5) when flown within 5 miles of an airport, the operator of the aircraft provides the airport operator and the airport air traffic control tower with prior notice of the operation; and (6) the aircraft is flown within the visual line of sight of the person operating the aircraft.

20 Registration Requirements Effective as of December 21, 2015, anyone who owns a UAS must register with the FAA registry before flying. AllUASmorethan0.55lbs.andlessthan55lbs.mustberegistered by February 19, Registration is valid for 3 years. A simplified registration process will be available April 1, Failure to register can result in civil penalties up to $27,500 as well as criminal penalties, which can include fines up to $250,000 and/or imprisonment up to 3 years. 21 Know Before You Fly An education campaign funded by the Association for Unmanned Vehicle Systems International (AUVSI), the Academy of Model Aeronautics (AMA), and the Small UAV Coalition in partnership with the FAA. Goal is to educate users about safe and responsible operation of model aircraft. Offers certain safety guidelines for model aircraft users.

22 Safety Guidelines for Operating Model Aircraft The following are safety guidelines for recreational users: Follow community-based safety guidelines, as developed by organizations such as the Academy of Model Aeronautics. Fly no higher than 400 feet and remain below any surrounding obstacles when possible. Keep your model aircraft in eyesight at all times. Remain well clear of and do not interfere with manned aircraft operations. Do not fly in adverse whether conditions such as high winds or reduced visibility. Do not fly under the influence of alcohol or drugs. Do not fly near or over sensitive infrastructure or property such as power stations, water treatment facilities, correctional facilities, heavily traveled roadways, government facilities etc. Check and follow all local laws and ordinances before flying over private property. Do not conduct surveillance or photograph persons in areas where there is an expectation of privacy without permission.
